MEMORANDUM TO: Board of County Commissioners Regular Meeting — April 9t', 2014 THRU: Cindy Ho�mmum - Development Director FROM: Mike Kraemer, Planner p4< RE: AT &T/Ives Special Review for a Cellular Telephone Facility SUMMARY: The Applicant is requesting a Special Review approval to expand an existing cellular telephone facility. The proposal would add an additional 27' stealth (tree camouflage) cell tower to the site and a 185 square foot building to contain equipment for the tower. OWNER: Ray Ives APPLICANT: AT &T REPRESENTATIVE: Tom Alexander, consultant for AT &T LOCATION /ZONING/LOT SIZE: 2147 Lower River Road/AR- 10/-14 acres 2011 AERIALPHOTOGRAPHY: 000001 '1 13 Page l of & REFERRAL COMMENTS: The application was referred to the Aspen hire Protection District and the Woody Creek Caucus. No comments were received from Aspen hire Protection District. The Woody Creek Planning Commission responded and had no objection to the application. PRIOR APPROVALS AND EXISTING CONDITIONS: The subject property contains a single family residence and an accessory outbuilding that were built sometime in the 1970's. In 2000, T- Mobile was granted approval to construct a 25' tall, free standing tower that holds four (4) antennae and equipment shed approximately 300' north of the Ives residence. Both the tower and equipment shed are brown and can been seen in the picture below. In 2006, T- Mobile gained BOCC approval to extend use of the cell tower facility indefinitely. Additionally in 2006, the subject property was granted approval for an additional 28' free standing mono- pole cell tower camouflaged as a conifer tree, for the Sprint/Nextel Company. This pole is visible in the picture below and is identified as the large conifer tree to the right of the brown equipment shed. Lequipment o existing cell towers and associated shed - looking south e r River Road. 02.12.20 1 B:03 The subject property is located adjacent to sensitive big game ranges to the north. Both previous cell tower resolutions granted approval of the facilities with specific conditions regarding limitations on the dates of construction in effort to not disturb important late season winter ranges. If an approval would be granted for the subject request, these conditions would be carried forward in a resolution. Page 2 of 8 SPECIFIC PROPOSAL: The Applicant is desirous of gaining Special Review approval to construct a third tower on the property. The tower is stated to be a maximum of 27" in height and will be camouflaged as a conifer tree, similar to the existing tower in the picture on the previous page. An additional equipment shed of approximately 185 square feet is also proposed. The proposed tower and equipment shed would be located just north of the existing facility. The Applicant states that this location is strategic, and an upgrade of the facility through a third tower will provide improved cellular coverage in this area of the Roaring Fork Valley. STAFF COMMENTS: SPECIAL REVIEW CRITERIA: Section 2- 30 -30(h): A telecommunication facility is considered a Special Review Use within the AR -10 zone district and is subject to the compliance with the following criteria: A. The special review use shall be consistent with the applicable Countv Master Plan. Response: The subject property is located within the Woody Creek Caucus and is subject to the Woody Creek Master Plan. The Master Plan does not make mention of cell towers specifically. Additionally, statements and policies in the Plan would not prohibit a cell tower proposal. B. The special review use shall not conflict with any applicable sections of the Pitkin County Land Use Code, including the County Land Use Policies in Chapter 1. Response: The proposed development is consistent with applicable Sections of the Code. Sec. 1 -60 -360 of the Code relates to Telecommunications. It states: The County encourages adequate, minimal impact regional and community telecommunications facilities to serve the needs ofgovernments, emergency services, businesses, and citizens ofPitkin County. 1. Where a telecommunications system utilizes a network of facilities, a comprehensive approach should be taken for evaluating potential sites in Pitkin County with a view to minimizing the number of sites required and any adverse impact. 2. When feasible and not otherwise detrimental, multiple telecommunications facilities should be consolidated onto common towers, and /or located adjacent to, on or incorporated into existing or proposed buildings or other structures. The proposal to construct an additional pole reduces impacts associated with a new location, while providing continuation of an already in place network. Offsite impacts at this location will be minimal. C. The proposed development must not materially endanger the public health, safety or welfare. Response: Staff has no information that would indicate that the development materially endangers the public health, safety or welfare. The proposed continuation and expansion of the facility is intended to serve the public health, safety and welfare by utilizing existing communications facilities and services. D. The proposed development must not substantially injure the value of adjoining or abuttingproperry. Response: Staff has no information that would indicate that the development would injure the value of adjacent properties Page 3 of 8 UJO003 E. The special review use shall be consistent with the intent of the zone district in which it is proposed to be located. Response: The stated intent of the AR -10 Zone District in Chapter 3 of the Land Use Code does not make mention of the use of cell towers. Regardless, the facility is a one -step Special Review to the BOCC which has the discretion to approve, approve with conditions, or deny this request. F. The special review use shall be compatible with the character of the immediate vicinity of the parcel proposed for development and surrounding land uses, or shall enhance the mixture of complimentary uses and activities in the immediate vicinity of the parcel proposed for development. Response: The character of the immediate vicinity is primarily rural residential development. The proposed expansion of this use is consistent with this area. The cell facility will not generate onsite employees. G. The location, size, design and operating characteristics of the proposed special review use must be in harmony with the surrounding area and minimize adverse effects, including visual impacts, impacts on pedestrian and vehicular circulation, traffic generation, parking, trash, service delivery, air /water pollution or other impacts on natural resources, noise, vibrations and odor on surrounding properties. Response: The current tower has minimal visual impacts on the surrounding environment. The existing facility is discernable from Hwy 82 or Lower River Road, designated scenic corridors, but does not negatively impact the scenic quality of the area. The additional tower will have the same effect. The proposal will not adversely affect pedestrian or vehicular circulation, parking, trash, service delivery, noise, vibrations, and odors on the parcel or surrounding properties. H. There must be adequate public facilities and services to serve the special review use, including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection, emergency medical services, hospital and medical services, drainage systems, and schools. Response: The location currently provides adequate services to support the use. SPECIAL REVIEW USE: Section 2- 40_20(C) Special Review Use Limitations under the Pitkin County Land Use Code include: A. Commencement of Operation: Approved special uses shall begin within three (3) years following the date of approval of the development permit, unless a longer period is specified, or the approval shall become null and void. B. Special Review Use: The decision making body may approve a special review use subject to a limited time period during which a use may operate. C. Submission of Annual Report and Review of Annual Reports: The decision making body may require any person operating pursuant to a special review use to submit a statement to the Community Development Director attesting to the continued conformance of the use to the conditions of the approval. If after reviewing the statement, inspecting the site and considering any other relevant materials, the Community Development Director determines that the use is in conformance with the provisions of the Special Review Use approval, the use may continue pursuant to the provisions of approval. If the Community Development Director determines that the use is not in conformance with the provisions of the Special Review Use approval, the Community Development Director may Page 4 of 8 00J004 recommend to the original review authority that it consider the withdrawal of such approval. Failure of any person operating a use under a Special Review Use approval to submit such a statement within the period specified above shall be considered a violation of the provisions of the special review approval and may be sufficient cause,for withdrawal of the approval D. Approval Withdrawal Procedure: The decision- making body shall consider and act on approval withdrawal after a public hearing. Notice of the public hearing shall be mailed to the applicant and published in a newspaper of general circulation in the County not later than thirty (30) days prior to the hearing. The notice shall state the time, location and subject matter of the hearing. E. Approval Expiration: Any Special Review Use shall expire after any continuous twelve (12) month period of non -use. Any unfislftlled obligations of the approval shall continue to be binding after expiration of the approval. Response: The Applicant shall abide by all limitations of the Land Use Code. USE SPECIFIC STANDARDS FOR A CELLULAR TELEPHONE FACILITY: Section 4-30- 42(gh the following standards shall be reviewed for compliance: (1) Principal Use of the Land A cellular telephone facility is a principal use of land, but may be located on a legally created lot or parcel without the need to include any additional acreage for the second principal use. Staff Response: Staff acknowledges that this is a principal use of land and that other principal uses may be located on the subject property (2) Building - Mounted Antennae and Towers Building- mounted antennae and towers are an accessory use of the land permitted pursuant to Sec. 4-10 - 10(e). Staff Response: There are no building mounted antennas proposed with this application, only an additional free standing tower and equipment shed is proposed at this time. (3) Freestanding Towers A non - stealth, freestanding tower shall not be located within two hundred (200) feet of an existing urban /suburban residential district. Freestanding non - stealth telecommunication towers located more than two hundred (2 00) feet from an urban /suburban residential, commercial, or special purpose zone district nury be permitted through special review. The maximtnn permitted height for freestanding towers is forty (40) feet. Staff Response: The existing facility and proposed tower and shed will comply with the 200' setback from a residence. The tower is proposed to be 27', in height and is well below the maximum 40' height limit. (4) Co- Location Required Each new tower shall be designed to accommodate one (1) additional riser's equipment. Page 5 of 8 °�� 05 Staff Response: The Applicant states that they will design for co- location. (5) Setbacks All towers, both concealed and not concealed, shall be set back front all existing dwellings and other urban /suburban zone districts property by a minimum of two hundred (200) feet, or at least two (2) times the height of the proposed tower, whichever is greater. All towers, both stealth and non - stealth, in a business, commercial, or special purpose zone district shall be set back a distance equal to the height of the proposed tower from the property boundary or rights -of- way, whichever would require the larger setback. Staff Response: The proposed tower is 27' making the 200' setback more restrictive. As stated earlier, the proposed facility will comply with required setbacks. (6) General Development Standards (a) Design and Neighborhood Compatibility (I) The exterior appearance of all towers and associated support structures and buildings shall be compatible with other buildings and /or the natural environment in the surrounding area. Staff Response: The proposed tower will be camouflaged as a conifer tree that will be visually compatible with the surrounding area. (2) The Board may require the applicant to apply to the Federal Aviation Administration (FAA) for compliance with FAA standards for a dual lighting system rather than a red and white marking pattern, when the Board determines such a markingpattern would cause aesthetic blight due to the visibility of the tower. Staff Response: No specific FAA standards apply to this height and location. (3) Support buildings located in any residential district may not be used as an employment center for any worker. This provision does not prohibit the periodic maintenance or periodic monitoring of equipment and instruments. Staff Response: The Applicant understands this condition. (4) No advertising sign or logo shall be permitted on any telecommunications facility. Staff Response: The Applicant understands this and there is no advertising at this location. (5) The decision- making body may require any other conditions to mitigate the impact of the tower on adjacent properties and uses. Staff Response: The Applicant understands this condition. (b) Buffering and Screening (1) All fences and walls shall be screened with landscaping meeting the requirements of Sec. 7-20 - 130(d)(2)(a). OUL006 Page 6of8 Staff Response: There are no fences or walls associated with this tower. The Applicant has shown a site plan that incorporates landscaping screening in the form of pine trees that will aid in screening the development. (2) The Board may require all antenna(ae) be appropriately screened to safeguard surrounding property provided that such screening will not interfere with the transmission and /or reception capabilities of any antennae located on the tower. Staff Response: The branches from the camouflaged conifer will screen the antennae. Additional screening of the antennae is at the BOCC's discretion. (3) Output power levels from the tower and/or all associated antennae shall not exceed the current federally approved levels for the tower as a whole for exposure to electromagnetic radiation. Staff Response: The Applicant understands this condition. (4) Radio, television, or other electromagnetic transmission(s) or reception on other properties shall not be disturbed or diminished. Staff Response: The Applicant has provided a letter in the submittal that states compliance with this standard. (7) Existing Towers New antennae may be co- located upon towers that exist on the 5th of July, 2006 without the need to obtain a separate special review approval. Staff Response: The Applicant has stated that co- location could occur on this existing tower. (8) Outside Experts and Disputes (a) Siting of telecommunications facilities may involve complex technical issues that require review and input by outside experts. Staff may require the applicant to pay the reasonable costs of a third party technical study of a proposed facility. Selection of expert(s) to review the proposal shall be at the sole discretion of the decision - making body. Staff Response: The Applicant is aware of this standard. (b) If an applicant for a telecommunications facility claims that one or more standards of this section are inconsistent with federal law as applied to a particular property, or Kould prohibit the effective provision of wireless communications within the relevant market area, the decision- making body may require that the application be reviewed by a qualified engineer for a determination of the accuracy of such claims. Any costs shall be charged to the applicant. Response: The Applicant is aware of this standard. 00 JJ07 Page 7of8 RECOMMENDATION: Staff recommends that the BOCC approve the AT &T/Ives Special Review for a Cellular Telephone Facility subject to the conditions in the attached Resolution. None. 00,0008 Page 8of8 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PI TKIN COUNTY, COLORADO, GRANTING APPROVAL FOR THE AT&TITVES SPECIAL REVIEW FOR A CELLULAR TELEPHONE FACILITY BOCC Resolution No. -2014 RECITALS 1. AT &T/Ray Ives ( "Applicants ") have applied to the BOCC for Special Review approval to expand an existing cellular telephone facility. The expansion includes construction of a 27' cell tower camouflaged as a conifer tree and a 185 square foot equipment shed. 2. The property is located at 2147 Lower River Road and is legally described as Lot 8 -A, Aspen River Valley Ranch. The property is approximately 14 acres and is located within the AR -10 zone district. 3. The BOCC heard this application at a duly noticed public hearing on April 9"', 2014, at which time evidence and testimony were presented with respect to this application. 4. The BOCC finds that the additional tower and equipment shed is appropriate and does not have any substantial visual impacts on the surrounding area. 5. The BOCC finds that the proposal is consistent with the applicable master plan and the Special Review Criteria in Land Use Code Sections 2- 30- 30(h), 240- 20(a -c), and 4- 30- 50(c). NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners that it hereby grants approval to the AT &T/Ives Special Review for Cellular Telephone Facility subject to the following conditions, which shall run with the land and be binding on all successors in interest: I. The Applicants shall adhere to all material representations made in the application and public meetings. 2. The property shall continue to comply with all conditions of BOCC Resolution No's. 206 -2000, 146- 2006, and 147 -2006, as amended. 3. The Applicants shall submit for review of a Building Permit. At Building Permit submittal, the Applicant shall also submit proof of all necessary FCC permits /licenses for the upgraded equipment. 4. The cellular facility shall comply with the Pitkin County Noise Code. 5. Due to sensitive big game ranges, no construction of the approved improvements shall occur from December I't to March 31". Additionally, no access to the site shall be allowed during this timeframe, except for emergency purposes. 6. The Applicants, owner and/or operator of the cellular facility shall maintain current at all times, complete contact and site information to be kept by the Community Development Director. This information shall include, but is not limited to the following: 0000®? Resolution No. -2014 Page 2 a. Identity, including name, address and telephone number including official identification numbers and FCC certification, and if different from the owner, the identity and contact information of the person or entity responsible for operating the facility. b. Name, address and telephone number of a local contact person for emergencies. c. This contact information shall also be posted on the door of the equipment room within 60 days of this approval. The tower shall be painted dark green, be camouflaged as a conifer tree, and shall look substantially similar to the representation made in the hearing and as viewed in Attachment A. The new equipment shed shall be of a color that matches the existing equipment shed. The tower is limited to 27' in total height. 9. All equipment associated with the cellular facility shall be removed when the cellular use ceases. 10. There shall be no exterior lighting associated with the tower or equipment shed. The proposed location is in a AR -10 zoning district and meets all setback requirements. Additionally, this location is an existing telecommunications site which currently has on site a T- Mobile telecommunications facility and a Sprint /Nextel stealth monopine telecommunications facility. The proposed stealth facility will hold the antennas and the associated equipment shelter will be on the ground in a 12'x16' shelter painted to match the surrounding foliage. Additionally, even though the telecommunications site is no visible from Lower River Road or Highway 82, we will also be landscaping foliage that will additionally hide the equipment structure. AT &T has explored other location in the area, however, none are available within the required search ring and would not be compatible from an engineering and technical nature for their existing and future facilities in Pitkin County. AT &T selected this site to work with the existing and proposed locations that will meet the RF requirement and design of other facilities within the AT &T network and Pitkin County. This location is necessary component of AT &T's overall communication network and is integrated into a coordinated communication service that will provide improved coverage though the Lower River Road area and Highway 82. This installation will increase and enhance service for the citizens and visitors of Pitkin County as well as emergency services along Highway 82. This site will also allow for enhanced E -911 coverage. In an attempt to enhance services, and to comply with our FCC mandate, we first looked at Co- locating on either one of the existing towers on this property. The T- Mobile Site is not structurally built to carry another tenant, and the Sprint Nextel Site is both not tali enough for us to co- locate on, but also, due to the underlying lease agreement with the Land owner and Sprint Nextel, it is not allowed. 0 00001 4 Section 2 -30 -30 One Step Review Criteria: Due to the fact this is an existing /approved telecommunications site located in Pitkin County, this project qualifies for the One step review criteria. APPLICANT understands and agrees that Pitkin County Ordinance No. 30 -2009 establishes a fee structure for land use applications and the payment of all processing fees is a condition precedent to a determination of application completeness. The fee structure is based on the COUNTY'S policy that development shall pay, in full, the cost of development review in the COUNTY. Fees have been set to be consistent and fair to the public and to reflect the expense incurred in providing such services to the public. 3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed PROJECT, it may not be possible at the time of application to ascertain the full extent of the costs involved in processing the application. 4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications shall accumulate if an application includes more than one type of land use review. 5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete processing or present sufficient information to the Planning Commission and/or Board of County Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally required findings for project approval, unless current billings are paid in full prior to decision. 6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to collect full fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the amount of $ which is based on — hours of staff time, and if actual time spent by staff to process the application exceeds the average number of hours by more than 20 %, then the COUNTY will bill the APPLICANT quarterly for the additional time spent. Such periodic payments shall be made within 30 days of the billing date. APPLICANT further agrees that failure to pay such accrued costs shall be grounds for suspension of processing.
