RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY,
COLORADO, GRANTING APPROVAL FOR AN EMPLOYEE DWELLING UNIT
TO RICHARD PEARLSTONE
Resolution No. 90 -Y21-
WHEREAS, Richard Pearlstone (hereinafter "Applicant ") has
applied to the Board of County Commissioners of Pitkin County,
Colorado (hereinafter "Board ") for approval to construct an
employee dwelling unit pursuant to Section 3- 8.13(a) of the Land
Use Code on a parcel of land more specifically described in
Exhibit "A ", attached; and
WHEREAS, the Board heard this application at a regularly
scheduled public meeting on August 14, 1990, at which time
evidence and testimony were presented with respect to this
application; and
WHEREAS, the Board finds that the proposed dwelling unit
conforms to the requirements of Section 3- 8.13(a) of the Code.
NOW, THEREFORE, BE IT RESOLVED by the Board that it does
hereby grant approval for the proposed deed restricted employee
dwelling unit 'subject to the following conditions:
1. The total FAR for the site shall not exceed the FAR
requirement for the R -30 zone district.
2. Prior to the issuance of a building permit, the
Applicant shall file a deed restriction with the
Housing Authority which meets the requirements of
Section 3- 18(a)(4) of the Land Use Code.
3. The entire house must meet Uniform Fire Code
requirements prior to the issuance of a Building
Permit.

REQUEST: The applicant is requesting approval to construct an
employee dwelling unit attached to single family home pursuant to
Section 3 -8.13 (a) of the Land Use Code.

LOCATION: 1099 Willoughby Way, Lot 1A, Block 1, Pitkin Green
Subdivision
ZONING: The 51,340 square foot lot is zoned R -30.
WATER: The residence is serviced by the Pitkin Green
Water System.
SEWER: The lot is tapped into the Aspen Consolidated
Sanitation District's sewage line.
ACCESS: Access to the property is directly off Willoughby
Way.

Fire Marshal- In a memorandum dated June 26, 1990 Wayne
Vandemark submitted the following comment:
"There is no water in the area for fire fighting or to
satisfy the required fire flow established by the insurance
service offices."
STAFF COMMENTS
The application for the 357.50 net livable square foot employee
dwelling unit meets all the code criteria of Section 3- 8.13(a).
1. The unit is not more than 500 square feet.
2. The total FAR for the site shall not exceed the FAR
requirement for the R -30 zone district.

3. One off - street parking space shall be provided for the
unit.
4. The unit shall be deed restricted pursuant to Housing
Authority requirements.
ALTERNATIVES: The Board of County Commissioners may:
1. Approve the applicant's request with conditions.
2. Deny the applicant's request.
RECOMMENDATION: Planning staff recommends alternative 1 with the
following conditions:
1. The total FAR for the site shall not exceed the FAR
requirement for the R -30 zone district.
2. Prior to issuance of a building permit, the Applicant

Dear Mary,

Our client, Richard Pearlstone, is proposing to include in his
residence at 1099 Willoughby Way (zone district R -30), an employee
dwelling unit above the garage. The unit would have a private entrance,
one bedroom, one bath, and living area totalling 357.50 livable square feet.
The owner agrees that the unit will be occupied by not more than two
adults, and related children, who qualify as residents of Pitkin County, as
stated in the Pitkin County Code, section 3 -8.13 (a). Said unit will not be
rented for less than six months, shall remain a rental unit (not to be
condominiumized), and will not be occupied by the owner or spouse.
Enclosed please find a site plan, vicinity map, and floor plan -showing
the proposed employee unit. Also submitted with this application is an
authorization letter from the owner, disclosure of ownership, adjacent
property owners list, and one copy of the pre - application summary sheet.

Conditions and Stipulations
1. The term mortgage, when used herein, shall include dead of trust, trust deed, or other security instrument.

3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties included
under the definition of insured in the form of policy or policies committed for and only for actual loss incurred in reliance
