This Grant is made as of the date last below sisned beriveen Pitkin County, herein referred to as
"County', and Friends of the Colorado Avalanche lnformation Center, hereafter referred to as
"A�encv'. Whereas, Friends of the Colorado Avalanche Information Center, a private non-
protit agency, promotes safety by reducing the impact of avalanches on recreation, industry and
transportation in the State throuoh a program of forecasting and education. 'The'Friends of CAIC
acts as an advocate and fund-raising agency for the CAIC.
L Term of Asreement: The term of this A��reement is from January L 2014, to December
31. 201�3.
2. Aeencv Oblieations: A�ency shall:
a) Strictly adhere to all applicable fcderal, state and local laws or reeulations that
have been or may hereafter be established.
b) Compliance �1�ith House Bill 06-1023. Perform the followin� verifications to
comply with House Bill 06-1023: Grantees who provide a benefit to persons over
the a�e of 18 years of aee and which reyuire an individual application from the
person who ��ill receive a benefit, are required to verify the applicant`s legal
presence in the United States. The verification of lawful presence requires all
applicants I 8 years of age or oldcr to:
i. Produce a valid Colorado driver's license or a Colorado identitication
card; or a United States military card or military dependent's identificaticn
card: or a United States Coast Guard Merchant Mariner card; or a Nativc
American Tribal document: and
ii. Execute an affidavit statine that applicant is a United States citizen or
legal permanent resident; or that applicant is otherwise lawfully
present in the United States pursuant to Federal law.
c) Be lawfully prohibited, pursuanc to Article 76.5 of Title 24, C.R.S., from
providing a Federal public benetit or a state or local public beneflt in violation of
para�raph (b) of this section. • �
i. Statutory Exceptions: Excepted from this requirement are the followin�
types of benefits:
A. Services for children under age 18;
B. Obtaining health care item's and services necessary for treatment of an
emergency medical condition of the person involved and not related to
an orean�transplanr, �
C. Short-term, in-kind. non-cash emergency disaster relief;
D. Public health assistance for immunizations, with respect to
immunizable diseases and for testin� and treatment of symptoms of

communicable disease, whether or not such symptoms are caused by
immunizable diseases:
E. Pro�rams, serv'ices or assistance such as soup kitchens, crisis
counseling and intervention; �
F, Prenatal care.
d) Public Grants for Services. CRS §8-175-101.

work under this Grant and will confirm the employment eli�ibility of all
employees who are newly hired for emplovment in the United States to perform
work under this Grant, throu;h participation in the E-Verify Program or the �
DepaRment program established pursuant to CRS �8-17.5-102(5)(c), Grantee
shall not knowin��ly employ or contract with an illegal alien to perForm work
�mder this Grant or enier into a �ra��t with a Subgrantee thar fails to ceitify to
Grantee that the Subgrantee shall not knowingly employ or contract with an
illegal alien to perform work under thi; Grant. Grantee:
i. shall not use E-Verify Prooram or DepaRment program precedures to
undertake pre-employment scree�ing ofjob applicants while this Grant is
being perfonned
ii. sha11 notity the Sub«rantee and the granting State agency rvithin three days
if Grantce has actual knowied�_e that a Suborantee is emplo�in�or
contractins with an ille�al alien for work under this Grant
iii. shall terminate the subgrant if'a Subgran[ee does not stop employing or
contracting wiih the illeeal alien within three days.of receiving the notice,
and
iv. shall comply «�ith reasonublc requests made in the course uf an
investigation, undertaken pursuant to CRS y8-17.�-102(�). by the Colorado
Department of Labor ancl Employment. IfGrantee participutes in the
Depamnen[program, Grantce shall deliver to the granting State aQeney,
� Institution of Hi�,her Education or political subdivision, a written, notarized
affinnaYion, aftirming tliat Grantee has examii�ed the le�al H-ork status of �
such employee, and shall comply ti i[h all of the other requirements of the
Depar[ment program. If Grantee fails to comply ��ith any requirement of
this provision or CRS §8-17.5-101 et seq.,the granting StaCe agency,
institution of hieher education or political subdivision may tenninate this
Grant for breach and, if so terminated, Grantee s'hall be Iiable for damaees.
e) The AQency shall comply with any reasonable request by the Department of
Labor and Employment made in the course of an investiaation that the
Department of Labor and Employment is under[aking pursuant to the authority
established in Subsection (5) of C.R.S. § 8-U.5-102.
fl Hold and maintain for the term hereofthe necessary licenses(s) as specified under .
Sta[e law, which permits the performance ofthe service(s) to be provided herein.

g) Shall maintain an affordable sliding-fee scale schedule for its services in order to
accommodate low-income individuals.
h) Subcontracts utilized by the Agency shall be subject to the requirements of the
Grant as listed here, and the Agency is responsible for the performance of any
subcontractor.
i) Abide by all applicable provisions of the Tide Vf and VI[ of the Federal Civil
Riehts Act of 1964, Section 504 of the Rehabilitation Act of 1973, and Title XX
of the Social Security Act of 197� as revised.
j) Maintain written requirements for safeguardina client information and comply
with the same.
k) Maintain service program records, fiscal records, documentation and other
records relevant to this Grant for the duration of the grant plus six years. The
above shall be subject at all reasonable times to inspections, review or audit by
Federal, State or County personnel, and other persons authorized in writing by the
Countv.
I) Provide the services at the location as shown as the address of the Aeency or
whatever is appropriate for that service within Pitkin County.
m) Provide the service(s) described herein at a cost not greater than charged to other
persons.
n) Provide semi-annual Performance i�leasure reports and Financial Reports. These
reports will indude the number of unduplicated clients �i�ho live and/or�vork in
� Pitkin County served by the Agency's program(s). �
i. The first repoR is nest years application. and it is due August l, 201a.
You will report your first six months' activity for 2014 H�ithin your
application. If you do not choose to reapply, you will only be required to
submit a 2014 year-end report.
ii. The second report, the yearvend report, is due Jlnuary 31, 201�, for the
entire period of the grant year. �
iii. The reports will include A��ency`s annual goals and actual results year-to-
date, as ���ell as an ezplanation of any variances observed and the steps that
are to be taken to address those variances.
3. Pitkin Countds Obli�ations: Pitkin County shall:
a) County a�rees to ,rant $7.000 to Friends of the Colorado Avalanche Information
Center as approved in the County's 2014 budget, which was approved by the
Board of County Commissioners on December 18, 2013. Grant funding will
cover approsimately 2�% of the costs of the CAIC forecasting and education
program.
b) The total amount of this contract shall not exceed $7,000 cash maximum in 201 d.
The County will pay Agency the total amount of this grant on or before the last
dny of March 2013. Payment is contingent upon receipt of mutually aereed upon
Performance Nleasures and satisfactory semi-annual reports as outlined in section
2(n) of this contract. The return of a completed contract is required in order to
� � receive payment. �

4. General Provisions
a. The Parties to this Grant intend [hat the relationship between them contemplated
by the Grant is that of independent agency. No aeent, employee, or servant
Agency will be solely and entirely responsible for its acts and Ihe act of its agents,
employees, servants and subcontractors during the performance of the Grant.
� b. Payment pursuant to the Grant, if in County, State or Federal funds, whether in
wholz or in part, is subject to and contin�ent upon the continuin� availability and
appropriation of County funds for the purpose thereof.
c. This Grant constitutes the full and complete agreement of the paRies and
supersedes or incorporates any prior written and oral a�reements of the paRies. In
addition, Asency understands that no County official or employee, other than the
Board of Coimty Commissioners actina as a body at a Board meeting, has
authority to enter into a Grantor to modify the terms of this Grant on behalf of the
County. Any such Grant or modification to this Grant must be in writing and be
executed by the parties hereto.
5. Default/Cancellstion. If Agency shall default in the performance of Aaency�s
Obligations pursuant to [he terms of this Aereement, and/or fails to provide an accounting
or use or appropriation uf monies granted in the manner in which such accountin� was
represented to the Count��, Aeency shall have the right to cure said default after w�ritten
notice b� the County of the default to Acency. If Agenc�� fails to cure such default within
sisty (60) days afler written notice is eiven from the County to Aeency specifying the
naturc of such dcfault (or if such default cannot be cured within the aforesaid period of
� time. if the A�ency shall fail to promptly commence to cure Che same and to thereafter
dili�ently proceed ��ith such cure), County shall reserve the right to cancel this
A�reement and make a demand for che return of all monies that County determines; at its
sole discretion, were not appropriated in accordance with this Agreement. Written notice
of default and cancellation shall be made to Agency by first class mail, postage prepaid
and by ceRified mail, return receipt requested, to the folloo:ine address:

6. Entire Avreement: This A�reement constitutes the full and complete Agreement of the
� parties hereto and shall not be modified except by a written agreement signed by the
parties.
