1041 HAZARD REVIEW APPROVAL

RECITALS
1. B. Kenin Hart (hereinafter "Applicant ") , has applied to
Pitkin County to request an extension of vested real property
rights pursuant to Section 6 -5.7 of the Land Use Code; and
2. The Applicant's parcel is a part of Tract 2, White Horse
Springs, and is located in Lots 12 and 20 of Section 26 and
in Lot 5 of Section 35, all in Township 9 South, Range 85 West
of the 6th P.M., and *is more specifically described in Exhibit
"A"; and
3. The applicant received 1041 Hazard Review approval from
the Planning and Zoning Commission on July 6, 1989, subject
to the conditions of resolution PZ- 89 -24; and
4. The Board of County Commissioners (hereinafter "Board ")
considered the applicant's request at a duly noticed public
hearing on September 15, 1992 at which time the Board found
the applicant's request to be consistent with the Land Use
Code; and
5. The Board of County Commissions adopted Ordinance 92 -08
on March 10, 1992 which requires special review approval for
properties under 20 acres to construct more than 15,000 square
feet.

NOW, THEREFORE, BE IT RESOLVED by the - .Board of County
Commissioners of Pitkin County, Colorado that it hereby grants
approval of the extension of vested real property rights for a
period of three years, subject to the following conditions:
1. The project shall comply with all conditions contained in
Planning and Zoning Commission Resolution PZ- 89 -24.
2. The applicant shall meet the new legislative requirements of
the Aspen Fire Protection District by installing a residential
sprinkler system, should the residence exceed 5,000 square
feet.
3. The applicant shall comply with the requirements of Ordinance
92 -08.

REQUEST: The applicant requests an extension of vested property
rights for the Hart 1041 Hazard Review approval.
APPLICANT: B. Kenin Hart.
APPLICANT'S REPRESENTATIVE: Jane Ellen Hamilton, Garfield & Hecht.
LOCATION: The 13.6 acre property is located immediately adjacent
to the Starwood Subdivision, off Trentaz Drive and is part of the
White Horse Spring's Subdivision.
BACKGROUND: The Planning and Zoning Commission granted 1041 Hazard
Review approval for this site on June 6, 1989, pursuant to
Resolution PZ- 89 -24. Approval was granted for a building envelope
just less than one acre in size and for a new driveway to be
constructed to the building site. The original 1041 hazard review
analyzed geologic hazards associated with the driveway which
crosses slopes in excess of thirty percent and wildfire hazards
affecting the building envelope. The access driveway has been
constructed, however no residence has been built on the parcel.
STAFF COMMENTS: Since approval in 1989, staff is aware of three
legislative changes which affect this parcel. The changes are as
follow:
FLOOR AREA /Resolution 92 -08: This resolution limits residential
construction on single family lots to a total floor area of 15,000
square feet. Residential structures exceeding 15,000 sq.ft. of
total floor area are subject to Special Review by the county. In
the event that a home of larger than 15,000 square feet of floor
area is proposed on this site, it will be subject to special
review. As the parcel is less than 20 acres, floor area
calculations shall be based on all structures on the property.
SCENIC FOREGROUND REVIEW/ Ordinance 90 -07: Ordinance 90 -07 was
adopted by the BOCC on September 11, 1990. It requires certain
development which can be seen from Highway 82, Brush Creek,
Snowmass Creek and /or Capitol Creek to be reviewed by the Planning
and Zoning Commission. Portions of this site are mapped within the
ridgeline area as seen from Highway 82. An exemption is provided
for parcels with 1041 approvals and vested property rights. The
extension of vested property rights is at the discretion of the
BOCC, and may include new conditions of approval, including
conditions requiring the applicant to comply with newly adopted
legislation.
The applicant will provide photographs of the parcel from Highway
82 near the airport as this location is where a proposed residence
may break a ridgeline. These photographs are will not be available
until prior to the Board meeting. A staff determination of whether
the parcel is subject to Ordinance 90 -07 will be made by staff at
the meeting.
OTHER: On August 12, 1992 the Aspen Fire Protection District
adopted new legislation requiring any structures in excess of 5,000
square feet and more than 5 minutes from the headquarters fire
station to provide a residential automatic sprinkler system.
No other ordinances or mapping amendments affecting the approval
on this parcel have been adopted and /or enacted since 1989.
The BOCC may determine how long to extend vested real property
rights. Staff recommends that vesting extensions be for a period
of three years.
ALTERNATIVES: The Board may:
1. Extend vested real property rights; or
2. Extend vested real property rights with a condition requiring
compliance with the Aspen Fire Protection District's new
regulation; or
3. Deny the request for extension of vested property rights.
RECOMMENDATION: Staff recommends alternative 2, approving vested
real property rights for a period of three years from the date of
BOCC approval, subject to the addition of the following conditions:
1. The project shall comply with all conditions contained
in Planning and Zoning Commission Resolution PZ- 89 -24.
2. The applicant shall meet the new legislative requirements
of the Aspen Fire Protection District by installing a
residential sprinkler system, should the residence exceed
5,000 square feet.
3. The applicant shall comply with the requirements of
Ordinance 92 -08.

APPLICATION FOR E %TENSION OF 1041 APPROVALS
I. Introduction.
B. Kenin Hart is the owner of the real property legally
described on Exhibit A attached hereto (the "Property "). On June
6, 1989, the Pitkin County Planning and Zoning Commission granted
a 1041 Geologic and Wildfire Hazard Review Approval to the Property
pursuant to Resolution No. PZ -89 -24 recorded in Book 595 at Page 99
of the Pitkin County records, attached as Exhibit "B" (the
"Approval ") and the plat recorded in Plat Book 25 at Page 4. The
Approval is vested for three years from the date of approval
pursuant to Resolution No. 88 -95. The Applicant wishes to secure
an extension of the vested rights for an additional three years
from the date the Approval will lapse.
II. Background.
The Property is an approximately 13.66 acre tract, the
building envelope for which lies within mapped wildfire areas of
concern. The building envelope contains slopes of between 5% to
15% and the driveway to the building envelope crosses slopes in
excess of 15 %. Thus the Property was originally reviewed for
wildfire concerns and geologic concerns with respect to the
driveway. The Applicant installed the driveway in accordance with
the Approval, but before he was able to commence construction of
his home, he suffered financial reversals due to the nation -wide
recession. The Property was listed for sale and remains on the
market today.
The Property is basically a large hill with very steep slopes
on most portions of the land. The building envelope was selected
based upon considerations associated with the site, such as the
presence of a gully which the Applicant wished to avoid, and
considerations set forth in Dr. Nick Lampiris' geologic report
dated September 30, 1988 (attached hereto as Exhibit "C "). These
considerations are all still valid today. Further, the building
envelope represents the flattest portion of the Property, the land
below the envelope is a steep hill and any cuts on that hillside
would be more visible than cuts made within the existing building
envelope.
The Property lies very close to areas subject to ridgeline
review. On April 6, 1992, Mary Lackner visited the site and
determined --ridgell-ne Assuan- .did_not apply to certain areas of
the site, and did not appear to apply to any of the envelope, but
requested that the building envelope be flagged and photographs
taken of the envelope from the proximity of the Pitkin County
Airport. Although numerous attempts were made to comply with this
request, even with the use of telephoto lenses, we were unable to
demonstrate the impacts a building would have upon the ridgeline,
if any. Therefore, the Applicant requests a determination by
HUO1.O
Pitkin County as to whether or not these regulation would apply.
According to a conversation with Assistant Pitkin County
Attorney John Ely on April 29, 1992, so long as this application to
extend the vested rights granted by the Approval is submitted
before the date the Approval lapses on June 6, 1992, the Applicant
is entitled to apply for an extension of its vested rights.
According to a conversation with Suzanne Konchan on June 3, 1992,
General Submission issues do not have to be addressed in this
Application; however, we have addressed those issues which would be
relevant if General Submission review was required below.
III. General Submission.
The Pitkin County Land Use Code identifies five General
Submission issues which may be applicable to this Application. The
Policies which reflect these issues are Policies 2 -6, 2 -7, 2 -8, 2-
10, and 2 -16.
Policy 2 -6 Adeauate Provision for Water Needs. The Property
is located within the White Horse Springs Water District and has
the absolute right to tap into the Water District system for
residential water uses. All easements exist for the installation
of the water lines, but no construction has begun as of the date of
this application.
Policy 2 -7 Sewage Treatment and Collection. The owner of the
Property will comply with all Environmental Health Department
requirements with respect to the septic system for the Property.
Nicholas Lampiris, Ph.D. states in his geologic report for the
Property dated September 30, 1988, that a standard septic system
should work for the Property with no potential for high ground
water or near - surface bedrock problems.
Policy 2 -8 Impacts on Road System. Access to the Property is
gained by virtue of Trentaz Drive across the driveway constructed
on the Property in accordance with the Approval. As the Property
will only be developed with one single family home and a possible
caretaker or employee dwelling unit, the increase in road impacts
by virtue of the development of the Property will be minimal.
Policy 2 -10 Logical Extension of Utilities. As discussed
above, water is available to the Property from the White Horse
Springs Water District. Electrical and telephone service are
available in the immediate area and will also be undergrounded
along the driveway alignment, if possible, in accordance with the
Approval.
Policy 2 -16 Scenic Ouality. The location of the building
envelope is really the only suitable site for construction of a
home, given the presence of steep hillsides on all of the rest of
the Property. The designated building envelope is surrounded by
mature scrub oak and aspen and is the flattest site on the
Property. If a home were built elsewhere on the Property, it would

be much more visible as it would necessarily have to be located on
a hillside, requiring larger cuts and moving the home away from the
partial natural screening provided by the oak and aspen.
IV. CONCLUSION.
Based upon the following facts, the Applicant respectfully
requests approval of this Application and that the approval be
vested for three years from the date of approval: the fact that the
Applicant requests nothing different from the County in terms of
development approvals than the approvals which currently apply to
the Property; the fact that the site conditions remain the same as
on the date of the original Approval; the fact that there have been
no changes to the environment, natural or community setting which
would affect the Approval; the fact that no regulations have been
adopted by the County subsequent to the date of the original
Approval which would prevent this Application from being approved,
and, the fact that the Applicant is willing to comply with all
terms of the original Approval.

The Aspen / Pitkin Environmental Health Department has reviewed the
above - mentioned land use submittal under authority of the Pitkin
County Code, Title II, and has the following comments.
SEWAGE TREATMENT AND COLLECTION: Sections 2 -7 and 5 -200:
The application indicates that the wastewater will be disposed of
by means of individual septic system - absorption field. The lot
was evaluated and an on -site sewage disposal permit issued for the
house design originally proposed for this site. Our evaluation of
the proposed home site used the general conditions reported for the
soil types on the lot, as indicated on the Soil Conservation
Service (SCS) maps.
It would appear that most of the lower portion of the property is
considered suitable for such a conventional septic system. Slopes
in the area are not over 30% around the building envelope.
Further, the basic soil type unit (28E and 28F) as shown on the SCS
maps, located within this building site, is characterized as a silt
loam to a cobble sandy loam grading to a stony loam with bedrock
moderately deep. Typically such types of soil are rapidly
permeable and have a low shrink -swell potential.
The mapped soil units conform in basic characteristics detailed in
the original opinion from the consulting geologist, Nick Lampiris,
in his letter of September 30, 1988. In that letter he stated that
a standard septic system should work for the property and that
there was no potential for high ground water or near - surface
bedrock which present severe limitations to the construction of a
sewage disposal system.
It is our opinion that within the building envelope, that an on-
site wastewater disposal system can be constructed which conforms
to the County regulation. Some site conditions present may require
that this system be designed specifically for the slope and soil
However, a system similar to that permitted, where a dual plumbing
system and separate black and grey water absorption fields are
terraced on the slope contour will probably conform to

requirements.
ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2 -6 and 5 -205:
Water is apparently to be supplied to the building site by the
White Horse Springs Water District. This is a suitable and
accessible water source. The district water conforms to all
requirements for construction, disinfection, quantity and quality.
There are numerous fire hydrants on the water supply system and
sufficient storage for fire fighting.
The submission indicates that lot has an "absolute" right for a
water tap. The easements for the water supply lines to the
building envelope have been obtained. This proposed water supply
conforms to policies of this department.
AIR QUALITY: Sections 2 -17 and 5 -106:
Only that development is permitted which will not contribute
significantly to degradation of air quality in Pitkin County.
Building a single family home should not constitute a significant
air quality problem.
A report on air quality impact is required to address air quality
characteristics of the site and the proposal. This includes
existing alternatives to automobile traffic and any special design
or construction methods or improvements which would reduce the
impacts of pollutants produced by the proposed development. These
items were not included in the application.

HAZARD REVIEW APPROVAL TO THE BART APPLICATION
Resolution No. PZ -892y-
WHEREAS, Kenin Hart, hereinafter "Applicant ", has applied to
the Planning and Zoning Commission of Pitkin County, Colorado,
hereinafter "Commission ", for 1041 Geologic and Wildfire Hazard
approval for a driveway and single - family residence pursuant to
Section 5- 400.2(a) (1,3) of the Land Use Code; and
WHEREAS, the applicant's parcel is zoned RS -20 and contains
approximately 13.66 acres and located east of Trentaz Drive and
adjacent to Starwood Subdivision and is part of the White Horse
Spring's Subdivision more specifically described in Exhibit "A";
and
WHEREAS, the Commission did consider the application at a
duly noticed public hearing at their regularly scheduled meeting
on February 21, 1989, May 16, 1989 and June 6, 1989.
NOW, THEREFORE, BE IT RESOLVED by the Commission that it
does hereby grant 1041 Geologic and Wildfire Hazard Review
approval to the applicant subject to the following conditions:
1) 1041 Geologic Hazard:
a) The building envelope shall be located outside of
the gully.
b) Landscaping shall be provided insuring positive
drainage around the building;
C) Perimeter foundation drains shall be required;
d) The waste water disposal system shall be
constructed within the building envelope and
conform to the County regulation;

f) The entrance (intersection) of the proposed
driveway to Trentaz Road shall have a minimum
sight distance of 250 feet;
g) The proposed driveway shall be engineered and not
exceed County width standards of 8 to 16 feet of
driving surface;
h) A detailed landscape/ revegetation plan shall be
provided to the County Land Use Engineer for
review and approval prior to construction. The
plan shall include estimated costs of successful
implementation;
i) The County shall obtain assurance from the
applicant (i.e. bond or letter of credit) that the
landscape /revegetation plan will be successfully
placed;
j) The applicant shall present to the Land Use
Engineer a detailed drainage plan that determines
the amount of run -off or rain water carried in the
gully during a significant run -off or storm. If
the drainage study shows that a problem may indeed
exist, the applicant shall mitigate these drainage
concerns within a revised driveway design;
k) Any and all utilities to the proposed development
shall be buried to the building envelope along the
driveway alignment when applicable;
1) Development shall keep accumulation of radon gas
under the minimum acceptable level set by the EPA
standards.
2) 1041 Wildfire Hazard Mitigation Plan:
a. There shall not be a flat roof on homes where
leaves, needles, or other flammable debris can
accumulate;
b. Keep all roofs clear of debris;
C. Roof coverings shall be of a noncombustible
Underwriter Laboratory approved material;
d. Enclose or screen off porch, floor, roof, or attic
openings;
e. Tree branches hanging within 15 feet of chimneys

shall be removed;
f. Keep weeds and debris at least 10 feet away from
the base of your home;
q. Do not park any motor vehicle in tall dry grass
(hot muffler may start fires);
h. Develop an external water supply for firefighting.
This can be a small pond, cistern, well, or
hydrant;
i. Stack firewood uphill or on a contour away from
buildings. Keep fine fuels away from stacked
wood;
j. Place at least one 10 -pound ABC -class fire
extinguisher in the home. A 50 -foot garden hose
connected to the hot water heater drain is useful
in a firs emergency inside the house;
k. Thin trees within 30 feet of homesite if
necessary. Adequate thinning is reached in he 30-
foot area when tree crowns do not touch each
other. Isolated clumps may be permissible under
certain conditions. Following thinning, trees
remaining within two tree heights of structures
should be pruned of dead limbs to a height of 10
feet. Prune live branches to 10 feet from at
least half the trees in this strip.
3) All material representations in the application and
public meeting shall be adhered to unless otherwise
amended by other conditions.
4) The Applicants shall submit a site plan for recording
which meets the approval of the Planning Office and the
County Attorney.
5) Any and all utilities except for a water well to the
property may require 1041 Hazard Review.

DATE: August 6, 1992
I have reviewed the application submitted by B. Kevin Hart and also
made a site visit. The site is covered with various types of
undergrowth which could contribute to spread of fire. I recommend
that the Colorado State Forest Service guidelines be followed
pertaining to clearing of vegetation and access roads. The
structure will have to be supplied with enough water to satisfy the
required fire flow. When an application to build comes in it will
be necessary for the owners to contact our office for calculation
of the required fire flow.

The Planning Office has completed its preliminary review of the captioned application. We
have determined that this application is complete. Please submit the following additional items:
1) List of Adjacent Property Owners and an addressed envelope for each one.
2) 6 copies of a plat.
3) 6 copies of a vicinity map.
4) Referral fees in the amount of $110.00 ($55- Environmental Health and $55- Engineer)
We have scheduled this application for review at a public hearing by the Board of County
Commissioners on Tuesday, September 15, 1992 at a meeting to begin at 5:00 P.M. Should
this date be inconvenient for you, please contact me within 3 working days of the date of this
letter. After that the agenda date will be considered final and changes to the schedule or tabling
of the application will only be allowed for unavoidable technical problems. The Friday before
the meeting date, we will call to inform you that a copy of the memo pertaining to the
application is available at the Planning Office.
All applications are now being scheduled for the Development Review Committee (DRC). The
DRC is a committee of referral agencies which meet with Planning and the applicant early in
the process to discuss the application. This case is scheduled for August 13, 1992 at 2:00 p.m.,
City Hall, City Council Chambers.
Please note that it is your responsibility to post the subject property with a sign within 15 days
of the public hearing and to remove it from the property within one week following the hearing.
Please submit a photo of the posted sign as proof of compliance with the Code prior to the
hearing.
