Dear Rob,
It is the policy of the Community Development Department to close land use files which have been
inactive for more than one year. Your application was submitted to our department on April 22, 1999.
During the review of this application, it was brought to staff s attention that there are a number of
outstanding violations on both parcels with respect to working being completed without proper Count}'
permits. Pursuant to section 7- 20- 030(E) of the Land Use Code, no land use approvals or building
permits shall be issued if the County has knowledge of any violations of the Land Use Code or the
Uniform Building Code. Ample time has been permitted to resolve the outstanding violations on both
properties.
If I do not hear from you within the next fifteen (15) days of receipt of this letter, no further review of the
application will be conducted and your application will be closed. If you need any further information. I
can be reached at 970 -920 -5103.

We are requesting a subdivision exemption to adjust a lot line between the subject properties as per land use
code Section 3- 190 -030 of Pitkin County.
We desire to adjust the existing lot lines to provide ownership of the lands currently being used and enjoyed by
the perspective land owners. The proposed lot line configuration trade equal areas, improves the existing
setbacks to the house structures, and provides for lot delineations which encompasses landscape occupancy and
natural /existing topography.

1. Grantor hereby grants, and conveys to Grantee a perpetual, non - exclusive, limited
easement to use, in common with Grantor, that portion of the Property which is cross - hatched
on the site plan attached hereto as Exhibit and made a part hereof (the "Easement Area ") as
a landscaped area to be utilized for the purposes for which a residential lawn and garden area
is customarily utilized in the Red Mountain area of Aspen, Colorado, including the construction,
installation, maintenance and use of a swimming pool and/or spa.

2. Grantee agrees to keep the Easement Area attractively landscaped at all times
during the term of this Easement, to keep the Easement Area in a well maintained, clean, neat
and attractive condition at all times and to comply in all respects with all governmental
ordinances, regulations, statutes or requirements pertaining to the Easement Area. Grantee's
maintenance requirements and responsibilities shall include, but are not limited to, the following:
(a) All trees, shrubs, plants and ground cover shall be timely and properly
trimmed (including the removal of dead wood therefrom) according to their plant culture
and landscape design and shall be watered and fertilized at such times and in such
quantities as required to keep them alive and attractive. Any dead tree, shrub, plant or
ground cover shall be removed and replaced promptly. All dead areas shall be keep free
of weeds and cultivated periodically as needed. Any exterior lighting shall be kept in
good working order.
(b) All lawn areas shall be timely mowed and edged as needed to keep an
even, well - groomed appearance, shall be watered and fertilized at such times and in such
quantities as required to keep the grass alive and attractive; and shall be kept free of
weeds.
3. If Grantee shall breach any of the duties or obligations imposed upon Grantee
under the terms and conditions contained herein, Grantor shall have the right to (i) seek
injunctive relief to require Grantee to perform such duties or obligations (ii) cause such duties
or obligations to be performed, in which event all sums expended by Grantor in causing the
duties or obligations of Grantee to be performed shall become a demand obligation owed by
Grantee to Grantor from the date such sums are expended by Grantor, shall bear interest at the

lesser of the highest lawful contractual rate or 18% per annum from the date expended by
Grantor until repaid by Grantee, and shall be subject to collection by suit in any court of
competent jurisdiction or (iii) exercise all rights and remedies otherwise available at law, in
equity or by statute. All rights or remedies shall be cumulative and non - exclusive. It is
expressly agreed that time is of the essence in the performance of all terms, provisions and
agreements contained herein. In any legal or equitable proceeding for the enforcement of any
of the terms, provisions, conditions or agreements contained herein or damages for the breach
thereof, the losing party shall pay the attorneys' fees and court costs of the prevailing party.
