Special Review for two Satellite Dishes DATE: December 17, 1991 REQUEST: The applicant is requesting special review approval to install two additional satellite dishes on a parcel of land which presently has one dish. APPLICANT: ASPCOL Corporation, N.V. APPLICANT'S REPRESENTATIVE: William R. Jordon III, Agent and Attorney DESCRIPTION OF THE PROPOSAL: A copy of the complete application is attached to this memorandum. LOCATION: The applicant's parcel is Lot 2 of the Starwood Ranch Lot Split, which is located adjacent to the Starwood Subdivision. ZONING: The approximately 95 acre parcel is zoned RS -20 PUD. REFERRAL AGENCY COMMENTS: Starwood Homeowner's Association- The Starwood Homeowner's Association does not oppose the applicant's request, nor do they have any outstanding concerns. STAFF COMMENTS: The applicant is requesting approval for the two additional dishes so to provide the house with three different zones of satellite service at one time. It is important to the owner of the property to have access to all major news broadcasts at all times. Moreover, these dishes will provide backup service in the event of interruptions in cable service. The satellite distribution system must be able to supply raw feeds as well as the actual news broadcasts. Section 3 -3.59 of the Land Use Code identifies the RS -20 zone district as requiring special review approval for the installation of a satellite dish. Section 6- 6.1(f) of the Land Use Code specifies the review requirements for multiple satellite dishes on a parcel: "(f) Applications for special review for satellite radio frequency signal reception and /or transmission devices, pursuant to Section 3 -3.59. Provided, however, the Planning Director may authorise, without review by the Planning 001;005 Commission, the placement of a single satellite radio frequency signal reception or transmission device if it is found to be in conformance with the criteria in Section 5- 105.2(b) and if it is the only such reception or transmission device located on the parcel." The applicant received Planning Director approval for one satellite dish in October 1990, pursuant to Section 6- 6.1(f). Therefore, approval of two additional dishes requires review by the Planning Commission. Section 5- 105.2(b) is the Scenic Quality regulation of the County. The site location of the proposed dishes do not violate any of these regulations of the County. Minimal vegetation and grading manipulation will need to take place to prepare the site for the dishes. The applicant's submission materials illustrate the viewplane of a neighboring parcel, which depict that no visual obstruction will occur to this adjacent residence from the placement of the satellite dishes in the proposed location. Vehicular access is available immediately adjacent to the dish site, therefore no additional disturbance for site access is necessary. The applicant has also represented that the frame of the dishes will be colored to blend in with the scrub oak vegetation in the area. SUMMARY: The applicant's existing satellite dish and proposed dishes cannot be seen from neighboring properties nor from public right -of -ways. The applicant's proposal is consistent with the requirements of the Land Use Code. RECOMMENDATION: Planning staff recommends that the Planning and zoning Commission approve the applicant's request subject to the following conditions: 1. The dishes must be located in the area as illustrated on Exhibit B of the application, to minimize potential visual impacts on neighboring parcels. 2. BY: William R. Jordan III, its Agent and Attorney DATED: October 24, 1991 This is an application for special review approval pursuant to Section 6- 6.1(f) of the Pitkin County Land Use Code. The applicant is requesting an approval for the installation of two (2) additional satellite dishes on its property. A first satellite dish on this property was approved pursuant to Section 6- 6.1(f) of the Code by the Planning Director on March 20, 1990, as amended by Planning Director on October 1, 1990. Proposed satellite dishes numbers two and three are to be located in the same location as satellite dish number one, hidden from the view of the surrounding neighbors. Dishes two and three are required to provide three zones of satellite service in the house and to provide access to three separate satellites at one time. Also, it is important to the owner of the property to have access to all major news broadcasts at all times and considering the frequency of interrup- tions in cable service, the satellite distribution system must be able to supply raw feeds as well as the actual news broadcasts. A minimum of three of the following networks must be accessible simultaneously: ABC, CBS, NBC, CNN, HNN, PBS. This can be WILLIAM R. JORDAN III ATTORNEY AT LAW accomplished with three dishes receiving satellite transmissions in virtually the same location. The Property and Surrounding Environment. The property which is the subject of this application is Lot 2, Starwood Ranch Lot Split, consisting of approximately 95 acres. The property is surrounded by Starwood Subdivision to the South, Star Mountain Ranch to the East, Lot 1, Starwood Ranch Lot Split, the George Stranahan Ranch to the North and the James E. Moore Ranch to the West. The property is located in the RS -20 zone. Accompanying this application as Exhibit A is a vicinity map showing the location of the property and as Exhibit B is a diagram showing the location of the proposed satellite dishes on a portion of the property. Attached as Exhibit C is a view study prepared by design Workshop depicting the view from the Towne residence, which is the only possible neighbor to see the area where the satellite dishes will be located. As you can see from Exhibit C, the dishes will be located in a depression, contiguous to the first satellite dish already approved and hidden from the view of surrounding neighbors (including the Towne residence) by hills, vegetation and barns. Specific Request for Approval. The attached Exhibit B identifies the proposed location of the satellite dishes, which would be located more than 60 feet from the lot line of the subject property. The applicable set back in this area is 50 feet. The criteria of Section 6 -6.1 of the Code provides for special review for satellite radio frequency signal reception 2 �v�t�ub WILLIAM R. The criteria for approval is whether or not the application is in conformance with the provisions of Section 5- 105.2(b)(7). The installation of the proposed satellite dishes will not adversely impact the scenic quality of the county or the neighborhood. The location is adjacent to the existing satellite dish and will allow for ease of access and maintenance. Clustering the dishes in one location will minimize visual impact. The existing satellite dish is not visible from neighboring views due to existing vegetation and grade changes. The two new satellite dishes will be located in this same area and will not be visible from neighboring views. The three dishes together will be in a triangular placement, each located approximately 18 feet from the others. Thus, the total area covered by the three dishes is minimal. Installation in this location will require no disturbance of existing vegetation. The new dishes, like the first dish, are made of clear, unobtrusive materials. I have also included with this application as Exhibit D a photograph of the type of satellite dishes that will be used. As you can see from the enclosed picture, the dishes are practically transparent and therefore will be difficult to see from a distance. in addition, the frame of the dishes will be painted a color to blend in with the scrub oak bushes that are indigenous to the area.
