Approval for two Temporary Construction Staging Envelopes, to accommodate construction access and staging for the addition, and a Driveway Envelope is also requested . A Transferrable Develop- ment Right ( "TDR ") will be used to accommodate the proposed addition's square footage. Vested rights status is requested for all approvals granted pursuant to this application. The application is submitted pursuant to Section 7 -10 -50 of the Pitkin County Land Use Code (the "Code ") by the William and Marie Wise I Family Limited Partnership (hereinafter "Applicant "), the owners of the property (see Exhibit 2, Proforma Title Report. Permission for Vann Associates, LLC, Planning Consultants, to represent the Applicant is attached as Exhibit 3. An executed application fee agreement and a list of property owners located within three hundred feet of the project site are attached as Exhibits 4 and 5, respectively. Project Site The project site is legally described as Lot R -14, Starwood Subdivision, the plat for which is recorded in Plat Book 2 at Page 282 in the office of the Pitkin County Clerk and Recorded. As the attached Improvement Survey illustrates (see Exhibit 6), the property abuts North Starwood Drive along its eastern boundary, and drops steadily P.O. The property contains approxi- mately 3.93 acres, and is a legally created, non - conforming lot of record in the RS- 20, Resource -20 Acre, zone district. Existing improvements to the property consist of a multi - level, four - bedroom single - family residence which was constructed in 1995. A one - bedroom detached caretaker dwelling unit was constructed on the property in 2000, BOCC approval for which was granted in 1998 pursuant to Resolution No. 98 -220 (see Exhibit 7). As the attached floor plans illustrate (see Exhibit 8), the residence and caretaker unit contain approxi- mately 8,642 square feet of floor area. Vehicular access to the residence and caretaker unit is provided from North Starwood Drive via an asphalt driveway. Parking for the residence and caretaker unit is provided in a enclosed three car garage and a covered carport, respectively. Additional parking is available within a paved and snowmelted courtyard located adjacent to the residence and garage. As the Improvement Survey illustrates, a portion of the Red Mountain Ditch consist- ing of the so- called "Upper Ditch ", "Middle Ditch" and "Lower Ditch" traverse the property from north to south. Various segments of these ditches have been replaced with underground pipelines to accommodate the development of the property. Existing vegetation in the immediate vicinity of the residence, caretaker unit and proposed addition consists primarily of aspen and spruce trees and ornamental shrubs and plantings. Proposed Development The Applicant proposes to construct an approximately 328 foot addition to the existing residence which is to be used as an art studio. As the proposed floor plan, elevations and perspective illustrate (see Exhibit 9), the addition will abut the western side of the residence and contain a small bathroom with a utility sink, toilet and shower. Access to the addition will be provided from within the existing residence. The addition's fenestration and exterior building materials will match those of the existing residence, and will include a rusted corrugated metal roof and stone walls. A metal gutter and downspout will be installed to accommodate the limited amount of runoff from the new roof area. Water for domestic use and fire protection purposes is provided by the Starwood Metropolitan District. The existing residence is sprinklered, and sprinklers will also be installed in the proposed addition. Wastewater treatment is provided via an onsite wastewater treatment system which Church OWC, LLC, Onsite Wastewater Consul- tants, has determined to be adequate to accommodate the proposed addition (see Exhibit 10). uju002 Mr. Mike Kraemer February 25, 2014 Page 3 As the gross floor area of the expanded residence will exceed 5,750 square feet, a TDR certificate will be surrendered at building permit submittal. Pursuant to Section 6- 30- 50(b)(2) of the Code, a TDR may be used to construct additional floor area on lots within the Starwood Subdivision exempt from growth management and Special Review. As a TDR permits an increase in floor area of up to 2,500 square feet, and the proposed addition is limited to 328 square feet, the unused floor area will be reserved for further use as provided for in Section 6- 70- 30(b). An Activity Envelope has been established which encompasses the existing residence, its garage, the caretaker unit and the proposed addition (see Exhibit 11, Site Plan). A separate Driveway Envelope contains the existing access driveway. A Temporary Construction Staging Envelope JCS Envelope BI) abutting the Activity Envelope is also depicted to accommodate construction access to the proposed addition. A second Construction Staging Envelope (TCS Envelope 132) encompassing a portion of the existing driveway is also proposed. All disturbed areas within the temporary enve- lopes will be revegetated upon completion of construction and the envelopes aban- doned. Review Requirements The applicable review standards for Activity Envelope /Site Plan Review approval, and the proposed development's compliance therewith, are summarized below. 1. Section 7- 20 -10: Site Preparation and Grading All grading, fill, clearing, grubbing, vegetation removal and earthmoving will be confined to the area of the proposed addition and to Temporary Construction Staging Envelope Bl. All trees with a diameter of six inches or greater located within the area of the proposed addition and within Temporary Construction Staging Enve- lope B1 to be removed will be replaced with one or more trees with a total diameter at least equal to those removed. Revegetation will utilize native or similar horticultur- al materials, and will occur no later than one year following the receipt of a Certifi- cate of Occupancy for the proposed addition. All revegetation will comply with the Pitkin County Revegetation Guidelines. 2. Section 7- 20 -20: Steep and Potentially Unstable Slopes As the Improvement Survey illustrates, the area in which the proposed addition is to be constructed contains slopes of less than 15 percent. All but a portion of the proposed construction access alignment is located on slopes of less than 30 percent. Pursuant to Section 7- 20- 20(c)(5) of the Code, an exception may be permitted through the building permit process for short driveway encroachments on slopes greater than 30 percent provided they do not exceed one hundred feet in length and are free of avalanche and rockfall hazards. The proposed construction access alignment is temporary in nature, free of natural hazards, and will be restored to pre - construction condition following completion of the addition. In the event required, a detailed alignment and grading plan for the temporary construction access route will be submitted with the Applicant's building permit application. 3. Section 7- 20 -30: Water Courses and Drainage The proposed addition and the construction thereof will have no adverse impact on the property's existing drainage patterns and runoff amounts. The area of the addition's roof is minimal, and runoff therefrom will discharge to the surrounding area via a roof gutter and downspout. Appropriate silt fencing will be provided around the down gradient perimeter of all disturbed areas. Erosion logs and /or hay bales will be placed as necessary to control erosion and sedimentation during construction. As noted previously, all disturbed areas will be revegetated. 4. Section 7- 20 -60: Wildfire Hazards The project site is mapped as lying within a low wildfire hazard area. All development will comply with the applicable wildfire mitigation standards contained in Section 7- 20 -60(c) of the Code. 5. Section 7- 20 -70: Wildlife Habitat The project site is mapped as lying within mule deer and elk winter range. The Applicant will comply with the County's applicable standards pertaining to wildlife habitat. 6. Section 7 -20 -120: Scenic View Protection Areas The proposed addition is exempt from the requirements of Section 7- 20- 120(d) of the Code pursuant to Section 7- 20- 120(c)(4)(a). The existing residence and the proposed addition thereto are not visible from either McLain Flats Road or State Highway 82. Mr. Mike Kraemer February 25, 2014 Page 5 7. Section 7 -20 -130: Landscaping and Vegetation Protection As the Site Plan illustrates, several aspen trees will be removed to accommo- date the proposed addition. As noted previously, replacement trees in an amount complying with applicable Code requirements will be installed within one year of the receipt of a Certificate of Occupancy for the addition. All areas disturbed during construction will be revegetated with native or similar horticultural materials. 8. Section 7 -20 -140: Lighting The proposed addition will not contain exterior lighting. Compliance with this section of the Code, therefore, is not required. Should you have any questions, or if I can be of any further assistance, please do not hesitate to call. Starwood Drive Pitkin County, Colorado Job No. 8998 Mr. Habermann, As requested, CHURCH Onsite Wastewater Consultants, LLC (COWC) performed a site visit to observe the onsite wastewater treatment systems (OWTS) at the subject site. Church & Associates Inc. prepared OWTS design documents under Job No. 8052 dated September 3, 1999 for the caretaker unit on the property. Church & Associates also designed and monitored the OWTS for the main residence. COWC has not been able to locate the design documents for the main residence. Mr. Todd Habermann, of Todd Habermann Construction provided the information that the original trench configuration drainfield designed by another engineering firm failed shortly after occupancy and a non - pressurized drip dispersal system (NDDS), that was experimental at the time, was installed to the north of the residence. The NDDS system has functioned without any issues. PROPOSED CONSTRUCTION An addition to the main residence including an additional bedroom is proposed. The residence currently has 4- bedrooms and is >6,000 SF. The average flow for a five bedroom home with greater than 6,000 SF of total living area is 1,000 gallons per day (gpd). The average percolation rate recorded in the 1999 design for the caretaker unit, near the NDDS for the main residence was 33 minutes per inch. The required area for a five- bedroom residence with a percolation rate of 33 minutes per inch (MPI) would be 1,000 gpd x 1.5 x 1.6 x 1.17 x 0.75 / 0.36 = 5,850 SF. If we assume that a slower percolation rate was used for the design due to the failure of the original OWTS the NDDS, the required area for a five- bedroom residence with a percolation rate of 110 MPI would be 1,000 gpd x 1.5 x 1.6 x 1.17 x 0.75 / 0.22 = 9,573 SF. OBSERVATIONS A site visit was performed on November 35, 2013, at the request of Todd Habermann, of Todd Habermann Construction. At the time of the site visit, the original OWTS and repair NDDS OWTS for the residence were observed. The OWTS for the caretaker unit was also observed. The existing NDDS system was measured to be 9,600 SF. There were twelve 2 -inch observation ports, one for each 4 -feet by 100 -feet section. There was no indication of any existing or past surfacing effluent in the drip field area. P.O. The integrity and capacity of the existing septic tanks should be determined and the septic tanks should be pumped and effluent filter cleaned. If there is no effluentfilter, one should be installed. If additional septic tank capacity is required a design for the addition can be completed at that time. A test pit can be excavated and evaluated at the time of construction to verify the subsurface conditions near the existing OWTS. If at that time the percolation rate is determined to be slower that 110 MPI the original OWTS for the main residence including five rows of chambers in the backyard of the main residence still exists and could be plumbed to receive a portion of the effluent from the main residence. CONCLUSIONS COWC believes that the NDDS field for the residence is adequate for a five bedroom residence and that subsurface conditions can be verified in the spring. If subsurface conditions indicate that the NDDS field is not adequately sized the existing original chambered drainfield trenches can be incorporated into the design. This letter provides information from observations made during one visit to the subject site by COWC. COWC observed installed components of the OWTS from the ground surface. COWC did not observe the installer's methods or the equipment selected by the installer and /or client.
