RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF P1TK1N COUNTY,
COLORADO,APPROVING AN ALLOCATION OF A 2013 RURAL RESIDENTIAL GMQS
ALLOTMENT

RECITALS
1. On September 3'�, 2013 the Planning and Zoning Commission ("Commission") held a duly noticed
public hearing, at which time evidence and testimony were presented with respect to Urban Residential
Growth Management applications.
2. The Commission reviewed the following application for the 2013 Rural Residential GMQS competition
for additional floor area:
• Beir requesting an allotment of 2,500 square feet.
3. The Lot is located at 92 Eppley Drive and is legally described as Block 16, Lot R-90 of the Starwood
Sixteen Subdivision. PID#: 264335107002.
4. The Planning and Zoning Commission on September 3"�, 2013 adopted a motion to accept Staff's
scoring of 21 on a 7-0 vote. The application met the minimum threshold score of 20 points.
5. Pursuant to Section 2-30-40 of the Code, the Commission's scores were forwarded by Resolution to
the Board of Counry Commissioners (`BOCC") on September 11'�, 2013.
6. No appeals of the Commission's scores were filed within the required 14 day appeal period.
NOW, THEREFORE BE IT RESOLVED by the BOCC that it does hereby approve an
alloca[ion of 2,500 square feet of floor area to the Beir residence for the 2013 Rural Residential GMQS
competition subject to the following conditions:
1. These allceations are conditioned upon the Applicant's recorda[ion of a covenant documenting the
representations made in [he application and the September 3�, 2013 Planning and Zoning Commission
public hearing for the additional floor area. This covenant shall be reviewed by the Community
Development Department and, if it is found acceptable, will be approved and recorded against the
property,prior ro submittal of any pennits.
2. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in the Pitkin County Land
Use Code § 2-20-170 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall
expire on October 9'", 2016.
