1. Kathrine White (hereafter "applicant's has applied to the Pitkin County Board of County EtoPMENr
Commissioners (hereafter "Board's for consideration of approval of a caretaker dwelling unit
pursuant to Section 3- 150.130(C) of the Land Use Code.
2. The property is described as Lot 16, Block 1, White Horse Springs.
3. The Board considered the request at its regularly scheduled meeting of May 14, 1997, at
which time evidence and testimony were presented with respect to this application.
4. The Board determined that the proposed development meets the criteria established in
Section 3- 150.130(C) of the Land Use Code, and therefore found the development of the
caretaker unit to be appropriate.
NOW, THEREFORE, BE IT RESOLVED by the Pitkin County Board of County
Commissioners that it does hereby grant approval for development of a caretaker dwelling unit
on the property described herein subject to the following conditions:
The applicant shall adhere to all material representations made in the application and at the
public meeting.
2. The proposed caretaker unit shall not contain more than 700 square feet of net livable floor
area.
3. A caretaker dwelling unit deed restriction to the satisfaction of the Housing Office shall be
recorded before building permit approval.
4. The floor plan of the caretaker unit shall be provided to the Housing Office for approval prior
to application for a building permit for the unit.
5. Prior to issuance of a building permit, the applicant shall provide documentation of an
adequate domestic water supply to the satisfaction of the Environmental Health Department.
6. The septic system for the development shall meet the approval of the Environmental Health
Department. The applicant shall obtain such approval prior to the issuance of a building
permit.

REQUEST: The applicant requests approval to construct a detached Caretaker Dwelling
Unit pursuant to Section 3- 150.130(C) of the Land Use Code.
APPLICANT: Kathrine White
LOCATION: The property is located at 2020 McLain Flats Road.
ZONING: The property is approximately 6 acres in size. The zoning is RS -20 (20 acre
minimum). The property is a legal non - conforming lot.
REFERRAL COMMENTS: Referral comments were received from Zoning and
Housing and reflect standard concerns. These comments are attached.
STAFF COMMENTS: This application has been reviewed by the staff for conformance
with the standards contained in the Land Use Code. The subject property does not
contain any mapped or known 1041 Hazard Areas. The site is not affected by any scenic
overlay or ridgeline. The staff notes that a Caretaker Dwelling Unit survey is nearing
completion but the results of that study are not yet available. The following staff review
is based on the criteria contained in Section 3- 150.130(C) of the Land Use Code.
Criteria (B): The Board may permit Detached Caretaker Dwelling Units up to 700
square feet in size on any size lot in the RS -20 zone district.
Staff Comment: The property is zoned RS -20 and contains approximately 6.0 acres. The
RS -20 zone district requires a minimum lot size of 20 acres for a single family residence.
The property is a legal nonconforming lot (as to lot size). The lot size is consistent with
the other White Horse Springs lots.
Criteria (B): The total floor area of the principal caretaker unit shall not exceed the
allowable FAR of the applicable zone district.
Staff Comment: The detached caretaker unit will be limited to 700 square feet of net
livable floor area. The total FAR for the site is below that allowed in the RS -20 zone

district which is 15,000 square feet. It is the staff opinion that no significant visual
impacts will be created by this proposal because of its small size relative to the existing
approved homes and associated buildings in the neighborhood. The floor area of the
property will total approximately 8,692 square feet. This total includes the main
residence (6,210 square feet), the barn (1,728 square feet) and the CDU (754 square feet).
Existing homes and associated structures in the neighborhood contain floor areas in the
range of 5,000 to 10,000 square feet on similarly sized properties.
Criteria (B) 2: There shall be provided one off - street parking space for each bedroom
within the principal unit and one off -street parking space for each bedroom in the
caretaker unit.
Staff Comment: The applicant commits to provide the required parking. The staff notes
that a site inspection shows that there is adequate parking area within the building
envelope.
Criteria (B) 3: The applicant shall by deed restriction or other permanent commitment
running with the land guarantee the occupancy of the unit will conform with the
requirements governing caretaker units in the Land Use Code Section 3- 150.130 C.3 and
CA.
Staff Comment: The applicant agrees to the required deed restrictions.
SPECIAL REVIEW:
Section 3 -210 of the Land Use Code provides criteria for Special Review uses. Those
criteria and staff comments follow:
A. The special review use must be consistent with:
Criteria 1: The applicable County Master Plan;
Staff Comment: The Down Valley Comprehensive Plan states "Provide safe, affordable
housing in a variety of types and styles for all residents."
Criteria 2. County Land Use Policies in Article 2;
Staff Comment: Policy 2 -260, Housing, states "It is the policy of the County to assure
the existence of a supply of desirable and affordable housing for persons employed in
Pitkin County, senior citizens, the handicapped and other qualified persons of Pitkin
County who are necessary for a balanced community."
Criteria 3. The intent of the Zone District in which it is proposed to be located; and
Staff Comment: The intent of the RS -20 zone district is:

111. Permit low density, single family residential development and customary
accessory uses, while recognizing natural hazards, wildlife areas, limited utility service,
roads or schools, and other facilities may constitute a constraint precluding the realization
of zoned density;
2. Encourage an orderly development pattern minimizing scattering of
development in rural areas;
3. Provide potential for the clustering of development preserving open space
and creating efficient utility service for development;
4. Preserve agricultural operations and environmental resources;
5. Maintain the rural lifestyle;
6. Locate development outside of irrigated lands and deer and elk habitat;
and
Protect cattle and wildlife by prohibiting dogs in new subdivisions."
Criteria 4. The character of the immediate vicinity of the parcel proposed for
development and surrounding land uses, or enhance the mixture of complimentary uses
and activities in the immediate vicinity of the parcel proposed for development.
Staff Comment: The character of the McLain Flats area is low - density, large homes with
associated caretaker dwelling units.
Criteria 5. The location, size, design and operating characteristics of the proposed
special review use must be in harmony with the surrounding area and minimizes adverse
effects, including visual impacts, impacts on pedestrian and vehicular circulation,
parking, trash, service delivery, noise, vibrations and odor on surrounding properties.
Staff Comment: The staff opinion is that the proposed use blends harmoniously with
surrounding properties.
Criteria 6. There must be adequate public facilities and services to serve the special
review use including but not limited to roads, potable water, sewer, solid waste, parks,
police, fire protection, emergency medical services, hospital and medical services,
drainage systems, and schools.
Staff Comment: There are adequate public facilities to serve the proposed use.
Criteria 7. An application for a special review use must demonstrate to the Board of
County Commissioners that the proposed development will not:
1. Materially endanger the public health, safety or welfare; and
2. Substantially injure the value of adjoining or abutting property.
Staff Comment: The staff does not expect any negative impacts to result from this
proposal.
RECOMMENDATION: The staff recommends approval of the White detached
Employee Dwelling Unit subject to the conditions outlined in the attached Resolution.

REQUEST: This is a request for approval of a detached Caretaker
Dwelling Unit (CDU) pursuant to Section 3- 150.130 (C) of
the Land Use Code.
LOCATION: 2020 McClain Flats Road, Aspen, Colorado.
LEGAL DESCRIPTION: Lot 16, Block 1, White Horse Springs. See

ZONING: RS -20.
BACKGROUND: The 6+ acre property on which the CDU would be
located presently contains one legal building, a single
family residence under construction. The proposed CDU
would be located above a barn also to be constructed.
The barn would be located 110 feet SW of the residence.
ACCESS: The CDU /Barn (as well as the residence) is accessed off
a private shared drive off of McClain Flats Road.
SIZE: The floor area of the proposed CDU is 698 net liveable
square feet. The midpoint of the roof is 19' 10" from
the lowest grade and the building height measured to the
peak is 24' 611. The combined areas of the residence
(6,210), the barn (1,728) and the CDU (754) would be
8,692 square feet, well under the 15,000 square feet
allowed in the RS -20 zone district. See Exhibit "C ".
PARKING: All county parking requirements for the CDU shall be
provided on the property.
DEED RESTRICTION: The CDU will be deed restricted as described in
Section 3- 150.130 (C) 3 of the County Land Use Code and
as required by the Housing Authority Guidelines.
1041\RIDGELINE REVIEWS: Francis Krizmanich has visited the site
and performed an administrative 1041 Hazard / Ridgeline
review. He determined the proposed CDU /Barn structure
complies with the county 1041 hazard and ridgeline
restrictions.

ISSUE: The applicant is requesting to deed restrict a caretaker dwelling unit to be located in
above a proposed barn.
BACKGROUND: According to the Pifkin County Land Use, Section 3- 150.130 C, 'Caretaker
Unite-Outbuildings'. the Board may permit one Caretaker Dwelling Unit not to exceed 700 square
feet, to be located within a properly approved outbuilding on any lot within the R -30, AFR -10,
AFR -2, RS -20, RS-3O and RS -160 zones. All such units may be approved under the folovbng
conditions and limitations:
1. The total floor area of the princoal and caretaker unit shall not exceed the allowable FAR of
the applicable zone district.
2. The applicant shall by deed restriction or other permanent commtinerd running with the
land, guarantee that the caretaker unit shall not be required to be rented; not be
condominlumized or sold; not be occupied by the owner or spouse; be limited to occupancy
by not more than two (2) adults, and related children, who qualify as (and have been found
by the Housing Authority to be) employees of the community under such guidelines as may
be from time to time established by said Authority; be rented for terms not less than six (6)
months ff rented. The caretaker dwelling unit may be occupied by members of the
immediate family even though they may not qualify as employees of the community,
'Immediate Family' shall mean a person related by blood or marriage who is a first cousin
(or closer relativa) and his or her children.
3, The Garetaker Dwelling Unit restriction may be removed by the property owner upon
approval of the Board, subject to the requirement that the dwelling is removed or modified.
If modified, the remaining improvements must no longer be capable of occupancy as a
dwelling unit and must meet otherwise applicable Code requirements.
RECOM ENDATION: Staff recommends approval as long as the following conditions are met:
1. the kitchen contains at least a two -bumer store wirh oven, standard sink, and at least a 6-
cubic foot refrigerator plus freezer;
2. a Caretaker Dwelling Unit deed restriction be recorded before building permit approval
(this document shall be obtained through the Housing Office); and
3. inspection by the Housing Office prior to Certificate of occupancy.

I have reviewed the above referenced application and offer the
following comments:
ZONE: RS -20, twenty acre minimum lot size
This parcel contains approximately 6 acres and is non - conforming
in size.
SETBACKS: The required setbacks for this parcel are:
100 foot Major Road setback as measured from the McClain Flats
Road right -of -way
50 foot front yard setback
30 foot side yard setback
30 foot rear yard setback
The proposed structure appears to lie outside of all required
setbacks.
FLOOR AREA: The allowed floor area on this parcel is 15,000
square feet. The existing residence is approved at square
feet of floor area.
The floor area of the proposed barn /cdu has not been verified.
The amount of net livable floor area has not been verified.
HEIGHT: Sufficient information has not been submitted to
determine compliance with County height regulations.
OTHER: Ridgeline review is not applicable to this site.
This parcel has been extensively bermed. These berms are not

Dear Ladies and Gentlemen:
I apologize for being unable to attend this meeting with you today. It is understandably difficult to get on
your agenda and we did not want to delay further although Dianne and I had previous plans to be out of
town. Larry Yaw will be more than able to present the design options and logic behind our request to
separate our single- family house into two closely adjacent buildings.
There are four points I wish you to consider:
I. Design
We think the County should encourage designs similar to ours which break up the mass of homes. In
several specific developments I have been involved in, we have instituted covenants that encourage designs
using two or three smaller building elements to create a reduced scale, a more rural feeling, and to save
trees.
2. Precedent
You may be concerned about setting a precedent by approving our design with adjacent but separate
buildings connected by a passage way instead of a fully enclosed area. I hope you will review the facts of
our situation. We are building within a very tight building envelope which was carefully reviewed and
approved by Pitkin County in a lengthy process. Because we are within a non - typical building envelope,
approval of our request should not be a precedent for any future applicant whose intent is to build two
separate houses on a large piece of property without a pre - established building envelope.
3. Protection Against Use as Two - Houses
There are carefully drafted and recorded land -use covenants which provide solely for single - family use of
this property. These will be enforced by the homeowners association. The County also has rights to
enforce these covenants.
4. Cost
Finally, I hope you will take into consideration the additional cost of approximately $10,000 to join the
buildings as suggested by staff in the building department. I think this qualifies as a legitimate "hardship"
request.

REQUEST: This is a request for approval of a detached Caretaker
Dwelling Unit (CDU) pursuant to Section 3- 150.130 (C) of
the Land Use Code.
LOCATION: 2020 McClain Flats Road, Aspen, Colorado.

located presently contains one legal building, a single
family residence under construction. The proposed CDU
would be located above a barn also to be constructed.
The barn would be located 110 feet SW of the residence.
ACCESS: The CDU /Barn (as well as the residence) is accessed off
a private shared drive off of McClain Flats Road.
SIZE: The floor area of the proposed CDU is 698 net liveable
square feet. The midpoint of the roof is 19' 10" from
the lowest grade and the building height measured to the
peak is 24' 611. The combined areas of the residence
(6,210), the barn (1,728) and the CDU (754) would be
8,692 square feet, well under the 15,000 square feet
allowed in the RS -20 zone district. See Exhibit "C ".
PARKING: All county parking requirements for the CDU shall be
provided on the property.
DEED RESTRICTION: The CDU will be deed restricted as described in
Section 3- 150.130 (C) 3 of the County Land Use Code and
as required by the Housing Authority Guidelines.
1041\RIDGELINE REVIEWS: Francis Krizmanich has visited the site
and performed an administrative 1041 Hazard / Ridgeline
review. He determined the proposed CDU /Barn structure
complies with the county 1041 hazard and ridgeline
restrictions.

Regarding your review of the application for a Caretaker Dwelling
Unit for the White property at 2020 McLain Flats Road, you
indicated you would require a new septic tank and a new or an
additional leach field which we expected. Additionally, you
indicated that Ron Ferguson, who is in charge of the White Horse
Springs water system involved, was concerned about 1.) the
proximity of the barn to the water line and 2.) the proximity of
the leach field for the existing house.
In response, the barn is located outside of the thirty foot
building setback required by county code. The water line is inside
the 7.5' utility easement and is approximately 20' from the
setback. Therefore, it is 20' -30' from where excavation would
occur and is quite safe. This is not an unusual situation for
construction in this community.
Regarding the proximity of the water line to the existing leach
field, we feel this is not a subject for this review.
Nevertheless, the leach field system was built over 25' away from
where Ron originally had indicated the water line was. After
completion of the system Ron informed us the water line was located
closer to the leach field than he had previously indicated. It is
also outside the utility easement. The water line is accessible
and probably fine as it is. However, if it is determined to be too
close to the leach field, we would expect Ron to relocate it within
the easement where we were told it was and where it should be.

In reference to the building permit requested by the home owners at
2020 McLain Flats Road:
Our water main, according to our maps and line locates, is within 10 ft of the
leach field. This distance is closer then what Pitkin County regulations specify.
The Board,of Directors for White florse Springs Water District would like to make
it clear thatlfthere is any problems with the water main which are caused by the septic
system, the homeowners will be held totally responsible for all damages and for
any necessary relocation of the water main.

The Aspen / Pitkin Environmental Health Department has reviewed the
details of the White application under the authority of the Pitkin
Countv Code,Title II, Land Use Code and has the following comments.
The application shows minor changes to the use of the water supply
system. This parcel is served with water by the White Horse Springs
Water district. The district has water to serve this project. However
the District has several concerns.
I had done a final site inspection and given final approval to the
installation of the septic system for the main house on July 17,
1997. About a week later, I received a call from Ron Ferguson, Plant
Superintendent for White Horse Springs Water District, that he had
concerns because the absorption field was located too close to his
water line. I met Ron and Rick Stevens from the excavating company at
the site. Ron pointed out where the water line location was. If the
water line is where Ron indicated, there is only a 10 ft -17 ft
setback maintained from the waterline to the edge of the septic
field.
However, David Muckenhirn, the contractor for the house, stated to me
that he was misinformed by Ron as to the location of the water line.
David thought that he was maintaining the proper setback of 25 ft.
I have attached letters from the two which describe their positions
on this.
The Environmental Health Department would want the two parties to
come to agreement on how best to settle this so that the proper
setback of 25 feet from the water line to the septic field is
maintained. Either the water line or that portion of the septic
field that is encroaching into the setback must be moved. After that

is resolved, we would recommend that the Caretaker unit /barn be
approved. There is adequate room on the property and suitable soil to,
either enlarge the existing sewage disposal system or install a
separate system for the caretaker /barn.
What also must be resolved is the concern Ron has with the location
of the waterline in relationship to the new barn location. Though
this is not a concern to our department, we would like to see
agreement reached between the two parties. Our concern would be that
the proper setbacks are maintained between the waterline and the
sewage disposal system.
