AGENDA ITEM TITLE: Consumer Protection Program State Contract Renewal

ISSUE STATEMENT: The Pitkin County Board of County Commissioners is being asked
to approve a one-year contract for the continuation of the County’s participation in the
Consumer Protection Program.
BACKGROUND: Since the late 1960’s, the Department of Environmental Health and
Sustainability (DEHS), formerly the Consumer Protection Division, of the Colorado
Department of Public Health and Environment (CDPHE) has contracted with Pitkin County
to have the County perform consumer protection services which include the inspection of
restaurants, schools, childcare facilities, and summer camps. Managing this program at a
local level has proven to be very effective in efforts to maintain working relationships with
the regulated community in Pitkin County and to protect public health.

KEY DISCUSSION ITEMS: This is a contract with the CDPHE to perform restaurant,
childcare, and school inspections and enforce hotel, campground, swimming pool and
mobile home park regulations by complaint only. The State has made some adjustments to
the contract for this year. Last year the State change the requirement to 80% completion to
allow inspectors to focus more time on high risk facilities and not on number of inspections
completed. This year the State has changed the requirement to “the Contractor must strive
to complete 100% of the retail food, child care, and school inspections”. While the change
is of some concern, the State has given us assurances that they understand 100% is not a
realistic goal and will work with us if extenuating circumstances cause us to not complete
the required inspection. Staff has discussed this change and believes it will not be a
problem and recommends approving the contract.
BUDGETARY IMPACT: The contract amount is for $10,000 and is the same amount as
the previous year.
RECOMMENDED BOCC ACTION: Approve the Resolution accepting Contract
Amendment #2

A RESOLUTION BY THE PITKIN COUNTY BOARD OF COUNTY COMMISSIONERS
AUTHORIZING PITKIN COUNTY TO PERFORM CONSUMER PROTECTION
SERVICES ON BEHALF OF THE COLORADO DEPARTMENT OF PUBLIC HEALTH
AND ENVIRONMENT
RESOLUTION NO. ________-2014
Recitals
WHEREAS, Pitkin County and The State of Colorado, acting through its Department of
Public Health and Environment, are duly constituted governmental entities; and
WHEREAS, Pitkin County, acting through its Environmental Health and Natural
Resources Department, desires to continue to provide services described in Contract
Amendment #2, including, but not limited to inspections of retail food establishments,
schools, child care centers, and summer camps, inspections of mobile home parks,
campgrounds, motels or hotels after a complaint is received, and timely response to
environmental health emergencies, and to perform these services, through June 30,
2015; and
WHEREAS, the State desires to pay a sum not to exceed $10,000; and
WHEREAS, the Pitkin County Board of County Commissioners and the Colorado
Department of Public Health and Environment are authorized to execute the Contract
Amendment on behalf of the respective parties; and
WHEREAS, both parties have determined that it is in the best interests of the citizens of
Pitkin County that they enter into the Contract Amendment.
NOW, THEREFORE, BE IT RESOLVED by the Pitkin County Board of County
Commissioners that it does hereby authorize the Chair to execute the attached Contract
Amendment #2.
