HomeMy WebLinkAboutBocc Packet 02262014 Allocation for Commercial Growth Management Competition (Cameron)MEMORANDUM TO: Board of County Commissioners Regular Meeting February 26th, 2014 ck# TI IRU: Cindy Houben, Community Development Director FROM: Mike Kraemer, Planner f V4 RE: Allocation for the 2013 Commercial GMQS Competition for Employee Generation Unit's (EGU's) SUMMARY: Section 2-30-40(h)(2) of the 2006 Land Use Code ("Code") states, "The Board shall receive the GMQS scoring from the Planning and Zoning Commission, and shall make allotments in accordance with that scoring unless an appeal has been filed pursuant to 2-20-180, in which case the Board shall hear and take action before making GMQS allotments pursuant to the scoring. If there is no appeal on the scoring, the Board shall confirm the decision of the Planning and Zoning Commission in a resolution recorded with the County Clerk and Recorder". The following development application was submitted for the 2013 competition: • Cameron: requesting an allotment of 3 EGU's for a 20,000 square feet commercial riding arena. The property is located at 8276 Snowmass Creek Road and is commonly referred to as "Moon Run Ranch". 43 EGU's are available on an annual basis for Commercial GMQS. The Commission voted unanimously to accept Staffs scoring for the application which was 28 points. The application met the minimum threshold score of 24 points. In summary, the Commission recommends allocation of 3 EGU's for the Cameron application. Pursuant to Section 2-20-180, any appeals of the scoring must be filed in writing within 15 days of the P & Z Commission's public hearing. The P & Z Commission's meeting took place on January 14`h, 2014 and Staff forwarded the scores to the BOCC on January 22'1, 2014, within the appeal period. No appeals were filed. A majority of at least a quorum of the BOCC may vote to rescore an application. Once the 15 day appeal period has expired, the BOCC shall by resolution allocate the allotments. RECOMMENDATION: Staff recommends that the Board adopt a motion to allocate the 2014 Commercial GMQS allotments to the Cameron commercial riding arena. Page 1 of I 1 o{ RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, APPROVING AN ALLOCATION OF A 2013 COMMERCIAL GMQS ALLOTMENT Resolution No. -2014 RECITALS 1. On January 14d`, 2014, the Planning and Zoning Commission ("Commission") held a duly noticed public hearing, at which time evidence and testimony were presented with respect to Commercial Growth Management applications. 2. The Commission reviewed the following application for the 2013 Commercial GMQS competition for Employee Generation Units (EGU's): • Cameron: requesting an allotment of 3 EGU's for a 20,000 square foot commercial riding arena. 3. The Lot is located at 8276 Snowmass Creek Road, is commonly referred to as "Moon Run Ranch" and is legally described as Attachment A. 4. The Commission voted unanimously to accept Staffs scoring of 28 points and recommend approval to the BOCC. 5. The application meets the minimum threshold score of 24 points as required to be eligible for an allotment. 6. Pursuant to Section 2-30-40 of the Code, the Commission's scores were forwarded by Resolution to the Board of County Commissioners ("BOCC") on January 22"d, 2014. 7. No appeals of the Commission's scores were filed within the required 14 day appeal period. NOW, THEREFORE BE IT RESOLVED by the BOCC that it does hereby approve an allocation of 3 EGU's to Cameron for the 2013 Commercial GMQS competition subject to the following conditions: 1. These allocations are conditioned upon the Applicant's recordation of a covenant documenting the representations made in the application and the January 14, 2014 Planning and Zoning Commission public hearing for the EGU's. This covenant shall be reviewed by the Community Development Department and, if it is found acceptable, will be approved and recorded against the property, prior to submittal of any permits. 2. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in the Pitkin County Land Use Code § 2-20-170 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on February 26th, 2017. Resolution No. -2009 Page 2 APPROVED ON THE 26114 day of February, 2014.
