David Nesslein ( "Applicant ") has applied to the Community Development Director of Pitkin County, Colorado, for approval of a Detached Caretaker Dwelling Unit. 2. The Applicant's parcel contains 1.3 acres and is in the R -30 zone district. 3. Said parcel is located at 0151 Herron Hollow, and is more specifically described as Lot 6, Block 2, Pitkin Green Subdivision. 4. The Applicant proposes to deed restrict the proposed caretaker dwelling unit pursuant to Section 3- 150.130(A)(4) of the Land Use Code. 5. The Director finds that the Nesslein Detached Caretaker Dwelling Unit complies with applicable standards of the Land Use Code Sections 3- 150 -130 and 3 -210 and has recommended approval of the request based upon compliance with these sections. THE DIRECTOR DOES HEREBY APPROVE the Nesslein Detached Caretaker Dwelling Unit subject to the following conditions: 1. The caretaker dwelling unit shall be limited to 700 net livable square feet and the kitchen shall contain a minimum of a two burner stove with oven, standard sink, and at least a 6 cubic foot refrigerator plus freezer. A minimum of one off -street parking space shall be provided for the unit. 2. Prior to submission of any building permits for the caretaker unit, the Applicant shall obtain and the Housing Office shall record a caretaker dwelling unit deed restriction. Actual floor plans of the unit shall be submitted to the Housing Office with the deed restriction. 3. Prior to issuance of a Certificate of Occupancy for the caretaker dwelling unit, the Housing Office shall inspect the unit. 4. The Applicant shall adhere to all material representations made in the application. 5. The roof covering of the CDU shall be a non- combustible Roof Covering on a Class A Roof Assembly (wood shake /shingle roof coverings are prohibited). 6. The study was conducted in accordance with our agreement for technical engineering services to you dated June 10, 2003 and revised on June 15, 003. The subsoils encountered, below about 2 to 21/2 feet of granular fil consist of medium stiff sandy silt with rock fragments up to boulder size. Pit 1 was ex vated through the asphalt driveway. Results of swell- consolidation testing performed n relatively undisturbed samples of the sandy silt, presented on Figure 3, indicate oderate compressibility under conditions of loading and wetting. Results of gradatio analyses (minus 8 inch fraction) performed on the subsoils are presented on Figur 4. No free water was observed in the pits at the time of excavation and the soils were 1 ioist. Foundation Recom mendations: Considering the subsoil conditions encountered in the exploratory pits an the nature of the proposed construction, we recommend spread footings placed on a undisturbed natural soil designed for an allowable soil bearing pressure of 1,500 f for support of the proposed addition and caretaker house. To reduce the effects of some differential movement, floor sla os should be separated from all bearing walls and columns with expansion joints wh b allow unrestrained vertical movement. Floor slab control joints should be used to re uce damage due to shrinkage cracking. The requirements for joint spacing and slab re' forcement should be established by the designer based on experience and the " ended slab use. A minimum 4 inch layer of free- draining - gravel should be placed be4eath basement level slabs to facilitate drainage. This material should consist of MAUS 2 inch aggregate with less than 50% passing the No. 4 sieve and less than 2% p ing the No. 200 sieve. Frozen ground during spring runoff can create a perched condition. We recommend below -grade construction, such as retaining walls and basement areas, be protected from wetting and hydrostatic pressu a buildup by an underdrain system. The drains shoula consist of drainpipe placed in the bottom of the wall backfill surrounded above' he invert level with free - draining granular material. The drain should be placed each level of excavation and at least 1 foot below lowest adjacent finish grade and sl )ped at a minimum 1 % to a suitable gravity outlet. Free - draining granular material i sed in the underdrain system should contain less than 2% passing the No. 200 sieve, les than 50% passing the No. 4 sieve and have a maximum size of 2 inches. The drx rk gravel backfill should be at least 11/2 feet deep. Surface Drainage Surface runoff from uphill areas should be diverted around the buildings. The sw face grading above the caretaker house should consider surface runoff if the salvat on ditch should overflow. As an alternative, the ditch could be placed in a culvert above the site. The following drainage precautions should be observed during cc ristruction and maintained at all times after the addition and caretaker house have been Meted: 1) Inu lion of the foundation excavations and underslab areas should be avo ed during construction_ 2) Ext for backfill should be adjusted to near optimum moisture and co acted to at least 95 % of the maximum standard Proctor density in pav ent and slab areas and to at least 90% of the maximum standard Prc , -� density in landscape areas. Free - draining wall backfill should be cap with about 2 feet of the on -site, finer graded soils to reduce surf ce water infiltration. 3) The Yground surface surrounding the exterior of the buildings should be stop d to drain away from the foundation in all directions. We reco rimend a minimum slope of 6 inches in the fast 10 feet in unpaved area and a minimum slope of 3 inches in the first 10 feet in pavement and Ivalkway areas. 4) Roo downspouts and drains should discharge well beyond the limits of all kfill. 5) Lan scaping which requires regular heavy irrigation, such as sod, should be 1 ted at least 5 feet from the buildings. Limitations: This dy has been conducted in accordance with generally accepted geotechnical engin ring principles and practices in this area at this time. We make no warranty either a ss or implied. The conclusions and recommendations submitted in this report are base I upon the data obtained from the exploratory pits excavated at the locations indicated n Figure 1 and to the depths shown on Figure 2, the proposed type of construction, arm our experience in the area. APPLICANT: David Nesslein REPRENSENTATIVE: Martin Mata LOCATION: 0151 Herron Hollow, Pitkin Green ZONING: R- 30/1.3 acres REFERRAL COMMENTS: • Housing comments will be reflected in the resolution. • The Pitkin Green Water Association (HOA) stated that they have no problem with the Nesslein CDU. STAFF COMMENTS: Caretaker Dwelling Unit: A caretaker dwelling unit is listed as a special review use in the R -30 zone district, and therefore must comply with the following standards (as amended by Ordinance No. 021 - 2001): A. The special review use shall consider the applicable Courtly Master Plan. Response: The special review use is consistent with the applicable Master Plan. B. The special review use shall not conflict with any applicable sections of the Pitkin County land Use Code, including the County Land Use Policies in Article 2. Response: The use is consistent with the Pitkin County Land Use Code and the Land Use Policies. Development on slopes greater than 15% is prohibited. C. The special review use shall be consistent with the intent of 'the Zone District in which it is proposed to be located. Response: The intent of the R -30 zone district is in part "to provide areas for suburban density, single - family, residential dwelling units with customary accessory uses." The County considers a CDU to be accessory to a principal residence. 0 D. The special review use shall he compatible with the character of the immediate vicinity of the parcel proposed for development and surrounding land uses, or shall enhance the mixture of complimentary uses and activities in the immediate vicinity of the parcel proposed for development. Response: Caretaker Dwelling Units have been approved, and built in the Red Mountain Area. The CDU will be built in association with a detached garage. E. The location, size, design and operating characteristics of the proposed special review use must be in harmony with the surrounding area and minimizes adverse effects, including visual impacts, impacts on pedestrian and vehicular circulation, traffic generation, parking, trash, service delivery, air /water pollution or other impacts on natural resources, noise, vibrations and odor on surrounding properties. Response: The proposed CDU will be located near the principal residence and should have minimal adverse effects. Some of the neighbors reviewed the proposal and felt that there would be no impacts. F There must be adequate public facilities and services to serve the special review use, including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection, emergency medical services, hospital and medical services, drainage systems, and schools. Response: The applicant utilizes existing services and the CDU will not create additional impacts on public facilities and services, such as fire, EMS, schools, etc., beyond the impacts generated by the existing principal residence. G. An application for a special review use must demonstrate to the Board of County Commissioners that the proposed development will not: a. Materially endanger the public health, safety or welfare; and b. Substantially injure the value of adjoining or abutting property. Response: Staff has no information that would indicate that the development would injure the value of adjacent properties, or endanger the public health, safety or welfare. Pursuant to Section 3- 150 -130 of the Code, a detached caretaker dwelling unit not to exceed 700 square feet may be permitted in the R -30 zone district under the following conditions and limitations: 1. The door area of the caretaker unit shall be included in the total allowed floor area for the lot or parcel of land. Response: The parcel is limited to a maximum Floor Area of 7,361 square feet. The CDU will be included in this maximum. There shall be provided one off - street parking space for each bedroom in the caretaker unit. Response: The CDU will contain one bedroom. Adequate on -site parking is available to accommodate the CDU. 9 3. The applicant shall deed restrict the unit to comply with the caretaker unit deed restriction pursuant to Section 3- 150 - 130(()(3) of the Land Use Code. Response: The Applicant agrees to deed restrict the unit. The Housing Office recommends approval of the CDU. 4. The dwelling unit deed restriction may only be removed upon approval by the Conunrnity Development Director. It is the applicant's desire that the new structure compliments the present use and character of the applicant's property as well as the adjacent residential properties. We have received a verbal approval from the homeowner's association and will make a formal application to them once this application is approved by the county. The applicant's intent is to provide housing for an on -site caretaker and thereby mitigate the need for an individual to find housing elsewhere in the county. The caretaker's duties will be maintenance of the property and structures and to attend to the personal and business needs of the owners and their guests. The new structure will make use of utilities presently serving the property. The public facilities and services listed in this section of the code would not be materially impacted by the CDU described in this application. Section 3-80 -020, Exempt Development Activities: The proposed location for the CDU is subject to an administrative 1041 review as was done for a building permit application ( #2390 -2002) for expanding the main residence. The footprint and location shown on site plan drawing A -1.1 are approximate; a more detailed site plan as well as floor plans and exterior elevations will be submitted with the CDU building permit application. Section 3- 150 -130, Caretaker Dwelling Units: A detached caretaker dwelling unit of up to 700 s.f. net livable area is allowed on this property under the present R -30 zoning as a special review use. The applicant has submitted a building permit application to expand the existing residence; the combined floor area of both structures is to be within the allowable overall floor area for the parcel (6,824 s.f.). The applicant agrees to provide parking as required in section 3- 150 - 130 -B -2. The applicant agrees to comply with the deed restriction requirements in section 3- 150 - 130 -B -3.
