RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITRIN COUNTY, COLORADO, GRANTING APPROVAL OF A
THREE YEAR EXTENSION OF VESTED PROPERTY RIGHTS
TO ROBERT A. HEFNER III

RECITALS
1. Robert A. Hefner III, hereafter "Applicant'" has applied to the
Board of County Commissioners of Pitkin County, Colorado, for
approval of an Extension of Vested Property Rights.
2. The property contains approximately 13.66 acres and is described
on "Exhibit All attached.
3. The applicant received 1041 Hazard Review approval from the
Planning and Zoning Commission on July 6, 1989, subject to the
conditions of Resolution PZ- 89 -24.
4. The Board of County Commissioners (hereinafter "Board ")
considered the applicant's request at a duly noticed public hearing
on September 13, 1995 at which time the Board found the applicant's
request to be consistent with the Land Use Code.
5. The Board of County Commissioners adopted Ordinance 92 -08 on
March 10, 1992 which requires special review approval for properties
under 20 acres to construct more than 15,000 square feet. The
applicant is subject to the standards contained in this ordinance,
as amended, and codified as Section 3- 200.90 of the Pitkin County
Land Use Code.
6. Section 3 -80.70 (Wildfire Areas), of the Pitkin County Land Use

Code contains new wildfire mitigation standards which should be
applied to this property as it is identified as being a moderate
wildfire hazard.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Pitkin County, Colorado that it hereby grants a three year
Extension of Vested Rights to the applicant subject to the
following conditions:
1. The 1041 Hazard Review Map, recorded at Book 25, Page 4, shall
remain in effect, except for conditions as modified by this
Resolution.
2. The conditions of the Planning Commission Resolution PZ -89 -24
and Board of County Commissioners' Resolution No. 92 -378 are
incorporated into and superseded by this Resolution.
3. The applicant shall comply with the requirements of ordinance
92 -08, now codified in the Pitkin County Land Use Code as Section
3- 200.90, which regulates homes of greater than 15,000 square feet.
4. To mitigate wildfire hazards, the applicant shall comply with
the following conditions:
* Brush, debris and non - ornamental vegetation shall be removed
within a minimum 10 foot perimeter around the structure.
* Vegetation shall be reduced to break up the vertical and
horizontal continuity of the fuels a minimum of a 30 foot perimeter
around a structure built on flat ground. (For greater slopes ref.
CSFS Safety Zone chart, Page 13, Wildfire Guidelines for Rural
Homeowners).
* Spacing between clumps of brush and vegetation within the 30 foot
perimeter shall be a minimum of two times the height of the fuel.
Maximum diameter of the clumps shall be two times the height of the
fuel. All measurements shall be from the edges of the crowns of the
fuel.
* All branches from trees and brush within the 30 foot perimeter

shall be pruned to a height of 10 feet above the ground and removal
of ladder fuels from around trees and brush.
* Tree crown separation within the 30 foot perimeters shall have
a minimum of 10 feet between the edges of the crowns. This does not
apply to mature stands of aspen trees where the above
recommendation for removal of ladder fuels has been complied with.
In areas of aspen regeneration, the spacing guidelines shall be
followed.
* All branches which extend over the roof eaves shall be trimmed
and all branches within 15 feet of the chimneys shall be removed.
* The density of fuels within a 100 foot perimeter of the
structures shall be reduced where natural reduction has not already
occurred.
* The applicant shall be responsible for the continued maintenance
of the defensible space vegetation requirements.
* Roof construction shall be class A, non - combustible (no wood
shake /shingles) material with no flat roofs.
* Vents shall be screened with corrosive resistant wire mesh with
mesh 1/4 inch maximum.
• Roofs and gutters shall be kept clear of debris.
• Yards shall be kept clear of all litter, slash and flammable
debris.
* All flammable materials shall be stored on a parallel contour a
minimum of 15 feet away from any structure.
* Weeds and grasses within the 10 foot perimeter shall be
maintained to a height of not more than 6 inches.
* Firewood /wood piles shall be stacked on a parallel contour a
minimum of 15 feet away from the structure.
• Swimming pools shall be accessible to Fire Department vehicles.
• Fences shall be kept clear of brush and debris.
• Wood fences shall not connect to the structure.
• Any outbuildings or additional structures shall adhere to the
same standards as structures.
* Propane tanks shall be installed according to NFPA 48 standards
and on a contour away from any structure with standard defensible
space vegetation mitigation around any above - ground tank. Any wood
enclosure around the tank shall be constructed with materials
approved for 2 hour fire - resistive construction on the exterior

side of the walls.
* Each structure shall have a minimum of one 10 pound ABC fire
extinguisher.
* Addresses shall be clearly marked with 2 inch non - combustible
letters and shall be visible and installed on a non - combustible
post.
* The residential structure shall be required to install in -house
sprinkler systems which meet the standards of the local fire
protection district and the Uniform Building Code.
* Utility lines shall be buried.
5. To mitigate geologic hazards, the applicant shall comply with
the following conditions:
* Landscaping shall be designed to ensure positive drainage around
the building.
• Perimeter foundation drains shall be required.
• The waste water disposal system shall be constructed within the
building envelope and conform to County regulations.
* The entrance (intersection) of the proposed driveway to Trentaz
Road shall have a minimum sight distance of 250 feet.
* A detailed landscape /revegetation plan shall be provided to the
Planning Department for review and approval prior to construction.
The plan shall include estimated costs of successful implementation
and a performance guarantee to ensure success of the landscaping.
* The applicant shall present to the County Engineer a detailed
drainage plan that determines the amount of run -off or rainwater
carried in the gully during a significant run -off or storm. If the
drainage study shows that a problem may indeed exist, the applicant
shall mitigate these drainage concerns within a revised driveway
design.
* All utilities to the proposed development shall be buried to the
building envelope along the driveway alignment.
* The residence shall be designed to provide for the venting and
removal of radon gas.
6. The applicant shall abide by all representations made at this
meeting and in the previous hearings.

Location: The property is located off of Trentaz Drive in White
Horse Springs.
Issue: The applicant requests an Extension of Vested Rights for a
13.66 acre parcel which contains mapped geologic and wildfire
hazards. The property received 1041 Hazard Review approval from the
Planning and Zoning Commission in 1989, pursuant to Resolution No.
PZ- 89 -24. In 1992 the Board granted approval of Extension of Vested
Property Rights for three years by Resolution No. 92 -378. In
reviewing this second request, the staff's only concern is that our
wildfire regulations have been revised subsequent to these previous
approvals. The staff recommends revisions to the previous approvals
to incorporate the new moderate wildfire safety guidelines into
this request.
Recommendation: The staff recommends approval of the Hefner
Extension of Vested Rights subject to the conditions contained in
the attached Resolution.

I have reviewed the above referenced application and offer the
following comments.
ZONE: RS -20, twenty acre minimum lot size
This parcel contains 13.66 acres and is non - conforming in size.
SETBACKS: The required setbacks for this parcel are:
100 foot front yard setback
30 foot side yard setback
50 foot rear yard setback
The proposed building envelope lies outside of all required
setbacks. The applicant is proposing a retaining wall for the
driveway up to 25 feet high. Some of this wall lies within the
required rear yard setback. This wall will not be permitted in the
setback where it exceeds 30" in height unless approval is granted
by the Board of Adjustment.
FLOOR AREA: This site is allowed a total of 15,000 square feet
of floor area. All structures are included in the calculation of
floor area. No representation of proposed floor area has been
made.
HEIGHT: No plans have been submitted to determine compliance with
County height regulations.
OTHER: There is a note in the original file in Mary Lackner's
handwriting that implies that she did not determine that ridgeline
issues did not apply. In her memo to the BOCC dated September 15,
1992, she states that "Portions of this site are mapped within the
ridgeline area as seen from Highway 82. An exemption is provided
for parcels with 1041 approvals and vested property rights. The
extension of vested property rights is at the discretion of the
BOCC, and may include new conditions of approval, including
conditions requiring the applicant to comply with newly adopted
legislation. The applicant will provide photographs of the parcel
from Highway 82 near the airport as this location is where a
proposed residence may break a ridgeline. These photographs will
not be available until prior to the Board meeting. A staff
determination of whether the parcel is subject to Ordinance 90 -07
will be made by staff at the meeting." It is not known what the
determination was.

The Applicant is entitled to apply for an additional extension
of vested rights according to established policy. General
Submission requirements are briefly summarized as follows:
III. General Submission.
The Pitkin County Land Use Code identifies five General
Submission issues which may be applicable to this Application:
Policies 2 -6, 2 -7, 2 -8, 2 -10, and 2 -16.
Policy 2 -6 Adequate Provision for Water Needs. The property
is located within and can be served by the White Horse Springs
Water District.
Policy 2 -7 Sewage Treatment and Collection. The applicant
will comply with all Environmental Health Department requirements
with respect to the septic system for the property. Nicholas
Lampiris, Ph.D. stated in his geologic report for the property
dated September 30, 1988, that a standard septic system should work
for the property with no potential for high ground water or near -
surface bedrock problems. This finding has been confirmed in
consultation with the engineering firm of Schmueser, Gordon &
Meyer.
Policy 2 -8 Impacts on Road System. Access to the property is
gained by virtue of Trentaz Drive across a driveway constructed on
the property.
Policy 2 -10 Logical Extension of Utilities. Water is
available to the property from the White Horse Springs Water
District. Electrical and telephone service are available in the
immediate area and will also be undergrounded, if possible, along
the driveway alignment.
Policy 2 -16 Scenic Ouality. The designated building envelope
is surrounded by mature scrub oak and aspen and is the flattest
site on the property.
IV. CONCLUSION.
Based upon the following facts, the applicant respectfully
requests an extension of vested rights in connection with 1041
approvals pertaining to the property for an additional three years.
