DETERMINATION OF ADMINISTRATIVE APPROVAL BY THE
COMMUNITY DEVELOPMENT DIRECTOR FOR THE CITY OF ASPEN
MINOR AMENDMENT TO A SPECIAL REVIEW PERMIT
Determination No. Admin. 99- �T-
RECITALS
1. The City of Aspen requests approval for the continued use of a four (4) acre parcel
located at Peapke Ranch immediately northwest of the Pitkin County Service Center
as a snow and street sweeping dump site.
2. 11 - proposal requires administrative approval by the Community Development
Director.
3. Staff has reviewed the request subject to the standards of the original approval
contained within Pitkin County Resolution No. 93 -103 granted June 15, 1993 and
Administrative Change to a Development Permit granted on August 20, 1997.
NOW, THEREFORE, BE IT DETERMINED by the Pitkin County Community
Development Director that BOCC Resolution No. 93 -103 (Attachment A) relating to the
City of Aspen Snow Dump Site is hereby amended as follows:
1. Language within the Resolution shall be amended to include street sweep dumping
(in addition to snow dumping) as an approved activity on the site.
2. Existing condition No. 7 shall be amended to read, "The operation of trucks on the
site shall be limited to the hours of 12:00 (midnight) to 9:00 A.M. except in the case
of unusual or emergency circumstances."
3. A new condition No. 23 shall be created to read, "Day hauling shall be permitted for a
maximum of five trucks limited to the hours of 9:00 A.M. to 4:00 P.M."
4. Existing condition No. 8 shall be amended to read, "The City shall be responsible for
maintenance of the site and all of the installations. The site should be kept free of
standing water, trash and debris so that birds, rodents and other animals are not
attracted to the area."
5. Existing condition No. 20 shall be amended to read, "The permit shall be issued
indefinitely and may be revoked if at any time the City is found not operating in
compliance with this approval."
6. Existing condition No. 22 shall be amended to read, "In the event that the property is
no longer utilized for snow and/or street sweeping storage, the City of Aspen shall
within one year after the cessation of snow and/or street sweep storage use, reclaim
the property to a state similar to its natural state. Said reclamation shall include re-
grading the site to eliminate the berms, providing adequate topsoil to support native
vegetation (if adequate topsoil is not available in the berms) and re- establishing
vegetation on the property.

7. A new condition No. 24 shall be created to read, "The City shall install nova -chip
surface on Service Center Road as well as the snow dump entrance in the year 2000."
8. A new condition No. 25 shall be created to read, "The Applicant will provide
sweeping and flushing services on service center road and the County Shop area upon
request from the County."
9. A new condition No. 26 shall be created to read, "Each year the Applicant will
provide a written notice to all contractors to strictly obey all traffic signs and to yield
right -of -way to County and RFTA vehicles. Failure to comply will result in
termination of their contract(s)."
10. A new condition No. 27 shall be created to read, "Any trash shall be collected and
removed by the operator when material is dumped. No trash or debris shall be
allowed to remain out overnight."
11. A new condition No. 28 shall be created to read, "If blowing trash and debris
becomes a problem, the County reserves the right to require the City to fence the site
at the City's cost. The County shall be sole determining authority of the need of
fencing."
12. A new condition No. 29 shall be created to read, "The City shall be responsible for
acquiring all Federal, State and local permits and approvals and shall comply with
any and all conditions of such approvals."
13. A new condition No. 30 shall be created to read, "The City shall develop a site for
dumping of the street sweeper in the NW comer of the site. The site shall be kept to
the minimum size necessary for this operation.
14. A new condition No. 31 shall be created to read, "The City shall not knowingly dump
or unload any hazardous material. Should any such material be brought to the site,
the City shall remove such material immediately and in such a manner as required by
law, and at its sole cost."
15. A new condition No. 32 shall be created to read, "The City shall extend electric
power towards the west part of the site in order to provide a more efficient storage
area for city equipment."
16. A new condition No. 33 shall be created to read, "The County has the right to
terminate this agreement given a one (1) year prior notice to the City."

Subject: Snow Dump Soil Testing.
Brian: This is the results of the soil testing at the City of Aspen snow dump /
sweeper dump site that was asked for by Pitken County. Attached is a rough map
of where the three test sites were and the depth the samples were taken at. 1SDS,
site sample is in the street sweeper dump area. 2SDS sample site is in the snow
dump area 127 feet from the concrete delineators' going back toward the new road
entrance. 3SDS sample site is 74 feet from the new snow dump road entrance going
west toward the street sweeper dumping site. We will schedule and deliver too
Pitken County the soil sampling results of this snow /sweeper dump site per our
agreement terms with the Pitken County / City of Aspen snow dump contract.

samples are determined to be hazardous, additional charges apply for disposal (typically less than
$10 /sample). If you would like the samples to be held longer than ACZ's stated policy or to be returned, please
contact your Project Manager or Customer Service Representative for further details and associated costs.
ACZ retains analytical reports for five years.

PROCEDURE/PROCESS: Administrative Review
BACKGROUND/DESCRIPTION OF PROPOSAL: On June 15, 1993, the BOCC
granted Special Review approval to the City of Aspen for utilization of a four (4) acre
parcel in Pitkin County for snow dumping purposes. On August 20, 1997 an
Administrative Change to a Development Permit was granted for temporary use of the
snow dump for street sweeper dumping as well. Since the approval for street sweep
dumping expired June 15th, 1998 the new amendment should include street sweeper
dumping as an approval of the original resolution.
STAFF ANALYSIS OF THE PROPOSAL: The City of Aspen has operated in
compliance with the conditions of the original approval specified in Resolution No. 93-
103 approved August 23, 1993 and the Changes to a Development Permit approved
August 20, 1997.
RECOMMENDATIONS AND CONDITIONS OF APPROVAL: Staff recommends
approval of the requested Special Review Permit and recommends continued use of the
subject property indefinitely as a snow and road sweeper dump based on compliance with
the previous approvals and future compliance with all conditions. This approval is
subject to the conditions in the attached Administrative Approval Document.

The City of Aspen would like to apply for approval to extend the use of the street sweeping dirt
staging area. The City requests an administrative approval of continued use of the site, based on our
environmental investigation (see attached memo).
As you know, small piles of street cleaning dirt are stored temporarily at this site until once or twice a
week, the material is taken to the county landfill. This reduces VMT and air pollution since each time
the sweeper is full, it does not have to drive all the way to the landfill.
I have investigated the soil characteristics of the area, looked at the site design, conferred with several
other states about their guidelines for (permanent) storage of this material, and found the locations of
surrounding wells. The site is ideal since it is more than the recommended distance from the river,
and it is also provided with a berm between the site and river. There are no close wells, the soil
percolation rate is not extremely fast, and the material is quite dry in the winter when it would be
expected to contain more MgC12- Many other states and communities use this material for fill, for
cover, or re -use it the next year. The City of Aspen is investigating the possibility of developing a
long -term solution of recycling the material, but that process is some time in the future.
I have visited the site with Tom Dunlop, and you may want to confirm with him the characterization
of this site as by far the most environmentally benign location that has been found for temporary
storage of this material.
I would recommend the following conditions for use of the street cleaning dirt area.
• The site shall be kept to the minimum size necessary for this operation.
• (When I visited the site, there was no trash whatsoever, but to cover that possibility): Any trash
shall be collected and removed by the operator when material is dumped.
• The City shall be responsible for maintaining the site and shall prevent the existence of any trash
or debris that would attract animals or rodents.
• This approval should not have an expiration date.
• There would not be a limit to the hours the street - cleaning trucks can use the site, because in
winter, street cleaning usually must occur during the day when it has warmed up.
• If you feel a truck speed limit would be helpful, that would be acceptable, although I believe the
street cleaning trucks cannot go very fast.

SUMMARY: The City of Aspen needs to find a long -term solution to the issue of interim storage of road
sand sweepings before the material is periodically taken to the county landfill. This memo discusses
information about the environmental safety of continuing to stage the material at the County Snow Dump
Site. The City Engineer is also researching the possibility of developing a patented method for recycling
the material as a long -term alternative to landfilling it.
BACKGROUND: The City of Aspen applied to Pitkin County for permission to temporarily store dirt
from street cleaning operations at the snow dump site. The material is taken to this site as it is collected
and when there is a dump truck load, it is taken to the landfill. This is done approximately once /wegk. So
this site is not the permanent repository for the dirt, but a place to store small amounts until it is taken to
the dump. Using this site was approved for six months, and this time has expired. A decision should be
made about whether we can store the material there without risk of significant environmental impact. If
so, we could ask the county for the ability to continue using the site. If not, another alternative should be
found quickly.
DISCUSSION: I have contacted the departments of transportation of all the snowbelt states, and the
federal transportation department as well, to learn what guidelines they have for disposal of this material.
It should be kept in mind that this site is not for disposal, but for temporarily storing small amounts of dirt
until they can be taken to the landfill.
Other state guidelines: The states of Connecticut and Rhode Island both have comprehensive sets of
guidelines, geared to preventing damage to wetlands, silting of surface waters, and impacts on potable
water supplies. For Connecticut, these include careful selection of the disposal site considering distance to
wells, wetlands, and rivers. They recommend using an open field where any drainage would flow through
grass or native vegetation. The site should not be within 100 ft. of any river, 100 feet of a private well,
within 250' of a public water supply well, or below the seasonal groundwater level. They recommend
limiting disposal to less than 100 cu yards "unless the municipality maintains permanent records of any
larger fill location ".
I have obtained records of all of the permitted wells in the area from the Colorado Division of Water
Resources. From the map I have, it appears that the site is 0.1 mile from the nearest well. The site is more
than the required distance from the river and is not near the seasonal groundwater level. The amount

The State of Connecticut recomriOds covering the material with 3" of t64 and stabilizing if necessary
to prevent erosion. This is for permanent storage sites.
The State of Connecticut also recommends using the material as aggregate, in certain gardening activities,
as fill in composting sites, re -using it the following year after mixing with fresh sand, mixing with gravel
for use under roads or parking lots, and spreading on lawns or wooded areas.
The State of .Rhode Island recommends use of this material as landfill cover material, road base, backfill
for publie works projects like culverts, and reusing the following year. They do not use it as fill in
wetlands, near wellheads; or in residential yards or park playgrounds. The material can be used in an
unrestricted "manner if it is first tested for lead, hydrocarbons, and other toxic compounds.
Comments from other state agencies: Many state agencies felt that most of the salt will'already have
washed out of the dirt"while it was on the roadway, and that the sweepings would not be considered
harmful. Pennsylvania tries to use the material as fill and in road and other construction projects. Their
feeling was that "it would be hard to imagine a whole lot.of " harmful' compounds that could leach from
the piles and run off to cause problems with ground water or streams. They recommended making sure the
site be above the floodplain. They suspect that the particle size will prevent much salt from being
absorbed, and note that while there may be some magnesium in the dirt (as there is in. native dirt), the
chloride is likely to be more mobile and not in the dirt. They recommend using the material under parking
lots and roads, and would give it away and allow in residential areas except for concerns about liability.
To verify its content in runoff, they suggested sampling the runoff.
It would also be desirable to place this material in soils that have neither a very fast, not an extremely
slow percolation "rate. (If too fast, the liquid will too quickly travel to possible groundwater. If too slow,
the liquid could pool on the surface and be washed off by rainwater.) Fortunately, we do have some
limited soil test data for this area, with percolation rates of around 20 minutes per inch. This is an
intermediate perc rate that will allow some filtering of the effluent before it reaches any groundwater.
In Vermont,.this material is used as fill. or cover, or is re =used the following year. They use sodium
chloride (rock salt) instead of magnesium chloride.
Site investigation: tion: The site has a natural berm between it and the river, since the storage area was dug into
the ground. It would be impossible for material washing off of these piles to flow over the berm into the
river. The site is in the middle of a flat, open, vegetated area that drains away from the river. In any case,
any liquid at the site comes from snowmelt, rather than these dirt piles. (If enough stored snow melted fast
enough, it could wash over the berm.)
I intended to collect a sample of water that had washed off of the dirt piles, knowing that while this liquid
could have higher concentrations of salts than would leave the site, testing it would provide an upper limit
on the amount of salt in the piles. I was unable to collect a sample because there was not only no liquid
running off of the piles, but there hadn't-been in the past, and the piles were completely dry. In fact, I
thoughtI was in the wrong location and that the piles were compost the city or county was making. The "
material.was a light and fluffy mixture of dirt and leaves. (In the summer, more water is used on-the
streets and the dirt is much wetter. In the winter when.MgC12 is present on the roads; a minimal amount of
water, if any, is used, and as a consequence the dirt is quite dry.)

Other implications of choice: From an air quality point of view, it would be better to dispose of or recycle
the material closer to town, to avoid the exhaust and reentrained dust emissions from haul trucks going
out to this site and then to the landfill. However, the snow dump site would be better from this point of
view than taking'the material to the landfill each time. The city shop site is closer to the river, so would be
a less desirable site than the present location from the point of view of proximity to water.
There is obviously an environmental benefit to reusing the material as fill or cover, or in the following
year's sanding. The City could 41so consider giving the material to the county or CDOT for their use the
following year, mixed with new material.
RECOMMENDATION: The City should look into the possibilities of reusing the material, so it will not.
waste 'space in the landfill. However, until a process is developed and found to be feasible, a storage/ '
staging site is needed. Given the suitable soil, distance from the river and wells, dryness of the dirt, and
relatively - harmless nature of the dirt, it appears that the current snow dump site is a much better
alternative for storage than other sites farther away that would require greater trucking_ distances. It is also
better than available'sites closer to town. The snow dump site appears to be ideally located and designed
to isolate the site from the river. The street - cleaning dirt is so dry in the winter when MgC12 is used, that it
is unlikely that salts leach out of it before it is taken to the landfill. I would encourage continued use of
this site from an environmental point of view.
I have also visited this site with Tom Dunlop, who felt that this location is "the most benign place for
snow that we've ever found."

There were 22 Special Conditions of approval. The following is a summary of
the Special Conditions required by Pitkin County for the City's use of the Snow
Storage Site. and the response to those conditions.
1 No Improvements were made to the site before the County owned it.
2 Subdivision Exemption Plat - Book 35, Page 85
3 A grading plan for construction was submitted prior to the work being
done. A final grading plan, done by a licensed surveyor. is included with this
packet, to show that the project drains as was intended.
4 The haul road into the project is along the* river side. allowing access
through to -the Faepke property if needed.
5 The site is kept relatively clean of debris. It is graded after the snow melts
and any trash or other debris is hauled to the landfill.
6 The berms meet the condition requirements. They meander and undulate
and are the appropriate height and width.
7 The nighttime operation is kept to 10:00 to 07:00 whenever possible. We
notify Brian Pettet whenever we need to run later. Now that we have a new
blower, which loads trucks much faster, we are better able to keep within the
time frame.

8 The site drains to the north west corner and standing water is kept to a
minimum.
9 We have not found ourselves to be in conflict with RFTA of the County
except on a few occasions. When that happened we were asked to cut the
number of trucks to mitigate the conflict. Most of the time, we're finished before

Just so we all have the same information ..... I suggested to Amy two weeks
ago the City HAD to formally file an amendment to the conditions of the
original special review to amend the set hours of operation, I still think
that was the right call. For all I know there may in fact be other
condition violations that also need to be addressed. Moreover, I believe
the safety /circulation issue will be triggered by that amendment,
especially
given the animal shelter proposal. The best solution will likely be a
seperated access fox both the snow dump and animal shelter facilties.
Perhaps a letter from com dev to Amy and Jack outlining the remaining
for an amendment request, and the suggestion (if you agree) to process
concurrently with the animal shelter, would be appropriate.

I think that Jack is embellishing the discussion he had with Bud and I.
While we thought that the signage and letters were good ideas, neither of

told jack that these actions would meet all our concerns. Speed enforcement
is probably not going to happen. We still think that the original hours of

Your agreement with Jack can only be a recommendation to the BOCC.
Nonetheless, if you are comfortable with these changes, great! What effect

Snow Dump and have agreed to the following:
1. Change the condition of operations for night hauling(22 trucks) from
midnight to 7:00am to midnight to 9:00am
2. Add day hauling for a maximum of five trucks from 9:00am to 4:00pm
3. Leave the provision in which provides for extended hours in the case of
emergencies
4. The City will install a yield sign at the exit of the snow dump and
sign
service center road for 15 mph speeds.
5. The City will extend electric power to the west in order to provide a
more efficient and safer storage area for city equipment
6. The City will install a nova -chip surface on service center road and
continuing into the snow dump entrance in the year 2000
7. The City will provide sweeping and flushing services on service center
road and the affected County shop area upon request from the County.
8. The City will provide written notice to all contractors to strictly
obey
