HomeMy WebLinkAboutBocc Packet 03122014 STASH Retail Marijuana Cultivation FacilityAGENDA ITEM SUMMARY REGULAR MEETING DATE: March 12, 2014 AGENDA ITEM TITLE: Application Submitted by Shawna and Garrett Patrick d/b/a STASH for a Retail Marijuana Cultivation Facility STAFF RESPONSIBLE: Jeanette Jones, Deputy County Clerk ISSUE STATEMENT: Shall the Board of County Commissioners approve a Retail Marijuana Cultivation Facility for Shawna and Garrett Patrick dlb/a STASH. BACKGROUND: Shawna and Garrett Patrick, d/b/a as STASH, came before the board on March 4th with an application for a Retail Marijuana Store License for an establishment located at Building 300, 310 AABC and a Retail Marijuana Cultivation Facility located at 102 North River Road under the trade name of STASH. At that meeting, the BOCC approved their application for a license for a Retail Marijuana Store and continued their application for a Retail Cultivation Facility to this meeting. KEY DISCUSSION ITEMS: With respect to the application for a Marijuana Cultivation Facility License for property located on North River Road, certain requirements of the application have been met by the applicant, which are addressed in this application and/or attached to this memorandum. The outstanding issues are as follows: 1) Brian Pawl, Pitkin County Chief Building Official, has responded to his referral comment (Attachment 10 — Page 24) that the applicants are still in the permit review process and have not completed the required corrections at this point in time. Again, 1 have asked Brian Pawl to attend the meeting to discuss the corrections/permit process and further, answer any questions the board might have with respect to these compliance issues. 2) Bill Harding, Fire Marshall, Basalt & Rural Fire Protection District, has submitted a referral letter dated February 21, 2014, addressing issues that he has with respect to the cultivation facility. Mr. Harding submitted an additional letter dated February 27, 2014 updating the status of the compliance issues. Copies of both these letters are attached to this memorandum (Attachment 8, Page 21). Additionally, the applicant has responded to Mr. Harding's first letter with a "Clarification of Fire —Related Events at 102 North River Road" (Attachment 9, page 23). Staff has contacted Mr. Harding's office to ask if he could attend the hearing on March 12th, but at the time of drafting this memo I have not heard back from him. RECOMMENDED BOCC ACTION: Staff does not have a recommendation at the time of drafting this memo pending the outcome of the outstanding issues being resolved. Staff will be prepared to make a recommendation at the March 12th meeting. AMENDED LEASE AGREEMENT THIS AMENDED LEASE agreement ("Lease") is made by and between Elk Valley Ranch, LLC ("Lessor") and Good People, LLC d/b/a Stash, a Colorado limited liability company ("Lessee"). WHEREAS Lessor entered into a lease agreement with Lessee effective January 1, 2012, for a term of two (2) years; and WHEREAS Lessor and Lessee desire to extend the term of the lease for an additional two (2) years; NOW, THEREFORE, in consideration of the mutual terms, conditions and covenants contained herein, the parties agree as follows: 1. Lease. Lessor agrees to lease to Lessee the premises that were constructed for Lessee's business located at 102 North River Road, Snowmass, Colorado, and commonly referred to as the "Barn". Lessee agrees to conduct its business in accordance with all applicable laws, rules and regulations of the State of Colorado and Pitkin County, Colorado, and to continue to comply with such laws, rules and regulations. 2. Term of Lease. The term of this Lease shall be for a period of two (2) years and two (2) months, to run from January 1, 2014 through February 28, 2016. 3. Rent. Lessee agrees to pay the sum of $1,000 per month for the lease of the premises. The $1,000 shall be due and payable on the first day of each month through the term of the Lease. 4. Extension of Lease. If the Lease is extended beyond February 28, 2016, the parties agree to negotiate a fair rental value for the premises. Nothing contained herein shall be construed to be an obligation of Lessor to continue the Lease beyond its original term. 5. Default. If at any time Lessee is in default of the payments as outlined herein, the Lease can be terminated. Lessor may extend the time for payment as outlined herein, and such extension shall not be deemed to be a waiver of either the present default nor any future default. The actions of Lessor in providing indulgences as far as the payments are concerned will not be considered to be any waivers or modifications to the lease term, and Lessee agrees that any such indulgences are not waivers or modifications to the requirements of this Lease nor a waiver of any default. 6. Repairs to Premises. The Lessee agrees that during the term of this Lease and any extensions of the Lease, that it will be responsible for any and all repairs to the premises, both interior and exterior. The Lessee is responsible for all repairs to the premises. 1 �9� 7, Utilities. Lessee agrees to pay all utilities that it incurs in connection with the use of the premises, including but not limited to electric, gas, cable, monitoring and any and all other utilities and expenses in connection with the use of the premises. Such utility bills shall be paid promptly and kept current at all times. 8. Insurance Coverage. Lessee agrees to waive any and all liability of the Lessor as a result of the destruction or damage of the premises or its contents. It is understood that the Lessee will maintain all insurance coverage for the premises, including but not limited to casualty and liability insurance. To the greatest extent possible, Lessee agrees to indemnify and hold harmless the Lessor from any and all liability arising from the use of the premises and arising from any destruction or partial destruction of the premises and the contents therein. Lessee agrees to keep all insurance as it may deem desirable and required and all such expenses shall be the expenses of the Lessee. 9. Damage to Property. If at any time there is any damage to the premises that the Lessee is leasing, Lessee shall immediately repair the damage to the property and premises and restore such property and premises to the condition as existed prior to such damages. River Road — Marijuana Grow Facility Dear Brian and Garrett, As a follow-up from the correspondence received from Dave Tomecek P.E. of Hughes Associates I offer the following Condition of Pennit Letter to apply requisite IFC items to Garrett Patrick's grow operation located at 102 N. River Road. Mr. Tomecek's correspondence is attached as part of the record for this permit. Some of the items are direct requirements, others such as the interior finish may require further verification of the makeup of those existing materials in place to determine compliance. It would be acceptable to issue the permit with the understanding that this verification will be part of the ongoing construction process. Garrett you will want to have your sprinkler system contractor contact me as soon as possible to assist in expediting the alternative design process as mentioned below. The requisite items are listed in normalfont while explanatory or educational statements, based from Mr. Tomecek's correspondence and code commentary is in italics below. Automatic Fire Sprinkler System: A. The automatic sprinkler protection will need to be reconsidered, in light of the significant change in hazard and the change in use. As a commercial structure, the IFC and IBC would expect the design to conform to NFPA 13 commercial 1089 JW Drive, Carbondale, Co 8162•3 Phone:(970) 704-0675 - FAN: (970) 704-0625 www.bass(tfiremor'g design approaches. Therefore, the alternative analysis must be revisited. The Fire District will consider alternative design approaches that are developed and submitted by those qualified, (A Professional Engineer, (P.E.) with expertise in fire suppression system stamp required.), in accordance to the alternative means and methods section of IBC 104.11 and IFC 104.9. Hughes Associates States; "As with the original alternative analysis, automatic sprinkler protection with offsite notification seems appropriate, however the sprinkler system design density, which corresponds to Light Hazard protection (0.10 gpm/ft2), does not align with the hazard, which is at least Ordinary Hazard, Group 1 (0.15 gpm/ft2). With regard to the number of sprinklers that might activate, the current design considers four sprinklers operating, consistent with NFPA 13D residential design approaches. The number of sprinklers could be limited through the use of'statistical evaluations (e.g., NFPA data indicates that 96% of fires are controlled by. four or less sprinklers when the system is fully functional), use of the "small room rule" or engineering evaluation. These approaches often require other compensatory measures, such as compartmentalization, which might require replacing the existing oriented strand board (OSB) panels with fire retardant OSB or plywood to achieve something akin to fire resistance rated construction. Regardless of the alternative approach proposed, it should be developed and submitted by qualified individuals under the "alternative means and methods" methodology provided for in the IBC (Section 104.11) and the IFC (Section 104.9)." B. A certified company registered through the State of Colorado Fire Suppression Program shall complete the design and installation of the sprinkler system. A minimum of three sets of plans is required to be submitted to the Basalt Fire Prevention Bureau. The system design and submittal shall meet the requirements of the State of Colorado Fire Suppression Program, (8 CCR 1507-11), and NFPA 13. The plans will need to include underground water tank supply and underground piping as part of the submittal. Mr. Patrick's present sprinkler installation contractor is a qualified licensed fire suppression installing company and I understand may have design staff who are capable of performance based design as noted above. If not I can provide a list of those qualified. Fire Alarm System: C. The fire alarm system will require interior notification to alert the occupants in accordance to NFPA 72. A single pull station in a common location is required. A low voltage electrical permit will need to be applied through the County Building Department by a Qualified Alarm Installation Company. The permit application will need to have at a minimum a scope of work letter that list information/specifications about the current system along with battery calculation information. Flexible cords and temporary wiring: D. IFC 605.5 stipulates that extension cords and flexible cords shall not be a substitute for permanent wiring. Extension cords and flexible cords shall not... be extended through walls, ceilings or floors or under floors or floor coverings, nor shall cords be subject to environmental damage or physical impact. While it is recognized that appliances such as the grow lights do come with listed cords. Paraphrasing the comrnentary aphis provision states; as a way of limiting the use of extension cords, their use is restricted to portable appliances... such as the grow lights. The key here is to minimize the length of runs and have the cords immediately connected to a power source installed in accordance to the NEC to avoid entrapment and electrocution hazards. It is not acceptable to run these cords through walls. Emergency personnel who responded to the December 19th, 2013 fire were concerned about the hazards presented by the amount of flexible wires present and the potential for entrapment. There exist several documented fire responses to both legal and illegal marijuana cultivation. facilities reveals that the extensive use offlexible cords within these facilities results in a safety hazard to responders. Traditionally, this IFC section is in place to address the electrical fire hazards associated with such installation. The insulation offlexible cords is typically of some type of plastic with a low melting temperature. Under fire conditions, the cords can droop or fall, exposed energized wiring or separate from other equipment (e.g., transformers, connectors, etc.). Exits and exit pathway: E. IBC and IFC Section 1008.1.1 requires all door openings in commercial properties to be a clear width minimum of 32 inches, which entails 36 inch doors to be installed. The Building Official has noted this in redline on the permit set ofplans, to replace the 28 inch doors to the larger 36 inch. F. The layout of rooms and doors in the facility does not provide "a discernible path of egress travel to an exit", as required by Section 1014.2.1 to allow for egress through intervening rooms. Therefore, illuminated exit signs must be provided to provide a discernible path or additional doors would need to be installed to eliminate egress through intervening rooms. The Building Official has detailed an exit pathway with illuminated exit lights that is acceptable. G. The exit pathway shall meet egress width (Section 1005) and floor surface slip - resistance and attachment (Section 1003.4) of the IBC and IFC. Fire Extinguishers: H. Portable fire extinguishers are required to be installed in accordance to IFC Section 906 and NFPA 10. A 2A-1 OB-C is required at both the front and the rear exit at a minimum. Knox Box — Key Box: I A Knox box style key safe is required at the entry of the building in accordance to IFC Section 506.1. The pernnttee can pick up the authorized Knox Box form from the fire Prevention Bureau. Interior Finish: As of this writing the interior materials are being evaluated for their respective ratings with regards to flame spread and smoke development. In order to provide this correspondence to you in a timely manner I offer this in commentary form from which compliance can be determined post building permit issuance. In consideration of (A.) above regarding performance criteria for the sprinkler system a designer may take a compensatory approach by upgrading these materials to achieve compartmentalization. The chief concern I have received from emergency personnel during the December 19'f', 2013 incident is the use of sheet plastic on the walls and intermittent use of DOW foam boards. Mr. Tomecek in his correspondence to wit; "The contribution of heavy smoke and toxic gases from plastics is well -documented, as are the associated emergency response problems. These are exacerbated with plastic sheeting in cultivation.facilities in that the sheeting either remains in place, becoming an obstruction to firefighter movement and water discharge, or falls to the floor, becoming a tripping/falling hazard to firefighters. Wall- and ceiling -mounted plastics have the potential to drip and fall under fire conditions, increasing falling -debris hazards to responders. Floor -mounted plastics have the potential to burn or melt through, creating uneven walking surfaces with tripping hazards. It is therefore important to ensure not only compliance to the IBC and IFC, but also to verb quality installation practices for these materials to meet their ultimate safely goals." River Road, Basalt Dear Susan, Thank -you for your time yesterday to discuss Garrett Patrick's application for his facility located at 102 N. River Road. In response to Mr. Patrick's recreational license application, his many queries and our conversation regarding the licensing process l offer the following. It's an established record that the grow operation has not been in compliance since its inception. It had been previously approved for licensing administratively by the County as a medical grow facility. However, neither the County Building Department nor the Fire District were included as part of that initial process. It was during an emergency event October 22nd, 2013 that the fire district had firsthand experience with the premise and associated deficiencies toward life safety. By not having this initial inclusion the Building Department and the Fire District were prevented from doing their requisite jobs of administering the building and fire codes. As stated in earlier correspondence the scope of these codes work toward meeting criteria for life safety through national standards and good practice not only for the occupants but for emergency responders has been compromised. Consequently Mr. Patrick is going through the building permit review process that I understand has been submitted December of 2013. Upon my return to work from an extended absence in mid -January I was advised of a 2nd event, (a fire this time) that took place at the grow facility December 19th. I passed the incident report and photos on to Brian Pawl and Pitkin County Attorney John Ely January 10th for their review. Brian Pawl met me January 15th to discuss the fire event as well as ongoing code concerns with the permit review to that point, 1 was provided the building permit set of plans for further processing. L9- /) As discussed with Mr. Pawl, the fire district decided to request outside qualified expertise to review the plans and provide a risk assessment for the use. In consideration of the fire event, shared concerns from responding fire personnel regarding life safety and since marijuana as a legal use is relatively new in the building code world the international Code Conference technically hasn't caught up with occupancy determination and associated hazard risk analysis. Pursuant to international Fire Code Section 104.7.2 Basalt Fire has contracted with a Fire Engineering Protection Firm to provide the analyses and give us direction on how to mitigate the various deficiencies noted at the premise. The resultant report upon receipt will be passed onto Mr, Patrick, Brian Pawl and other interested parties to review and evaluate toward the application. Once I have assimilated the contents of the document 1 can then write the Conditions of Permit for the fire side of the permit review to be passed back to the Building Department toward finalizing the permit process. Mr. Patrick was gracious as the host for a November 14`h, 2013, onsite meeting by County Officials as well as representatives from the area fire districts. He has been very cooperative in working with us and indicates his desire to continue to work towards meeting compliance to the applicable codes. The fire district also desires to continue working with Mr. Patrick and Chief Building Official Brian Pawl towards that goal. At this time the County Administration has allowed Mr. Patrick to continue to keep his business viable until the permit application process and subsequent mitigations have come to resolution. It is within the scope of the fire district to assist Mr. Patrick and the Building Department to achieve eventual code compliance for the premise and its associated operation. It is not our place in this case to advise the County either way, whether to continue the present non- conforming situation until compliance, to allow an extension toward recreational use or deny the application altogether. This decision and the associated risks has to lie with the County and Mr. Patrick. We look forward to a final resolution to this matter. I had Western States Fire Protection consult and replace all of the faulty sprinkler heads with the correct ones. Also at this time, the fire department noticed 1 had a couple violations such as extension cords and clear all pathways to the exit doors. When they came back to do their second inspection with the county, everything had been fixed and they could find no other fire hazards. We had a second incidence with the sprinkler system. There was a defect with one of the fittings on the pipes to the sprinkler system. It became loose and leaked water. Western States came and immediately fixed the problem, and no damage was done to the facility. We purchased a machine that had a faulty motor. The motor shorted out, and melted. There was no damage done except for the machine. Since the first sprinkler went off, we have been in constant communication with Bill Harding, and he knows that I will address any fire concerns he may have. I respectfully ask the Board to consider these facts while reviewing my Retail Cultivation application. I have and always will continue to work with Local and state authorities in all matters concerning this business. We have come to a consensus on how best to handle some electrical cord concerns. This leaves the final outstanding issue being the Fire Sprinkler System upgrade. I cannot sign off on the building permit until the Fire suppression engineers and Bill Harding have completed the Sprinkler redesign. I should hear from them today regarding the final' direction for resolution of this issue. Bill Harding mentioned today that he would be amenable to issuing the License with a stipulation that Garrett has 60 days to complete the Sprinkler System upgrade. Currently, the engineer and Bill seem willing to express that the existing Sprinkler system is providing an adequate level of protection to continue operating while working on completing the necessary upgrades.
