Todd and Gabrielle Emerson, the owners of the property (hereafter collectively referred to as "Applicants ") have applied to the Community Development Director of Pitkin County ( "Director") for 1041 Hazard Review approval in connection with an application for a Building Permit for a new residence. See Section 3 -80 of the Pitkin County Land Use Code. B. The property is zoned AFR -10 and AHP PUD and contains .68 acres. The property is Lot 36 of Holland Hills at Basalt. C. The property is located in critical mule deer and elk winter range in the Roaring Fork Valley. D. The Director finds that the request is consistent with the requirements of the Pitkin County Land Use Code. APPROVED by the Director, subject to the following conditions: The Applicants shall adhere to all material representations made during the application process. 2. To minimize further impacts on wildlife in connection with development on the Property, any dog(s) kept on the property must be kenneled or leashed at all times when out -of- doors. For purposes of this requirement, "electric fencing" does not constitute a kennel. 3. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. 4. This Administrative Determination shall not be effective (and shall not be recorded by the Community Development Department) until the date Applicants submit a Building Permit application (including any Earthmoving or Access Driveway Development Permit application) for the property. Applicants will be required to pay the $430 fee for a "1041 at Building Permit' prior to issuance of any such permit. In the event Applicants fail to submit a permit application and pay the foregoing fee within 12 months of the date of this Determination, this Determination shall be null and void.
