Thurston III LOCATION: 3.5 miles east of Aspen on the north side of Highway 82; SW; of Section 28, Township 10 South, Range 84 West of the 6th P.M. ZONING/LOT SIZE: AFR-10; 2.18 acres ACCESS: Access is provided from Highway 82 onto an existing driveway which leads to the proposed building envelope. WATER AND SEWER: The existing house is served by a standard septic system and is served with surface water from a stream. The applicant proposes to drill a well for the new house. The Environmental Health Department does not have a permit on file for the existing septic system, therefore, the applicant must apply for an ISDS permit to determine if the existing system is adequate. SITE DATA: The property lies on a gently west dipping slope covered with aspen and conifer trees. Several small drainages associated with the alluvial fan run through a small portion of the site and lead to small ponds which are incorporated into the existing landscaping. The northern portion of the lot has steep slopes; the building envelope is situated approximately 200 feet from the base of the slope. There are two existing legally created residences on the site: the one near the highway will remain and the other is proposed to be demolished and replaced or rebuilt and renovated. REQUEST: The applicant requests 1041 Hazard Review approval and GMQS Exemption to demolish and replace or remodel the existing single family residence. The site is encumbered by low wildfire hazard and geologic hazards, including mapped alluvial fan and debris flow. The applicant also requests administrative scenic overlay approval; this review will be processed by the Zoning Officer in conjunction with the building permit approval. 000002 STAFF COMMENTS 1041 REVIEW Wildfire The property is mapped in a low wildfire hazard area. Since the site was not determined to be in a "no" wildfire hazard area, the applicant will be required to comply with the standards in Section 3-807(C) of the Land Use Code. These requirements are included in the conditions of approval. Kelly Rogers of the Colorado State Forest Service states that the building envelope is in a riparian area, and that "The combination of low hazard fuels, close proximity to a fire station, and adequate road and driveway access make this proposal a very low risk from wildland fire." Ed Van Walraven of the Aspen Fire Department notes that the pond behind the building site must be accessible to fire equipment, and if the structure is greater than 5000 square feet, an approved automatic fire sprinkler system will be required. No comments were received from the Sheriff. Geologic The site is mapped in an alluvial fan and debris flow hazard area. The proposed building envelope avoids the geologic hazard areas. Nicholas Lampiris, consulting geologist, states that there is no rockfall or avalanche hazard on the property, and that any debris from the alluvial fan would flow east of the envelope because of the natural topography. The ponds and streams provide natural protection for the existing residence from debris flows. If a new residence is constructed, he recommends constructing a berm between the creek and the residence to divert debris flows around the home in both directions. Constructing a berm adjacent to the existing residence would be too disruptive to the ponds and streams, and is not recommended. Lampiris also recommends landscaping to improve the natural topography to insure that debris or mud flows approaching the site will be diverted around the residence. Site specific soils engineering studies and proper soils engineering techniques shall be utilized to mitigate for any hydrocompaction and to ensure correct foundation design. Ron Thompson, of Schmueser, Gordon, Meyer Engineers, states that the berm shall be located 20 feet from any water body to minimize erosion and sedimentation and to preserve the natural vegetation along the water course. After construction is complete, the berm shall be revegetated to minimize erosion. PA 000003 --I GMQS EXEMPTION FOR REMODELING, RESTORATION, RECONSTRUCTION OR REPLACEMENT OF LEGALLY ESTABLISHED STRUCTURES The applicant also requests GMQS Exemption pursuant to Section 3- 1502. The applicant shall demonstrate that the structure was legally created either by producing a valid copy of the building permit for the structure or by proving that the structure was built prior to the issuance of County building permits (pre -1976) and that the structure complies with the "Dwelling Unit" definition in Article 8 of the Land Use Code, which states: "Dwelling Unit means a separately enterable room or combination of rooms, which contain kitchen or bath facilities and which are designed for or can be used as a residence by a single family or guests, independent of other families or guests." The applicant has provided verification of the legality of the structures. The application complies with the standards in Section 3-1502(B) and (C) in that it does not propose a change in use, addition of dwelling units, or addition of tourist accommodation or dormitory units. According to Section 3-1502(B)(2), an expansion of floor area is allowed when one single family dwelling unit is being replaced. OTHER The building envelope encroaches into the required 100 foot arterial highway setback. The portion that encroaches shall be excluded from the envelope. The side yard setbacks shown on the site plan do not comply with the required setbacks for the lot. Board of Adjustment approval will be required for any development to occur within the required setbacks. The applicant has agreed to a 10 foot setback on the west side of the envelope, since development is proposed to occur in the southeast corner of the building envelope. The building envelope does not include the entire existing residence in order to limit future development to the area farther away from the creek. Only interior remodeling will be allowed to the portion of the existing residence that is outside of the established building envelope. Any additions must occur on the west/southwest side of the residence, away from the ponds and creek. A new residence must be located entirely within the established envelope. FINDINGS: 1. The wildfire hazard can be mitigated. 2. The geologic hazards can be mitigated by avoidance and diversion of the potential debris flow. 3 000004 3. The application complies with the standards for a GMQS Exemption for Remodeling, Restoration, Reconstruction or Replacement of Legally Established Structures. Pursuant to Section 3-801(B)(2) of the Land Use Code, the Hearing Officer is authorized to approve a site plan and application for a Minor 1041 Hazard Review. The Planning Director is authorized to approve a GMQS Exemption pursuant to Section 3-1502. Pursuant to Section 4-103, the 1041 review and the GMQS Exemption have been combined for approval by the Hearing Officer. Based on the findings referenced above, Staff recommends approval of the Thurston Minor 1041 Hazard Review and GMQS Exemption for Remodeling, Restoration, Reconstruction or Replacement of Legally Established Structures. Said approval is subject to the conditions of approval listed below. This memo will serve as a reference document authorizing approval of said application. The Hearing Officer's sign -off on a 1041 Hazard Review Site Plan is also necessary for completion of the review process. The Site Plan shall be recorded in the Clerk & Recorder's office, and a copy shall be placed in the file. CONDITIONS OF APPROVAL: 1. The applicant shall record a 1041 Site Plan, prior to submission of any building permit applications. All conditions of approval shall be noted on the site plan. The plan shall be modified in the following manner: The Planning Director Approval shall be amended for the Hearing Officer. An acceptance for recording block for the County Clerk shall be included on the site plan. The building envelope shall be amended to exclude the area that encroaches into the 100 foot arterial highway setback. The east boundary of the building envelope shall be amended to be 10 feet from the property line. 2. Prior to issuance of a septic permit, the applicants shall provide documentation to the Environmental Health Department as to the location of the well and the quantity/quality of the water. 3. An ISDS permit for the existing or a new septic system shall be obtained from the Environmental Health Department, prior to issuance of a building permit. 4 0U JUS 4. A fireplace/woodstove permit shall be approved by the Environmental Health Department prior to issuance of a building permit. 5. The applicant shall comply with the following landscaping and wildfire defensible space mitigation standards: a. Brush, debris, and non -ornamental vegetation shall be removed within a minimum 10 foot perimeter around the structure. b. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30 foot perimeter around the structure. C. Spacing between clumps of brush and vegetation within the 30 foot perimeters shall be a minimum of two times the height of the fuel. Maximum diameter of the clumps shall not exceed 10 feet. All measurements shall be from the edges of the crowns of the fuel. d. All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of 10 feet above the ground and ladder fuels from around trees and brush shall be removed. f. Tree crown separation within the 30 foot perimeters shall have a minimum of 10 feet between the edges of the crowns. g. All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. h. The density of fuels within a 100 foot perimeter of the structure shall be reduced. i. All deadfall within the 100 foot perimeter shall be removed. j. The applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. 6. The applicant shall comply with the following additional wildfire mitigation standards: a. The building envelope shall not be located in draws, canyons or on slopes greater than 30%. b. Roof construction shall be Class A, non-combustible material with no flat roofs. C. Vents shall be screened with corrosive resistant wire mesh with mesh ; inch maximun. d. Roofs and gutters shall be kept clear of debris. e. Yards shall be kept clear of all litter, slash, and flammable debris. f. All flammable materials shall be stored on a parallel contour a minimum of 15 feet away from any structure. g. Weeds and grasses within the 10 foot perimeter shall be maintained to a height not more than 6 inches. 5 000006 h. Firewood/wood piles shall be stacked on a parallel contour a minimum of 15 feet away from the structure. i. Swimming pools shall be accessible to Fire Department vehicles. j. Fences shall be kept clear of brush and debris. k. Wood fences shall not connect to the structure. 1. Any outbuildings or additional structures shall adhere to the same standards as structures. M. Fuel tanks shall be installed underground with an approved container. n. Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any above -ground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 hour fire -resistive construction on the exterior side of the walls. o. Each structure shall have a minimum of one 10 pound approved ABC fire extinguisher placed in a visible and accessible location. P. Addresses shall be clearly marked with 2 inch non- combustible letters and shall be visible and installed on a non-combustible post. q. Utility lines shall be buried. 7. If the proposed residence exceeds 5,000 square feet, an approved automatic fire sprinkler system shall be installed. The sprinkler system shall be included in the building plans. 8. Access for fire equipment to the ponds to the east of the building envelope shall be maintained. 9. A berm shall be constructed between the creek and a new residence to divert debris flows around the home in both directions. The berm shall be located 20 feet from any water body and shall be revegetated after construction is complete. An earthmoving permit is required unless the berm is clearly indicated as part of the building permit application. A berm is not required if the existing residence is retained. 10. site specific soils engineering studies and proper soils engineering techniques shall be utilized to mitigate for any hydrocompaction and to insure correct foundation design. 11. No development, including grading and landscaping, shall occur outside of the approved building envelope, with the following exceptions: a. Utility and driveway extension and maintenance; b. As necessary to implement the wildfire mitigation measures; C. Interior remodeling of the portion of the existing C1 000007 residence that is located outside of the established building envelope. 12. The residence shall be designed to Seismic Zone II standards of the Uniform Building Code. 13. The home shall be designed to preclude the accumulation of radon gas. 14. An administrative scenic overlay review shall be processed by the Zoning Officer in conjunction with building permit review. 15. Board of Adjustment approval is required to develop within the required setbacks. 16. The applicant shall demonstrate that the structure was legally created. 17. All material representations made by the applicants in the application or in public meetings shall be adhered to and considered conditions of approval, unless amended by other conditions. SETBACKS: The required setbacks for this parcel are: 100 foot Arterial Highway setback (from highway right-of-way) 30 foot front yard setback 20 foot side yard setback 30 foot rear yard setback 20 foot minimum stream setback The proposed building envelope is located within the 100 foot arterial highway setback and both side yard setbacks. The envelope should be reduced to eliminate these areas. It appears that the 20 foot stream setback is being measured from the centerline of the stream. This setback should be measured from the mean identifiable high water mark. The building envelope should be pulled back on the Northeast side to eliminate this encroachment. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-6 and 5-205: 'it is the policy of the County to ensure that land is not committed to any use and that no use is initiated without adequate evidence that a water supply of adequate quality, quantity, pressure and dependability is available to support the use intended.' The Environmental Health Department requires adequate information on the quantity and quality of domestic water available. The applicant states that a new well will be drilled on the property. This should be done prior to the issuance of any building permits or septic permits. The flow from the well can then be documented.- The applicant must make sure that the water quality is acceptable by having it tested at a laboratory, such as the Snowmass Water and Sanitation District Lab. Before a septic permit can be issued, the well must be located to make sure that the 100 -foot setback requirement from the well to the septic system is met. A condition of approval for this application is the receipt of documentation of the location of the well and the quantity/quality of the domestic use water.. SEWAGE TREATMENT AND COLLECTION: Sections 2-7 and 5-200: 'it is the policy of the County to ensure that land is not committed to any use and that no use is initiated without adequate evidence that facilities to collect, treat and dispose of anticipated types and quantities of waste water are available or can and will be provided with suitable capacity, quality of discharge, suitable point of discharge and dependability.' Lots in the Independence Pass area are served by individual sewage disposal systems (ISDS). All such systems installed within Pitkin County require septic permits issued by the Aspen/Pitkin Environmental Health Department, and must comply with Pitkin County Title X Sewage Regulations. Before the building permits are issued, this Department will evaluate the information on what type of septic system is currently being used and will determine if the system will be adequate for any new construction. To receive a septic permit, the applicant will need to submit a Septic Permit Application and appropriate fee with a completed Soil Data Form including percolation test results and profile hole information. It must be possible to design an adequate septic system before a building permit can be issued. Also, it must be determined if a conventional system can be installed or if an engineered designed system is needed. As part of the permit fee the Aspen/Pitkin Environmental Health Department will determine the design of the system based on the soil test results which include percolation data and profile hole data. An engineered design system is required if the following conditions occur: a percolation rate faster than 5 minutes per inch or slower than 60 minutes per inch, the maximum seasonal level of the groundwater table or bedrock is less than 4 feet below the bottom of the proposed absorption system, or if there is a slope in excess of 30%. Based on percolation test results in the general vicinity, this Department is confident that a septic system can be installed. Site specific soil data will have to be obtained. The applicant will need to adhere to minimum horizontal setback requirements for placement of septic systems components which can be difficult on small lots. The applicant will need to locate the leach field site a minimum of 100 feet from the well and from any neighboring wells. The area for the absorption field should be located in an area of no vehicular traffic, planted with low water use grasses and should not be watered. It is desireable to locate the system down -grade of the house to take advantage of a gravity fed system. The site might pose some difficulty in placing the system away from hazards due to the slope of the site. The first consideration is water drainage from runoff could impair the functioning of the septic system by overloading and saturating the soils. This would severely impair the soil's function to absorb and filter water from the septic system. Percolation tests could be done during runoff in the area of the proposed leach field. Measures to mitigate water drainage could include but are not limited to putting in culverts or creating diversion swales to move the water away from the septic system. The second consideration is minimum horizontal distances between components of a sewage disposal system and pertinent physical features must be in accordance with Section 4-4 of the Pitkin County Sewage Regulations. The minimum horizontal setback distance required from all slopes in excess of forty-five percent (45%) shall be thirty- five feet (35). 000012 Thurston 1041 Hazard Review & Scenic Overlay 3 January 30, 1995 Unless designed by a registered professional engineer and approved by this Department, no soil absorption system shall be permitted in areas where the ground slope is in excess of thirty percent (30%). A condition of approval for this application is the review of the current sewage disposal system and approval of the ISDS permit, if needed, by the Environmental Health Department before the issuance of the building permits. WATER QUALITY IMPACTS: Sections 2-22 and 5-107.2: 'it is the policy of the County to preserve and protect Its present water resources. To this end it is the policy of the County that no land use be initiated which would adversely affect the quantity, quality, or accessibility of the County's water resources; or which would occur at the expense of established water -dependent agricultural activities; or which would result in increased selinizatlon of water resources, loss of minimum stream flows, further destruction of wildlife habitat, or major expenditures to reacquire or redistribute major water resources. it is also the policy of the County to maintain a natural vegetative buffer along its surface waters such that the surface and groundwaters of the area are not encroached upon by land uses or other human activities which could cause deterioration of water quality or impair the natural treatment processes provided by meadows and wetlands.' The Environmental Health Department will be addressing water quality impacts only on down stream water quality. This application is not expected to impact down stream water quality. A condition of approval for this application is - None. AIR QUALITY: Sections 2-17 and 5-106: 'Only that development is permitted which will not contribute significantly to degradation of air quality in Pitkin County.' This project is not expected to contribute significantly to air quality degradation in Pitkin County. The applicant must file a fireplace/woodstove permit with the Environmental Health Department before the building permit will be issued. Metropolitan areas of Pitkin County which includes this site may have two department certified devices and unlimited numbers of decorative gas appliances per building. New homes may NOT have wood burning fireplaces, nor may any heating device use coal as fuel. Remodeling that affects the firebox of any fireplace will necessitate that the device meet current regulations. A condition of approval for this application is the receipt and approval of the fireplace/woodstove permit by the Environmental Health Department. CONFORMANCE WITH OTHER ENVIRONMENTAL HEALTH LAWS: Section 2-2 'it is the policy of the County to ensure that no use or development of land is permitted which is in violation of the laws of the County, the State of Colorado, or the United States of America.' The building site is rated as low hazard. Vegetation on the site consists of aspen trees mixed with occaisional spruce, with an understory of grass, sedge, and willow. Several small ponds and a perennial stream are in close proximity to the proposed structure; the building site is in a riparian area that will not burn readily. The combination of low hazard fuels, close proximity to a fire station, and adequate road and driveway access make this proposal a very low risk from wildland fire. My only recommendation to further mitigate any fire danger would be to keep all vegetation cleared back within ten feet of the proposed structure, and to maintain this ten foot area in low vegetation such as mowed grass. Due to vegetation on and around the subject property and as there are various water bodies including the Roaring Fork River nearby, the wildfire hazard should be very low or possibly nonexistent. If after inspection by the wildfire experts (from the Colorado Forest Service or the Pitkin County Sheriff's Department) a determination is made that the property is actually in a low wildfire hazard area, the applicant agrees to all the mitigation standards in Section 3-801(C) of the Code when the standards are applicable and required for the low wildfire hazard found on the subject property. Second, you asked us to address the provision of water for fire protection. The applicant agrees to have one 10 pound fire extinguisher per floor (the basement, kitchen level and second level) for fire protection. In addition, the pond to the rear of the home site will be available for fire protection in the event of a fire. Attached is a site plan showing the two existing residences on the subject property. The applicant intends to demolish or possibly rebuild or renovate the residence to the north, the subject of this application. The second structure is to continue in its existing use as a single family residence and there are no plans to demolish the unit. Category 1 and 2 Administrative Development Permit Review pursuant to Section 3-27; and 3. Administrative Scenic Foreground Overlay Review pursuant to Section 3-6 of the Pitkin County Land Use Code. This letter describes the subject site, proposed development, and demonstrates compliance with the relevant Pitkin County Land Use Code Standards. SITE DESCRIPTION Location The site is located on the north side of Independence Pass (Highway 82), 3.5 miles east of Aspen across from the entrance to Wildwood School. The site is traversed by a small irrigation ditch and has a few other small water features which are incorporated into the landscaping. The subject parcel is a legally created substandard sized lot. Access The subject site abuts State Highway 82 to the south, with the Jacobs and Cooper properties to the west and east respectively. Vehicular access to the site is from Highway 82 onto the existing driveway which leads up to the existing home to be demolished and to the proposed building envelope. Topography The property lies on a gently west dipping slope covered with aspen and conifer trees. There are several small drainages associated with the alluvial fan running through a small portion of the site. Several of these small drainages lead to small ponds which are incorporated into the existing home's landscaping. A small pond is the water source for the existing house. The upper, northern portion of the property which is far removed from the proposed building envelope rises sharply. These steep slopes are not shown on the topographical map as they will in no way be disturbed. Existing Land Uses There are two existing single family homes on the subject property. One small residence is located near the Highway and a second which will be demolished is located in the proposed building envelope. PROPOSED DEVELOPMENT We have carefully studied this site with the applicant in order to select the most appropriate building envelope. The most appropriate envelope encompasses the existing second residence plus some additional land surrounding it. The building site is screened from the Highway by existing vegetation, aspen and conifer trees. Please refer to the 1041 site plan in Attachment 1. LAND USE REVIEWS This section addresses the requested land use reviews. ®0333 1041 Environmental Hazard Review Section 3-803 of the Code requires that development take place in a hazard free area if such a site exists. The proposed building envelope is hazard free except that a small section includes the small distributary drainage associated with an alluvial fan. Any potential impacts (debris flow) from this alluvial fan can be diverted so that the envelope is effectively hazard free. The selected building envelope appears to be the most "hazard free" portion of the site. The 1041 hazard maps indicate that geologic concerns are the only hazard requiring review. The following section shows compliance with standards for development on sites within a geologic hazard area (Section 3-805). Geologic Hazards - Section 3-805 Nicholas Lampiris, Ph.D. indicates in his report in Attachment 2, that the geology of the site consists of an alluvial fan which coalesces with an alluvial fan complex on the other side of the Roaring Fork River. There are several small distributary drainage associated with the alluvial fan running through this portion of the fan. These are contained by levees formed by previous debris flows emanating from the gully to the east. As indicated in Mr. Lampiris' report, if his recommendations are followed, the building envelope will be free of any hazards. The applicant agrees to these recommendations which are summarized below. (Please refer to Attachment 2, Lampiris' report, for a complete list of his recommendations.) 1. Landscaping should be completed in such a manner which will improve the natural topography wherever needed to insure that debris or mud flows approaching the site will be diverted around it. A berm (6 to 8 feet high in the rear and 4 to 6 feet high in front) is recommended at the rear of the new or remodeled home which would divert flows around the home in both directions. 2. Although data indicates the potential for a high ground water table on the site is minimal, the conditions under which construction excavation is completed should be evaluated to test for negative ground water conditions. 3. Site specific level soils engineering studies and proper soils engineering techniques should be utilized to mitigate for any potential hydrocompaction and to insure a correct foundation design. 4. The home should be designed to avoid the accumulation of radon gas. 00003. Category 1 and 2 Building Permit Review This section demonstrates compliance with Section 3-27 of the Land Use Code by addressing the Policies and Standards of Articles 2 and 3. Section 2-1: Community Balance As a home currently exists on the site, a new, rebuilt home will have minimal additional impacts. The proposed single family development will not degrade the natural environment and natural resources. The small, natural water channels on site will not be disturbed. As construction will involve the redevelopment of an existing residential dwelling unit, the unit is exempt from the Growth Management Quota System. The Community Balance policy takes into account the redevelopment of such homes and therefore, the proposal is consistent with this policy. Section 2-2 Comprehensive Planning This policy is not applicable to this site. Section 2-3 Conformance with the Adopted Comprehensive Plan The proposed development is in conformance with the Roaring Fork East Master Plan, the comprehensive plan which encompasses the subject site. Sections 2-4 Growth Rate: Phasing of Public Services and Facilities and section 3-13 impact on Taxes and Management of Necessary services The proposed development will not have a significant impact on the provision of public services as it involves the redevelopment of an existing home. Section 2-5 Development or Expansion of Ski Areas This policy is not applicable to the proposed development section 2-6 Compatibility with Existing and Adjacent Neighborhoods The proposed development is compatible with the development. There are similar single family homes on of the property and Forrest Service and BLM public located to the north. Section 2-7 Conformance with Other Laws The proposed development conforms with other laws. 9 000040 surrounding three sides lands are Sections 2-8 & 3-8 Natural and Man-made Hazard Areas and Areas of Local and State Interest/1041 Environmental Hazard Areas This application has demonstrated compliance with this policy and applicable standards in the preceding section of the land use application. Section 2-9 Soil, Surficial Geologic Characteristics and Radiation Radiation is not a concern affecting this site. Geologic hazards are addressed in the previous 1041 Environmental Hazard section of the application. Sections 2-10, 11 & 3-703 704 Drainage & Erosion Historic drainage patterns on-site will be maintained. The applicant will have the new home designed so as to provide positive drainage away from the structure and will utilize accepted techniques to minimize erosion. See Attachment 3 for Ron Thompson's engineering report which addresses drainage and erosion. Sections 2-12 & 3-605 Scenic Quality The building envelope is screened from Highway 82 by dense aspen and conifer trees. The curb cut is visible from the road, but the driveway meanders back into the woods and has minimal visual impacts. Please refer to the following scenic foreground review for further details. Sections 2-13 & 3-602 Air Quality The applicant will comply with the current County standards for woodburning devices. The project will not degrade air quality. Sections 2-14 & 3-7 Water Resource Impacts This policy is not applicable to the proposed development. Most of the small water channels on the property are man-made and will be maintained or eliminated. According to the geologist's report, the small drainage associated with the alluvial fan are contained by levees formed by previous debris flows emanating from the intermittent stream in the steep gully to the east. Granitic boulders are incorporated within the levees. Any natural water course will not be altered as a part of this application. Section 2-15 Noise The proposed development will comply with County noise standards. Sections 2-15 & 3-308 Wildlife Management There will be no substantial impacts on wildlife as a result of 5 000041 this proposal. A review of the 1041 Environmental Hazard maps indicates that this is not a mapped wildlife hazard area. Sections 2-17 & 3-1104 Adequate Provision for water Needs and Water Supply In the past, water needs for the existing home have been met from surface water from a stream. As this is no longer adequate for the new home, a new well will be drilled. As discussed in Ron Thompson's engineering report, wells in the Roaring Fork alluvium in this area have been very successful at 70 to 90 feet and no problems are anticipated. The site qualifies for a residential exempt well. Sections 2-18 & 3-1105 Sewage Treatment and Collection The existing home is now served by a standard septic system which is no more than ten years old. As recommended in the engineer's report, the applicant will, if it is deemed necessary, have Bob Nelson of Nelson Environmental and Wastewater Solutions, inspect the system to evaluate its adequacy. Sections 2-19 & 3-1107 Impacts on Road System The proposed development should have no additional impact on the State and County road system. Sections 2-20 & 3-1107 Road Design and Construction The existing driveway will be used to serve the new home. As stated in Ron Thompson's engineering report, this gravel driveway is adequate and allows at least three hundred fifty feet of sight distance at its intersection with Highway 82. The driveway complies with Pitkin County Road Standards and Specifications. Sections 2-21 & 3-1102 Logical Extension of Utilities As an existing home is being replaced with a new home on the same parcel, utilities are already on site and can easily be converted to the new house. As stated in Ron Thompson's report, Holy Cross electric and U.S. West telephone have been and will continue to service the site. Rocky Mountain Natural Gas has recently installed a pipeline along Highway 82. This pipeline should be activated shortly, so service should be available to the new home. Water will be from a new well and the existing septic system, less than ten years old, is adequate for wastewater disposal. Section 2-22 Impacts on Taxes and Management of Necessary Services and Facilities The proposed development should not have a significant impact on the provision of services. ri 000042 Section 2-23 Transportation As the proposal is for the replacement of an existing house, there will be no new impacts on transportation systems. Section 2-24 Compatibility with Agricultural Lands and Operations The site is not adjacent to or near agricultural lands and operations, therefore this policy does not apply. Sections 2-25 6 3-806 Compatibility with Historical and Archaeological Resources There are no known historical and archaeological resources located on the site. Section 2-26 & 3-1302 Housing Affordable housing mitigation is not required for the proposed site development. Section 2-27 Energy Conservation The buildings proposed for the subject site will be in compliance with or exceed the County Uniform Building Code requirements for Energy Conservation. Section 2-28 Compatibility with Public Lands The proposal is compatible with adjacent and nearby publicly owned lands. Section 2-29 Access to Public Land Public lands are not accessed via the subject site. Section 2-30 Private Land Surrounded by Public Lands (Inholdings) This policy is not applicable to this site. ADMINISTRATIVE SCENIC FOREGROUND OVERLAY REVIEW Section 3-604 (D) of the Pitkin County Land Use Code allows the Planning Director to sign off on a Scenic Review if the applicant demonstrates the development is insignificant and will not impact the visual quality of the overlay area. As the proposed building envelope is not visible from Highway 82 due to dense vegetation, even in the winter, the applicant is requesting this write-off. The potential for hydrocompaction can be easily mitigated by proper soils engineering techniques at the site specific level to insure a correct foundation design. Most infrastructure is already on site and should be easily converted to the new house. The property is currently served with an adequate gravel driveway which exits onto Highway 82. At least three hundred fifty feet of sight distance is available at the driveway intersection with Highway 82. On-site commercial utilities include Holy Cross Electric and U.S. West telephone. Both utilities will continue to provide service to the new house. Rocky Mountain Natural Gas has recently installed a pipeline along Highway 82. This pipeline should be activated shortly so that service will be available to the new house. The existing house is served by a standard septic system which is no more than ten years old. We assume this septic system is adequate for the new house, however, an inspection of the system by Nelson Environmental and Wastewater Solutions is recommended to determine the adequacy of the existing septic system. The existing house is served with surface water from a stream. This is no longer acceptable. A well is proposed to be drilled for the new house. Wells in the Roaring Fork alluvium are very successful at 70 to 90 feet. We would anticipate no problem supplying adequate water for the new house. The building envelope for the new home is located downhill of Warren Creek and the ponds. As recommended by the geologist, a berm will be constructed between the creek and the building envelope to protect the home from debris flow. This berm will ensure historical flow patterns are preserved and will prevent property damage. The new home will replace an existing house so minimal increase in runoff will be experienced. An on-site drainage facility can easily be designed to accommodate any increase in the runoff rate and provide storage and treatment for any pollutants. Runoff volumes and peaks will not exceed the historic runoff levels attributable to the site. Soil disturbance will be limited to the immediate area of the old house removal and new house construction and construction of the berm between the creek and the new home.
