2. Description of Project/Development: Applicant proposes to amend the Animal Shelter GMQS
and Subdivision Exemptions for Essential Community Facilities, 1041 Hazard Review, Special
Review and Scenic Overlay approval for an Animal Shelter and Boarding Kennel. The Applicant
is proposing to change the access to the Shelter from the western end of the parcel, to the Northern
edge. The proposal will have scenic (and possible other) implications.

RE: Animal Shelter Minor Amendment to a Development Permit - Permit (Parcel ID:
264334100852)
Dear Ezra:
The following is in response to the Aspen / Pitkin County Animal Shelter and Boarding Kennel
Development Team's interest in relocating the driveway (primary entrance and exit). The
original driveway is located on the west side of the new Animal Shelter Project, just east of State
Highway 82. The Development Team would like to relocate the driveway to the north side of
the Project. Please see attached revised plan dated 2 May 2005 and landscape rendering.
The Development Team believes the change is better suited to the site. In addition to improving
grading and drainage issues, the relocation improves handicap access to the Animal Shelter's
main entrance. The relocation also allows emergency service vehicles immediate access to the
facility without having to drive though a possibly full and busy parking lot.
Pitkin County Land Use Code; Section 3- 300 -080:
Subsection A. — The amendment must not change the use of the proposed development between
residential, commercial and tourist accommodation uses. Answer: There is no change from the
development's use.
Subsection B. - The amendment must be consistent with the action taken during the review of
the original development and does not constitute a new land development. Answer: There is no
change from the original development.
Subsection C. — The proposed activity does not:
1. Change the basic character of the approved use of land on which the activity occurs including
basic visual appearance and method of operation. Answer: There is no change in the
approved use of land. There will be a slight change in appearance from State Highway 82 as
one drives up valley. This request will allow a cut or opening in the existing berm to
accommodate the new driveway. Drivers will get a quick glimpse of the front primary
entrance. This entrance will be practically obscured due to a large memorial wall. There is
no visual change to the roof line from State Highway 82. The building's visibility is actually
Rather minimized due to the structure being lowered two feet to accommodate soil stability
and drainage. The roof's color will change over time as it is exposed to the natural
environment or weather conditions. There is no change to the development's method of
2operation.
0009 O increase off -site impacts in the surrounding neighborhood. Answer: There are no increases
to off -site impacts. The new Animal Shelter and Boarding Kennel will actually be partially
hidden and better protected from sight then many of the other buildings and uses along State
Highway 82.
3. Endanger the public health, safety or welfare. Answer: To my knowledge, there is no
endangerment to the public health, safety or welfare with the proposed change in the
driveway's location. Site distances will be addressed so that there is no impact to safety.
4. Violate any Land Use Code standard. Answer: To my knowledge, there are no violations to
any Land Use Code standards.
5. Substantially increase the need for on -site parking or utilities, or affect affordable housing
generation. Answer: With the exception of three additional parking spaces, there is no
substantial increase or affects to the previously mentioned.
6. Increase the floor area of the use by more than two percent (2 %) or decrease the open space
on the site by more than three percent (3 %). Answer: There is no increase in the floor area
nor is there any affect on open space.
In addition:
A question has been asked about will the relocation of the driveway change the visibility of the
previously approved building design, roof line and parking lot. The answer is no. The
previously approved building design, roof line and parking lot will not affect or alter scenic
visibility. The building's visibility is actually further minimized due to the structure being
surrounded by large, landscaped berms all the way around the Project site and lowering the
building two feet to accommodate soil stability and drainage. The roof's color will change over
time as it is exposed to the natural environment or weather conditions. The roof will rust or
change color to blend in with the natural color -scape of the surrounding hills.
A question has also been asked about will relocating the driveway alter the existing lighting plan.
The answer is no. The most visible aspect of the building from the new driveway is the primary
entrance. The building's entrance is buffeted from the driveway entrance by a large memorial
wall. The memorial wall will buffer and minimize light from the building. In addition, the
outside lighting plan consists of downward facing low level lighting.
Further, another question has been asked about will the driveway relocation affect visibility as it
relates to the lighting plan associated with the upstairs apartments. The answer is no. The
existing lighting plan for the upper level of the building has not changed. Moe important, it is to
Code. Once again, the building structure, roof line and associated lighting will be further
minimized by lowering the structure two feet. Again, the building and parking lot are also
surrounded by large landscape berms.
