HomeMy WebLinkAboutbocc.packet.12152014 - Environmental Health Department FeesAGENDA ITEM SUMMARY REGULAR MEETING DATE: December 15, 2014 AGENDA ITEM TITLE: Second Reading, Environmental Health Fees STAFF RESPONSIBLE: Kurt Dahl, Environmental Health Manager ISSUE STATEMENT: The Environmental Health Department is establishing fees for two new OWTS permits and clarifying the fee for the OWTS use permit. BACKGROUND: The Environmental Health Department is establishing two new fees for the Onsite Wastewater Treatment System (OWTS) Program and clarifying the fee to be charged for OWTS Use Permits. The new fees are part of the new OWTS Regulations adopted in August of 2014. LINK TO STRATEGIC PLAN: Flourishing Natural and Build Environment KEY DISCUSSION ITEMS: The renewable permit fee is for a new permit established as part of the adoption of the 2014 OWTS Regulations. The fee is $100/permit. This permit will be for all commercial and higher level treatment OWTSs in Pitkin County and will be renewed every two years. The other new fee is for the establishment of a minor repair permit. This permit will capture small repairs to OWTSs (i.e. pipe repairs, pump replacements, etc.). The Department does not currently capture this repair information and it has become evident through the use permit program that these repairs need to be recorded. Staff recommends the fee be set at $50 to encourage compliance and the permit will be initiated when the Department implements the CSI software. The permit will be issued "over the counter" and with little or no staff involvement and is only intended to capture basic repair information. At the December 2, 2014 BOCC Work Session, the BOCC recommended the department not charge a fee for this permit. The Board recognized the importance of collecting information on all types of repairs to OWTSs but felt that the Department would obtain little to no compliance if a fee was charged for a minor repair permit. The no fee recommendation was included in the approval at the December 3, 2014 first reading and the change is reflected in the attached Appendix A of the Fee Ordinance. The use permit fee is $100 per permit. Previously, the department had been charging $100 per property and in some cases was issuing four permits per properties with four separate OWTSs but only charging $100 for all four permits. BUDGETARY IMPACT: Additional revenue of approximately $4,000 per year. Pitkin County proposes to set fees for the Environmental Health Department that are consistent and fair to the public and reflect the expense incurred in providing such services to the public and where applicable, follow Colorado State Statutes. 2. Certain fees currently charged for environmental health services no longer reflect the cost of providing the necessary levels of such services. The policy of the Pitkin County Board of County Commissioners is that development shall pay, in full, the cost of development review in Pitkin County. The fees herein will not achieve that goal, but implementation of the new fee schedule will allow the County to move closer to the goal. 3. The Department is establishing fees for renewable permits, and minor repair permits, which are new permit types pursuant to the adopted 2014 Onsite Wastewater Treatment System (OWTS) Regulations and have not been previously established. 4. The BOCC considered the proposed fees at a first reading on December 3, 2014 and at a second reading and public hearing on December 15, 2014. NOW, THEREFORE, BE IT ORDAINED by the BOCC that it does hereby adopt fees for the Environmental Health Department as follows: 1. Environmental Health Department Fees.
