RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY
COLORADO, APPOINTING INDEPENDENT REFEREES (HEARING OFFICERS) TO
HEAR TAX PAYER'S APPEALS OF THE PITKIN COUNTY ASSESSOR'S
VALUATION AND DEVELOPING A LIST OF PERSONS QUALIFIED TO ACT AS
ARBITRATORS OF PROPERTY VALUATION DISPUTES
RESOLUTION NO. 036 2013
1. Pursuant to C.R.S. 39-8-101, the Board of County Commissioners (BOCC) of
Pitkin County shall comprise the Board of Equalization (BOE).
2. The BOE is charged with the duty of assuring that the Assessor fairly and equally
applies appraisal procedures.
3. The volume of appeals in 2013 will exceed the amount of time that the BOCC
has available to sit as the BOE.
4. Pursuant to C.R.S. 39-8-102(2)0) the BOE has the authority to appoint
independent referees (hearing officers) who are experienced in property
valuations to conduct hearings, and on behalf of the BOE, make findings and
submit recommendations to the BOE for its final action.
5. The BOCC wishes to appoint hearing officers to act on behalf of the BOE.
6. The BOCC has considered the applications and qualifications of persons
interested in acting as hearing officers on behalf of the BOE and desire to make
appointments at this time.
7. Pursuant to C.R.S. 39-8-108.5, if a petitioner is not satisfied with the BOE's
decision they could choose to go to arbitration.
8. Pursuant to C.R.S. 39-8-108.5, the BOCC shall develop a list of persons who
shall be qualified to act as arbitrators of property valuation disputes. Such list
shall be kept in the office of the county.clerk and recorder.
9. Pursuant to C.R.S. 39-8-108, qualified arbitrators in addition to being either an
attorney licensed to practice law in the state, an appraiser who is a member of
the institute of real estate appraisers or its equivalent, a former county assessor,
a retired judge or a licensed real estate broker must also be a registered or
certified appraiser.
10. The BOCC has considered the applications and qualifications of the persons
interested in acting as arbitrators pursuant to C.R.S. 39-8-108 and desire to
approve an amended list of arbitrators at this time. Such list shall be kept in the
office of the clerk and recorder.
NOW THEREFORE BE IT RESOLVED by the Board of County Commissioners of Pitkin
County, Colorado that:

1. The persons on the attached list (Attachment 1) are hereby appointed to act as
hearing officers on behalf of the BOE for a term commencing July 1, 2013 and
continuing for one year, unless otherwise terminated by the BOCC.
2. The persons on the attached list (Attachment 2) have been selected to act as
arbitrators to hear property valuation disputes for a term commencing September
1, 2013 and continuing for one year, unless otherwise amended by the BOCC.

Jack Musser
Jack moved to the Roaring Fork valley in 1976 after being
licensed as a realtor in Pennsylvania. He has worked with the Aspen
Board of Realtors as a chairperson and received his GRI
designation in 1992. He has been a top producer in residential and
new project sales for over zo years. Jack has been a hearing officer for Pitkin County
for the past z years.
Jack has worked with different homeowner's associations.
He is presently helping with design control issues in his neighborhood of Blue Lake.
Jack is serving on the citizen advisory board for the proposed rec center at the Sopris
Tree Farm.
His interests include golf, tennis and road biking. Jack
has cycled on several "Ride the Rockies" through the mountains of
Colorado. He is married with z boys in college.

My name is Allen Black and I have over 30 years experience in every facet of Property Tax Assessment.
The majority of my professional career has been as a County Assessor in the State of Colorado.
The 2013 Property Tax Year in Colorado includes a complete reappraisal of all property by the County
Assessor. It has been my experience that the reappraisal usually results in an increased number of
taxpayer appeals to the County Board of Equalization. I am a uniquely qualified professional,who is able
to assist Colorado counties as a hearing officer or as an arbitrator. I have served in the role of hearing
officer for several County Boards of Equalization. As a hearing officer, I conducted hearings and made
the appropriate recommendations to the board. I have also been an arbitrator for Colorado counties.
As an arbitrator, I was available for appeals cases when a taxpayer chose to carry an appeal beyond the
Board of Equalization level.
My experience and qualifications include:
