HomeMy WebLinkAboutpitkin.planning.273717311813,273717311817 (2014)ADMINISTRATIVE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF PITIQN COUNTY, COLORADO, APPROVING A SUBDIVISION EXEMPTION FOR A MINOR PLAT AMENDMENT TO THE NORTHEAST AND NORTHWEST COMMON OPEN SPACE PARCELS IN THE PRESERVE SUBDIVISION FOR THE EAST OF ASPEN TRAIL r Administrative Decision Nob -2014 RECITALS Pitkin County ("Applicant"), has applied to the Community Development Director of Pitkin County, ("Director"), pursuant to Section 2-20-150(b) of the Pitkin County Land Use Code ("Code"), to amend the Preserve Subdivision Plat to revise the trail easement for the East of Aspen Trail to coincide with the existing alignment of the trail and to vacate the alternative easement shown on the plat, and to define the Nordic Easement and the River Access Easement. 2. The Aspen Preserve Homeowners' Association has authorized submission of the application. 3. The parcels are located on both sides of Northstar Lane, and are described as the Northeast and Northwest Common Open Space parcels, Preserve Subdivision. The parcels are zoned AFR-2. The Northeast Parcel contains 6.068 acres and the Northwest Parcel contains 2.988 acres. The Plat for the Preserve was recorded in Plat Book 18 at Pages 84-87. The Plat depicts two alternate trail easements and a public in -stream river easement. The Plat includes a note that states, "The trail easements, as shown hereon, are dedicated to the county for public use according to the terms and conditions set forth in the Protective Covenants recorded in Book 516 at Page 472, of the records of the Pitkin County Clerk and Recorder." The Plat also includes a note dedicating the In -Stream River Easement to the public. The Plat was amended in Plat Book 20 at Page 34 and Plat Book 83 at Page 36. 6. The Director finds that the amendments to the plat will not affect the degree of compliance with the Code, will be made to a recorded plat, and are consistent with representations made in prior reviews. The Director further finds that the Aspen Preserve Homeowners' Association, Inc. has authorized the submission of the application. APPROVED by the Director, subject to the following conditions: The Applicant shall adhere to all material representations made during the application process. 2. Within 180 days of this approval, the Applicant shall be required to submit for approval by the County Attorney and Community Development an amended plat for the Northeast and Northwest Common Open Space Parcels in the Preserve Subdivision.
