RECITALS
I. Pursuant to Section 2-20-150(6) of the Land Use Code, AVR AH LLC ("Applicant") has applied to
the Community Development Director of Pitkin County, Colorado ("Director") to amend the Activity
Envelope Plan for Homestead 9 to allow a water feature and the on-site wastewater treatment system
within the previously approved Development Envelope, which was restricted to native revegetation and
a utility corridor.
2. The property is located at 1135 Aspen Valley Ranch Road, and is described as Homestead 9, Aspen
Valley Ranch.
3. The parcel contains 36.92 acres and is conforming in size in the RS -20 zone district.
4. The BOCC approved Resolution No. 112-2005, which granted Special Review, 1041 Hazard Review,
Conceptual Submission and GMQS Exemption for Homesteads 1-9 and the Agricultural Facilities
Parcel of Aspen Valley Ranch. The BOCC granted 20 year vested rights with the approval. The BOCC
amended the approval, pursuant to Resolution Nos. 081-2008 and 069-2014.
5. The Activity Envelope/Site Plan for Homesteads 9 is recorded in Plat Book 107 at Page 92. The Plan
established a Building Envelope and a Development Envelope Restricted to Native Revegetation and
Utility Corridor.
6. The Director finds that the meadow where the Development Envelope is located was previously cleared
of native vegetation, and that the additional uses within the envelope will not disturb native vegetation.
7, The Director further finds that the water feature, septic field and pipeline within the Development
Envelope comply with the 100' setback from Dry Woody Creek.
8. The Director further fords that the proposed amendments to the envelope comply with the applicable
provisions of the Land Use Code, and will not change the use of the proposed development or the
basic character of the land, are consistent with action taken during the original review, do not increase
off-site impacts or the allowable floor arca, and will not endanger the public health, safety or welfare.
THE DIRECTOR DOES HEREBY APPROVE the AVR AH LLC Minor Amendment to the
Homestead 9 Activity Envelope Plan, subject to the following conditions, which shall run with the land and
be binding on all successors in interest:
1. All conditions of BOCC Resolution Nos. 069-2014, 081-2008 and 112-2005 shall remain in full
force and effect, except as amended herein.

2. Prior to submission of any development permit applications for I lomestead 9, the Applicant shall be
required to submit for approval by the County Attorney and Community Development an amended
Activity Envelope and Site Plan for I homestead 9. The above referenced approvals shall be a
condition precedent to finalization and recordation. The owner must sign the mylar copies of the site
plans prior to submittal for recording.
3. The Applicant shall adhere to all material representations made in the application.

Dear Suzanne:
Enclosed with this letter is the 11 x 17 inch print which you requested. I am also enclosing a 24 x
36 inch print. I made a few minor insignificant changes to the print. Please look over the print
and make any changes which are necessary. I will bring you a mylar for signature.
As we discussed, the pond has been eliminated. Instead, we are proposing to develop a water
feature using water from the Waco Ditch which is located on the north end of Homestead 8
which adjoins Homestead 9. An immersed pump will be placed in the Waco Ditch when water is
flowing in the Ditch. Water will be pumped up above the house and will flow back down to the
Ditch. The onsite waste water treatment system will be placed below the house. The proposed
plan is better than previously proposed because there will be significantly less grading and site
disruption.

Dear Suzanne:
Davis Hom Incorporated represents AVR AH LLC, the Applicant in this land use application and
the owner in fee simple of all of Aspen Valley Ranch including Homesteads 1 through 9
inclusive and the Agricultural Facilities Parcel. A vicinity map with the property's location is
shown in Attachment 1. jr�S(TaAl
The Applicant is requesting to amend the Activity Envelope Pla ecorded in Plat Book 107 at
Page 92 (see Attachment 2). The plan shows a Building Envelop and a Development Envelope
that is currently restricted to "native revegetation and utility corridor." Attachment 3 depicts the
proposed Third Amended Aspen Valley Ranch Homestead 9 Activity Envelope and Site Plan.
The proposed residence will be within the building envelope, but additional development,
including a pond associated grading and landscaping, is proposed to be within the Development
Envelope. The proposed Activity Envelope and Site Plan depicts the proposed plan for the
driveway, house, septic system and conceptual landscaping.
LAND USE REQUEST
A pre -application conference summary is found in Attachment 43. As required in the summary,
the following section of the Pitkin County Land Use Code will be addressed.
Section 2-120-150 Minor Amendment to a Development Permit;
A minor amendment to a development permit application must meet the following standards
found in Section 2-120-150(6) of the Code, as determined by the Community Development
Director. The Land Use Code language is given in bold and the Applicant's response follows.
1) Consistent with actions taken during previous development approvals for the
property; and

2) Does not change the use of the proposed development between residential,
commercial and tourist accommodations uses; and
3) Does not change the basic character of the approved use of land on which the
activity occurs, including basic visual appearance and method of operation; and
4) Does not constitute a new land development activity; and
5) Does not increase off-site Impacts in the surrounding neighborhood; and
6) Does not endanger the public health, safety or welfare; and
7) Does not violate any Land Use Code standards; and
8) Does not substantially increase the need for on-site parking or utilities, or affect
affordable housing generation; and
9) Does not increase the floor area of the use by more than five percent or decrease the
open space on the site by more than five percent.
The proposed amendment complies with the Minor Amendment to a Development Permit
standards. The previous approval restricted the development envelope to "native revegetation
and a utility corridor." The area which is proposed for the pond is a meadow which was
previously cleared of most native vegetation. The Applicant will revegetate the envelope with
native vegetation around the pond. The residential use is not changed, the basic character is the
same, there is no new development activity, it does not endanger the public in any way, nor does
it violate the Land Use Code Standards, increase parking, utility or affordable housing impacts,
increase floor area or decrease open space. The request meets this section of the Land Use
Code.
SUMMARY
The Applicant owns the 809+/- acre Aspen Valley Ranch (AVR) on Upper River Road which
includes 546 acres in AVR Homesteads 1 through 9 and the Agricultural Facilities Parcel (AFP).
The Ranch has been extensively planned and the most recent Pitkin County approval is
summarized in BOCC Resolution No. 069-2014. This land use application requests approval
develop a small pond to south of the proposed house on Homestead 9. The proposed minor
amendment has been shown to meet the criteria for a Minor Amendment to a Development
Permit pursuant to the Pitkin County Land Use Code.

fee structure for land use applications and the payment of all processing fees is a condition precedent to a

development shall pay, in full, the cost of development review in Pitkin County. Fees have been set to be
consistent and fair to the public and to reflect the expense incurred in providing such services to the public.

project, it may not be possible at the time of application to ascertain the full extent of the costs involved in

4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications
