Vos Caudill, Pitkin County, CO RESTRICTIVE COVENANT FOR THE USE OF AND AGREEMENT FOR AN AGRICULTURAL BUILDING THIS RESTRICTIVE COVENANT ( "Restrictive Covenant') is made and entered into this 18th day of November 2013, by Snowmass Acres LLC ( "Grantor" or "Owner "), concerning the property known as 5809 East Sopris Creek Road, Snowmass, CO (State Parcel ID #264504200003), more specifically described in Exhibit "A" attached hereto, located in Pitkin County, for the benefit of the Pitkin County Board of County Commissioners ( "County "). WITNESSETH WHEREAS, Grantor owns the real property described in Exhibit "A" ( "Property"), which Property will contain an agricultural building as allowed pursuant to Sec. 5 -20 -70 of the Pitkin County Land Use Code. Said agricultural building will be located as shown on the attached site plan (Exhibit `B ") and shall contain a 155 sq ft root cellar (Building Permit #0154.2013.prgr) and the conversion of 264 sq ft of the already approved 988 sq ft Agricultural Equipment Storage shed into a greenhouse (Building Permit 90166.2013.prgr and Administrative Decision 85- 2013). All of this floor area shall be exempt from Floor Area and Growth Management calculations as allowed pursuant to Ordinance 11 -2011. For the purposes of this Restrictive Covenant, the approved agricultural buildings and all appurtenances and fixtures associated therewith shall hereinafter be referred to as the "Agricultural Buildings "; and WHEREAS, this Restrictive Covenant imposes certain covenants upon the Property, which restrict the use of the Agricultural Buildings, as more particularly set forth herein. NOW, THEREFORE, for and in consideration of the covenants, terms, conditions, and restrictions hereinafter set forth and for other good and valuable consideration, the receipt and sufficiency are hereby acknowledged, Grantor does hereby grant and convey to the County, forever and in perpetuity, an interest in the Property, for and in consideration of the recitals and mutual covenants, terms, conditions and restrictions contained herein: 1. Restrictive Covenant pertaining to use of the Property. The use of the Agricultural Buildings shall henceforth be limited to a root cellar and greenhouse in support of an on -site agricultural operation. An indoor riding arena shall not be considered a barn. 2. Covenant running with the land: binding effect. The provisions of this Restrictive Covenant shall constitute a covenant that runs with the title to the Property as a burden thereon for the benefit of the County, its successors and assigns and shall be deemed an appurtenance to the title to such land. 3. Permitted uses and activities. As owners of the Property, the Grantor retains the right to perform any act consistent with the Land Use Code to the extent such act is not prohibited or limited by the requirements of this Restrictive Covenant. These ownership rights include, but are not limited to, the right to exclude any member of the public trespassing on the Property and the right to sell, lease, or otherwise transfer the Property to anyone Grantor chooses. Nothing herein shall be construed to be an approval by Grantee under the Land Use Code for any purpose. 4. Enforcement and Inspection. This Restrictive Covenant and its terms and representations shall be fully enforceable by the County, its successors, assigns and agents in any action at law or equity or both, to secure compliance, including but not limited to, seeking injunctive relief and /or specific performance requiring the Grantor, its successors or assigns to cease and desist all activity in violation of the terms of this Restrictive Covenant and to return the Property to its condition prior to any violation. Moreover, the County and its successors, assigns and agents shall be permitted access to, and to enter upon, the Property at reasonable times upon at least 48 hours advance notice to the Grantor or Grantor's representative, solely for the purpose of monitoring, inspection, and if necessary, remediation of the Agricultural Building in order to enforce and assure compliance with the terms and conditions of this Restrictive Covenant. 5. Costs and liabilities. Grantor retains all responsibilities and shall bear all costs and liabilities of any kind related to ownership, operation, upkeep, taxes and maintenance of the Property, including but not limited to, costs associated with compliance with this Restrictive Covenant. The County's acceptance of this Restrictive Covenant shall in no way be construed as an assumption of any duties or liabilities associated with the Property and Grantor acknowledges that by this Restrictive Covenant, Grantor continues to retain responsibility for any and all duties and liabilities associated with the Property. 6. Subordination. At the time of the conveyance of this Restrictive Covenant, the Grantor represents that the Property is not subject to any mortgage, deed of trust, or judgment lien, or any other instrument that might result in a foreclosure action that could affect the viability of this Restrictive Covenant. 7. Incorporation of the Land Use Code. The Land Use Code, as may be amended from time to time, and any terms or definitions contained therein, are hereby incorporated by this reference in their entirety. 8. Modification. The terms of this Restrictive Covenant can only be modified by an amended covenant executed by both Grantor and County and recorded in the records of the Clerk and Recorder for Pitkin County, Colorado. 9. Venue and jurisdiction. Grantor and the County consent to venue and jurisdiction in the District Court for Pitkin County, Colorado for all matters concerning the interpretation and enforcement of this Restrictive Covenant. 10. Attorneys fees and costs. In the event of any action or suit between the parties hereto or their successors and assigns to enforce any of the agreements, covenants or restrictions contained herein, the substantially prevailing party in any such action or suit, whether by final OV judgment or out of court settlement, shall recover from the other party all costs and expenses of such action or suit including reasonable attorneys fees. 11. Section headings. Paragraph or section headings within this Restrictive Covenant are inserted solely for convenience of reference, and are not intended to, and shall not govern, limit or aid in the construction of any terms or provisions contained herein. 12. Further actions. The parties to this Restrictive Covenant agree to execute such further documents and take such further actions as may be reasonably required to carry out the provisions and intent of this Restrictive Covenant or any agreement or document relating hereto or entered into in connection herewith. 13. Notices. Any notice which is required to be given under this covenant shall be given by mailing the same, certified mail, return receipt requested, properly addressed and with postage fully prepaid to any address provided herein or to any subsequent mailing address of any additional parties, as long as prior written notice of the change of address or additional parties has been given to the other parties to this Restrictive Covenant. Snowmass Acres LLC ( "Applicant ") has applied to the Community Development Director of Pitkin County, Colorado ( "Director "), pursuant to Sec. 2- 30- 20(g)(19) of the Land Use Code ( "Code "), to obtain additional exempt floor area for a greenhouse and root cellar. 2. The property is located at 5809 East Sopris Creek Road, and is more specifically described in Exhibit A. 3. The parcel contains 35.74 acres and is a conforming size parcel in the RS -30 zone district. The Certificate of Occupancy for the existing residence was issued by the County in 1982. Other improvements include two riding rings and three agricultural outbuildings. 4. The Community Development Director approved an Activity Envelope and Site Plan, and GMQS Exemption for a new single family residence, caretaker dwelling unit and accessory agricultural buildings, pursuant to Administrative Decision No. 07 -2013; the Site Plan is recorded in Plat Book 102 at Pages 47 -48. 5. Based on Sec. 5 -20 -700) of the Code, the property is eligible for the following floor area exemptions for agricultural buildings: 4,060 square feet for a barn(s); 990 square feet for an agricultural equipment storage building, 672 square feet for a hay storage building, an unlimited number of loafing sheds each of up to 300 square feet. The Applicant is fully utilizing these exemptions with the existing and proposed agricultural buildings. 6. The Applicant is requesting additional exempt floor area for (1) a 268 square foot greenhouse attached to the agricultural equipment storage building, and (2) a 160 square foot root cellar under the lawn to the south of the residence. Both buildings will be within the approved Activity Envelope. 7. The Agricultural Building Review Committee reviewed the request, and found that the proposed greenhouse and root cellar are designed to support an agricultural operation and are functional for agricultural uses. 8. The Director finds that the request complies with the criteria in Sec. 2- 30- 20(g)(19) of the Code, as follows: A. Agricultural buildings are allowed in the RS -30 zone district. B. The proposed agricultural buildings comply with the applicable standards of Chapter 7 of the code. C. Proposed agricultural activities on the property include: irrigated pastures to produce feed quality hay; fruit and nut producing orchards; vegetable, perennial and herb gardens; cattle grazing and beef production; raising of 4 -6 hogs for butchering; chicken coop; and a bee hive for fruit orchard pollination. The Applicant is represented in this application by Davis Horn Incorporated. The Applicant is requesting flexibility for Agricultural Support facilities in order to develop a greenhouse and a root cellar. The property contains 35 +/- acres and is located at 5809 East Sopris Creek Road. Attachment I is a vicinity map showing the location of the property. The Applicant is in the process of developing a new single family dwelling unit, caretaker dwelling unit and new accessory agricultural buildings. The Applicant is also developing a pond, new irrigation sprinkler irrigation system, vegetable gardens and fenced fruit tree orchard. This land use application is addressed under the following headings: I. Existing Conditions; II. Recent Land Use Approval; III. Proposed Development; IV. Land Use Code Compliance; and V. Summary. I. EXISTING CONDITIONS The subject property is accessed via East Sopris Creek Road. Attachment 2 is a 2012 Topographic Survey of the property which has been prepared by Alpine Surveys. The tract is bordered by East Sopris Creek Road to the north, the Hawn and Russell 35 acre +/- tracts and the Puckett Ranch to the west, large agricultural tracts to the south and the Little Elk Creek Subdivision to the east. The Little Elk Creek Ditch traverses the property and most of the land is flood irrigated from the Ditch. The land gently slopes generally from west to east. The tract was developed with a legally created single family dwelling unit which has been demolished. The property is improved with two riding rings and three accessory agricultural outbuildings (see Attachment 2). There are outstanding views of the Elk Range and the Capitol Creek Valley from the southwest corner of the property where the existing house is located. The property is in the process of being redeveloped as a working farm. II. RECENT LAND USE APPROVALS On February 6, 2013 the Pitkin County Community Development Director approved Administrative Decision No. 7 -2013 granting the Snowmass Acres LLC Activity Envelope and Site Plan Review, Special Review and GMQS Exemption for a single Family house, caretaker dwelling unit and accessory agricultural buildings (see Attachment 3). Attachment 4 is the Snowmass Acres Activity Envelope and Site Plan which depicts the overall plan for the property including the new Agricultural Equipment Building which is proposed to be located to the east of the house, south of the fire truck turn around and fenced orchard. III. PROPOSED DEVELOPMENT The Snowmass Acres LLC Activity Envelope and Site Plan is depicted by Attachment 4. The new house will be located in approximately the same location as the existing house. The house and proposed attached caretaker dwelling unit (CDU) will be accessed by a driveway located in approximately the same alignment as the current driveway. A new 722 square foot agricultural equipment building is proposed to be located just to the east of the house (see Attachment 5). There will be a 268 square foot greenhouse attached to the agricultural equipment building. Attachment 4, the Activity Envelope and Site, shows a small lawn is proposed on the south side of the house just to the east of the "patio, garden and fire place." The Applicant is seeking approval to develop a root cellar containing 160 square feet of floor area under the lawn. Refer to Attachment 6, a site plan of the south side of the house which depicts the root cellar location and Attachments 7, Root Cellar: Building Plans, Elevations and Details which shows the floor plan and cross section of the root cellar. The house will be surrounded by an assortment of trees which are designed to create shade and shelter. Two small fenced orchards are proposed on the east and north sides of the house. Ample parking and a fire truck turn around are proposed. 000004 A new barn which will contain four horse stalls and three pigpens is depicted in Attachment 8. The barn is planned to be located in the northwest corner of the property between two existing sheds. The barn will be adjacent to the existing horse corrals and will be easily accessible to the driveway and East Sopris Creek Road. A new loafing shed and hay storage building is proposed to be located across the driveway from the barn (to the east). Attachment 9 shows the hay storage building elevations. A small irrigation pond is proposed below the Little Elk Creek Ditch to the east of the house and agricultural compound. A small loafing shed may be developed southeast of the pond in the future. The following is a narrative prepared by Glenn Russell, the owner of Snowmass Acres LLC. The narrative describes Glenn and Jennifer Russell's plans for the property. Our future in Pitkin County Glenn, Jennifer and Alexander Russell (July 2013) "My interest in cattle ranching began over 2 decades ago while helping my father on his 800 acre ranch in eastern Oklahoma. We mostly ran cattle and sold to market the year old calves at the end of each growing season, culling the older cows periodically to keep good producing heifers. As my father grew older and became less active we reduced the size of our herd and supplemented ranch income by cutting and selling hay. In the late 1990's I acquired a 300 acre property close to his ranch and began my own cattle operation. The approach was similar, to keep a small herd for selling yearlings to market, to lease pastures for livestock grazing, and to bail hay for sale. While ranching became my hobby this new property offered me opportunities to expand into farming. I began by planting a variety of fruit and nut bearing trees; apples, pears, peaches, plums and apricots along with pecans and walnut. It took nearly 5 years before the orchard was mature enough to begin producing substantial product but every year I would add more trees and now have over 50 ranging in age from 2 to 15 year old. Needless to say harvest time is very busy and the excess is given to friends, family and co- workers. During my first couple years of farming I also started a vegetable and perennial garden. It included common crops such as tomatoes, potatoes, onions, squash, lettuces, peppers, melons, beans, peas, asparagus and various berry patches (blackberry, raspberry and strawberry). Each year I would expand the garden and learned quickly what grew well and what didn't. I focused on getting plants started early to take advantage of the cooler springs before the weeds and insects became as much of a challenge as the hot Oklahoma summer. I also learned to extend the growing season well into the winter by using cold frames. To get fall In0005 plants started I would keep seed pots in partial shade on the porch then transplant into the garden during a cloudy week. I eventually built a greenhouse that allowed me to grow certain vegetables and herbs year round. In 2012 when my wife and I were expecting our first child we closed on the 35 acre property at 5809 East Sopris Creek Rd. in Snowmass Colorado. This parcel of land was ideal for building our future home and the needed agricultural facilities to relocate my family with our ranching lifestyle and to raise our new son. Having learned a lot in Oklahoma about livestock and farming we know we will have to be adaptive to the higher elevations and colder climate of Pitkin County. Our dream is to have the ability to be semi -self sufficient raising our own beef, pork, poultry, along with cutting hay and growing the vegetables, fruits and herbs needed to maintain a healthy lifestyle. The excess would be sold locally or offered to neighbors as we were accustomed to doing back east. The relocation to Colorado will provide us the opportunity to build better, more efficient agricultural facilities and to hone in on our ranching skills. We have consulted many local experts in the design and implementation of a more modern, environmentally sensitive operation. For example, the greenhouse will be heated solely by the sun's energy with no back up fossil fuels by utilizing the "climate battery" design our consultants Michael Thompson and Jerome Osentowski have perfected. It needs to be located close to the gardens for easy accessibility and ideally attached to the agricultural equipment building for energy savings by sharing a common wall reducing perimeter heat lost. It will also share this "thermal mass" wall between the interior work space of the greenhouse and shop to capture natures' radiant heat. This combination will allow our family to start plants early in spring, to protect the young plants from wind and frost, and to grow a large variety of produce well into the fall and hopefully all year long. This is essential to any productive, self - sustaining garden. Our agricultural activities will include big gun irrigated pastures to produce feed quality hay, establishing fruit and nut producing orchards, growing vegetable, perennial and herb gardens, and utilizing a greenhouse for early spring starter plants and to extend the winter growing season. The hay will be used as feed for beef or to horses with remaining sold to local ranchers. The fruit will be for food production with excess used for cider and jam. The vegetable gardens will produce food for consumption with excess sold locally or offered to neighbors and friends. Fallen fruit and vegetables will be used to supplement pig feed. We estimate we can run up to 50 head of cattle during the peak grazing season while keeping several young calves each year to produce beef. The facilities will allow us to continually raise 4 -6 hogs for butcher and sale. There will be a chicken coop for 10 egg laying hens and a bee hive for fruit orchard pollination. M uou006 We plan to have a 50 hp tractor with front end loader and rear PTO for farm implements, ranger ORV, 3/4 ton ranch truck, brush hog mower, hydraulic augur, hay fork, road grader, horse /livestock trailers, utility trailer, fertilizer /spreader, tiller, maintenance tools for farm equipment such as air compressor, floor jacks, welder, cutting torch, drill press, grinders and management tools for fencing, gardens, and livestock; the essential equipment required for successful farming and ranching. Over the next 2 -3 years as we fulfill our commitments in Oklahoma, we will complete the construction of the house, agricultural buildings and property improvements getting our new ranch ready for full operation. We will go from part time living in Pitkin County to full time residence. We are so excited at the prospect of seeing our fruit orchards mature, our hay pastures grow, our vegetable gardens and greenhouse flourish and our livestock continuing to expand. LAND USE APPROVAL The Pitkin County Community Development Department pre - application conference summary sheet for the proposed redevelopment is found in Attachment 10. This section of the application demonstrates compliance with the applicable sections of the Pitkin County Land Use Code identified in the pre - application conference summary sheet. Section 2- 30- 20(g)(19) is addressed. The Land Use Code standards appear in bold and are underlined followed by the Applicant's responses. (19) Flexibility for Agricultural Support If a property does not meet the minimum acreage required in Sec. 5- 20 -70(i) for an exempt agricultural building, or if the exempt floor area provided in Sec. 5- 20 -70(i) is not adequate to support an agricultural operation, the owner may submit a request to obtain additional exempt floor area. The Community Development Director shall approve the additional exempt floor area, provided the following criteria are met: (a) Agricultural Buildings are listed as an allowed, special review or master plan use in Table 4 -1 in the zone district; and Agricultural buildings are allowed in the RS -30 zone district. (b) The agricultural building(s) complies with the applicable standards of Chapter 7; and The proposed buildings comply with the Code standards in Chapter 7. (c) The owner demonstrates that the property is utilized for an agricultural operation as defined in Chapter 11 and that the agricultural building(s) are designed and will be used to support the agricultural operation. Vas Caudill, Pitkin County, CO ADMINISTRATIVE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF PITHIN COUNTY, COLORADO, APPROVING THE SNOWMASS ACRES LLC ACTIVITY ENVELOPE AND SITE PLAN REVIEW, SPECIAL REVIEW AND GMQS EXEMPTION FOR A CARETAKER DWELLING UNIT Administrative Decision No. 1 -2013 RECITALS l) Snowmass Acres LLC (hereafter "Applicant') has applied to the Community Development Director of Pitkin County (hereafter "Director ") to establish an Activity Envelope to encompass all site development, and obtain Site Plan review approval for a new single family residence, attached caretaker dwelling unit, agricultural buildings, a pond, landscaping, and other associated development. 2) The property is located at 5809 East Sopris Creek Road, and is more specifically described in Exhibit A. 3) The parcel contains 35.74 acres and is a conforming size parcel in the RS -30 zone district. The Certificate of Occupancy for the existing residence was issued by the County in 1982. Other improvements include two riding rings and three agricultural outbuildings, 4) The Director finds that the request complies with the applicable provisions of the Land Use Code ( "Code "), as follows: A) The wildfire hazard is rated as low, and can be mitigated pursuant to the provisions of Sec. 7-20 - 60(c) of the Code. B) The activity envelope primarily contains slopes of less than 30 %. Slopes in excess of 30% within the envelope are man -made in association with the Little Elk Creek Ditch and are anomalies in an otherwise continuous slope of less than 30 %. The Code permits development in these areas of slopes in excess of 30 %, pursuant to Sec. 70- 20- 20(c)(3). C) The parcel is less than ' /4 mile from mapped mule deer and elk winter range and winter concentration area across East Sopris Creek Road on the southeast facing slopes of Light Hill. The redevelopment of the site will have minimal additional impacts on wildlife. D) The site is visible from East Sopris Creek and Capitol Creek Roads. The development complies with the Scenic View Protection Area criteria in Sec. 7- 20- 120(d) of the Code. The residence is located on the highest portion of the site, however, this area was previously disturbed with the existing residence, and avoids steeper slopes and irrigated lands. The residence and other proposed buildings do not break a ridgeline. The mass of the residence has been broken up into smaller forms and the facades and rooflines are staggered. Existing and additional trees will provide screening of the residence. E) The proposed development will be located at the edge of the irrigated pasture with buildings clustered in two areas, both of which have been previously developed. Therefore, the proposed development complies with the Rural Character Guidelines for Building Location in Sec. 7-20 - 120(e) of the Code. F) The proposed roof - mounted solar energy collectors comply with Sec. 4- 30 -50(h) of the Code Two arrays are proposed, including a 715 square foot array on the roof of the residence and an 80 square foot army on the roof of the caretaker dwelling unit. The roofs have the same orientation and pitch, and the collectors will lay flat on the roof and will not protrude above the ridge of the roof. The collectors will be used primarily for on -site purposes. U���12 Administrative Decision No. _�-2013 Page 2 G) The proposed agricultural buildings — hay storage building, loafing shed(s), agricultural equipment storage building, greenhouse and bam — comply with Sec. 5- 20 -70(i) of the Code. H) The attached caretaker dwelling unit complies with the applicable provisions of the Code, including Sec. 4- 20- 50(e), use specific standards for Caretaker Dwelling Units; Sec. 2- 30- 30(h), Special Review criteria; and Sec. 6- 3040(c), GMQS exemption for a caretaker dwelling unit. 1) The valuation of the property and the improvements proposed to be made under the approvals will be significantly higher relative to the value of any agricultural products produced and it is unlikely for the Applicant to generate enough revenue from commercial agricultural activities to sustain a viable agricultural operation. J) The approvals when fulfilled change the primary and fundamental use of the land from being agricultural. APPROVED by the Director, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. The property is exempt from growth management for up to 5,750 square feet of floor area. The floor area of the caretaker dwelling unit shall be included in the total allowed floor area for the lot. Agricultural buildings that comply with the provisions of Sec. 5- 20 -70(i) of the code are exempt from Floor area. 3. Prior to submission of any building permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with Activity Envelope in accordance with Land Use Code Section 2- 30 -20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation of them. 4. With the building permit application for the residence and caretaker dwelling unit, the Applicant shall: A. Provide proof of an adequate water supply (in terms of quantity and availability) for domestic and fire protection purposes for two dwellings, and for irrigation purposes, if applicable. B. Submit an On -Site Wastewater Treatment System ( "OWTS') Use Permit application to Environmental Health for review and approval in order to utilize the existing OWTS for the new residence and caretaker dwelling unit (the current use permit expires on April 10, 2013; after that date a new use permit will be required). If the OWTS is expanded, the Applicant shall submit an OWTS Construction Permit to Environmental Health for review and approval. C. Submit a drainage and erosion control plan for review and approval by Planning/Zoning. If the development disturbs one (1) acre or more, the Applicant shall apply for and obtain a State Stormwater Permit. All historic and natural drainage patterns shall be maintained. D. Submit a large scale construction management plan for review and approval by Planning/Zoning. E. Submit an Access Permit application for improvements to the existing driveway. Improvements to the driveway shall comply with the Asset Management Plan and the requirements of the Basalt and Rural Fire Protection District. The existing driveway complies with the Fire District's requirements for access off of East Sopris Creek Road. F. Complete a fireplace/woodstove registration form with the Community Development Department, if necessary. G. Submit a tree mitigation plan for the removal of trees larger than 6" DBH. Diseased trees do not require mitigation; a certified arborist must evaluate the trees to verify. H. Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes. J. Submit a lighting plan. 5. The Applicant shall apply for and obtain a County Earthmoving, Clearing and Grubbing Permit for all earthwork, landscape and water course/water feature /pond improvements. 6. Prior to issuance of the building permit application for residence, the Applicant shall pay the applicable road and employee housing impact fees. Prior to issuance of a building permit for any agricultural buildings, the Applicant shall record an Occupancy Covenant and Agreement that shall specify that the exempt floor area for the agricultural buildings may only be used in association with the raising, producing, or keeping of plants or livestock, or cultivation and management of other crops or farm products, and that any area not consistent with those uses would count as floor area. The Occupancy Covenant and Agreement shall allow the County to inspect the agricultural buildings at any time for compliance with the specified use limitations, subject to the provision of reasonable notice to the property owner. The form of the Occupancy Covenant and Agreement shall be approved by the County Attorney. S. Prior to issuance of a Certificate of Occupancy for the main residence, the Applicant shall submit for recording a covenant acceptable to the Community Development Department and County Attorney prohibiting commercial agricultural activities on the parcel, pursuant to Sec. 2- 20 -10(e) of the Land Use Code. 9. Areas disturbed by construction shall be re- vegetated within one growing season of the project's completion. 10. No development in excess of 30" above or below natural grade shall occur within the setbacks of the parcel, with the exception of driveways and associated retaining walls of up to 6' above or below natural grade and fencing. Landscaping in the form of berms within the setbacks shall not exceed four feet from the most restrictive grade. Any development located within setbacks mandated by County zoning regulations that does not comply with these restrictions shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 11. The exterior of the residence shall utilize indigenous earth tone materials or colors and the roofs shall have a non - reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflectivity, with the exception of materials associated with solar or photovoltaic equipment. Driveway lighting is prohibited and all other lighting shall comply with the lighting code. 12. The Applicant shall comply with the following landscaping and wildfire defensible space mitigation standards: A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): 006014 Administrative Decision No. 3 -2073 Page 4 1) Brush, debris, and non - ornamental vegetation shall be removed within a minimum 10 foot perimeter around the structure. 2) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30 foot perimeter around the structure. 3) Spacing between clumps of brush and vegetation within the 30 foot perimeters shall be a minimum of two times the height of the fuel. Maximum diameter of the clumps shall not exceed 10 feet. All measurements shall be from the edges of the crowns of the fuel. 4) All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of 10 feet above the ground and ladder fuels from around trees and brush shall be removed. 5) Tree crown separation within the 30 foot perimeters shall have a minimum of 10 feet between the edges of the crowns. 6) All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. 7) The density of fuels within a 100 foot perimeter of the structures shall be reduced. 8) All deadfall up to a 100 foot perimeter shall be removed. 9) No new conifer trees shall be planted within 10 feet of a residence. 10) No flammable mulches shall be placed within two feet of a residence. 11) The applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Roofing Materials: Roofs shall be constructed with a Class A roof covering or a Class A assembly as defined in the building code. Wood shake/shingle roof coverings are prohibited. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: 1) All roof coverings shall be constructed of non - combustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing the roof. 3) All roof designs shall facilitate the natural process of clearing debris. Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required by the approved building code and shall have a minimum slope of 1:48. 5) All roof designs, coverings or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. C. Additional wildfire mitigation standards: 1) Vents shall be screened with corrosive resistant wire mesh with mesh '/4 inch maximum. 2) Roofs and gutters shall be kept clear of debris. 3) Yards shall be kept clear of all litter, slash, and flammable debris. 4) All flammable materials and firewood/wood piles shall be stored on a parallel contour a minimum of 15 feet away from any structure. 5) Swimming pools or ponds shall be accessible to Fire Department vehicles. 6) Fences shall be kept clear of brush and debris. 7) Wood fences shall not connect to the structure. 8) Fuel tanks shall be installed underground with an approved container. 9) Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any above - ground tank. The Applicant shall install an automatic fire suppression system in the residence and caretaker dwelling unit; the system shall be approved by the Fire Marshal. Water supply for fire- fighting is available at the Little Elk Creek Subdivision, therefore, the Fire Marshal has not required an on -site supply. 14. The Applicant shall comply with the following conditions regarding wildlife: A. Dogs shall be kenneled within 50' of the residential buildings or leashed under human supervision at all times. B. Contractors shall be prohibited from bringing their dogs on -site. C. Manipulation of vegetation outside of the activity envelopes is prohibited, except as necessary to comply with the wildfire hazard mitigation measures. D. Landscaping shall not include nut, berry or fruit producing trees or shrubs to minimize an attractant to bears. An exception is permitted for an orchard with nut, berry and fruit- bearing trees, which shall be fenced with an exclusion fence that complies with the recommendations of the Colorado Department of Parks and Wildlife. E. Trash/garbage shall be kept in an approved bear resistant container or enclosure as required by the County's Wildlife Protection Ordinance. F. All outside doors shall utilize only solid round handled door knobs unless another type is required by the applicable building code for disabled accessibility purposes. G. Bird feeders, including hummingbird feeders, shall be hung away from any deck or window, and shall be at least 10' from the ground suspended between 2 trees or posts. All seed feeders shall include a seed catchment pan to catch discarded seeds. Bird feeders should be removed from April through November. H. Fencing shall comply with the following, except for fencing immediately adjacent to the buildings to contain pets or livestock: 1) Wood fencing shall employ three mils or less, be the round or split rail type, shall not exceed 48 inches in height above ground level and 12 inches in width (top view), and shall have at least 18 inches between two of the rails. 2) Wire fencing shall consist of no more than 3 strands of smooth wire and shall not exceed 42 inches in height. 3) Mesh or woven wire fences are prohibited, except when used for protection around isolated trees or clumps of trees. 15. Prior to issuance of a Certificate of Occupancy for the caretaker dwelling unit, the Applicant shall obtain and the Housing Office shall record a caretaker dwelling unit deed restriction. Actual floor plans of the unit shall be submitted to the Housing Office with the deed restriction. Prior to issuance of a Certificate of Occupancy, the Housing Office may inspect the unit. 16. The kitchen shall contain a minimum of a two burner stove with at least a 5 cubic foot oven that can bake and broil, sink of at least 14 "W X 16 "D X 5.25 "K and at least a 5.3 cubic foot refrigerator and 0.73 cubic foot fieezer. Two off -street parking spaces shall be provided for the unit. The caretaker dwelling unit must have separately accessible utilities. This does not preclude shared utilities. The fencing shall remain in place until issuance of a Certificate of Occupancy. 19.
