Vos Caudill, Pitkin County, CO ADMINISTRATIVE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF PITKIN COUNTY, COLORADO, APPROVING THE CLARK FAMILY TRUST SITE PLAN REVIEW FOR AN AGRICULTURAL EQUIPMENT STORAGE BUILDING AND A NEW DRIVEWAY, AND APPROVING ADDITIONAL EXEMPT FLOOR AREA FOR THE AGRICULTURAL EQUIPMENT STORAGE BUILDING Administrative Decision No. 13 -2015 RECITALS 1) Clark Family Trust (hereafter "Applicant") has applied to the Community Development Director of Pitkin County (hereafter "Director") for Site Plan Review approval to construct an agricultural equipment storage building and a new entrance for the driveway into the property that will be separate from the driveway to the adjacent lot. The Applicant is also requesting approval for an additional 330 square feet of exempt floor area for the agricultural equipment storage building (for a total of 1,320 square feet) via the Flexibility for Agricultural Support provision. 2) The property is located at 7039 East Sopris Creek Road, and is described as Lot 1, Capitol and Elk Creek Subdivision. 3) The lot contains 44.036 acres and is conforming in size in the RS -30 zone district. 4) The BOCC created the two lot subdivision, pursuant to Resolution Nos. 77-34 and 88-49. The final plat was recorded in Plat Book 5 at Page 88, and an amended plat was recorded in Plat Book 21 at Page 5. The residence was completed in 1979. 5) The Community Development Director granted 1041 hazard review approval to expand the residence and construct a detached caretaker dwelling unit, pursuant to Administrative Decision Nos. 10-2005 and 28-2005. The 1041 site plan was recorded in Plat Book 72 at Page 56 and amended in Plat Book 75 at Page 25. The caretaker dwelling unit was completed in 2008. 6) The Director finds that the activity envelope and site plan for the agricultural equipment storage building complies with the Code, as follows: A) The envelope is on slopes of less than 30%. B) The wildfire hazard is low, and can be mitigated. C) The agricultural equipment storage building will not create any additional impacts on wildlife habitat beyond those associated with the existing development on Lots 1 and 2. D) The existing driveway includes a turnaround in front of the building that will accommodate movement of the equipment in and out of the building. E) The agricultural equipment storage building is located within an existing stand of vegetation in order to minimize the visibility of the building from East Sopris Creek Road and to avoid the irrigated meadow. The building will sit approximately 430 feet back from East Sopris Creek Road. Given the surrounding irrigated meadow and driveway areas, vegetation removal for wildfire mitigation can be minimized. F) The agricultural equipment storage building will have a height of 16' to the top of the roof ridge, and the mass of the building has been broken down and the roofline has been staggered. The proposed materials — barn wood or stained wood siding and corrugated rusted steel roof panels — are compatible with the rural character of the property. Administrative Decision No. B -2015 Page 2 G) The Applicant commits to remove the existing airplane hangar that is highly visible from East Sopris Creek Road once the new building is constructed. 7) The Director further finds that the property is eligible for an agricultural equipment storage building of up to 990 square feet exempt from floor area, pursuant to Sec. 5-20-70(i) of the Land Use Code ("Code"). 8) The Director further finds that the additional 330 square feet of exempt floor area for the agricultural equipment storage building (for a total of 1,320 square feet) complies with the criteria in Sec. 2-30- 20(g)(19) of the Code, Flexibility for Agricultural Support, as follows: A) Agricultural buildings are allowed in the RS -30 zone district. B) The proposed agricultural building complies with the applicable standards of Chapter 7 of the Code. C) The 30 acre meadow is irrigated and is grazed by approximately 25 horses. The building will accommodate two tractors, a horse trailer, a Polaris snowmobile used during the winter and a pick-up truck. The existing shed and airplane hangar, which are currently used for storage of tools and implements, will be removed. There are no other agricultural buildings on the property. D) The Applicant has demonstrated that the property is utilized for an agricultural operation as defined in the Code and that the proposed agricultural equipment storage building will be used to support the agricultural operation. 9) The Director further finds that the activity envelope and site plan for the driveway comply with the applicable provisions of the Code, as follows: A) The proposed driveway complies with the Asset Management Plan: it will have a 90 degree intersection with the County road and a flat (2% grade) platform adjacent to the road, and will have a 16' wide surface. B) The County Engineer finds the intersection of the driveway with the County road provides adequate sight distances. C) The original subdivision approval provided a common entrance point for the two lots in order to minimize interference with the agricultural pasture. The new driveway will impact a small portion — less than 1% - of the existing meadow. The Applicant notes that the airstrip through the meadow created much more of a disturbance to the meadow, and is in the process of being reclaimed as meadow. D) An adequately sized culvert will be placed where the new portion of the driveway crosses an existing drainage swale in the meadow. E) The driveway has been laid out with soft curving edges that complement the natural setting and does not present a straight line corridor. APPROVED by the Director, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. The Applicant shall comply with the conditions of all prior approvals, except as amended herein. 3. Prior to submission of a building permit application for the agricultural equipment storage building or a driveway/access permit for the relocation of the entrance to the driveway, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan in Administrative Decision No. 13-2015 Page 3 accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation of them. 4. With the building permit application for the agricultural equipment storage building, the Applicant shall: A. Submit a site specific drainage and erosion control plan prepared by a qualified engineer or geologist for review and approval by the Planning Engineer. B. Submit a construction management plan for review and approval by the Planning Engineer. C. Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes. D. Submit an exterior lighting plan. 5. Prior to issuance of the building permit for the agricultural equipment storage building, the Applicant shall record an Occupancy Covenant and Agreement that shall specify that the exempt floor area for the agricultural equipment storage building shall only be used for storage of equipment utilized for an on-site agricultural operation, and that any area not consistent with that use would count as floor area. The Occupancy Covenant and Agreement shall allow the County to inspect the agricultural buildings at any time for compliance with the specified use limitations, subject to the provision of reasonable notice to the property owner. The form of the Occupancy Covenant and Agreement shall be approved by the County Attorney. 6. Prior to issuance of a Certificate of Occupancy for the agricultural equipment storage building, the Applicant shall obtain a demolition permit and complete the demolition/removal of the airplane hangar from the property. 7. With the driveway/access permit for the relocation of the entrance to the driveway, the Applicant shall: A. Demonstrate compliance with the Asset Management Plan and the requirements of the Basalt and Rural Fire Protection District. B. Submit a site specific drainage and erosion control plan prepared by a qualified engineer or geologist for review and approval by the Planning Engineer. C. Submit a construction management plan for review and approval by the Planning Engineer. D. Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes. 8. The agricultural equipment storage building shall be limited to a maximum size of 1,320 square feet of exempt floor area. The height of the building shall not exceed 16' to the top of the ridge. 9. The agricultural equipment storage building shall not contain any plumbing equipment other than a hose bib, but may contain mechanical or electrical equipment. The building may have an excavated, raised or slab foundation. 10. The agricultural equipment storage building shall comply with the following landscaping and wildfire defensible space mitigation standards: A. Brush, debris and non -ornamental vegetation shall be removed within a minimum ten -foot (10') perimeter around the agricultural equipment storage building. B. Beyond the 10' perimeter, existing vegetation shall be thinned to break up the vertical and horizontal continuity of the fuels. Adequate vegetation shall remain to screen the building as seen from East Sopris Creek Road. Administrative Decision No. LZ -201 S Page 4 11. Additional wildfire mitigation standards: A. The roof shall be constructed with a Class A roof covering or a Class A assembly as defined in the building code. Wood shake/shingle roof coverings are prohibited. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: 1) All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing the roof. 3) All roof designs shall facilitate the natural process of clearing debris. Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required by the approved building code and shall have a minimum slope of 1:48. 5) All roof designs, coverings or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. B. Roof vents shall be screened with corrosive resistant wire mesh with mesh 1/4 inch maximum. C. Roofs and gutters shall be kept clear of debris. 12. The exterior of the agricultural equipment storage building shall utilize indigenous earth tone materials or colors and the roofs shall have a non -reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflectivity, with the exception of materials associated with solar or photovoltaic equipment. Driveway lighting is prohibited and all other lighting shall comply with the lighting code. 13. The Applicant shall comply with the applicable codes and requirements of the Basalt and Rural Fire Protection District. 14. No development shall occur outside of the approved activity envelopes, except as required for wildfire mitigation. 15. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the corners of the activity envelope and install construction fencing around the construction site within the perimeter of the activity envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. 16. All areas disturbed by construction shall be re -vegetated with native shrubs and grasses within one growing season of the project's completion. 17. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit. Any structures represented in the application may not be permitted under building and zoning regulations. 18. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. APPLICANT has submitted to COUNTY an application for Activity Envelope/Site Plan Review (hereinafter, THE PROJECT). 2. APPLICANT understands and agrees that Pitkin County Ordinance No. 30-2009 establishes a fee structure for land use applications and the payment of all processing fees is a condition precedent to a determination of application completeness. The fee structure is based on the County's policy that development shall pay, in full, the cost of development review in Pitkin County. Fees have been set to be consistent and fair to the public and to reflect the expense incurred in providing such services to the public. 3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed project, it may not be possible at the time of application to ascertain the full extent of the costs involved in processing the application. 4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications shall accumulate if an application includes more than one type of land use review. 5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete processing or present sufficient information to the Planning Commission and/or Board of County Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally required findings for project approval, unless current billings are paid in full prior to decision. 6. Therefore, APPLICANT agrees that in consideration of the COUNTY's waiver of its right to collect full fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the amount of $2,550 which is based on 6 hours of staff time (plus $54 public notice and $624 Planning Engineer fees). If actual time spent by staff to process the application exceeds the average number of hours by more than 20%, the COUNTY will bill the APPLICANT quarterly for the additional time spent. Application Request This is an application to establish a new driveway entrance and build an agricultural equipment building on a lot in unincorporated Pitkin County. The legal description of the property is Lot 1, Capitol and Elk Creek Subdivision. The lot's street address is 7039 East Sopris Creek Road, Snowmass. The Parcel ID# for the property is 264503202001. A vicinity map showing the location of the property is included in this application booklet. The application is being submitted by the owner of the property, Clark Family Trust (hereinafter, "the applicant"). Proof of ownership of the property is provided in the warranty deed, attached hereto as Exhibit #1. The applicant is being represented by Alan Richman Planning Services for this application. A letter from the applicant confirming this is attached as Exhibit 92. A pre -application conference was held with a member of the Community Development Department. The Pre -Application Conference Summary issued by the staff (see Exhibit #3) states that the review procedures applicable to this proposal are as follows: Activity Envelope and Site Plan Review; and Flexibility for Agricultural Support The applicant also requests that the site plan approval be granted vested rights status pursuant to Sec. 2-20-170 of the Pitkin County Land Use Code. The Pre -Application Conference Summary lists the following sections of the Pitkin County Land Use Code that should be addressed by the applicant to designate an Activity Envelope and obtain Site Plan approval: Section 7-20-10: Site Preparation and Grading; ' Section 7-20-20: Steep and Potentially Unstable Slopes; ' Section 7-20-30: Water Courses and Drainage; ' Section 7-20-60: Wildfire Hazards; * Section 7-20-70: Wildlife Habitat; * Section 7-20-120: Scenic View Protection Areas; Section 7-20-130: Landscaping and Vegetation Protection; and Section 7-30: Roads, Driveways and Parking. The following sections of this application identify the Code provisions applicable to these procedures and provide responses to the applicable County standards. First, however, a brief description of the property and summary of the development planned for the lot are presented below. Clark Family Trust Activity Envelope and Site Plan Review Page 1 000004 B. Property Description and Proposed Development The subject lot is an irregularly shaped parcel of land that is approximately 44.06 acres in size. The property is zoned RS -30, a zone district with a minimum lot size of 30 acres, making this a conforming sized lot of record. The vicinity map shows that this lot is located just to the west of the "T" intersection, between Capitol Creek Road and East Sopris Creek Road. Access to the property is obtained from an existing shared driveway that intersects with East Sopris Creek Road which serves Lot 1 and the adjacent Lot 2 of the Capitol and Elk Creeks Subdivision. The property is largely comprised of open ranch land, but is also bisected by Little Elk Creek and Capitol Creek and their associated riparian areas. There are also a number of irrigation ditches that cross the property, which contribute to the fact that this is a relatively wet piece of land that supports some brushy wetland vegetation. The lot was created through two subdivision approvals granted by the Board of County Commissioners in the 1970's and 1980's. The Capitol and Elk Creeks Subdivision was first approved by the Board of County Commissioners in 1977 pursuant to Resolution 77- 34, with the final plat being recorded in Plat Book 5 at Page 88. The lot lines between the two lots were then amended in 1988, pursuant to Resolution 88-49, with the amended plat being recorded in Plat Book 21 @ Page 5. More recently, the prior owner received 1041 Hazard Review approval to make an addition to the existing residence and to develop a detached CDU. Approval for these activities was granted pursuant to Administrative Determinations 10-2005 and 28-2005, attached hereto as Exhibits #4 and #5, respectively. The 1041 Hazard Review Site Plan documenting the approved activity envelopes is recorded in Plat Book 72 @ Page 56. The improvements authorized by these determinations have since been constructed. The applicant now proposes to develop a short (approximately 350) driveway spur entry to the ranch. Currently Lot 1 obtains access via a driveway that is shared with the adjacent Lot 2. This driveway is located at a low spot along East Sopris Creek Road. Because the applicant's residence is not visible from this location, the driveway appears to most observers to be the access to the adjacent property, not to this property. This is a confusing situation for visitors to the applicant's residence. The applicant has identified a location for a new driveway entrance approximately 390 feet to the west of the existing entry. This location is at a higher spot along East Sopris Creek Road, with excellent sight distances in both directions. It is easy to see the applicant's residence from this location and it provides an entry that allows one to see the entire property. The driveway would cross a section of the meadow and merge with the existing driveway just below the neighbor's residence, creating a private entry into Lot 1. Clark Family Trust Activity Envelope and Site Plan Review Page 2 000005 The driveway has been designed to comply with the applicable County standards. It would have a 90 degree intersection with the County road, offer a flat (2% grade) platform adjacent to the road, and have a surface that is 16' wide. Given the relatively flat nature of the meadow it crosses, cut and fill activity can be kept to a minimum. An appropriately - sized culvert will be placed where the driveway crosses an existing irrigation ditch. The applicant also proposes to develop a new agricultural equipment building on the ranch. Section 5-20-70 G) (3) of the Land Use Code provides a floor area exemption for a 990 square foot agricultural equipment building for a property of this size. The Code limits such buildings to a height of 16', measured to the top of the ridge. The building which the applicant has designed would have a floor area of 1,320 square feet, which is 330 square feet more than is allowed by the Code. This added area may be authorized by the County's Agricultural Committee pursuant to the program known as Flexibility for Agricultural Support. The need for this size of building stems from the fact that the applicant owns numerous pieces of agricultural equipment that are used to operate this ranch property and yet does not have a barn or other significant accessory building on the property in which to store this equipment. The following vehicles require a space within the bays planned for this building: 2 tractors; Horse trailer; Polaris snowmobile; and Pick-up truck. Today, there are just two small accessory structures on the ranch used to support its operation. First there is a small shed that is used as an animal shelter, tack room and for hay storage. Second, there is structure that a former owner built as an airplane hangar that is now used to store tools and other farm implements. The applicant hereby agrees to remove this hangar from the property when the new equipment building is completed. The proposed location and footprint of the new agricultural equipment building are shown on the site plan. The new building would be located just to the east of the existing hangar, partially shielded from view by the shrubby vegetation that is present in this area. This location is set back by approximately 430' from East Sopris Creek Road and is also set back by more than 150' from Little Elk Creek. An activity envelope for the agricultural equipment building is shown on the site plan. The activity envelope has been drawn to include the new building location, the hangar (which will be removed) and surrounding brushy vegetation that will be removed to make way for the building and access to the building. The conformance of the proposed activity envelope and site plan with the applicable standards of the Land Use Code is addressed in the sections which follow. STANDARDS FOR SITE PLAN REVIEW Chapter 7 of the Land Use Code establishes the standards related to the quality of development in Pitkin County. Following are the applicant's responses to the applicable standards of that chapter, as specified in the pre -application summary form. A. Site Preparation and Grading (Sec. 7-20-10) (a) Grading and Fill Placement. The applicant agrees that all grading and filling associated with this project will take place within the activity envelopes depicted on the site plan. (b) Clearing, Grubbing and Vegetation Removal. The applicant agrees that all clearing, grubbing and vegetation removal associated with this project will take place within the activity envelopes depicted on the site plan. (c) Tree Removal and Mitigation. There are areas on the property with significant stands of mature vegetation. No development is planned in any of these areas. Therefore, there will be no removal of any trees from this property that would require mitigation to occur. (d) Protection of Natural Terrain. The applicant agrees to follow those design and construction techniques that may be recommended by the County Planning Engineer or the Community Development Director to mitigate any physical or visual damage from the proposed development. This shall include, but not be limited to: ♦ Areas of the property that are disturbed by development will be re -vegetated. Revegetation will be completed during the first planting season after completion of the construction, using native vegetation. Additional detail on the proposed re - vegetation of the property is included in Section II.F of this application. ♦ Topsoil will be removed and saved prior to any mass grading or excavation, and will be replaced following construction. ♦ Appropriate weed prevention techniques will be employed that are consistent with the provisions of the 2006 Revised Pitkin County Weed Management Plan. ♦ The applicant will comply with the County's adopted erosion and sedimentation control and stormwater management standards. Sediment barriers will be placed on-site as necessary to control the impacts of soil disturbing activities (see Section II.C, below). Steep and Potentially Unstable Slopes (Sec. 7-20-20) Section 7-20-20 of the Land Use Code provides standards for development on slopes of less than 30%, 30% to 45%, and 45% and greater. The site plan depicts topography throughout the proposed activity envelopes, illustrated as two foot (2) contours. An analysis of the slopes on the property demonstrates that there are no areas within the proposed activity envelopes where development is planned on slopes in excess of 30%. Therefore, all proposed development will occur on slopes of less than 30%, as permitted by Sec. 7-20-20 (d) of the Land Use Code. No development is proposed on slopes in excess of 30% on the subject property. Therefore, no further response to the provisions of Sec. 7-20-20 (b), (c), or (e) of the Code is required. Clark Family Trust Activity Envelope and Site Plan Review Page 5 00000 C. Water Courses and Drainage (Sec. 7-2030) (b) Encroachment or Channeling. No encroachment or channeling activities are proposed in Capitol Creek or Little Elk Creek. (c) Drainage. A drainage report and plan will be prepared by the applicant as part of the building permit package for the structure and the grading permit package for the new driveway spur. It will describe the techniques that will be employed to keep developed runoff volumes from exceeding those of the existing site. (d) Groundwater. No activities are proposed that would interfere with groundwater recharge or pollute groundwater. No contaminants will be introduced to groundwater as a result of the proposed development. (e) Irrigated Areas. The proposed development will have no affect on water supplies available for irrigation or any water rights. (f) Irrigation Ditches. The will be no impacts to irrigation ditches as a result of this application. An adequately -sized culvert will be placed will be placed where the new driveway spur will cross an existing drainage swale in the meadow. (g) Sedimentation. The applicant will comply with the County's standards for controlling sedimentation. A plan will be prepared and included with the building and grading permit application packages that locates and describes the erosion and sedimentation control measures that will be installed during construction. Sediment barriers, to include straw bales, silt fences and similar filtering devices, will be placed down-slope of all disturbed areas. Disturbed areas will be re - vegetated no later than one growing season after completion of construction by applying native seed mixes and fertilizer to disturbed areas and mulching seeded areas with straw. (h) Water Quality. (1) The activity envelopes that have been designated for this property assure that all development will comply with the County's stream setback standards. (2) The applicant will comply with those state and federal regulations concerning water quality that may apply to the proposed development. (i) Efficient Water Use. The applicant will comply with this standard. Clark Family Trust Activity Envelope and Site Plan Review Page 6 D. Wildfire Hazards (Sec. 7-20-60) During the pre -application conference with staff, the applicant was informed that the County's wildfire hazard maps designate this site as being in an area subject to a low degree of wildfire hazard. The mitigation standards for development in wildfire hazard areas are found in Section 7- 20-60 of the Land Use Code. Following are the applicant's responses to these standards. (1) Defensible Space (a) Brush, debris, and non -ornamental vegetation shall be removed within a minimum ten (10) foot perimeter around the structure. Response: The applicant will comply with this requirement. (b) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a thirty (30) foot perimeter around a structure built on flat ground. Response: The applicant will comply with this requirement. (c) Spacing between clumps of brush and vegetation within the thirty (30) foot perimeter shall be a minimum of two (2) times the height of the fuel. Maximum diameter of the clumps shall be two (2) times the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. Response: The applicant will comply with this requirement. (d) All branches from trees and brush within the thirty (30) foot perimeters shall be pruned to a height of 10 feet (10) above the ground, and removal of ladder fuels from around trees and brush. Response: The applicant will comply with this requirement. (e) Tree crown separation within the thirty (30) foot perimeters shall have a minimum of ten (10) feet between the edges of the crowns, except for mature stands of Aspen trees where ladder fuels have been removed. In areas of Aspen re- generation, understory shrubs and down and dead materials shall be removed. Response: The applicant will comply with this requirement. (f) All branches that extend over the roof eaves shall be trimmed and all branches within fifteen (15) feet of the chimneys shall be removed. Clark Family Trust Activity Envelope and Site Plan Review Page 7 000010 Response: The applicant will comply with this requirement. (g) The density of fuels up to a one hundred (100) foot perimeter of the structures shall be reduced where natural reduction has not already occurred. Response: The applicant will comply with this requirement. (h) All deadfall up to a one hundred (100) foot perimeter shall be removed. Response: The applicant will comply with this requirement. (i) The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. Response: The applicant will comply with this requirement. Y) No new conifer trees shall be planted within ten (10) feet of a residence. Response: The applicant will comply with this requirement. (k) No flammable mulches shall be placed within two (2) feet of a residence. Response: The applicant will comply with this requirement. 2. Access (a) Access roads and driveways shall be built to County standards; however, these standards may be increased to mitigate wildfire hazards based on comments provide by the Colorado State Forest Service, the Sheriffs Department, local fire protection districts, and/or a person approved by the County as an expert in wildfire areas and mitigation. Where feasible, looped routes of access/egress to a public road shall be incorporated in the design of a proposed development. Looped routes of access/egress is defined as two (2) or more dedicated access roads to the main artery/highway for widely separated ingressregress looped drives with one entrance point or divided single entrances do not satisfy this condition. Where this is not feasible, the Community Development Department may approve vehicle turnaround areas a maximum of seven hundred -fifty feet (750) apart, installed between the road intersection and its terminus. Turnaround areas shall be the same standard as cul-de-sac turnaround pads; these may be incorporated in the proposed driveway entries. Response: The proposed new driveway spur has been designed to comply with the County's driveway design standards. The new driveway will offer a looped access route for emergency vehicles, since the original driveway will remain in place. Clark Family Trust Activity Envelope and Site Plan Review Page 8 000011 (b) New dead-end streets (no cul-de-sacs) shall not be permitted, except for cul-de- sacs and other turnarounds accepted by the applicable local fire district. Response: No new streets are proposed. (c) Cul-de-sac turnaround pads shall have a minimum of a thirty foot (30) drivable surface inside turning radius, or a hammerhead or other T-tum area acceptable to the applicable local fire district. Response: There is a turn-around area along the existing driveway, serving the CDU, which is located immediately behind where the new building is proposed. The applicant will review this location with the Fire Marshal during the referral process for this application to ensure it complies with the Basalt Fire District's design standards. (d) New driveways and access roadways shall enter the roadway at a ninety (90) degree angle for the first twenty-five feet (25) of the driveway. Response: The proposed driveway has been designed to comply with this standard. (e) Fuel breaks, as recommended by a wildfire expert approved by the County, may be incorporated into the design of access roads or driveways. Response: This is not a subdivision application. 8. Water Supply for Fire Safety (a) When access to a public or private pressurized water system is not available, or if it is necessary to augment the fire protection water systems, private ponds may be used if approved by the Community Development Department and the Fire District. Response: A pond is not part of the development plan. (b) Any fire department recommendation for individual structure water supply and storage shall be accessible to fire department vehicles from the exterior of the structure through a Fire Department approved mechanism (such as a fire hydrant). The amount of storage capacity shall be determined by the fire protection district, with a minimum of one thousand (1, 000) gallon storage capacity per structure. Response: The applicant does not anticipate installing on-site water storage for this structure, since it is not planned for human habitation. (c) Regardless of size, all structures where humans congregate regularly (including detached garages and horse barns) that are located within areas identified as containing "C - Severe Hazard: Trees" or X - Severe Hazard: Brush" wildfire Clark Family Trust Activity Envelope and Site Plan Review Page 9 000012 hazard shall be required to install in-house sprinkler systems which meet the standards of the local fin; protection district and the adopted building code. Response: This property is not rated as a severe wildfire hazard area. (d) All structures greater than five thousand (5,000) square feet in size shall be required to install in-house sprinkler systems that meet the standards of the local fire protection district and the adopted building code. At building permit submittal, the local fire protection district may require smaller structures to be sprinkled due to hazard considerations, emergency access difficulties and lack of proximity to fire protection services. Response: The structure will be well less than 5,000 square feet in size. We would also note that the Snowmass fire sub -station is located within 1 mile of this property, providing for good response times to this highly accessible property. 4. Roofing Materials and Projections At And Below Roof Line (a) Low Hazard Area. 1. Roofing Materials: a. Class A covering or Class A Assembly as defined by the currently adopted building code. b. No wood shakes or shingles. All other Building Code compliant methods and materials permitted. Response: The applicant will comply with these requirements. (b) Medium Hazard Area, and (c) Severe Hazard Area. Response: Not applicable (d) All Hazard Areas. Roofs with less than a 3:12 pitch are not permitted in low, medium, or severe wildfire areas unless they comply with the following., 1. All roofs coverings shall be constructed of non-combustible materials and installed on a Class A assembly. Clark Family Trust Activity Envelope and Site Plan Review Page 10 000013 2 All roof coverings shall have a surface that shall facilitate the natural process of clearing the roof. 3 Protrusions above the roofline, such as parapets, shall be prohibited. 4. Roofs shall be installed as required by the adopted building code and shall have a minimum slope of 1:48. 5. All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshall prior to submittal of a building permit application. Response: The applicant will comply with these requirements. 5. Maintenance and Miscellaneous Requirements (a) Roofs and Gutters shall be kept clear of debris. (b) Roof vents shall be screened with corrosive resistant wire mesh, with mesh one- fourth inch (1/4) maximum. (c) Yards shall be kept clear of all litter, slash, and flammable materials. (d) All flammable materials shall be stored on a parallel contour a minimum of fifteen feet (15) away from the structure. (e) Weeds and grasses within the ten foot (10) perimeter shall be maintained to a height of not more than six inches (6). (t) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifteen feet (15) away from the structure. (g) Swimming pools and ponds shall be accessible by the local fire district. (h) Fences shall be kept clear of brush and debris. (i) Wood fences shall not connect to the structure. () Fuel tanks shall be installed underground with an approved container. (k) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space mitigation around any above -ground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire -resistive Clark Family Trust Activity Envelope and Site Plan Review Page 11 000014 construction on the exterior of the walls. (1) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. (m) Addresses shall be clearly marked with two inch (2) non-combustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non-combustible post. (n) Additional recommendations from the Colorado State Forest Service, the Pitkin County Sheriffs Department, and the local fire protection district may be incorporated into any conditions of approval as necessary to mitigate wildfire hazards. Response: The applicant will comply with all of these requirements. Clark Family Trust Activity Envelope and Site Plan Review Page 12 000015 E. Wildlife Habitat Areas (Sec. 7-20-70) According to the pre-application conference summary, the properly is located within or adjacent to mule deer winter range. A mule deer severe winter range and winter concentration area and elk winter range and winter concentration area is mapped to the northwest of the property, across East Sopris Creek Road on Light Hill. The applicant agrees to comply with the species-specific standards applicable to mule deer winter range that are described in Section 7-20-70 (f) (2) of the Land Use Code. Therefore, any dogs that are kept on this property will be properly kenneled within 50' of the residential buildings, except for any dogs working on the ranch. The applicant also agrees that no "high impact recreational uses" will occur on this property. The applicant has not provided any specific responses to the other species specific habitat types, since those areas are located well off the property. Since this property has been developed for many years and the applicant proposes only minor changes to the existing land uses on the property, the applicant does not believe that these changes will cause any additional impacts to these off-site habitat areas. Section 7-20-70 (c) of the Code establishes the County's general land use standards for wildlife habitat areas. Following are the applicant's responses to these standards. 1. When existing native vegetation must be altered within the Activity Envelope, the applicant may be required to prepare a habitat mitigation plan acceptable to the County. Such mitigation plan may substitute (in a nearby area on the subject property) vegetation equal in type and quantity to that being removed to mitigate effects on wildlife species. Should there be no opportunity on the property for habitat mitigation or restoration, off-site mitigation benefitting the same species may be required, or financial mitigation may be paid into a County habitat mitigation fund should such a fund be established in the future. Response: The applicant will submit a landscape plan as part of the building permit package that illustrates the native vegetation that will be planted to replace any native vegetation that is removed as a result of the proposed development of the site. 2. Manipulation of vegetation outside of the Activity Envelope is prohibited. Response: The applicant will comply with this requirement. 3. Mesh or woven wire fences are prohibited outside of the Activity Envelope. Response: The applicant will comply with this requirement for any new fencing that may be installed. Clark Family Trust Activity Envelope and Site Plan Review Page 13 000016 4. Wood rail fencing shall employ three rails or less, be the round or split rail type, shall not exceed fifty-four (54) inches in height above ground level and 12 inches in width (top view) and shall have at least eighteen (18) inches between two of the rails. Response: The applicant will comply with this requirement for any new fencing that may be installed. 5. Win- fencing must be three strand or less. The top wire shall be twelve point five (12.5) gauge twisted barbless type at a maximum height of forty-two (42) inches. The middle strands (which may be barbed) should be located a minimum twelve (12) inches apart and from the top wire preventing entanglement when mule deer jump over. The bottom strand should be sixteen (16) inches from the ground. Response: The applicant will comply with this requirement for any new fencing that may be installed. Tall, overly mature trees and standing dead trees (snags) should be retained at the rate of two (2) to five (5) per acre whenever possible as nesting or perching habitats. Response: The applicant will comply with this requirement. 7. In areas of high black bear activity, fruit bearing trees and shrubs shall be prohibited within the Activity Envelope. This does not include pre-existing native trees and shrubs. Response: No fruit bearing trees or shrubs will be planted on this property. 8. Development shall be clustered to the maximum extent possible to minimize impacts on wildlife. Response: The new building is located adjacent to the existing CDU and in proximity to the main house, clustering these buildings and leaving the meadow as open space. 9. Access shall be provided to the Colorado Division of Wildlife for trapping, tagging, studying, or otherwise managing wildlife. Response: The applicant will comply with this requirement. 10. Trash/garbage shall be kept in an approved bear resistant container or enclosure. Response: The applicant will comply with this requirement. Clark Family Trust Activity Envelope and Site Plan Review Page 14 000017 11. Bird feeders, including hummingbird feeders, shall be hung away from any deck or window, and be at least ten (10) feet from the ground suspended between two (2) trees or posts. All seed feeders shall include a seed catchment pan to catch discarded seeds. 12. Horse grains, pellets, and cookies shall be stored in bear resistant containers or enclosure. 13. Pet food shall not be left outside. Response: The applicant will comply with each of these requirements. Clark Family Trust Activity Envelope and Site Plan Review Page 15 F. Scenic View Protection (Sec. 7-20-120) The purpose of the County's scenic view protection standards is "To minimize the visual impact of new development (including expansions to existing structures) when viewed from designated road corridors, as well as to preserve the rural character of all Rural Areas of the county The applicant has prepared a series of visual images to represent the visual impact of the new agricultural equipment building. These images include elevations illustrating the building's design and materials and a photograph taken from East Sopris Creek Road into which the architect has hand drawn the proposed building. The images show that the proposed agricultural equipment building will complement the rural character of the Snowmass-Capitol Creek valleys. The building will sit approximately 430' back from East Sopris Creek Road, so it will be situated in the backdrop, not the foreground as viewed from that road. The building will have a low profile, since it complies with the requirement that it be just 16' in height to the peak of the roof. The articulated building design and peaked roof form also help to break up the massing of this relatively small structure. It will be built using traditional materials (barn wood or stained wood siding and corrugated rusted steel roof panels). These materials will enhance the rural character of this ranch property and soften the visual impacts of the new structure, particularly as compared to the existing hangar which is painted with a bright color and has a flat roof and flat building form. The applicant will remove the hangar from the property prior to occupancy of the new building. Following are the applicant's responses to the County's scenic view protection standards The proposed development shall utilize existing topography and natural vegetation, such as ridges, hills and existing trees, to screen buildings to the maximum extent practicable. Response: The building will be located behind a stand of mature brushy vegetation. Although some of that vegetation must be removed to allow for the building footprint, access into the building and defensible space around the building, the photo image is meant to accurately portray the vegetation that will remain standing in front of the building. 2. The proposed development shall avoid the location of structures within the Scenic View Protection Areas and shall avoid the location of structures within any Viewplane identified in the State Highway 82 Corridor Master Plan and Down Valley Comprehensive Plan, if possible. If location outside of the Scenic View Protection Area and defined viewplanes is not practicable, then the proposed development shall not be located on the highest ground or most visible portion of the site as viewed from those corridors listed above. Clark Family Trust Activity Envelope and Site Plan Review Page 16 000019 Response: The lot is a flat piece of land that is located along East Sopris Creek Road so it is not possible to fully avoid the location of structures within the Scenic View Protection Area. However, the building has been located 430' back from the County road, which is a less visible portion of the site than the lands located immediately adjacent to the road. 3. The proposed development's height and bulk shall be designed to avoid, to the maximum extent practicable, the visibility of buildings from those corridors listed above. This may include, but shall not be limited to, breaking the mass of the building down into a series of smaller forms, articulation of the building facades to avoid a wall or row effect, and staggering rooflines to avoid a long unbroken plane. Response: The building is composed of four vehicle bays which have been designed as series of articulated modules to break down the mass into smaller elements. The roof line is also slightly staggered so it does not appear to be a single unbroken plane. The three cupolas on the top of the building add further interest to the roof form. 4. The proposed structure shall be placed so that it does not project above a ridgeline such that a structure silhouettes against the sky when viewed from those corridors listed above, unless there are no alternate building sites on the lot or parcel. Response: The proposed structure will not penetrate a ridgeline and will not silhouette against the sky. 5. The proposed development shall be designed to compliment the natural topography of the land through the use of techniques such as earth sheltered design, the use of natural materials and coloring, the use of low-reflectance materials, or clustering of structures on the least visible portions of the site. When a building is proposed near a ridgeline, then its form (particularly its roof form) shall replicate, parallel or compliment the natural form of the ridgeline so that it appears to be an element of the natural ridgeline. Response: The applicant plans to use natural materials or man made materials that have natural coloring. The building will be built with traditional materials, including barn wood or stained wood siding, corrugated rusted steel roof panels and metal clad wood windows. The building is clustered next to the existing caretaker dwelling unit. 6. The proposed development shall preserve natural vegetation and avoid development within irrigated meadows to the maximum extent practicable. Response: The proposed building has been located at the edge of the meadow, next to the existing driveway. Some natural brushy vegetation will be removed to make way for the structure and to provide required defensible space. The applicant would prefer not to plant any replacement vegetation to further screen the building but will do so if the staff feels that additional screening is necessary and appropriate. Clark Family Trust Activity Envelope and Site Plan Review Page 17 000020 The proposed development shall install utilities in locations and through procedures that minimize visual impacts to the maximum extent practicable. Response: Utilities have previously been installed underground to serve the other structures on the property. No major extensions are anticipated at this time. All satellite dishes in the proposed development shall be located to minimize visibility from those rights-of-way listed above and shall use earth tone colors and/or screening to minimize their visual impact. Response: The applicant will comply with these requirements. 9. The proposed development shall not utilize earth moving and berms as the primary means of compliance with these regulations, but earth moving may be utilized in conjunction with other techniques to comply with the standards of this section. Where earth moving techniques are necessary, man-made forms should be undulating and natural in appearance. Response: Earth moving and berms are not proposed as the means of complying with these regulations. 10. In the Rural Area only, development shall be located so that activities and development occur in at least one of the locations specified in subsection (e) as they may apply to the particular property. Response: The proposed building has been located at the edge of the meadow and partially behind an existing stand of vegetation, in compliance with the siting guidelines. 11. The exterior of all development shall be built or painted with indigenous earth tone materials or colors. Response: The materials listed on the architect's site plan demonstrate that the proposed building will comply with this requirement. 12. All roofs shall have a non -reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflection, with the exception of materials associated with solar or photovoltaic equipment. Response: The roof will be composed of corrugated rusted steel panels, in compliance with this requirement. 13. Lands disturbed by earth moving or berms should be revegetated using native species that are already growing on or near the site. Topsoil shall be stockpiled Clark Family Trust Activity Envelope and Site Plan Review Page 18 000021 and placed on disturbed areas. Irrigation shall be provided to the mvegetated areas if it is necessary to ensure the survival of planted native species. Response: The applicant will comply with this requirement. 14. To the maximum extent practicable, roads and driveways shall be located to skirt the edge of and avoid dividing meadows and pastures and to avoid major road cuts. Roads and driveways should take advantage of the screening potential of natural topography and existing vegetation. Existing roads and driveways shall be used where practical. To enhance screening, a row of trees may be planted along the roads or driveways. To the maximum extent practicable, roads and driveways located around the edge of or in meadows shall be laid out with soft, curving edges and shall avoid straight line corridors that are incongruous with the natural setting. Response: The proposed driveway will cut across the existing meadow. However, we have calculated the area of the meadow as compared to the area of the driveway and find that the existing meadow is approximately 29.5 acres in size. Although the driveway envelope is rather wide to account for necessary grading, the actual surface of the new driveway will be 16' wide and take up just 7,500 to 8,000 square feet of the meadow. When added to the footprint of the small new building, the proposed development will impact less than 10,000 square feet of meadow land (less than %< acre) which equals less than 1 % of the existing meadow. We would also point out that previously there was an airstrip across this meadow that created much more of a disturbance to the meadow than will the proposed driveway. That airstrip has been abandoned and is in the process of being reclaimed as meadow. The applicant has also committed to removing the airplane hangar that was associated with the airstrip, reclaiming additional area as meadow. The driveway has been laid out with soft curving edges that complement the natural setting and does not present a straight line corridor. Clark Family Trust Activity Envelope and Site Plan Review Page 19 000022 G. Landscaping and Vegetation Protection (Sec. 7-20-130) The applicant does not propose to install additional landscaping around the agricultural equipment building. Some natural brushy vegetation will be removed to make way for the structure but no trees larger than 6" DBH are present in this area.. The applicant would prefer not to plant any replacement vegetation to further screen the building but will do so if the staff feels that additional screening is necessary and appropriate. The applicant will, however, use native vegetation and a County -approved native grass seed mix to stabilize and restore the areas disturbed to install the driveway and new building. Following are the applicant's responses to each of the standards in this section: (b) General Provisions. 1. Protection of Natural Vegetation. The applicant will preserve the natural vegetation on the site, except for that vegetation within the activity envelope that must be disturbed to build the new agricultural equipment building and create defensible space around the building. 2. Conformance with Wildfire Regulations. There is no conflict between the County's wildfire regulations and the requirement to protect natural vegetation on this site. 3. Berms. A berm is not proposed for this site. 4. Landscape Enclosures. Landscaping is not proposed to be used to enclose the boundary of the parcel. 5. Visibility Clearance. No landscaping is proposed where it would inhibit the visibility of drivers. 6. Utility Easements. Landscaping will not be installed over a utility easement. 7. Financial Security. The applicant requests that no financial security be required for this project. 8. Maintenance. The applicant agrees to maintain all installed landscaping in a healthy condition and to replace plants that do not survive. (c) Required Landscaping in Rural Areas. None of the purposes for which the Code requires landscaping to be provided apply to this proposal. Should any shrubs or trees be installed on the property the species chosen will be indigenous plants which are clustered into groupings similar to those which occur naturally on the site. Trees or shrubs will not be installed in regularly spaced lines or rows. Clark Family Trust Activity Envelope and Site Plan Review Page 20 000023 H. ROADS, DRIVEWAYS AND PARKING (Sec. 730) The applicant does not plan any activities that would have significant impacts on the County's road network. The new driveway entrance will be located approximately 390 feet to the west of the existing entry. The driveway has been designed to comply with the applicable County standards. It would have a 90 degree intersection with the County road, offer a flat (2% grade) platform adjacent to the road, and have a surface that is 16' wide. Given the relatively flat nature of the meadow it crosses, cut and fill activity can be kept to a minimum. An appropriately- sized culvert will be placed where the driveway crosses an existing drainage swale. Parking on the site already complies with the adopted County standard of 2 spaces for the main residence and 1 space for the CDU. The spaces were previously designed to comply with the applicable County design standards. Clark Family Trust Activity Envelope and Site Plan Review Page [ 1 000024 III. FLEXIBILITY FOR AGRICULTURAL SUPPORT Sec. 2-30-20 (g) (19) of the Land Use Code authorizes an applicant to request additional exempt agricultural floor area beyond that which is provided in Sec. 5-20-70 (i) of the Code. That sub -section permits an agricultural equipment building to be 990 square feet in size for a property that is 20 to 160 acres in size. The applicant proposes a structure of 1,320 square feet which is 330 square feet larger than allowed by the Code. Following are the standards for review of an application for added floor area: (a) Agricultural Buildings are listed as an allowed, special review or master plan use in Table 41 in the zone district; and Response: Agricultural buildings are listed as an allowed use in the RS -30 zone district. (b) The agncultural building complies with the applicable standards of Chapter 7, and Response: Section II of this application demonstrates that the proposed building complies with the applicable standards of Chapter 7 of the Code. (c) The owner demonstrates that the property is utilized for an agricultural operation as defined in Chapter 11 and that the agricultural building(s) are designed and will be used to support the agricultural operation. To demonstrate that the property is utilized for an agricultural operation and that the agricultural building(s) are designed and will be used to support the agricultural operation, the owner shall submit the following: (1) Detailed description of existing and proposed agricultural activities, including number of animals, types and size of equipment, implements and gear, etc. Response: The subject property is an active ranch with an irrigated meadow that is nearly 30 acres in size. The meadow is grazed by approximately 25 horses that are owned by others. The drawing showing the floor plan includes a diagram that lists the pieces of equipment that would be stored within the building. There are five such pieces of equipment that the applicant owns today which are used to maintain the property. These include two tractors, a horse trailer, a Polaris which is used during the winter and a pick-up truck. Other implements and gear are stored in the small shed. (2) Site plan showing existing and proposed buildings and areas on the property used for the agricultural operation. There are currently just two small storage buildings on the site that support the ranching activities. The old airplane hangar and the small shed are both used for storage of a variety of implements and gear. The hangar will be removed prior to the occupancy of this new structure. The shed will remain as a storage building. (3) Floor plans and elevations of the agricultural buildings to demonstrate that the scale and layout of the buildings are appropriate given the specked agricultural activities. Response: Floor plans and elevations accompany this application. It is important to note that the proposed agricultural equipment building will be the primary agricultural building on this property. The property does not contain a bam, even though the Code would authorize an exempt barn of 4,060 square feet for a property of this size. (4) Description of how the proposed agricultural buildings will support and sustain the rural character of the County. Response: This site is a prominent property located along one of the primary roads in Old Snowmass. This property establishes the entry image for the East Sopris Creek Valley, since it is one of the first properties one sees when the roads splits off from Capitol Creek Road. Today this ranch property establishes an open, agricultural entry image which is consistent with the rural character of Old Snowiness. This building has been designed to project a simple, utilitarian image that is consistent with ranching. It will replace the airplane hangar, which is quite inconsistent with the character with the area. IV. CONCLUSION The applicant has responded to all applicable criteria of the Pitkin County Land Use Code, pursuant to direction given during the pre -application conference. Sufficient evidence has been provided of the project's compliance with said criteria, and commitments have been made to insure that the proposed development will mitigate its development impacts. The site plan and plat amendment shall be submitted to the Community Development Department for review, approval and recording, prior to application for any building permit for the CDU. I The detached CDU shall not exceed 1.000 net livable square feet of Floor area. I still believe that everyone would be better served if the building were moved 10-15' North and 10-15' West of the originally submitted location (not 50' as I stated before) in case you require brush clearing of 10' or more from the perimeter. This would not only move the building from my view plane, it would allow much more foliage to remain to block the view from the roadway. With respect to the proposed second access to 7037, 1 think it would be great for both of us to have separate entrances to each property. If you print them out, you should be able to read them after enlarging and get the gist. This Clark proposal shows there building not only in our view plane, but also in a beautiful stand of wild servicebery bushes which provide wind, blockage to my property as well as a haven for dear to weather. If they simply move their proposed building 50' or so to the North and to the West,(I have marked up their survey attached) they will get out of the wet lands and out of the forage where the existing building is that he intends to tear down. If it is approved where it is shown, according to the submittal the whole stand of bushes will have to be removed to provide the 30' fire set back. They did do a nice job of locating the building out of my direct Sopris view, but we will still be impacted negatively unless they move it further away. There are currently irrigation ditches in the proposed building location that irrigate that portion of the property and take the run off from the whole Capitol Creek drainage. When I plated the subdivision originally in 1977, we needed to keep all buildings out of this comer, hence the location of the existing hanger and the agricultural out buildings. We appreciated the opportunity to review this application. Caucus board members Martha Ferguson, John McBride, Patsy Batchelder, and I visited the site on 19 January, with John Clark present to describe the application. We discussed the driveway realignment, the agricultural equipment building, and the removal of the existing airplane hangar. The proposed driveway entrance makes sense. The location of the proposed agricultural equipment building appears to minimize its impact on neighbors' viewplanes. We discussed and approved the allowance of 330 additional sf of floor area for the agricultural equipment building. The Caucus members, supported by the Snowmass Capitol Creek Caucus board at its monthly meeting, did make note of certain conditions for approval. One, that a maximum ridgeline height of 16 feet from existing grade be preserved. Second, that removal of existing vegetation of scrub oak and willow be minimized as far as fire codes and related guidelines allow in order to screen the equipment building from the East Sopris Creek roadway and neighbors in the vicinity. Third, that wood siding and rusted metal roof be used, as proposed. Fourth, that the removal of the existing airplane hangar be conditional on its being re -used by someone who wants to remove it or that its materials (chiefly steel framing and aluminum exterior) be appropriately recycled. Fifth, that the abandoned stretch of the current driveway be allowed to revegetate. The Snowmass Capitol Creek Caucus board approved the Clark Family Trust application by unanimous vote on 19 January 2015. Sincerely yours, rLL-k k-Q�� Land Use Committee Snowmass Capitol Creek Caucus Snowmass Capitol Creek Caucus PO Box 507 Snowmass, CO 81654 C4��1 PITKIN COUNTY COMMUNITY DEVELOPMENT DEPARTMENT 130 South Galena Street Aspen, Colorado 81611 (970) 920-5526 FAX# (970) 920-5439 MEMORANDUM To: Suzanne Wolff FROM: Susan Pearson, Planning Engineer Re: Clark Family Trust Activity Envelope and Site Plan Review (PID 2645-032-02-001; Case P109-14) DATE: January 15, 2015 After reviewing the application I have the following comments: ➢ The applicant shall obtain an approved Access Permit for any improvements or changes to the existing access ➢ The application shall include: • An engineered Access plan with a slope analysis for the drive, with details (plan, profiles and sections) showing all dimensions and slopes — existing and proposed • Compliance with the current Asset Management Plan • Compliance with all requirements of the Basalt Fire Department • Details on all pull-outs, turn arounds and parking locations • Details and sections demonstrating the driveway slope and any culverts, and/or drainage improvements existing and proposed • If required, fire hydrants shall be included in this permit application • Access plans should be stamped and signed by a Professional or Civil Engineer and include sections, take offs, profile view and slope analysis • Any abandoned accesses or portions of abandoned accesses will need to be reclaimed and revegetated to match surrounding vegetation • The culvert location and sizing must also be engineered and included with this Access Permit submittal • This new driveway intersects a County Road and must have the review and approval of the County Engineer ➢ A detailed engineered (stamped and signed) Drainage and Erosion Control Plan shall be submitted with each development permit: • All historic and natural drainage patterns shall remain unchanged. • Minimal disturbance shall take place • Natural vegetation shall be preserved as much as practicable cif -�_ _ • Mitigation measures and BMPs shall remain in place until replacement vegetation is viable • Biodegradable erosion control matting shall be used for revegetation on slopes ➢ The applicant shall submit a Large Scale detailed Construction Management Plan (CMP) with each development permit that addresses all phases of construction. This shall include a site plan and written methodology addressing the requirements of a large scale CMP. The application shall include: • Fugitive dust control • A revegetation plan inclusive of the entire site • A tire washing device or a vehicle track pad should be used at the egress from the site to ensure that no sediment is tracked off site • Top soil shall be kept alive and stored on site using adequate BMPs • Stormwater management techniques appropriate to the site should be utilized — no sediment or runoff should leave the site https://www.codot. Dov/programs/environmental/water- quality/documents/CDOT%20Pocket%20Guide%20122211.pdf • Silt fencing, straw wattles and hay bales must be used during construction to control drainage from this site until disturbed areas are adequately revegetated. • Acquire a State Stormwater Permit if the cumulative area of the entire project disturbs in excess of 1 acre ➢ The applicant shall provide a detailed outdoor lighting plan, which should include all outdoor lighting cut sheets — this plan must comply with the requirements of PCLUC 7-20-140 ➢ Retaining walls, if over 4 feet in height shall be engineered. They should be shown on the Access/Earthmoving Permit application, but, should be submitted for approval using a Building Permit Application. No retaining walls more than 4 feet in height are allowed in any setback ➢ Berms have not been proposed with the application; however, if berms or other earthwork become a proposed or required action — An Earthmoving Permit application will be required. Essentially the applicant desires to provide for a new access into the property that will conform to the Pitkin County Access Management plan for driveways and build a roughly 990 square foot equipment building that will be accessed by the new driveway. The existing driveway can act as a seasonal secondary emergency route that I understand will be allowed to blend in with the natural landscape but maintain its structural integrity over time. The department can serve the existing premise and the new equipment shed as proposed. Regards brush mitigation it can be minimal to within the immediate zone roughly 10-15 feet around the building to mitigate direct flame impingement and small brush radiant hazards. The premise is in close proximity to the Basalt Fire District Lazy -O sub -station easy to accommodate as such. If I can be of further assistance please contact me at your convenience.
