Vos Caudill, Pitkin County, CO AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO AUTHORIZING A REQUEST FOR TREASURER'S (TAX) DEEDS ON COUNTY -HELD TAX CERTIFICATES AND DIRECTING THE TREASURER TO ISSUE SAID DEEDS ORDINANCE NO. QIq -2014 RECITALS 1. C.R.S § 39-11-142 allows the Board of County Commissioners to apply for and receive a tax deed in like manner as is provided by law in the case of delinquent tax sales certificates held by individuals in all cases where a tax lien on real estate has been struck off to the county at tax sales and the county has held the certificate of sale for three years or more. 2. The statute further allows that in cases where the county has held the tax certificate for five years or more and such real estate is not located within the limits of any incorporated town or city within the said county, the county may include in one request or demand any or all separate parcels of real estate for which it holds tax sale certificates for sales in any one year, and the board of county commissioners may apply for and receive tax deeds therefor. 3. At an annual sale of real property for delinquent taxes for the year 2000, commencing on November 8, 2001 and closing on November 9, 2001, five properties owned by Blue Ridge Capital Corporation, more specifically described in Exhibit "A" attached hereto, after proper notice of delinquent taxes to the owner and publication as required by C.R.S. § 39-11-102 and there being no bidder at the close of the sale and the treasurer then satisfied that no more sales could be effected, were struck to Pitkin County. 4. The following Tax Lien Certificates were issued to the County: Certificate Numbers 20010018, 20010024, 20010025, 20010026 and 20010027. 5. The BOCC desires to exercise its right to apply for and receive tax deeds for these properties. 6. The County Treasurer shall comply with all provisions of the statutes prescribing prerequisites to an application from the County for these tax deeds and upon the requirements being entirely satisfied and there being no redemption of the properties as provided by law, is directed to issue the County tax deeds to the properties. 7. Upon receipt of the tax deeds, the properties will be maintained as public open space. 8. The BOCC finds that adoption of this ordinance is in the best interest of the public health, safety and welfare of the citizens of Pitkin County. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Pitkin County, Colorado that: I . The County has held Tax Lien Certificate Numbers 20010018, 20010024, 20010025, 20010026 and 20010027 since November 9, 2001. 2. The Chair or Chair's designee hereby requests that tax deeds be issued to the County for the properties corresponding to these Tax Lien Certificates. 3. The County Treasurer having complied with all provisions of the statutes prescribing prerequisites to obtaining these tax deeds and there being no redemption as provided by law, is directed to issue tax deeds to the County for these properties.
