Pursuant to Subsections 3- 80- 050(C)(1)(b) and 5 -70 -040 of the Land Use Code, a 1041 Hazard Review Site Plan shall be prepared for recording as follows: A. Neat, legible black ink drawing on a 24" by 36" sheet of mylar; B. Title identifying type of review with name of owner(s) (e.g., "Smith 1041 Hazard Review Site Plan "); C. Boundaries of the parcel(s) with a survey tie in to a governmental monument or other permanent marker; E. North directional arrow, F. Date; G. Building envelope(s) and access must be depicted at a scale of no smaller than 1" _ 50' (building envelope(s) should encompass all existing and proposed development; envelopes should be designated for any utility work or septic system as well); H. Topographic information depicting 2' contour intervals within the building envelope(s) and along the access, and extending at least 10' beyond the envelope(s) and access (additional topographic information may be required on a site specific basis upon further review); I. No development is permitted outside the designated building envelope(s), other than clearing required for wildfire mitigation. Prior to commencement of any earthmoving or other construction activity, the corners of the building envelope shall be staked and construction fencing installed around the construction site within the perimeter of the building envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. All areas permanently disturbed by construction shall be revegetated with native shrubs and grasses within one growing season of the project's completion. 2. Any development located within setbacks mandated by County zoning regulations shall require a variance from the Board of Adjustment. Approval of building and access envelopes within such setbacks does not assure approval of a variance. 3. The following measures are required to avoid further impact on wildlife: a. Any dog(s) on the property must be in a fenced enclosure, kenneled, or leashed at all times when out -of- doors; for the purpose of this requirement, "electric fencing" does not constitute a fenced enclosure or kennel. b. Mesh or woven wire fences are prohibited. Any wood fencing on the property shall (i) employ 3 rails or less, (ii) be of the round or split rail type, (iii) not exceed 48" in height above ground level and 12" in width (top view), and (iv) have at least 18" between two of the rails. Wire fencing shall consist of no more than 3 strands of smooth wire and shall not exceed 42" in height. C. Approved, bear -proof Wildlife Proof Refuse Containers, as required by BOCC Ordinance # 010 -2001, "Establishing Regulations and Standards Regarding the Protection of Wildlife," shall be used on the property. The use of fruit - bearing trees and shrubs shall be avoided in connection with any new landscaping. 4. The following wildfire mitigation measures are required: %VI -IIII Defensible Space: The area around all structures (limited by property boundaries which may limit the property owner's ability to comply with this section), shall incorporate landscaping with wildfire defensible space considerations as follows, provided that actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions: a) Brush, debris and non - ornamental vegetation shall be removed within a minimum 10' perimeter around all structures. b) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a minimum of a 30' foot perimeter around a structure built on flat ground. (For greater slopes, reference CSFS Safety Zone Chart, Page 13, Wildfire Guidelines For Rural Homeowners.) C) Spacing between clumps of brush and vegetation within the 30' perimeter shall be a minimum of two times the height of the fuel. Maximum diameter of the clumps shall be two times the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. d) All branches from trees and brush within the 30' perimeter shall be pruned to a height of 10' above the ground with removal of ladder fuels from around trees and brush. e) Tree crown separation within the 30' perimeters shall have a minimum of 10' between the edges of the crowns, except for mature stands of aspen trees where ladder fuels have been removed. In areas of aspen regeneration, the spacing guidelines of paragraph (c) above shall be followed. f) All branches that extend over the roof eaves shall be trimmed and all branches within 15' of chimneys shall be removed. g) The density of fuels within a 100' perimeter of the structures shall be reduced where natural reduction has not already occurred. h) All deadfall within the 100' perimeter shall be removed. i) The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. Structural Design and Construction Requirements: Unless the wildfire expert has recommended a different method of construction due to proximity to a Severe Wildfire Hazard area, in Low and Medium Wildfire Hazard Areas, roofs shall be constructed with a Class A roof covering or a Class A assembly as defined in the International Building Code Section 1505.2. In Severe Hazard Wildfire areas, roofs shall be constructed with a roof covering of non - combustible materials installed on a Class A roof assembly. Non- combustible materials shall be one of the following: cement shingles or sheets, exposed concrete slab, ferrous or copper shingles or sheets, slate shingles, clay or concrete roofing tile, or other approved roof covering of non - combustible material. Wood shake /shingle roof coverings are prohibited. Roofs with less than a 3:12 pitch are not permitted unless they: 1) Use roof coverings constructed of non - combustible materials and installed on a Class A roof assembly; 2) Use roof coverings with surfaces that facilitate the natural process of clearing the roof, 3) Use roof designs that facilitate the natural process of clearing roof debris (protrusions above the roofline, such as parapets, are prohibited); 4) Are installed as required by the International Building Code and have a minimum slope of 1:48; and 5) Have had the roof design, covering(s), or equivalent assemblies specifically approved by the Fire Marshall prior to submittal of a building permit application. Vents shall be screened with corrosive resistant wire mesh, with mesh X" maximum. Structures shall comply with any County requirements for in -house sprinkler systems. Maintenance/Miscellaneous: a) Roofs and gutters, as well as fences, shall be kept clear of debris. Wood fences shall not connect to structures. b) Yards shall be kept clear of all litter, slash and flammable debris 3/8/06 C) All flammable materials, including firewood /wood piles shall be stored on a parallel contour a minimum of 15' away from any structure. d) Weeds and grasses within the 10' perimeter shall be maintained to a height not more than 6 ". e) Any fuel tanks shall be installed underground with an approved container. Any propane tanks shall be installed according to NFPA 48 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 -hour fire- resistive construction on the exterior side of the walls. f) Each structure shall have a minimum of one 10 lb. ABC fire extinguisher. g) The property address shall be clearly marked with 2" non - combustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non - combustible post. h) New utility lines shall be buried. 5. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. 6. In the event that the building envelope contains slopes in excess of 15 %, prior to submission of any new building permits for new development, the Applicant shall submit a mitigation report from an engineer or geologist licensed in the State of Colorado. The report shall demonstrate that the site can be engineered in such a way that there is no hazard posed, and shall show the area of disturbed slopes, any re- grading required and the size and location of all mitigation devices.
