HomeMy WebLinkAboutbocc.res.066.2014AN EMERGENCY RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO AMENDING THE PITKIN COUNTY MEDICAL MARIJUANA LICENSING REGULATIONS TO PROHIBIT THE ISSUANCE OF MEDICAL MARIJUANA LICENSES IN THE WOODY CREEK AND EMMA CAUCUS AREAS RESOLUTION NO c' 166 -2014 1. BOCC desires to accept the recommendations of County caucuses concerning the issuance of marijuana licenses and in particular medical marijuana licenses. 2. Since the time of enactment of the County's medical marijuana licensing regulations, the Woody Creek and Emma Caucuses have requested that medical marijuana licenses not be issued within their caucus areas. 3. The BOCC adopted its regulations pertaining to medical marijuana licensing into on June 27, 2012 pursuant to Resolution 4062-2012. 4. Pursuant to Article 7(b) of the Medical Marijuana Licensing Regulations a license will not be issued for a medical marijuana center, for optional premises cultivation or for medical marijuana -infused products manufacturing in the Frying Pan caucus area (7(b)(11)); a license will not be issued for an optional premises cultivation in the Snowmass/Capitol caucus area (7(b)(12)); and a license will not be issued for a medical marijuana center in the Village Commercial zone district (Town of Redstone)(7(b)(13). 5. At this time the BOCC desires to amend Section 7(b)(11) of the medical marijuana licensing regulations to include the Woody Creek and Emma Caucuses in the areas in which no license will be issued for a medical marijuana center, optional premises cultivation establishment or medical marijuana -infused products manufacturing establishment. C.R.S.§ 12- 43.3-310 grants local governments the authority to so regulate. 6. The BOCC finds that adoption of this resolution is necessary for the immediate preservation of the public health, safety and welfare of the citizens of Pitkin County and therefore declares this resolution to be effective immediately upon adoption on May 6, 2014 pursuant to Pitkin County Home Rule Charter Section 2.8.5. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado that effectively immediately: 1. The Medical Marijuana Licensing Regulations adopted on June 27, 2012 shall be amended to include the Woody Creek and Emma Caucus areas in Article 7(b)(11). prohibiting a license from being issued for a medical marijuana center, optional premises cultivation establishment or a medical marijuana -infused products manufacturing establishment in the Woody Creek and Emma caucus areas. 2. All other terms of the Pitkin County Medical Marijuana Licensing Regulations as adopted on June 27, 2012 remain unchanged and in full force and effect.
