Bernard F. Rogers, Aspen Rogers Ranchers, Inc. and Full Recovery Partners, (hereafter "Applicants) have requested that the Planning and Zoning Commission of Pitkin County (hereafter "Commission ") grant approval for a Subdivision Exemption for a lot line adjustment between Parcels A, B and C as described in the attached exhibits A, B, C, and D and exhibits 1, 2, and 3. The lot line adjustment is pursuant to Section 4- 2.2(a)2 of the Pitkin County Land Use Code. 2. The County Attorney's Office has determined that no merger has occurred between the subject properties. 3. Parcel C has existing legal access off of Woods Road. In order to avoid substantial litigation, my clients have elected to resolve this litigation by agreeing to quit claim this strip of that property to the neighbor in exchange for a parking easement. The net affect of the preceding is that lot 2, although it will still be a conforming lot, will be slightly different than the lot reflected in the initial application. The Applicants wish to create two parcels from three existing contiguous parcels. Of the three parcels, one of the two smaller lots is owned individually by Bernard Rogers and the other is owned by Aspen Rogers Ranches, a Colorado corporation whose stock is held by Bernard Rogers and his four sons. The third and largest parcel is owned by Full Recovery Partners, Inc., a Colorado corporation whose stock is owned by Mr. Rogers four sons. The proposed lot line adjustment would involve combining the two smaller lots and adding .82 acres from the larger lot to create one parcel that is 2.34 acres in size. The second parcel, which is currently 12 acres in size, would be reduced to 11.18 acres in size. Section 6 -6(d) of the Land Use Code gives the Planning Commission final approval authority for lot line adjustments requested pursuant to Section 4- 2.2(a)2 of the Code. APPLICANTS: Bernard F. Rogers, Aspen Rogers Ranchers, Inc. (Mark H. Rogers, President) and Full Recovery Partners, Inc. (Mark H. Rogers, President). APPLICANT'S REPRESENTATIVE: Michael J. Herron; Garfield and Hecht, P. C. LOCATION: The subject properties are located in the Woody Creek area, between SH 82 and the Roaring Fork River. The parcel owned by Full Recovery Partners, Inc. is known by street and number as 114 Woods Road, Woody Creek, Colorado 81656. ZONING: AF -10, ten acre minimum lot size BACKGROUND: The property referred to as "Parcel A "(see Exhibit #1 for parcel locations) was purchased individually by Bernard F. Rogers from Marguerite D. Stewart on May 20, 1988. The property referred to as "Parcel B" was purchased by Aspen Rogers Ranchers, Inc. from Susan Parkinson and Paul Stern on May 13,1988. The property referred to as " Parcel C" was purchased by Full Recovery Partners, Inc. from Gould Properties on October 15, 1992. In conversations with Mickey Herron, it was learned that there 000016 %.. r currently exists one single - family residence on Parcel A and one single - family dwelling on Parcel C. Mr. Herron also indicated that there is a "partially completed studio" on Parcel B. One of Staff's primary concerns in this case was whether merger had occurred between the various parcels. This issue was examined by the Assistant County Attorney and is summarized below and is his referral memo. REFERRAL AGENCIES: Referral Agency comments are attached for reference. 1. COUNTY ATTORNEY: This case was reviewed by John Ely, Assistant County Attorney and he has indicated that the parcel owned by Full Recovery Partners, Inc. is indeed a separate legal entity and therefore has not merged with either of the other two subject parcels. The conclusions of the County Attorney's Office would seem to be based on the determination that Bernard F. Rogers is not legally associated with Full Recovery Partners, Inc. and therefore not subject to Cumulation under Section 7 -2.3 of the Land Use Code. It should be noted that the Applicant, Bernard F. Rogers, has indicated his address to be P.O. Box 176 Woody Creek, Colorado and that a submitted Warranty Deed lists the same address for Full Recovery Partners, Inc. 2. ZONING OFFICE: Joanna Schaffner has reviewed this application and has pointed out that the submitted parcel maps do not indicate two conforming size parcels after the proposed lot line adjustment. The current zoning requires ten acre minimum lot size to be conforming. Joanna also indicated that a building application was denied for an existing playhouse(also referred to as an "unfinished studio ") because it was located in the required 100 foot front 'yard setback. The Applicant then purchased the adjacent property and given the access on the adjacent parcel, the playhouse no longer lies within the 100 foot setback. 3. ENVIRONMENTAL HEALTH DEPARTMENT: The Environmental Health Department reviewed this application and haD no concerns regarding the proposed lot line adjustment. SUMMARY: Staff finds that the Applicants' request complies with the requirements of Section 4- 2.2(a)2 of the Code. The proposed lot line adjustment results in a reduction in the number of lots in this area. The existing conforming lot (Parcel C) will not be made non - conforming by this action. In addition, the two non - conforming parcels (Parcels A and B) will be made less non - conforming by being combined into one parcel (proposed Lot 2) and having additional 000017 EM W land (.82 acres) added to them from Parcel C. RECOMMENDATIONS: Staff is recommending approval of the Rogers Subdivision Exemption for a Lot Line Adjustment pursuant to Section 4- 2.2(a)(2) of the Code subject to the following conditions: 1. The Applicants shall submit a 24" x 36" mylar plat map to the Planning Office for recording, depicting the following: - The proposed and current lot lines that are to remain, with accurate dimensions and bearings; - building envelopes with all existing structures; - a general vicinity map which locates the subject parcels in relation to the surrounding area; - all access roads and easements associated with both parcels. - The plat shall delineate the front lot line for Lot 1 for the purpose of measuring setbacks. 2.
