HomeMy WebLinkAboutbocc.packet.10082014- Le Chamonix Trail Easement AGENDA ITEM SUMMARY REGULAR MEETING DATE: September 24, 2014 AGENDA ITEM TITLE: An Ordinance accepting the Le Chamonix Association Inc.,Trail Easement. STAFF RESPONSIBLE: Matthew F. Adeletti ISSUE STATEMENT: This ordinance will authorize the County to accept a public trail easement located within and along Maroon Creek. BACKGROUND: Pursuant to Resolution 068-2014 which approved a Site Plan and other entitlements,Le Chamonix Association Inc., agreed to convey a trail easement within and along Maroon Creek. An Ordinance is required for the County to accept any conveyance of real property. Article 13 of the Pitkin County Home Rule Charter sets forth the responsibilities of the Open Space and Trails Program,which includes ensuring access to public lands. The County's Ecological Bill of Rights pledges the County to ensure access to public lands. September 4, 2014 the Open Space and Trails Board of Trustees approved accepting the Le Chamonix Association, Inc. trail dedication as recommended by staff. LINK TO STRATEGIC PLAN: Acceptance of this public trail easement meets the County's goal to preserve recreational resources. KEY DISCUSSION ITEMS: Acceptance will successfully enable public access along this section of Maroon Creek. Aspen Village Highlands Open Space is located adjacent and northeast of the Le Chamonix property, thus linking the public access onto this new easement. Due to the steepness of the terrain, access to this section of Maroon Creek is limited and receives very few visitors. This trail easement would be mainly used for fishing access, and will not be a developed trail as it would not link to any existing trails. BUDGETARY IMPACT: The trail easement is offered at no cost. RECOMMENDED BOCC ACTION: Staff and the Open Space and Trails Board recommend the BOCC approve the attached ordinance at public hearing on October 8, 2014. TRAIL EASEMENT ORDINANCE NO. -2014 RECITALS 1. The Voters of Pitkin County and the Pitkin County Commissioners established an Open Space and Trails program for the purposes of preserving and providing open space and trails resources in Pitkin County, and specifically to ensure access to public lands. 2. The Open Space program has benefited from exactions of trail easements over the years. 3. Pursuant to Resolution 068-2014 which approved a Site Plan and other entitlements, Le Chamonix Association Inc., agreed to convey a trail easement within and along Maroon Creek. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Pitkin County, Colorado that: Upon approval of the form by the Open Space Director and County Attorney, the Chair is authorized to execute the Trail Easement needed to consummate this transaction.
