Zone District.- R -30 Representative: John Hufker Email: johnadjarchitects.com Phone: (970) 925 -3444 Request: James Richard, the "Applicant" requests Activity Envelope Et Site Plan Review (see attached Activity Envelope and Site Plan maps) with Vesting for his below described property (see attached Warrantee Deed as proof of ownership) in order to remodel the house with up to 5,750 square feet of gross floor area, including up to 4,000 square feet of basement area, and 750 square feet of garage area (see attached floor plans). Property: The "Property" is located at 75 Bennett Court (see attached Vicinity Map Et Legal Description) and its legal description is Lot 4, Replat 1, Ridge Of Red Mountain Subdivision in Pitkin County. The lot contains 24,718 square feet and is currently developed with a single family residence. The property lies inside of the Urban Growth Boundary and is zoned R -30. The access easement contains 266 square feet for a Lot Area of 24,452 square feet. The parcel was legally created in 1974 as part of the Ridge of Red Mountain Subdivision and is characterized as a flat bench which drops off steeply to the north and west. Previous Land Use Approvals: A search of the Pitkin County Community Development files revealed no previous land use applications or approvals attributable to the Property. Access: The Property is accessed by driveway directly off of Bennett Court. WaterfE Septic: The Property is serviced by the City of Aspen's Water Department and the Aspen Consolidated Sanitation District as well as the other standard utilities, electric, gas, cable, etc. Otju003 James Richard Activity Envelope Et Site Plan Review Parcel ID #273501406002 Page 3 of 45 REVIEW CRITERIA FOR SPECIFIED LAND USE CODE SECTIONS SEC. 7- 10 -50: ACTIVITY ENVELOPE (a) The intent of this Chapter 7 i to allow activities and development to take place where they comply with the provisions of this Land Use Code and with the Pitkin County Comprehensive Plan for the area. Compliance willgenerally involve avoidance of "Constrained Areas "through the identification ofan Activityfnve lope, "as wellas approval ofa Site Plan. Eorpurposes of Chapter 7, 'Constrained Areas "include all areas included in each of the following categories, as definedand regulated by this Land Use Code: (i)Areas of Statewide interestlisted in C.R.S 24 -65 L -101 et seq.), (ii)steep andpotentiallyunstableslopes, (iii) watercourses, drainage channels andareas subject to erosion, (iv) floodplain hazard areas, (v)geological hazard areas, (vi)severe orlow to moderate wildfire hazard areas, (vu) wildlife habitat areas, (viu)nverand stream corridors and wetlands (ix)irrigated /ands for food or crop production, (x) historic preservation areas and (xi) archeological resource areas. Response: While the Property does contain some slopes with gradients greater than 30%, the proposed Activity Envelope does not include any of these nor any of the other above cited constrained areas (see attached Activity Envelope Plan) (b) The Site Plan process incorporates an ActivityEnvel ape "approach in which the Countystaffworks with the applicant todetermine which portions of the site (ifany) would permit theproposedactivity or development to be conducted in compliance with this Land Use Code and inconformity with the Comprehensive Plan for the area. In general, this process will involve both a determination of(i) which portions of the site are notavailable for development because of the existence of ConstramedAreas, and (ii) of the remaining portions of the site, which areas would accommodate the activityor development so as to minimize impacts on surrounding properties, maximize compliance with the requirements of the developmentstandards m this Chapter 7, and maximize compliance with the Comprehensive Plan goals and objectives Response: The proposed Activity Envelope does not contain any of the above cited constrained areas and as it contains an already existing structure, driveways and associated landscaping there will be minimal disturbance of previously undisturbed land; neither will the proposed redevelopment alter the nature of the neighborhood, which currently consists of large single family homes. (c) In general, the defined Activiryfnvelope for development ofpnmaryusessha#be large enough to accommodate the proposed principal use of the propertyand traditional permitted accessorystructures, infrastructure (roads andsepticsystems), and uses but shouldnot be signifcandylarger than the area needed forsuchstructures.I n the case ofa site with few ConstrainedAreas the defined Activity Envelope may include more than one potential buildingsite fora newsingle familyhome. The defined Activiryfnvelope may include non- contiguousareas (including separate areas forseptic fields landscaping, driveways to pubficroads, mitigation measures requiredin connection with anyprovision ofthis Chapter7, and /orareas to bedisturbedonl yduringconstruction on theproperty- includingstagingareasandmaterialsstorageareas) Constructionoftrail Swill notrequireanActivityfnve lopeanalysisexceptas required bySec 7- 20 -50. Response: The proposed Activity Envelope complies with the above code section. (d) Clearing, grading, grubbing, earthmoving that exceeds fifty (50) cubic yards or changes in the natural drainage of the site shall occur onlyafteran Activiryfnvelope has been defined andall applicable local, state and federal permits have been obtained. In addition, Site Plan Approval is required if these activities will occur on a property within a Scenic view Protection Area. Response: The Applicant will comply with the above code section. While this application also requests Site Plan Approval it is not in order to be in compliance with the above section because the parcel is not within a Scenic View Protection Area. uiiu004 James Richard Activity Envelope R Site Plan Review Parcel ID #273501406002 1 Page 4 of 45 (e)Actiwty Envelope and Site Plan Rewew hors Stream Restoration Project shall adhere to a#developmentstandards m 7 -20-40 and 7 -20 -80 and shall be reviewed by the BOCCas set forth in Table 2 -1. Response: The above code section does not apply. (0 Once an Activityfnvelope has been defined, the naturalgrade, topography, vegetation and drainage ofareas outvde the defined areasshall not be disturbed exceptasspecificallypermitted in this Land Use Code. Prior to any developmentactivityon the parcel, the boundaries of the Activity Envelope shall be identified with construction fencing, andsuch fencing shall remain in place until development has been completed Response: The Applicant will comply with the above code section. (g) While it is preferable to obtain approval ofan Activity Envelope as part of the Site Plan approval process, applicants who are not prepared to submit a Site Plan fora specific structure may request approval ofan Activity Envelope separately. Prior to the issuance ofa Development Permit, the applicantshafl be required to apply forand obtain approval ofa Site Plan confirming that the proposed development is consistent with the defined Activity Envelope and with otherstandards m this Land Use Code notconsidered at the time the Activity Envelope was defined Response: The Applicant is requesting Site Plan approval in conjunction with its request for Activity Envelope Review and will comply with the above. (h) Thestandards m this Chapter 7shallbe used(i) to identify the Activity Envelope on a property, (ii) to review andapprove the Site Plan forproposeddevelopment, and(iii)to regulate development within the Activity Envelopepursuant to the Site Plan. Development Standards in this Chapter which are to be reviewedaspart ofActivityfnvelope andSite Plan review are set forth in Table 7 -1 below. Response: The Applicant will comply with the above code section. SEC. 7- 20 -10: SITE PREPARATION Et GRADING (INCLUDE TREE SURVEY Et MITIGATION PROPOSAL) (a) Grading and Fill Placement. Gradingand filling on a sitesha# takep /ace only within a definedActivityEnve lope. Allgradingand fillplacement that exceeds fifty (50) cubic yards shall be indicatedon the Site Plan. (b) Clearing, Grubbing, and Vegetation Removal. Clearing orgrubbing ofland, orremoval ofvegetation shall take place only within an approved Activity Envelope, except removal of noxious weedsand 10 orfewerdeadordiseased trees ofa caliperof6 "db.h. orgreater within a 12 month time period that create a hazard mayoccuroutside ofanActivityEnvelope. Disposal ofdead oidiseased treesshallbe in accordance with the Land Management Departmentspokcy. Treesremoved that contain active mountainpine beetlesshaflnotbestoredfor firewood. Each Site Plan shall document compliance with the requirements ofthissec. 7- 20- 10(b)andsec. 7 -20 -130. (c) Tree Removal and Mitigation. Each tree with six( 6) Inches orl argerdiameteratbreastheight (D.B.H) thatisremoved within theActiwtyEnvelopeshall be replaced with one (1) ormore trees with total D.B.H. at leastequal to the caliper(s) of the tree(s) removed, to the maximum extent practicable. Any tree that (i) isdiseased, or(ii)isrequired to be removedpursuant to the provisions of Sec 7- 20 -60, as those requirements maybe varied bya wildfire expertapprovedby the County, may be removedandno replacementshall be required. Allrevegetation sha / /a /so comply with the Pitkin CountyRevegetation Guidelines Required replacement trees thatdo notsurvive foratleast one (1) yearafter installation shall be replacedat the owner's expense, and the Countymayrequire financial security forsuch replacement pursuant to Sec. 7- 20- 130(6)(7). Response: The Applicant will comply with the above code sections. (d) Protection of Natural Terrain The County Pl arming£ ngineerorCommunityDevel opmentDirectorshall suggestandmayrequiredesignandconstruction techniques that lessen ormitigate anyphysical and visual damage caused bythe proposedactivityordevelopment to ConstrainedAreas or to the UUU005 James Richard Activity Envelope Et Site Plan Review I Parcel ID #273501406002 Page 5 of 45 natural terrain, stream vegetation, and other natural features of the landscape within the Activity Envelope. Techniques shall include, butarenotbmitedto: (1) Revegetation. Revegetation and reforestation utilizing native orsimilarhorticultural material, to be completedduring the firstplantingseason afterconstruction; where vegetation isremoved, itshall be replaced with vegetation that will reach similardensityandheight to that removed within two (2j years following conclusion of construction. (2) Topsoil Removing andsaving topsoilpriorto anygrat ing orexcavating and replacement forrevegetation. (3) Weed Prevention Weed prevention, thistle management, andprohibttion ofnon- native plants which mayinclude reducing animal damage to vegetation cover, as determined by the United States Soil Conservation Service Soil Survey (4) Utility Installation Locating andinstalling utilities in a mannerminimizing damage to the natural environmentandscenic quality 5) Erosion, Sedimentation, and 5tormwater Management (a) Land uses shall: (1) Not cause erosion problems and h practicable, retain all soil on site; (2) Minimize disturbance ofnatural vegetation andsoil cover, (3) Ensure thatall cuts and fills are adequatelydesigned and vegetated to control erosion as well asstabilityofthe slope area; (4) Ensure that natural drainage patterns are preservedandprotected from increased water flows thatsubject existing channels andadjacentareas to increased erosion; and (5) Preserve natural vegetation andsoil cover within those buffer distances adiacent to rivers, streams, lakes reservoirs and wetlands /riparian areas established in Sec. 7- 10 -80. (b) Mitigation measures identified in an approved erosion, sedimentation, or stormwater management plan shall remain in place until rvegetation is viable. Response: The Applicant will comply with the requirements of the above code sections, but as the proposed Activity Envelope contains primarily previously disturbed areas and no constrained areas, there should be no need for the implementation of the above code sections. 7- 20 -20: STEEP AND POTENTIALLY UNSTABLE SLOPES The following piovisionsshallapply wheneversteep slopes orpotentiallyunstableslopes occur within the ActivilyEnvelope, butdo not apply when the Activity Envelope have been defined to avoidsuch areas (a) Slope Delineation S/opesshall be delineated within the Activityfnvelope with two (2) foot contourintervals. Slopes between each two (1) foot contour in each of the following categoriesshall be designated bya distinctgraphicpattern. (1)S/opes thatare fifteen (15) percent orgreater, but less than thirty(30)percent; (2) Slopes that are thirty(30jpercentorgreater, but less than forty -five (45)percent, (3) Slopes that are forty -five (4s1 percent orgreater. (b) Forty-five (45) Percent or Greater Gradient Development is prohibited on slopes with a slopegradient equal to orexceeding forty-five(45)percent, except: (1) Where: (a) The lot is in a /egallyplattedsubdiw'sion, recorded prior to 1972, and (b) There is no alternative building site that avoidsareas ofslope exceeding forty -five (45) percent, and (c)An engineerorgeologistlicensed in the State of Colorado demonstrates that the site can be engmeeredso that there is no hazardposed by the location ofdevelopment on such slopes, and (d) Theproposed development complies with all standards in subsection (c)(1) belowapplicable to slopes ofthirty(30) percent orgreater,-and (2) As provided in subsections (c)(3) or (c)(4) below Response: As there are no slopes in excess of 45% on this property, this section does not apply. (c) Thirty (30) Percent or Greater Gradient Development is prohibited on slopes with a slopegradient of thirty(30)percent ormore, exceptas follows: jUu006 James Richard Activity Envelope Et Site Plan Review Parcel ID #273501406002 1 Page 6 of 45 (7) No Alternative Building Site if there is no alternative budding site available on theparcel with slopes of less than thirty(30)percent, development (but not roads ordriveways) maybe approved by the Community Development Department through the Site Plan processsubject to the following development standards: (a) An engineerorgeolog7st licensed in the State of Colorado shall be required to demonstrate that thesite can be engineeredso that there is no hazard posed by the location ofdevelopmenton such slopes. (b) To theextentpossib /e the development shall bedesignedsoasto: avoidaddmgwaterto the site that would cause decreasedstability, avoid removing the toe of the slope withoutadequate mechanical support; avoid increasing the weight load on top of the slope; re- contourdisturbed slopesso that they can be re- vegetated, a ✓oidsteepen7ng of existing slopes (c)Anydevelopmentapproved pursuant to this section shall be conditioned upon compliance with the engineeror geologists recommended mitigation measures. (d) Following Site Plan review, and prior to the application fora Building Permit, a precise engineerorgeologistapproved mitigation plan shall be submitted by the applicant thatshows the area ofdisturbedslope, any re-grading required and the exactsize and location ofall mitigation devices. The mitigation measures must be determinedby the Community Development Department to be the least visuallyand ecologicallyobtrusivea lternatives. (2) Parcels with 5omeAreas o£Less than Thirty(30) PercentSlopes (a) lfa parcel comainsareas with less than thirty(30) percentslopes thatareaccessible bya road ordriveway that meets the requirements of this Land Use Code, butsuch areas (afrerexclusion ofConsnainedAreas)are not/arge enough to develop the floorarea permitted byunderlying zoning, then areas contamingslopes ofless than thirty(30) percent must be utilized to develop as much of the floorares as can feasib/ybe accommodated. Areas containing slopes of thirty(30)percentor greater(butnot exceeding forty-five (45) percent) may then be used fordevelopment ofthe remainderof thepermitted floor area. The resulting area specified fordevelopmentshoulddefine a contiguous area with slopesofless than thirty(30) percent to the maximum extent practicable. (b) Developmenton slopes equal to orexceeding thirty(30)percent(but/ess than orequa/ to forty -five (45)percent)shall be subjectio the development standards in Sec.7- 20- 20(c)(7)(a) through (d), andshall minimize disruption ofnatura/ terrain as viewed from anyof those roads identified in Sec 7- 20- 720(b). Response: While the site does contain gradients of 30% and greater, The Applicant has proposed an Activity Envelope that avoids all naturally- occurring slopes greater than 30%. (3) Minor5lope Anomaly Through the Site Plan process, exceptions for minorchanges in slope- developmentmaybe permittedon lands that have slope equal to or in excess of thirty(30)percent when the slope is due to the presence ofa minor natural orminorman -made change in thegradient ofa continuous slope provided that an engineer orgeologist licensed in the State of Colorado demonstrates that the slope'sgroundsurface is notprone to instability or failure and that theproposed development will not causegreaterm5tabi /ity or increase the potential £orslope failure. Response: As this is a previously - developed site which includes some minor retaining walls that result in small areas of engineered grade greater than 30%, The Applicant will comply with the provisions of the above code section. (4) Existing Roads and Driveways Through the Site Plan process, an exception for minor road and an veway impro vem ems may be permitted to existing roads and driveways that traverse previously disturbed slopes equal to or In excess of thirty (30)percent, provided that the applicant demonstrates thatall of the following mnditionsare met: (a) The road or drive way was legally crea ted, as demonstrated by(i)a valid copy of the permit for the road or driveway, or fill evidence that the road or driveway was constructed prior to the County's road ordrivewaypermitsystem in 7993, or (K) that a permit was not required to construct the road or drive way. (b) The proposed use of the road is an existing /ega /use (i.e., ifresidentia/ development is proposed, it shall be demonstrated that the roadalready services an existing, legal residential structure) The current use of the road or drivewayshall not change between residential, commercial, lodging or industrial use. No road impro vemen ts shall be permitted pursuant to this provision to allow the de velopmen t ofany structure where there is no pre- existing, legal structure (e.g., a mining road or jeep road tha t pm vides access to a vacant parcel shall not be improved pursuant to this provision to create access to a new residence/ (c) The improvementsshah be limited to existing roads and driveways that traverse previously disturbed slopes equal to or in excess of thirty (30) percent and comply, or can comply without impacting slopes equal to or in excess of thirty (30)percent, with the minimum requirements in the Pitkin County Road Management and Maintenance Plan for width, grade and uuu00 7 James Richard Activity Envelope Et Site Plan Review Parcel ID #273501406002 Page 7 of 45 curvature. New roadanddaveway improvements that traverse undisturbeds lopesequal to or in excess of th#ty(30)percent are prohibited. (d) The improvements shall be minor in scopeandshall be the mmimum required to ensure the safety ofboth thegeneml publrcand safetyagencypersonnel. Improvements thatmay be permittedpursuant to this provision mayinclude, but not be limited to, pullouts turnarounds orgiading, if the road ordrivewayotherwise complies with thestandards of the Pitkin CountyRoad Managementand Maintenance Plan. Improvements that would create furtherimpactson slopes equal to orin excess of thirty(30)percent in order to bring an existing roadordrivewayinto compliance with the minimum standards of the Pitkin County Road Managementand Maintenance Plan are prohibited (e)An engineerorgeologist licensedin the State of Colorado demonstrates that the slope 'sground surface isnotprone to instabdityorfai lure, and that theproposedimprovements wi / /not causegreaterinstabi /ityorincresse thepotentia/ fors lope failure. (5) Sh o n O ri ve wa y fn c roa ch m en is Through the Budding Permitprocess, an exception forshort drivewayencroachmentsmaybe permittedas follows: (a) This exception mayonlybe utilized where there isno alternative alignment on slopes less than thirty(30) percentand the proposed drivewayis free ofall of the following hazards: high hazordava /anchezone (red zone)and moderate hazard avalanchezone(bluezone), landslideareas, orrockfallareas. (See See. 7-20-50). (b) Fora maximum ofone - hundred (100) l/nearfeet perlotorparcel, thedrivewaymayencroach on slopes between thirty (30)percent ands maximum of forty -five (45)percentgradient. The maximum ofone hundred (700) Anearfeetofpermitted encroachmentshall be measured along the centerline of the driveway. (c)All development permitted pursuant to thissection shall besubject to the developmentstandards of5ec. 7- 20- 20(c)(1)(a) through (d) Response: The Applicant has no plans to re -align the existing driveway at this time, so these code sections do not apply. (6) Micro Hydroelectric Systems Construction and maintenance ofmicro hydraelectricsystem improvements on steep slopes maybe approved by the BOCC through the5pecia /Re vie w and S1te Plan process subject to the fol lo wing deve %pm entstandards: (a) An engineer orgeologistlicensed In the State of Colorado shall be required to demonstrate that the site can be engineered so that there is no hazard posed by the location of the system components on such slopes. (b) To the extent possible, the system componen ts shall be designedso as to: avoid adding water to the site in a manner that would cause decreased stability- a void removing the toe of the slope; re- con tour disturbed slopes so that they can be revegetated,-a void steepening ofexisting slopes. (c)Any development approved pursuant to this section shall be conditioned upon comphance with the engineer or geo %gists recommended mitigation measures. (d) Following site plan review andprior to the application fora building permit, a precise engineerorgeologistapproved mitigation plan shall be submitted by the applicant thatshows the area ofdisturbedslope, anyre-gra&7g required and the exact size and location ofa#mitigation devices The mitigation measures must be determined to be the /east visually and ecologically obtrusive alternatives, and can include but are not limited to hand - burial or non -burial of transmission pipe liner, prohibition of the use ofexcavation equipment for founda tion improvements; and the positioning of facilities So that vegetation removal is kept to a mmimum. Response: This code section does not apply. (7) Habitable Retaining Structures Through the Site Plan process an exception for 'habi table retaining structures "and similar typesofconstruction maybe permitted at the toe, or along the base ofslopes equal to or in excess of thirty (30) percent, including slopesm excess offorty -fve (45)percent. This section shall not modify oth er prohibitions on development including but not limited to those in Section 7 -20- 50 Geologic Hazards. This section is available only when all of the following conditions are met: (a) The property on which the habitable retaining structures are proposed to be built has previously been developed with a structure(s) that meets Coun ty Codes for human habitation and that was budtpursuant to valid County land use approvals and building permits (as applicable). (b) An engineer ora geologist licensed In the State of Colorado has pro v /deda report demonstrating to the satisfaction of th e BOCCthat the site can be engineered so there is no hazardposed by the location of the proposed habitab/e retaining structures on such slopes. (c)The proposedstructuresshall be designed to function pni icipallyas retaining structures, but mayalso be permitted for human habitation. A habitable retaining structure thatalso meets the Code definition ofa residentia/dwe/ ling unit, orisa UU000U James Richard Activity Envelope Et Site Plan Review Parcel ID #273501406002 Page 8 of 45 structure that would typicallybeaccessory to residential dwelling (such as garage), oranystructure that Includes plumbing facilitiesshall not be allowedpursuant to thissub- section. (d) The proposed development at the toe or base of the slope shall be designed toavoidadding water to the site that would cause decreasedstabilityor would increase the weight load on the top of the slope. (e) Slopes thatare disturbed by theproposeddevelopmentshall be re- contouredso they can be re- vegetated, anda plan for such re- vegetation shall be provided which restores the exposedslopes to stable natural condition. (0 The proposed habitable retaining structures shall comply with the standards for retaining walls found in Section 7 -20 -20 (e)(6) of this Code as applicable, butshall not be subject to the limits on changing naturalgrade, the limits on graded, excavated or filled man -made slopes, and the guidelines for retaining walls found in Section 7 -20 -20 (e)(2), (3J, and (5) of this Code. Response: This code section does not apply. (8) P%tkm County5olid Waste Center Operations Response: This code section does not apply. (d) Less man Thirty (30) Percent Gradient Development ispermitted on slopes with less than a thirty(30)percentgradient Response: The proposed Activity Envelope is comprised of areas with slopes with gradients of 30% or less. (e) Additional standards. All activity and development on slopes with a gradient of thirty (30) percent or greater shall comply with the following standards. (1) Den5ity5lope Reduction lfmore than thirty (30)percent of the total landarea ofparcelis encumbered with slopes of forty -five (45) percentorgreater, the maximum permitted densityofdevelopment on the parcel shall be reduced pursuant to Sec. 5- 10 -20. Response: This code section does not apply. (2) Limits on Changing Natural Grade The original, naturalgrede ofareas within the Activity Envelope shall not be raised or lowered more than four(4) feetatanypoint forconstruction ofanystructure orimprovement, except: (a) The site's originalgrade maybe raisedorlowereda maximum ofseven (7) feet if retaining walls are used to reduce the steepness ofman-made slopes provided that the retaining walls comply with the requirements set forth in this section. (b) As necessary to construct driveway from the street to a garage orparking area, grade changes orretaining walls up to seven (7) feet maybe allowed Response: The Applicant will comply with the above code sections. (3) Orading for Accessory Building Pads Discouraged Separate building pads foraccessory buildings andstructures other than garages such as tennis courts swimming pools outbuildings andsimilar facilities, shall be discouraged except where the natural slope is twenty (20Jpercent or less. Response: The Applicant will comply with the above code section. The level ofhazard is determinedprimanlyby grade orslope and continuity of fuels Asa genera/guideline, low hazard is located on slopes ofzero to twenty (0-20)percent with discontinuous fuels moderate hazard is located on slopes often to twenty (10-20)percent with continuous fuels, or on slopes greater than twenty (20)percent with discontinuous fuels; andsevere hazard islocatedonslopesofgreaterthan twenty (20) percent with continuous fuels. (a) Wildfire Hazards Map Areas of Severe Wildfire Hazard" and "Low to Medium Wildfire Hazard "are designated on the Pitkin Countyadopted Wildfire Hazard Area Maps which aremaintainedmtheCommunityDevelopmentDepartment .However,themapsare only ageneral reference andactual wildfire hazardsshall be field verified. In the event field verification identifiesareas of wildfire hazardnot identified on such maps, the provisionsofthis Sec. 7- 20- 60shall apply to such areas In each case where an applicants propertyis locatedpartiallyor entirely within an area of'Severe Wildfire Hazard'; a wildfire expertacceptable to the County, shall visit the propertyto evaluate the /eve /ofnsk in more detail. The wildrire expert mayconfirm the levels of risk indicated on the Wildfire Hazard Area Maps ormayrecommend thatall ora portion(s)ofthe site be reclassified to a higherorlowerlevel of wildfire risk. In addition, the wildfire expertshall make recommendations regarding anymitigation measures thatshould be implemented in light of the proposed activityordevelopment, andsuch recommendationsshal /be considered by the Countyin the Site Plan process. (b) Wildfire Hazard Area Delineation and Activity lfrequested by the Community Development Department during a pre- application conference, the Site Plan shall delineate allareas of Severe Wildfire Hazard "and "Low to Medium Wildfire Hazard" within the Activity Envelope and within one hundred(100) feetoutside the Activity Envelope. In the case of varying hazard levels within the Activityfnvelope, itshall be sufficient to label the entire Activity Envelope with the highest level hazard existing in anypart ofsuch area. TheActivity Enve/ opeshou ldbedesignedtoavoidareasof "Severe Wil dfireHazard, andtomitigatewi ldAre hazards in areas of "Low to Medium Wildfire Hazard "asset forth in thi55ec. 7- 10 -60. All wildfire mitigation and creation ofdefensiblespace shall occur within the ActivityEnve/ope. (c) Standards Applicable to All Wildfire Hazard Areas Development isallowed in wildfire hazard areassubject to conformance with the following development standards (which maybe varied upon recommendation by the wildfire expert), and conformance with theadditionalstandards in subsection (d) as applicable. (1)DefensibleSpace The area aroundall buildings /structures limitedbyproperty boundaries tha t may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions maynotbe necessary where the natural vegetation patterns ha ve already fulfilled these conditions): (a) Brush, debris and non - ornamental vegetation shall be removed within a minimum ten- foot(lOJperimeter around all structures (b) Vegetation shall be reduced to break up the vertical and horizontal contmuityofthe fuels at a minimum ofa thirty (30) foot penmeter around a structure built on fiatground. (Forgrea ter slopes, reference the CSFSSafety Zone chart in Wildfire Guidelines For Rural Homeowners which providesgenera iguidelines that may bemodified bya wildfire expertacceptable to the County). (c) Spacing between clumps of brush and vegetation up to the thirty (30) foot perimetershall be a minimum of two (2) times the height of the fuel Maximum diameterof the clumps shall be equal to the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. (h)All deadfall up to a one hundred (100) footpenmetershall be removed (i) No new conifer trees shall be planted within ten (10) feet ofa residence. 6) No flammable mulchesshaLibe placed within two (2) feet ofa residence. (k) The propertyownershall be responsible for the continued maintenance of the defensible space vegetation requirements. Response: As the Property is mapped as being adjacent to High Wildfire Hazard, The Applicant will comply with all recommendations from the approved wildfire expert at the end of this application. (2)Access (a)Accessroadsand dnvewaysshall be built to Countystandards; however, thesestandards maybe increased to mitigate wildfire hazards based on commentsprovided by the Colorado State forest Service, theShenf' Department, Local fire protection distracts and Cora person approved by the County as an expert in wildfire area designation and mitigation. Where feasible, Looped routes ofaccess /egress to a public roadshall be incorporated in the design ofa proposeddevelopment Looped routes ofaccess /egress isdefinedas two (2) or more dedicated access roads to the main artery/highway for widelyseparatedingress /egress; Looped drives with one (I) entrance point ordividedsingle entrances do notsatisfy this condition. Where this is not feasible, the Community Development Department mayapprove vehicularturnaround areas a maximum ofseven hundred fifty(750) feet apart installed between the road intersection and its terminus. Turnaroundareasshall be the same standardas cul -de -sac turnaround pads; these maybe incorporated into the proposeddriveway entries. The Applicant will comply with all requirements set forth by the Aspen Fire Protection District. (3) Wa ter Suppl y for Fire Safety (a) When access to a public orprivate pressurized watersystem is not avaiiable or ifit is necessaryto augment fire protection watersystems private ponds maybe used ifapproved by the CommunityDeveiopment Department and the local fire disInct (b)Anyfre departmentrecommendation forindividual structure watersuppiyandstorageshall be accessible to fire department vehicles from the extenbrofthestructure through a fire departmentapproved mechanism (such ass fire hydrant). Wildbfe habitatshall be addressed broadly to include locations tha tare ecologicallysignificantand where activities or structures would interfere with important wildlife functionsandactivities. forpurposes of this Sec 7- 20 -70, ConstramedAreasshall include, butshall not be limited to, locations that include: anyportion ofa wetland; iparian habitat,-critical wildlife habitat,-Severe winter range, and /or winterconcentration areas; wildlife migration corridors or habitat; wildlife production, birthing orcalving areas; important waterfowl and wading bird habitat areas; significant mountain sage, aspen, and mountain shrub dominatedhabitat,-and rare, imperiled, sensitive threatened, or endangeredspeaes critical habitat (a) Wildlife Habitat Maps Areasofdesignated wildlife habitatare shown on the Colorado Division of Wildlife (CDOW)SpeciesActivityMaps(the Wildlife Maps), which are maintained in the Community Development Department and herebyadopted byreference, andmaybeamended from time to time by the Colorado Division of Wildlife. Areasshown on those mspsare known to be wildlife habitatareas by the Colorado Division of Wildlife. In all cases mapping will be field verified by the Colorado Division ofWildhfe ora wildlife expertapproved byPitkin County. The following regulationsshall apply to allareas known to be wildlife habitatasa resultofsuch field venfication, regardlessof whether those areas are mapped on the wildlife maps (b) General Principles Delineation of th e A ctivity fn velope, and the location and design ofactivities and structures within the A ctivity En velope, shall be based on consideration of the five (5) principles listed in subsections (1) through (5J below These principles shall be evalua ted not only on a site specific basis, but should also be used to consider the / ocation and role of the property in the con text oflarger habita t and wildlife patterns. Implementation of these principles mayalso include consideration ofconnectivity between otherparcels and the cumulative effect of th e proposed activity or development In light of other activity in the area affecting related habitat areas Approved developmentshall: (1) Maintain large intact areas ofnative vegetation and habitat area by preventing fragmentation of those patches by development. (2) Protect rare landscape elements such as locally rare vegetation, unique rock formations sheltered dra ws or drainage ways or other features, andguide development to wards areas of landscape containing more common elements. (3) Maintain connections among wildlife habitats by identifying and protecting corridors for movement. (4J Con tribute to the regional protection ofrare species byprotecting their habitat locally. (5) Minimize the combined and cumu /ative impacts ofactivities and deve /opmenton wildlife species, wildlife habitat, wildlife movement, and unique landscape elements (c) Oeneral Standard's Thestandards in thissection apply to all wildlife habitat areasshown on the Species Activity Maps or field verified bya wildlife expert approved by the County, or by the Colorado Division of Wildlife. (1) When existing native vegetation mustbe altered within the Activity Envelope, the applicant maybe required to prepare a habitatmitigation plan acceptable to the County. Such mitigation plan maysubstitute (in a nearbyarea on the subject property) vegetation equal in type andquantity to that being removed to mitigate effects on wildlifespecie . Should there be no opportunityon the property forhabitat mitigation orrestoration, off -site mitigation benefiting thesamespecies maybe required, or financial mitigation maybe paid into a County habitat mitigation fund shouldsuch a fund be established m the future. (2) Manipulation of vegetation outside of theActivItivEnvelooe isprohibited (3) Mesh or woven wire fencesare prohibited outside theActivityEnvelope. (4) Wood rail fencing shall employ three (3) rails or less be the round orsplit rail type, shall not exceed fifty- four(54J inches in heightaboveground level, and twelve (11J inches m width (top view), andshall have at least eighteen (18) inches between the lower two (1) rails. (5) Wire fencing must be three (3) strands or less. The top wire should be twelve- paint -five (12.5)gauge twisted barb/ess type at a maximum height offorty -two (42) inches The middle st rands (which maybe barbed)should be locateda minimum twelve (12) inchesapartand Mom the top wire preventing entanglement when mule deerjump over. The bottom strandshould besixteen (16) inches from theground (6) Tall overlymature trees andstanding dead trees (snags)should be reiainedat the rate of two (2) to five (5)peracre whenever possible as nesting and perching habitat. (7) /n areasofhigh black bear activity, fruit bearing treesandshrubsshal /be prohibited within the A ctivity En velope. (9)Access5ha /l be provided to the Colorado Division of Wildlife for trapping, tagging, studying, or otherwise managing wildlife. (10) Trash /garbage shal /be kept in an approved bearresistant contamerorenclosure. (I I) Bird feeders Including hummingbird feeders, shall be hung away from any deck or window, and beat least ten (10) feet from the groundsuspended between two (2) trees orposts. All seed feedersshall include a seed catchmentpan to catch discardedseed (12)Horsegrains, pellets, and cookiesshall be stored in bearresistant containers. (13) Pet food shall not be left outside. (14)A / / outside doorssha//utiATe onlysoAdround handled doorknobs unless another type is required by the applicable Building Code for disabled accessibilitypurposes. (15)[Reserved for standard for raptorprotection from new above ground utrhypoles]. (d) General Buffer Standards Structures locatednear wildlife habitatshall comply with the followingstandards formaimaining bufferdistances unless (i) Pitkin Countyor the Colorado Division ofW idlifesuggests thata different buffensappropriate due to unusual wildlife factors orother unique features of theproperty, and the alternative isapproved through the Site Planning process or(ii) the parcel in question is too small to accommodate the required buffers, in which case the buffersshall be provided to the maximum extentpracticable. (1)Nest/RoostBuffer The minimum buffer foranystructure locatednearan active peregrine fa /con, osprey, golden eagle, or bald eagle nest orroostsite shall be one-half (112) mile (2,640 feet) in Rural Areas, and five hundred (500) feet in Urban Areas. The minimum buffer for any structure locatednearanyother active raptornest site (exceptAmerican kestre /s)shall be one- quarter(114)mile (1,320 feet). (2) Intensive Use Buffer Intensive usessuch as commercial, industrial or motorized commercial /organized recreational uses, open pit mineral extraction or the construction ofroadwaysshal/requirea building orstructure bufferofa minimum of one thousand (1,000) feet from any wildlife habdatarea in Rura /Areas, and five hundred (500) feet in Urban Areas (3) Endangered, Threatened, or Rare Species No structure shall be located in rare, threatened, or endangeredspecies critical habitat. There shall be a minimum one -half 112 mile (2,640 foot) bufferbetween anybuilding orstructure andany threatened orendangeredspecies critical habitat. There shall be a minimum one- quarter(1 14)mile (1,320 foot) bufferbetween rare and /orimpenledspecies habitat (4) Important Waterfowl andWading Bird HabitatArea There shall be a minimum three hundred (300) foot bufferbetween anybuilding orstructure and important waterfowl and wading budhabitatareas. Within all important waterfowland wading bird habitat, dogsshall be kenneled within fifty(50) feetof the residential buildings orleashed underhuman supervision. (5) Wildlife Migration Corridors There shall be a minimum one- quarter(1 14) mile (7,320 foot) bufferbetween anybuilding orstructure and wildlife migration corridors . (6)5evereWinterRange, Winter Concentration Area Thereshall bea minimum one- quarter(1 14) mile (1,320 foot) bufferbetween anybuilding orstructure and critica /habitat, severe winterrange, and /or winterconcentration areas. (7) Production Area lfdeve/opment isapprovedadjacent to ungulate (bighorn sheep, mule deerand elk)production areas, thereshall be a minimum one- quarter(1 14) mile (1,320 foot) bufferbetween any building orstructure and production areas. (e) General Livestock and Domestic Animals The following standards sha/ /app /y to all habitatareas unless standard for livestock and domestic animals in relation to specific species is provided in subsection (f) below, in which case the standards in subsection (0shallgovern. (1) Wetland and Riparian Areas Activities that involve the keeping oflivestockand/orhorsesadjacent to wetlands or riparian areas or their bufferareas shall include provisions in the Site Plan thatprotect the wetlandand bufferareas from damage due to such domestic animals or livestock. (2)W7nterRange, Severe Winter Range, and Winter Concentration Areas and Critical Habitat /'development /s approved within winterrange, severe winter range and /or winter concentration areas dogs shall be kenneled within fifty (50) feet of the residential buildings or leashed under human supervision when outside requiredkennel. (3) Wildlife Migration Corridors lfdevelopment 15 approved within migration corridors dogs shall be kenneled within fifty (50) feetof the residential buildings or leashed underhuman supervision when outside a required kennel within a %4 mile (1,320 feet) ofmigration corridors and within oradjacent to migration pattems, transition range, or highwaycrossings. (4) Wildlife Production Areas Ifdevelopment is approved within oradjacent to wildlife production areas, dogsshall be kenneled within fifty (50) feet of the residential buildings orleashed underhuman supervision when outside requiredkennel If livestock is present, a livestock management plan shall be required to prevent interference with wildlife production. (6) Overgrazing Overgrazing of ranges b y livestock shall be a ✓aided. (f) Additional Species - Specific Standards (I)Deer, El kandBighom Sheep WinterConcentrationArea /Severe Winter Range Developmentisprohibited within deer, elk, andbighorn sheep winterconcentrationareasandsevere w/nterrangeareas. In the event that an application is denied because there is no hazard -free area on a site, and an appeal is latergrantedpursuant to Sec. 2- 20- 180orrelief isgrantedpur5uant to Sec. 2 -40 -150, theproposedactivityordevelopmentsha llbereviewedaccordingtothe followingstandardsandshall comply with Secs 7- 20- 70(b), (c), and (e) ApproveddevelopmentshalE (a) Prohibit commercialactivity(such asseismic activity, construction and tlmberharvesting)and recreational uses from December 1st through March 315t. (b) Prohibitdogs within oradjacent to elk, mule deer, and bighorn sheep severe wmterrangesand winter concentration areas, except for dogs working aspart ofan agricultural operation. (2) Deer, E/kand Bighorn Sheep Winter Range Land uses located in deer, elk or bighorn sheep winterrange shall comply with Secs 7- 20- 70(b) (c), and (e), and the standards in thissection. (a) High impact recreatlonal uses are prohibited (b) Dogs within oradjacent to winter range shall be kenneled, except for working dogs when at work (3) Deer and Elk Migiation Patterns /Conidorsand Highway Crossings Development that blocks deer or elk migration corridor andprevents migration between summerand win ter ranges is prohibited In the event that an application is denied because there is no hazard -free area on a site, and an appeal is latergranled pursuant to Sec 2 -20 -180 or relief is gran tedpursuant to Sec 2 -40 -150, the proposed activity or deve %pmentshall comply with Secs. 7- 20- 70(b), (c), and (e), and the standards in this section. (a) Dogs within one- quarter(114)mile (1,320 feet) ofmule deer and elk migration corridors andpatternsshall be kenneled, except for working dogs when at work (4) Deer and Elk Production Areas Development is prohibited within deer and elk production areas. In the event that an application is denied because there is no portion of the site outside ofa deer or elk production area, and an appeal is la tergran tedpursuan t to Sec. 2 -20 -180 orreliefis grantedpursuant to Sec. 2- 40- 90orSec. 2 -40 -130, the proposed activity or developmen t shall comply with Secs 7 -20 -70 (b), (c), and (e), and shall be reve wed according to the following standards Approved deve %pmentshall: (a) Prohibit other activities during the calving season that would disrupt reproduction. (b) Dogs are prohibited within one- quarter(114)mile ofdeeror elk production areas. Dogs within one- half(1 12)mile of deer or elk production areas shall be kenneled (c)Manipulation of vegetation is prohibited, excep t as appro ved by the Colorado Division of Wildlife or wildlife expert approved byP/tkin County (g) Timing of Construction (1) Winter Range, Severe Winter Range, and Winter Concentration Areas No construction shall be permitted from December 1st through March 31st lfthe proposed development is within one - quarter (114) mile (1,320 feet) o£a severe winterrange or winterconcentration area. This restriction shall also applyto winterrange areas ifrecommended by the Colorado Dtvision of Wildlife orotherexpertacceptab /e to the County, due to sitespecific arcumstances, and /orcumulative habitat loss. (2)W,ldlife Migration Corridors No construction shall be permitted within oradjacent to wild life migration corridors between October 15th and November30th orbetweenApril 151h and May30th. (3) Wildlife Production Areas (a) No construction shall be permitted in oradjacent to wildlife production areas between May 15th and June 30th. Response: The Applicant will comply with all recommendations from the County's wildlife expert. 7 -20 -130: LANDSCAPING AND VEGETATION PROTECTION All development in Pitkin Countyshall comply with the Pitkin County Landscape Guidelines and portions ofdevelopmentadjacent to public roadssha / /comp /y with the RoadwayLandscaping Guidelines comainedin the Atkin CountyAsset Management Plan In case of conflict between the provisions of these two documents and the standards below, the guideline documents shall apply. (b) General Provisions (1) Protection of Natural Vegetation In order to protect the rural characteroffitkin County, natural vegetation should be preserved to the maximum extent practicable, andanyinstalled landscapingshall use thespeciesplant materials naturallyoccurring on thesite oron neighboring properties (except forflowergardens) Restrictions on removal ofnatura/ vegetation, and requirements forrevegetation, areset forth in otherportions of this Chapter 7 CHAPTER 7: DEVELOPMENTSTANDARDSPitkin County Land Use Code CHAPTER 7- D EVEL OPMENT STA NDARDS Ju I y 2006 Page 78 (2) Conformance with Wildfire Regulations In the event the provisions of this5ec. 7 -20 -130 conflict with anyprovi5ionsof5ec. 7- 20 -60, as those requirements maybe varied bya wildfire expertapproved by the County, the provisions of5ec.7- 20- 605hallgovern. (3) Berms Berms maybe incorporated into anyrequired landscaping, buffering, orscreening area, provided that the County determines, during the development approval process, that the proposed berms will not cause drainage or erosion problems. No installed berm shall have a slope ofgreater than four -to one (4:1), nors heightgreater than four (4) feet abovegrade. (4) Landscape Enclosures Landscaping shall not be used to markor enclose the boundaryofa parcel, or to privatize an otherwise public viewplane. Use of indigenousshrubs or trees to enclose a portion of thepropertyimmedlatelysurrounding a dwelling, barn, and /oraccessory buildings (as opposed to the emirepropertyora /argearea of theproperty) arepermitted ifmade to resemb /esimi /ar windbreaks located nearolderproperties in Rura /Areas of the County. (5) Visibility Clearance All landscaping shall be insta / /edandmaintainedso that itdoes notinterfere with the abi /ityofdrivers to see nearbytraffic at the intersection ofanydnveway with a public road, orat the intersection of two pubficroads. (6) Utility Easements Whenever theprovisionsof this Sec. 7- 20- 130wou /drequire the installation of trees orshrubsoveroron utility easements where branches orroots mightinterfere with utilityfines orpipes, the required location forsuch treesandshrubssha / /be modified to require installation at the closest location that wouldavoid potemia /conflicts with utilitiesand would enable the treesand shrubs to serve the same landscaping purpose. (7) Financial Security The Community Development Department may require financial security in a form acceptable to the Coun tyA ttorney to ensure completion ofinstallation ofall required landscaping and /or successful establishmentofplants. (8)Maintenance A //plants sha / /be ma intained con tinua / /yina healthy condition in accordance with genera //y acceptedprofessiona /horticultural standardsand practices. Within areas required to be landscaped with installed p /ant materals, plants thatd /e orare unhealthy shall be replaced Landscape areasshall remain free of weeds, litter junk, rubbish and othernuisancesand obstructions. Response: The proposed development will comply with the above code sections. (c) Required Landscaping in Rural Areas In the Rural Area: (1) Landscaping isrequired for the fallowing purposes: N to screen satellite dlshesand other telecommunications equipment when located within five hundred(500) feet ofadjacent public roads and visible from such roads and(ill to screen parkingareas andserviceareas when viewed from adjacent public roads (iii) where necessary to comply with thestandardsofsecs. 7- 20 -70, 7- 20-80, or7 -20 -120, and (iv)torevegetatedisturbedareas. (2) Landscape treatments shall clustershrubsand trees intogroupingssimilar to those naturallyoccurring on thesite or neighboring sites, shall use indigenousspecies ofshrubsand trees andshall not be installed in regularlyspaced lines arrows, unless more specific provisions of5ecs 7- 20 -70, 7- 20 -80, or 7-20-120 require a different treatment. Response: As the property is in the Urban Growth Boundary, the above code sections do not apply. (d) Required Landscaping in Urban Areas (1) Where Required Landscaping is required for the fol %wmg purposes fornewdevelopment on the property: (i) to screen satellite dishes and other telecommunications equipment when located within two hundred (200) feet ofadjacentpublic roadsand visible from such roads, (ii) to screen non - residential parking areasandservice areas when viewed from adjacentpubhc roads, ('ii) to create a landscaped 0Uu019 James Richard Activity Envelope & Site Plan Review Parcel ID #273501406002 Page 19 of 45 street edge in the 8 -2 zone district, (iv) to breakup required parking areas in the 8-2 zone district into smaller cells "ofparking, and (v) to breakup the perceived mass oflargerbuildings in the 8-2 zone distract through the use of foundation plantings (2) Minimum Areas and Plant Densities Required All requvedareas for landscaping, buffering, orscreenmg shall comply with the followingstandards unless these standards conflict with another developmentstandardin this Chapter 7 (a) Satellite Dishes and Telecommunications Equipment. Landscape treatments shall use Indigenous species ofshrubs and trees andshall be sufficient to block visibility ofseventy-five (75)percentofthe dish or equipment within three (3) years of planting. (b) Non - Residential ParkingAreas and Service Areas m all Zone Districts, and5treetEdge in B -2 Zone District Screening for non- residential parking areas andsewice areasshall beat least fifteen (75) feet in width andshall have at least (I) large tree (minimum 30 foot height at maturity) per fifty(50) linear feet of landscape area, plus one (1) shrub per ten (10) feet of linear landscape area, plus two (2)groundcoverplants per each five (S) linear feet of landscape area. (c) Parking Cells in B -2 Zone District Landscaped islands shall be used to break up parking into cells "containing no more than forty (40)parkbg spaces, and the landscaped islands shall coverat least five (S)percent of thegross area of the parking lot, including areas fordriving aisles but excluding anyareas occupied byperimeterlandscapingalong adjacent publicstreets. Each landscaped islandshall be a minimum of eight (8) feet wide and shall contain at least one (1) medium tree (minimum 20 feet height at maturity) per fifty(50) feet oflinearlength, plus one (1)shrub per ten (70) feet of linear landscapedarea, plus two (2)groundcoverplants per five (5) linear feet of landscapedarea. (d) Building Perimeter Landscaping in 9-2 Zone District Shrubs shall be planted within ten (10) feet of the foundation of the primary structure along each building fayade visible from an adjacent public road, at the rate o f a t least twen ty (20J shrubs per one hundred (100) Anesr fee t of visible building fayade. Foundation plantings maybe clustered to provide interest, and plants oflargersize or differing species shall be installedadjacent to the main pedestrian entryway to each building to emphasize thatentryway. The Community Development Department may waive foundation planting requirements forport4ms of thesides arrears of buildings where loading areas orothersimilarareasprecluding planting. (e) Alternative Approaches Plantspacing and densitiesdiffering from those m subsections(a) through (d)above maybe approved ifthe Community Deve /opmentDepartmentdetermines thatsuch a/temative wi / /inc /ude at least thesameamountof living landscape materia /and will have an equallylandscapedappearance when viewed from adjacentroadsandproperties. Response: The proposed development lies within the R -30 Zone District inside the Urban Growth Boundary. While the above to a large extent is not applicable, the development will comply where it does. 7 -20 -140: LIGHTING (a) Applicability Thestandards m this Sec 7- 20- 140are applicable to all lighting in Pitkin County. No lighting shall be mstalledorcontinued that violates the standards of this section. (b) Bulb Visibility All exteriorlightingshall be designedso that the bulb (point /ightsource) is notdirect /y visible from adjacentandneighboring properties orpublicrights-of-way. Thiscan beaccomptshedusing fixtures that fu / /yshie /d "thebu /b behindopaqueshie /ding(i.e.,the I ghtdistribution is primarilydown and /orup directedJor which utilize non- transparentdiffusion material (eg. glass, acrylic, or polycarbonate) in the case of fixtures with some sortof translucent lens(es) around the bulb compartment, In thecase ofopaque shie /ding, wattageshall be limited to sixty(60) incandescent wattsperfixture or twenty-five (25) compact fluorescent watts (c) Light Trespass Light trespass is definedas theshining of lightproducedbya lightfixture beyond the horizontal boundariesof the propertyon which it is locatedand verticallyabove the property. Forall types of uses, light level shall be nogreaterthan one - half(? /2)ofa foot - candle at thepropertyline. (d) Maximum Heights and Intensities Maximum heightsand intensities oflightmg shall conform to the following table. lJUUO" 20 James Richard Activity Envelope Et Site Plan Review Parcel ID #273501406002 Page 20 of 45 (e) Up/ighting Uplighting isonlypermitted when usedas follows (1) Tolightaprimaryentrance, when the lighting fixture is wall- mountedunderanarchitecturalelement (eg.,roolsover walkwayslemnesoroverhanging, non - translucent eaves)and that this elementeontains the illumination, and (2) To light Rags, when no, more than two tightfixtures perflag are used, with a maximum ofone hundred fifty(150) watts each The fixturemust beshielded such that thepointsourve is not visible outsidea fifteen foot (15f radius. (f) Highlighting Illumination ofbui/ding facades, driveways and landscapingsha/l beproh/bited. Lighting intended to illuminate the Roaring fork, Frying Pan and Crystal Rivers or their tributaries shall be prohibited. (g) Floofthting Hood lighting is on/ypermitted when itisdown- directedandcontro / /edbya motion sensorthatis triggeredbyactivity within the owner's propertylines and when fulfil-shieldedsuch that the lightsource is not visible from adjacentand/orneighboring properties Ground - mounted floodlighting ofa structure isprohibited. (h) Safety and Security Lighting The use ofmotion senor photocells orphotoceli /timers to control duration ofmghttime illumination isrequired farsaletyand secuntybyhNng. mall cases, light intensityshall be limited to between oneand two (2) foot - candles (1)Motion Sensorsare the preferredmethod forcontrollingnighttime illumination. Theseareonlypermitted where thesensoris triggered byactivity within theowners propertylines (2) Photocellsareonlypermitted under the following conditions: (a)Atpnmarypomtsofentiance (e.g., front entries) or in criticalcommon areas forcommercialand multi- familyproperties ( b) Wherethel ightsourcesarefu llyshieldedbyopaquematenal(Ze thefixture illuminates the area butisnotitseTfvisibly bright); (c)ForntFidential properties thelightsource is fluorescent (orcompactfluorescent) to eliminate excesse /ectncity consumption; and (d) For non- residential properties HID Lightsources(high pressure sodium and metal hal/de) may be used instead of fluorescentlighting. (3) FrmePPhotorell Combina tions are a preferred method when used for nighttime control at pninarypoints ofentrance leg, front en tries) and maybe used with fully shielded lighting fixtures with non - bansparentdiffusion material. (i) Properties Adjacent to Public Rights of Way In addition to being in compliance with the above sections, no exterior fighting maybe used in any manner that could interfere with the safe move men tofmotor vehicles on public thoroughfares Specifically, the following is prohibited: (1) Any light not designed for roadway illumination tha t produces direct or reflectedglare that could bedisturbing to the operator ofa motor vehicle. (2)Any/ight that may be confused with or construed asa traffic con tral device excep t as au thorized by State, Federal, or County govemment. (%J Mercury Vapor and Low Pressure Sodium Sources These light sources are prohibited. Response: The proposed development will comply with the above code sections. Response: The proposed development is residential in nature and therefore the above code items do not apply. (o) Exemptions The following types oflighting m5tallations5hall be exempt from the provisions, requirementsand reviewstandards of thissection. The light mtensityofall holidaylightmg shall not exceed one- half(1 12) ofa foot candle at the propertyline. (3) Appro ved Historic Lighting fixtures Nonconforming lighting fixtures thatare consistent with the characterofthe historicstructure maybe exempted with approval from the Historic Preservation OlficerorHistonc Preservation Commission. Approved fixturesshall be consistent with the architectural periodand design style of the structure andshall not exceed fifty(5o) watts. (4) Lighting for Temporary Commercial Use /Special Events Requests forexemptions forlighting associated with temporarycommercial usesand/orspecia /events maybe applied forunder the Temporary Commercial Uses /Special Events procedures in this Land Use Code. (d) Subdivision Access All accesspoims to subdivisions shall be reviewedandapproved through the applicable developmentreview and approval process in Chapter 2. All accesspointsandroad designs must comply with the standards in subsection (e) above. (e) Completion of Road Improvements Required County high way, road, street and private street improvements must be completed within the time limits set forth in the developmentappro✓ aL (f) Traffic Volumes in Excess of Existing Road Capacities Development proposals forall types ofdevelopmentother than single family detached dwellings thatgenerate traffic volumes in excess of existing road capacities are prohibited unless road improvementplan is approved by the County. Any developmentproposal that is expected to generate orattract vehicle trips in excess of existing road capacities maypropose to upgrade the road(s) to serve the additional traffic volume. Techniques other than road improvements mayalso be proposed to provide forpublic orprivate transit solutions to increased traffic volumes. The Countymay approve any road improvementplan, Transportation Demand Management (MM) plan, orother technique that is found to be consistent with adopted Countypians and policies The Countymaydenyanyroad improvementplan orother technique that it finds to be inconsistent with adopted plansand policies, or that fails to adequately mitigate increased traffic impacts. Dear Mr. Hufker, I appreciate you and Michael Bassi of Aspen Constructors meeting with me on site at this property on Monday June 3rd and for providing me with the activity envelope and site plan. I remained on site for a time to take photos, measure slopes and evaluate the wildfire hazard conditions. I will qualify my observations as those of conditions as they now exist. Like many properties on Red Mountain this property is determined to be within a Severe Wildfire Hazard area because of the 75% + - slope below the activity envelope, the west facing draw below, the geography which can accelerate a wildfire in that area and the continuity and type of vegetation. The shape of the property results in short distances to the property lines to the southeast and southwest. This somewhat limits the ability of this property owner to manage the vegetation since this management can only be done on their own property. The steep slope below the activity envelope also makes it difficult to manage vegetation because slope stability should not be compromised. Along the property line to the southwest the area is somewhat level and landscaped, there is a mixture of aspen and conifer on both properties, most of which has been well maintained. However, the steep slope to the northwest along the property line has dense vegetation, mostly service berry, oak and other native brush which is continuous up to the trees between the homes. Along the property line to the southeast the area is again somewhat level and landscaped, there is a mixture of aspen, conifer and native brush which is contiguous with the steep slope and dense native vegetation down slope. The steep slope from northeast to northwest is densely vegetated with service berry, oak and other native brush in close proximity to the existing house. There are a considerable amount of deadfall visible on the property. The existing house was constructed utilizing a considerable amount of old railroad ties for landscape retaining walls and steps. Some of this is connected directly to the house. I recommend an alternative type of construction wherever this has been done. Vegetation Management and Modification Recommended: 1) For a distance of 15 -feet around the house and to the southeast and southwest property lines and beyond the furthermost projection of combustible construction the area should be of primarily noncombustible hard scape surfaces, low growing perennials, flowerbeds, cut grass and deciduous, well - trimmed and irrigated plants. Woody vegetation should not be planted within this area. Firewood or other combustible materials should not be stored within this area. The existing trees between the houses should be separated from the dense vegetation on the steep slopes by at least 30 -feet. 2) Beyond the 15 -foot area and up to 55 -feet down slope, thin existing trees and brush into individuals or clusters. Clusters of bushes or shrubs should be separated from each other and from those beyond the 55 -foot area by a distance of 2 '/z times the height of the mature vegetation. Oak and service berry should be thinned and clustered and all standing dead and deadfall in this area removed. This should be done in a manner that will not destabilize the steep slope. Most of the shrubs that will be cut are vigorous sprouting plants and with the approval of Pitkin County and the property owner the cut ends may be treated with a product named Garlon®, or an equivalent, by a person licensed to apply herbicides so as to prevent regeneration. 3) Cut materials should be either removed or chipped and spread. The following are paraphrased from the Pitkin County Land Use Code, Chapter 7, Section 7- 20 -60, Wildfire Hazards, and may not contain the exact language but it is intended to be consistent with the intent and purpose of the Pitkin County Requirements. Projections: Eves and other projections should be kept to a minimum on the down slope side and on cross slope sides and should not have ventilation openings unless the design and configuration of the openings are specifically approved by Pitkin County. Projections may include, but are not limited to eaves; cornices; soffits; roofs over open decks, cantilevered floors; bay windows; decks or balconies. Projections may cause heat traps and any to be included in the construction should be protected as follows: Any projection including guardrails should be constructed with materials approved for one -hour fire- resistive construction or Type IV Heavy Timber construction materials per the currently adopted building code. Projections should be constructed so that they do not trap, hold or retain leaves or debris that may be ignited by burning brands carried by air currents from any fire in the area. An alternative construction for projections may be permitted provided they are constructed of non - combustible building materials or materials with a flame spread rating of less than twenty five ( <25 tested to ASTM E84) and listed for exterior use. Areas below such projections must be void of vegetation or other combustible materials. The areas below these projections shall be protected from accumulation of vegetative materials by placement of a vegetative barrier covered with rocks or gravel or shall be concrete or stone. There shall be no storage of combustible materials under projections. The walls under these projections shall be constructed of materials approved for one -hour fire- resistive construction on the exterior side of the wall. Window openings in walls below projections shall be tempered glass. Doors shall be noncombustible or one and three - fourths inch (1 3/4 ") solid wood. Windows and Glass: Glazed openings shall be provided with closing, solid, exterior non - flammable shutters or shall be of tempered glass. Exterior Walls and Siding: Siding and exterior wall construction shall have a minimum of one -hour fire - resistive rating ground level to roofline, 5/8" gypboard underlying combustible materials or cement stucco with a minimum thickness of 1/4". Exterior doors shall be noncombustible or one and three - fourths inch (1 '/4 ") solid wood. Roofs: Roofs shall be constructed with a Class A roof assembly as defined in the 2003 International Building Code (IBC) Section 1505.2. Wood shake /shingle roof coverings are prohibited in all wildfire hazard areas. Roofs with less than a 3:12 pitch are not permitted in wildfire areas unless they comply with the following: 1) All roof coverings shall be listed for installation as a part of the Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing the roof. 3) All roof designs shall facilitate the natural process of clearing the roof of debris. Protrusions above the roofline, such as parapets, shall be prohibited unless specifically approved by the Fire Marshal. 4) Roofs shall be installed as required by the adopted building code and shall have a minimum slope of 1:48. 5) All roof designs, coverings or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. 6) Vents shall be screened with corrosive resistant wire mesh, with mesh one - fourth -inch (/4 ") maximum. Maintenance: 1) Roofs and gutters shall be kept clear of debris. 2) Yards shall be kept clear of all litter, slash and flammable materials and debris. 3) All flammable materials shall be stored on a parallel contour a minimum of fifteen -feet (15') from any structure. 4) Weeds and grass within the fifteen -foot (15') perimeter and under trees, bushes and brush shall be maintained at a height of not more than six - inches (6 ").
