Vos Caudill, Pitkin County, CO RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, GRANTING APPROVAL FOR THE BURKHOLDER INVESTMENTS LTDNERIZON WIRELESS SPECIAL REVIEW FOR BUILDING MOUNTED CELLULAR TELEPHONE ANTENNAS BOCC Resolution No. el3;1-2014 RECITALS Burkholder Investments/Verizon Wireless ("Applicants") have applied to the BOCC for Special Review approval for Building Mounted Cellular Telephone Antennas. The Applicants propose to expand the existing use of six (6) omni/whip antennas that are approximately 6' in height and 2" in diameter to eight (8) omni whip antennas that are approximately 7' in height and 4.6" in diameter. Mounting brackets and hardware make the antennas approximately 9' in maximum height. Overall height of the building and upgraded antennas will be a maximum of 31 W'. Equipment associated with the upgrade will be located on the top of the roof in three (3) equipment boxes. One (1) additional cabinet and one (1) surge suppressor will be added to the equipment room inside the building. 2. The property is located at 301 AABC Unit B and is legally described as Block I, Lot 3, Filing 1 Aspen Airport Business Center. The building is currently in use as the Aspen Animal Hospital. PID#:264334405053. 3. The property is zoned B-2 and contains 23,837 square feet 4. The BOCC heard this application at a duly noticed public hearing on March 12"i, 2014, at which time evidence and testimony were presented with respect to this application. 5. The BOCC finds that the proposed upgrade to the existing building is appropriate and does not have any substantial visual impacts on the surrounding area. 6. The BOCC finds that the proposal is consistent with the applicable master plan and the Special Review Criteria in Land Use Code Sections 2-30-30(h), 2 -40 -20(a -c), and 4-30-50(c). NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners that it hereby grants approval to the Burkholder Investments/Verizon Wireless Special Review for Building Mounted Cellular Telephone Antennas subject to the following conditions, which shall run with the land and be binding on all successors in interest: The Applicants shall adhere to all material representations made in the application and public meetings. 2. The Applicants shall submit for review a Building Permit for the antennae expansion. At Building Permit submittal, the Applicant shall also submit proof of all necessary FCC permits/licenses for the approved antennas. The Applicants shall comply with all requirements of the Aspen Fire District for the upgrade of the interior equipment room. Resolution No. Q7 -2014 Page 2 4. The cellular facility shall comply with the Pitkin County Noise Code. 5. The Applicants, owner and/or operator of the cellular facility shall maintain current at all times, complete contact and site information to be kept by the Community Development Director. This information shall include, but is not limited to the following: a. Identity, including name, address and telephone number including official identification numbers and FCC certification, and if different from the owner, the identity and contact information of the person or entity responsible for operating the facility. b. Name, address and telephone number of a local contact person for emergencies. c. Type of service provided. d. This contact information shall also be posted on the door of the equipment room within 60 days of this approval. 6. The approved roof mounted antennas shall not exceed 9' in height measured from top of roof. 7. The antennas shall be painted with a color that blends' with the existing structure and shall be maintained in a condition free of rust, peeling paint and/or other visible forms of deterioration. 8. All antennas associated with the telecommunication use shall be removed when the use ceases. 9. There shall be no exterior lighting associated with the antennas. 10. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in the Pitkin County Land Use Code § 4-140 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on March 12'h, 2017.
