RESOLUTION OF THE PITKIN COUNTY, COLORADO BOARD OF ADJUSTMENT GRANTING AN ARTERIAL HIGHWAY SETBACK VARIANCE FOR 31925 Highway 82, Aspen Resolution No. 03 -2013 WHEREAS, Mountain Rescue Charitable Trust, owner of 31925 Highway 82, is requesting approval of a 118 foot Arterial Highway setback variance where 200 feet is required for this I acre parcel in the P -I zone district, for the construction of a new rescue facility; and WHEREAS, the property is more fully described in Exhibit A; and WHEREAS, the Board of Adjustment is vested with the power to grant or deny such variances by virtue of Section 2- 10 -30(d) of the Pitkin County Land Use Code; and, WHEREAS, based on the evidence presented, the Board of Adjustment makes the following findings: 1. Proper notice procedures, including the notification of all adjoining property owners, has been shown by the applicant. 2. The required hardship or practical difficulty has been established. 3. Granting such relief will not cause substantial detriment to the public welfare and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment that a 118' Arterial Highway Setback variance be granted for the facility shown on Exhibits B and C due to downzoning. However, this variance shall only be effective once the existing Notice of Violation on the property pertaining to demolition issues, has been resolved as determined by the Community Development Director or her designee. WARNING: Any violation of the terms of this resolution may result in rehearing and possible revocation. Joanna S. Schaffner, Zoning Officer and Acting Secretary Head opened the meeting at 5:30pm. MINUTES: Brewster - McLeod moved to approve the minutes from the February 8, 2013 meeting. Head seconded the motion and Brewster - McLeod, Rifkin and Head voted to approve. Hmielowski had not yet arrived at the meeting. 02 -2013 AML Investments IV Lot 1, George Family LLC Subdivision Aka 76 Placer Lane, Aspen Shane Evans and Fred Wilson, (Structural Associates) were present to represent the owner in a request for a 6" height variance for a fence constructed without a permit within the front yard setback. The lot contains 1.718 acres and is located in the R -30 zone district. Rifkin stated that Structural Associates was his builder on two homes. Brewster- McLeod also stated that she works with Structural Associates. Head asked if they believed that they could deliberate without prejudice. They both stated "yes ". The Affidavit of Posting was submitted. There were no members of the public present to comment on this application. Hmielowski arrived at approximately 5:32. Evans and Wilson showed the Board a survey, site plan, photos, and height analysis of the existing fence. The fence as constructed was measured from the curb, not the existing grade. The maximum height above the allowed 6 feet is 6 inches. The neighbor to the East, Mr. West, has requested of the applicant that changes be made to the fence to mitigate its height. Evans and Wilson showed the Board a revised fence based on the comments from West, and presented his approval in writing on the plan. 000005 .W1 .,.,1 Rifkin asked if there were any other objections. Schaffner said "no'. Brewster - McLeod said that it was helpful that West signed off on the fence and that the applicant made an attempt to lower the fence before appearing before the Board. Rifkin moved to approve the request based on topographic hardships. Brewster- McLeod seconded the motion and all voted in favor. 03 -2013 Mountain Rescue Charitable Trust 31925 Highway 82, Aspen Patrick Rawley (Stan Clausen Associates, Inc), Charles Cunniffe and Brian Heffner (Charles Cunniffe Architects) were present to represent the owners in a request for a 1 1 E foot Arterial Highway setback variance where 200 feet is required in the PI zone district for the construction of a new rescue facility. The parcel contains 1 acre. The Affidavit of Posting was submitted. The applicant has been cited by the Building Department to Stop Work on demolition without a permit. The County Attorney's Office has offered language in the event the Board wishes to grant approval of this request. Brewster- McLeod read the email from Assistant County Attorney, Chris Seldin into the record: "The Board of Adjustment finds and concludes that the applicant has sufficiently satisfied the standards and other criteria necessary for approval of the requested variance. The Board authorizes issuance of the variance approval, however, only once the Community Development Director or her designee certifies that the applicant has resolved the existing Notice of Violation affecting the property." Rawley presented the Board with a survey, site plans, and photos of the proposed structure situated on the site. He stated that the property is not as deep as the setback requires. He explained that the violation is expected to be resolved within a few days. The hardship is shallowness of the site. The proposed structure is in the same location as the existing structure and will maintain the same setback. Cunniffe added that the porch section of the building has been designed to mimic the existing Mountain Rescue cabin. Also, the highway entrance will be closed off and access will be taken from Aspen Road. Head commented that this site was a good location for the Use. Jeff Ellison commented that he met with the surrounding property owners, and all were supportive. Cavenaugh and Blanca O'Leary were present to support the application. Ms. O'Leary stated that she is "just a citizen" but that she favors the proposal because it is in a good location and it improves public safety. Brewster- McLeod asked how long Mountain Rescue intended to be located on this site. Mr. O'Leary commented that the property is owned by a Trust. Mountain Rescue has a Gol)nu 100 year lease agreement with the Trust, therefore, they cannot sell the property for 100 years. Brewster - McLeod moved to approve the request conditioned on clearing the violation per Seldin's proposed language, due to downzoning. Hmielowski seconded the motion and all voted in favor. 04 -2013 Baker, Erika 28 Holland Hills Road, Basalt Aka Lot 10, Holland Hills Subdivision Cody Baker was present representing the owner in a request for a 50 foot Arterial Highway Setback variance where 100 feet is required on this 1.13 acre lot in the ARA 0 zone district to construct a greenhouse. The Affidavit of Posting was submitted. There were no members of the public present to comment on this application. Baker explained that the lot is adjacent to Highway 82 and that the whole back yard is in the required 100 foot setback. He wishes to construct a 22' x 48' temporary structure, 12' high, with no foundation. He stated that adjacent property owners are supportive, but offered the Board nothing in writing. He finished by saying that the structure won't be seen from Highway 82 because it's proposed behind the highest portion of a berm and fence on the berm (previously approved by the Board), behind 25' tall pine trees. Rifkin asked if the greenhouse would be used commercially. Baker responded, "no ", that he was a recent graduate of horticultural sciences and wished to produce food for his family all year. Brewster- McLeod moved to approve the request due to peculiar practical difficulties. Hmielowski seconded the motion and all voted in favor. COMMISSIONERS: Commissioner Mallory noted that a number of cottonwood trees were removed from a property on Willoughby Way that abuts the Rio Grande Trail. She asked if the stumps would remain or be removed. Mr. Clarke stated that staff would visit the site and make a determination. B. NICHOLS FAMILY TRUST REZONING CD -PUD PLAN REVIEW, GMOS EXEMPTION ACTIVITY ENVELOPE REVIEW CARETAKER DWELLIN G UNIT HITORIC DESIGNATION AND INCENTIVES STAFF RESPONSIBLE: SUZANNE WOLFF ➢ Applicant: Nichols Family Trust iJ:3tfi1�? M ➢ Applicant's Representatives: Francis Krizmanich ➢ Summary of Request: The Applicant is requesting to rezone the property to Conservation Development PUD ( "CD -PUD ") and obtain approval of CD -PUD Plan "r for "Development Optionl -Residential Development" to accommodate two single family residences (each of no more than 4,000 square feet of floor area), two caretaker ar dwelling units (each of no more than 1,000 square feet of floor area), and no more than 2,500 square feet for barns and accessory structures. In addition, the Applicant proposes to establish Activity Envelopes for development and to designate historic ,r resources -an existing cabin and adjacent collapsed structures- to the Historic Register. The CD -PUD option allows one TDR for each 20 acres in the CD -PUD, after 160 acres are subtracted for the residential portion of the development which equates to 7 TDRs. a Ms. Wolff summarized the application and staff's recommendation. She presented the letter from Colorado Parks and Wildlife that was submitted after the packet was completed, which questions the appropriateness of Activity Envelope #2 given the proximity to an elk production area. Mr. Krizmanich addressed various issues: • He questioned whether a covenant prohibiting condominiumization is legal. • He agreed to split the square footage between the envelopes. T • He noted that the Applicant would not accept an historic designation, if the existing cabin is not allowed to remain as an additional (fifth) dwelling unit. He agreed that if the cabin remains, it would count as one of the caretaker dwelling units, and that any square footage in excess of 1,000 sf would come out of the 4,000 sf available to the a principal dwelling. • He stated that Basalt Fire would not require sprinklers if the residences are accessed �. directly off of North Fork Road. • He stated that residential access is not allowed on the dam road. He presented a leter from Bio -Logic in response to the CPW comments. He questioned the CPW assessment that Activity Envelope #2 is within elk production, and noted that the property is only 1/ mile wide, so the entire property is within the % mile buffer. Greg Voth, neighbor, stated that the original intent for Himmeland Reservoir was for "common use" by the neighbors, and that neighbors had contributed to the construction of the reservoir. He suggested that the conservation easement should address removal of beetle killed trees, if necessary. He also noted that Activity Envelope #2 is less desirable since it is so close to the road and suggested that both principal residences be accommodated in Activity Envelope #1. r? _ 000013 M Anne Burrows, neighbor, stated that development in Activity Envelope #2 has a direct visual impact on her property and requested that Activity Envelope #2 be eliminated. She stated that the neighbors use the dam road for primary access, and that she has used it for • 18 years. She also mentioned that there is no deeded access to her property through the Nichols property. Dale Coombs, moderator of the Fryingpan Caucus, asked for clarification of the square footage allotments. He noted that there is no Caucus meeting until June, so he has conferred with Caucus members, but does not have an official comment from the Caucus. He agreed that the 4,000 square foot limit for the principal residences meets the goals of the Master Plan. Bill Green, neighbor, asked several questions, including: (1) If the North Fork Spur or Loop Road had to be improved/widened, would the bridge also have to be improved? (2) What are the height limits? He stated that he still questions whether the CD -PUD is a more appropriate zoning than RS -35. He noted that they hope to preserve their private, gated subdivision, and they hope to maintain their historic access to the Nichols property. He added that their lots are "entwined" with the Nichols property, and that he is concerned w about public access. Suzanne Green, neighbor, noted that there is limited human activity in the North Fork valley during the May /June calving season, and that the only full -time resident of the valley lives in the cabin on the Nichols property. Commissioner Thompson asked if some neighbors use the dam road as their primary access. Mrs. Green noted that certain owners did not participate in the replacement of the " bridge that primarily serves the North Fork Spur, since they use the dam road as their w. primary access. Mr. Voth noted that 4 parcels use the dam road for primary access. Commissioner Howard stated that legal access to all of the parcels should be clarified. .� Commissioner McNutt noted that these issues should be resolved before the Conservation Easement is finalized and recorded. „ Commissioner Mallory expressed concern with the siting of the Activity Envelopes in the meadows, and suggested that it would be more appropriate to site the envelopes in the forested area and clustered with the existing residences. She suggested that Activity Envelope #2 be eliminated and that all development occur within Activity Envelope #1. _ Commissioner VeShancey agreed. +. Mr. Krizmanich noted that potential sites on the the property are constrained by the 100' _ stream setback. Commissioner McNutt stated that the Conservation Easement limits development and that the Activity Envelopes are reasonable, and that she does not support the elimination of ® Activity Envelope #2. Commissioner VeShancey seconded. Chairman Howard called the question, and the motion passed 5 to 0 (Commissioner McNutt abstained as an alternate). 2. MOUNTAIN RESCUE ASPEN (HAWKINS) REZONING. MASTER PLAN REVIEW FOR A MAJOR PUBLIC FACILITY GMOS EXEMPTION FOR CIVIC AND INSTITUTIONAL USES AND SITE PLAN REVIEW STAFF RESPONSIBLE: MIKE KRAEMER ➢ Applicant: Mountain Rescue Aspen ➢ Applicant's Representatives: Stan Clauson, Associates r ➢ Summary of Request: Mountain Rescue Aspen (MRA) is requesting to rezone the subject parcel to P -I and create a Master Plan for the property in effort to construct a ,. new facility for the MRA operations. The new facility is proposed as a significant upgrade to the existing building in town that no longer serves the needs of this non- ' profit organization. Kraemer proceeded with the Staff presentation of the application. In summary, the application met almost all the standards of the Land Use Code except for the fact that the «. training tower and building will obstruct a ridgeline as viewed from Hwy 82, a designated scenic corridor. Staff recommended that the application be continued so that the applicant could address this concern. Suggestions offered were reduction of the height of the building and relocation of the training tower to the rear of the site. DOOM 9 Stan Clauson representing the Applicant outlined the proposal and reasoning for the request. Clauson stated that Mountain Rescue Aspen (MRA) has received a generous donation for construction of the new facility and that timely processing of the application was needed. Jeff Edelson with MRA presented a detailed explanation for the need for the tower, its future use, and requisite height of 45'. i Joe Disalvo, Pitkin County Sheriff, was present and echoed the public need for the new facility, timely processing of the application, and asked the P &Z to use their discretion when reviewing the height of the tower. Commissioner Mallory asked if meetings held by other public agencies could occur at the new facility, similar to the Aspen Fire House at the North 40. The Applicant stated they had not given this much thought but it could possibly occur. Commissioner Mallory also asked that the P &Z be mindful of treating public institutions differently than other applicants and the public image that might be portrayed by this alternative treatment. Commissioner Thompson stated that MRA is a unique non - profit organization and that the proposed heights of the structures are warranted and the new building and tower could be viewed as a source of "community pride ". Commissioner Thompson felt that the proposal could be moved forward to the BOCC, as presented. �. Chairman Howard felt that if the P &Z was interpreting the West of Maroon Plan (WOMP) and 2012 Aspen Area Community Plan (AACP), they should not rely exclusively on landscaping to screen the development and that alternative tower locations should be explored (northeast or southeast of site). Commissioner McNutt felt that the proposal was contrary to what the P &Z has been working on through the WOMP and AACP and that the visuals provided are not what has been contemplated in the meetings. Commissioner McNutt agreed with Commissioner Mallory and is also concerned about short cutting the system. Commissioner McNutt also ** felt that the tower may not be absolutely necessary to the development. Commissioner VeShancey stated that if a private developer had submitted this proposal, the ,. P &Z would not be considering these heights and visuals. He liked the architecture of the w. building and tower but not the proposed heights. Commissioner Bonfils Thibeault said that artificial landscaping was not needed and that the tower should be moved to the northeast or southeast corner of the lotibuilding. The meeting was opened for comment. No public comment was offered. Sheriff Disalvo reiterated that the new facility is greatly needed. Architect Charles Cunniffe representing the Applicant stated that the height of the building M. can be re- studied in effort to reduce its height. Galena Street, 3rd Floor Aspen, CO 81611 Re: Mountain Rescue Aspen I Board of Ad'ustment Application for Setback Variance Dear Susan: On behalf of our client, please accept this letter which outlines our request for a setback variance for the proposed Mountain Rescue Aspen (MRA) headquarters building to be located at 31925 Highway 82 (the "Property "). MRA has received a recommendation for approval from the Pitkin County Planning and Zoning Commission for its application for Rezoning to P -I, Master Plan, GMQS Exemption for Civic and Institutional Use, Activity Envelope, and Site Plan Review. MRA is scheduled to go before the Board of County Commissioners for final approval on 13 February 2013. We have received authorization from Pitkin County planner Michael Kraemer to proceed with this request for setback variance in advance of receiving final approval. The setback variance is requested to allow the headquarters to be located within the P -1 zone district's 200 -foot setback from an arterial highway. MRA is unable to comply with the required setback as the entire Property is located within the 200 -foot setback. The new headquarters building will be located the same distance from Highway 82 as the existing Planted Earth building, which is approximately 82 feet from Highway 82. Granting relief from the 200 -foot setback will not substantially impair the intent and purpose of the Pitkin County ..
