EXEMPTION AND SPECIAL REVIEW FOR REPLACEMENT UNITS, EXPANSION

RECITALS
1. Jamie and Carter Hall ("Applicant")has applied to the Pitkin County Board of County
Commissioners (`BOCC")to consider a GMQS Exemption and Special Review for
Replacement Units, Expansion of a Non-conforming Structure and a Caretaker Dwelling

F2. The property is located at 1654 and 1656 Castle Creek Road and is more specifically
A described as Lot 2 of the Aspen Music School Subdivision(MAA Inc. Subdivision).

3. The property is zoned AFR-10 and contains approximately 13.87 acres.
4. The BOCC heard this application at a duly noticed public hearing on December 19, 2001, at
which time evidence and testimony were presented with respect to this application.
5. The BOCC has determined that the proposed development meets the criteria established in
Sections 3-210, 6-40-030, 9-110-041, and 9-110-052 of the Land Use Code, and therefore
found the proposal to be appropriate.

Q NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County
Commissioners that it does hereby grant a GMQS Exemption and Special Review for
Replacement Units, Expansion of a Non-conforming Structure and Caretaker Dwelling Unit for

the submitted site plan shall be modified to exclude all slopes in excess of 30 percent.

the footprint(including porch areas) of the existing structure. The modified building
envelope shall be approved by Community Development prior to recordation.
3. The Applicants shall comply with all fire/safety emergency recommendations provided by
the Aspen Fire Protection District as represented in the application and shown on the
submitted site plan.
4. Prior to building permit issuance, the Applicant shall obtain a septic permit from the
Environmental Health Department for any improvement to the existing septic system
deemed necessary to accommodate the new development.
5. Structures shall be designed to blend with the surrounding natural landscape to the
greatest extent possible. Roof materials shall be non-reflective.
6. The Applicant shall submit a Positive Drainage and Erosion Control Plan to be reviewed
and approved by the Pitkin County Engineer prior to building permit submission.
7. The Applicant shall submit a Fugitive Dust Control Plan to the Environmental Health
Department prior to issuance of a building permit. The plan shall include measures to
ensure that dust does not become a nuisance and blow onto adjacent properties.
8. Prior to commencement of any earthmoving or construction activity, the Applicants shall
stake the corners of the building envelope and install construction fencing around the
perimeter of the building envelope. The fencing shall remain in place until issuance of
certificate of occupancy.
9. Floor area shall be limited to 5,750 square feet exempt from growth management for
replacement of the"A" frame structure (to be deemed the primary residential unit and
located at the southernmost portion of the property) and the caretaker dwelling unit. The
property owner understands that this approval qualifies as the one-time GMQS
Exemption for Replacement Units pursuant to Code Section 9-110-052 (D) (3). Floor
area shall be calculated based on the definition in effect at the time of building permit
submittal.
10. The Applicant shall covenant the property against any further subdivision. The
Community Development department prior to submission of a building permit shall
confirm documentation of this covenant.
11. Pursuant to Ordinance No. 022-2000, the Applicant is subject to the Fair Share
Requirements and shall pay a road impact fee as calculated at the same time as building
permit issuance.
12. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin
County Land Use Code and Colorado Statutes, subject to the exceptions set forth in the
Pitkin County Land Use Code § 4-140 and C.R.S., § 24-68-105. The statutory vested
rights granted herein shall expire on December 19, 2004.
