ESPN, Inc. (hereafter, the "Applicant') has applied to the Community Development Director of Pitkin County, Colorado for approval of a Temporary Commercial Use/Special Event Permit for (a) use of the Buttermilk Ski Area base area for the X Games Aspen 2015; and (b) use of Brush Creek Intercept Lot for parking for the event. This would be the 14a year the Applicant has produced the Winter X Games at Buttermilk under a Pitkin County permit. 2. The X Games Aspen 2015 will take place from January 22'" through January 25'" between the hours of 8:00 A.M. and 10:30 P.M. As in years previous, there will be both day and night events at the Buttermilk Ski Area. Approximately 15,000 spectators and 3,000 staff, athletes, vendors, media, and guests are expected at the venue at any one given time. 3. The event proposes to have live concerts at the Buttermilk venue starting on January 22od, 2015 through January 25'", 2015. All concerts are scheduled for the afternoons/early evenings with the exception of the Saturday January 20, 2015 concert which is proposed at the conclusion of the evening competitions from 9:30PM to 11:00PM. Entrance to the concerts will be ticketed and the maximum venue capacity is 6,000 participants. Alcohol will been served at the concerts and a liquor license has been attained for this service. 4. The Special Event Committee was referred on the application and proposal. The BOCC was updated on the permit process at a work session on January 20, 2015. The Sheriffs Office has signed off on the application. 5. The Applicant has provided a Certificate of Insurance demonstrating adequate General Liability coverage (and naming Firkin County as an Additional Insured) satisfactory to Pitkin County Risk Management. 6. Pursuant to Section 4-30-50(i) of the Pitkin County Land Use Code, the Community Development Director may approve a Temporary Use/Special Event Permit for commercial activities or special events. NOW THEREFORE BE IT DETERMINED by the Community Development Director that she does hereby grant approval for the X Games Aspen 2015 Temporary Use/Special Event Permit to utilize the Buttermilk Base Area and the Brush Creek Intercept Lot subject to the following conditions: 1. No signage promoting the event (as opposed to directional signs, "no parking" signs and the like) shall be placed in the County. 2. The Applicant shall pay appropriate Community Development Department fees within 45 days of receiving invoices. 3. Prior to the event, the Applicant shall coordinate with the Pitkin County Airport — Sardy Field, on night lighting. Lights will be re -positioned, as necessary and as specified by the airport, to avoid Page 1 of 2 glare to aircraft using the airport. The Applicant shall also position lighting in a way that minimizes the impact on adjacent residential areas,to the extent possible. 4. Aspen Valley Hospital shall be alerted that an injured person is being transported to them, if not in an ambulance. Proof of Insurance shall be required of all athletes. 5. ESPN shall install additional lighting in the dirt area of the Brush Creek Intercept Lot to the satisfaction of the Colorado State Patrol. 6. All X Games athletes shall wear helmets for all events. 7. Alcohol shall only be served to concert participants. No alcohol shall be served to general spectators. 8. The evening concert on January 24th, 2015 shall conclude at 11:00PM. 9. Spectators wishing to walk to or from the event shall be directed away from walking on Hwy 82 and shall be directed to the walking/biking path on the north side of Hwy 82. 10. For 2016 Winter X Games, all necessary permits for structures, tents, scaffolding, and electrical installations shall be submitted in accordance with the Pitkin County Building Department's rules and regulations on or before January 1, 2016. 4 11. Within 60 days of this approval, the attached invoice shall be paid in full to Pitkin County Community Development. 12. All material representations made by the Applicant in the application (which shall specifically include representations made in all related supporting documents, correspondence subsequently provided by the Applicant, and representations made at the meetings held with Applicant), shall be adhered to and considered conditions of approval, unless superseded by specific conditions in this Determination. 13. In the event that any of the deadlines specified above are not met,the Director may make a finding that the Applicant is not in compliance with this approval and this approval will be null and void. In addition to the standard Special Event application, ESPN is seeking to: (1) Hold concerts at the Buttermilk venue; (2) Hold a fireworks show at the conclusion of one of the evening concerts; and (3) Serve alcohol at the concerts It is anticipated that the concerts will likely exceed the County Noise Code thresholds, resulting in the need for a noise variance. The ability to administer alcohol at the concerts will require the issuance of a liquor permit. Both of these processes require a BOCC review and decision. To hold a fireworks show a fireworks permit is needed which is an administrative permit process that requires sign offs by the Sheriff, County Manager, and local fire district. Staff is bringing these topics to the BOCC for discussion with the ESPN representative, Vanessa Anthes. The reason this discussion is coming before the BOCC very early in the process is so that direction can be provided and the Applicant can gauge whether to begin making arrangements to submit permits and to secure talent for the concerts while planning for the new aspects of the event. If the BOCC seems amenable to allowing these activities to occur, ESPN will formally submit for the appropriate permits to attain a noise variance, serve alcohol, and hold a fireworks show. Lastly, the purpose of this AIS is to comprehensively present these issues to the BOCC in a work session format in effort to avoid having piecemeal permits filed for the BOCC to review without sufficient background and preparation. BACKGROUND: ESPN has proposed the event to occur from January 22" to January 25a'. 2015. Similar competitions as in years past are proposed for this year's event. These include skiing, snowboarding, and snowmobiling competitions. A Special Event Permit application has been submitted that details the operations and activities for the X Games event. As in previous years, this permit application will be reviewed by the Sheriffs Office and the Special Events Committee. In addition to the standard application and process, the Applicant has included details regarding the proposed concerts, alcohol service, and fireworks which can be viewed as Attachment A. As mentioned above, these activities require separate permitting processes. SPECIFIC TOPICS Concerts/Fireworks noise: Attachment A details the concerts that are proposed for the four (4) day duration of the X Games event. As indicated on the attached site plan, the proposed concert venue will be just west of the snowmobile pit area and the Inn at Aspen and will have a maximum capacity of 6,000 ticketed participants. Tickets for these concerts will be available for purchase. The concerts would be held each day in the late aftemoonlearly evening from Thursday January 22nd, to 000004 Sunday January 25" with the exception of Saturday January 20 when an afternoon concert and evening concert are scheduled. The evening concert is proposed from 9:30PM to 11:OOPM. During the conclusion of the evening concert, a fireworks show is scheduled for the last 10 minutes of the show. The County Code states that a noise source is in violation if the surrounding residential properties receive noise that exceeds 55dB(A) from 7:OOAM to 7:OOPM, m measured at the property line. From 7:OOPM to 7:OOAM, this limit is 50dB(A), as measured at the property line. The Applicant states that it is anticipated that the audio from the concerts will not exceed 8OdB(A) from the event perimeter and not more than I OOdB(A) for more than 5 consecutive minutes. If these limitations are exceeded, the Applicant has offered self-imposed adjustments to the sound level. The County Code requires that when noise is anticipated to exceed these threshold limitations, a variance request can be submitted to the Environmental Health Director for review and decision. Given the four (4) day frequency of the concerts and potential community impact, the Environmental Health Director will refer the variance request to the Board of County Commissioners for review and decision. Bundled into this request will be a variance from the noise code for the Saturday, January 25° evening fireworks show. A separate fireworks permit will also required and signed off by the County Manager, Aspen Fire Protection District, and the Sheriffs Office. If the BOCC feels that these activities could fit within the scope of the X Games event, the Applicant will apply for the appropriate permits in the near future. Alcohol: The Applicant states that they would like to serve alcohol to concert ticket holders, one (1) hour before the start of each concert and conclude serving 30 minutes prior to the end of each concert. Alcohol sales would be restricted to ticket holders who are 21 years of age or older and be limited to a 2-3 drink maximum. Alcohol sales would be in the form of beer and wine. Liquor is not proposed at this time. Alcohol would only be available for ticket holders of the concert and is not intended to be available to the entirety of the X Games spectators. As in past years, the credentialed VIP area and private viewing suites are intending to serve alcohol. Serving alcohol in this capacity will require a Liquor Permit. A Liquor Permit would be processed through the Clerk and reviewed by the Liquor Board. If the BOCC feels that serving alcohol in the manner described above could fit within the scope of the X Games event, the Applicant will formally apply for the appropriate liquor permit in the near future. Representatives from Environmental Health, the Clerk, and the Sheriffs Office will be available at the hearing to discuss the proposal. KEY DISCUSSION ITEMS: The Applicant is looking to understand if the BOCC feels that these activities could fit within the scope of the X Games event. If there is a sense that these activities could fit with the scope of the X Games event, the Applicant will formally apply for the appropriate permits. LINK TO STRATEGIC PLAN: These topics link the Core Focus of "Livable and Supportive Community" and the (1) Success Factor of "a sense of personal and community safety". With the proposed event additions to the X Games, the primary focus of the event review will be to ensure safety of the X Games spectators and the public at large. 000005 BUDGETARY IMPACT: None at this time. Applicant's details on the topics 000006 X Games Aspen 2015 Music Program Event Description The live music program for the X Games Aspen 2015 is a temporary event. All concerts will be ticketed with a maximum capacity of 6000 (pending approval from the Fire Marshall). As part of ESPN's commitment to the continued evolution and growth of the X Games brand, the X Games music program is an integral component of the overall X Games festival format. It is a core goal of the ESPN and X Games management team to continue to build and grow our live music concert presence within the footprint of the larger X Games event. After considerable discussion and review, we believe that the site chosen on Buttermilk Mountain is the only available option towards achieving our goal of presenting a robust music schedule that supports our competition schedule and enhances the overall content offering and spectator experience at the event. Concert Alcohol Plan ESPN would like the opportunity to sell beer and wine at the X Games Aspen 2015 music venue on Buttermilk Mountain. Alcohol sales would take place only during the hours when the music venue was open (approx. 1 hour before concert start times, see Schedule below). Alcohol sales would be discontinued 30 minutes priorto the end of the concert, and sales would be restricted to 2 drinks per person maximum over the course of the concert. Alcohol sales would be restricted to ticket holders within the fenced music venue. Ticket holders would enter scanning cue for either over 21 or under 21. Over 21 would show an ID, at which point they would be given a wristband that they would be required to show at the bar with each purchase of alcohol. The wristband would be hole punched with each alcohol purchase, and purchases would be restricted to 2 drinks per person. VIP ticket holders would have access to free beer and wine within the fenced in VIP corral. VIPs will enter via a separate VIP cue (both over and under 21). Those over 21 will be scanned and given a wristband that may be used as an ID for a drink at the bar. The bartender will hole punch the wristband with each drink, and free drinks will be restricted to 2 per person. ASC will manage all alcohol sales on site ESPN will have security personnel in all areas that are trained in friendly intervention and will prevent alcohol from leaving the speck music venue. There will be alternative beverages available at all times when alcohol is being served. The event is nonsmoking. Free public transportation is provided into Aspen, Snowmass and the Intercept Lot. Free public transpiration to the event is heavily advertised as there is no public parking on site. We will be working with the Pitkin County Sheriff to continue with the same plan as in years past to provide a detox holding area for any underage contacts until a designated guardian arrives. All adult detox cases will be transported into Aspen's detox facility. Law enforcement will be utilized on event days (1/22-1/25) at all times when the venue is open — typically from 8am-1 Ipm. The event will also maintain an Incident Command Center (ICC) to address security, safety and/or medical needs through a unified command dispatch service. All concerts will be ticketed with a maximum capacity of 6000 (pending approval from the Fire Marshall). As part of ESPN's commitment to the continued evolution and growth of the X Games brand, the X Games music program is an integral component of the overall X Games festival format. It is a core goal of the ESPN and X Games management team to continue to build and grow our live music concert presence within the footprint of the larger X Games event. Aker considerable discussion and review, we believe that the site chosen on Buttermilk Mountain is the only available option towards achieving our goal of presenting a robust music schedule that supports our competition schedule and enhances the overall content offering and spectator experience at the event. ConcertAlcohol Plan ESPN would like the opportunity to sell beer and wine at the X Games Aspen 2015 music venue on Buttermilk Mountain. Alcohol sales would take place only during the hours when the music venue was open (approx.1 hour before concert start times, see Schedule below). Alcohol sales would be discontinued 30 minutes priorto the end of the concert, and sales would be restricted to 2 drinks per person maximum over the course of the concert. Alcohol sales would be restricted to ticket holders within the fenced music venue. Ticket holders would enter scanning cue for either over 21 or under 21. Over 21 would show an ID, at which point they would be given a wristband that they would be required to show at the bar with each purchase of alcohol. The wristband would be hole punched with each alcohol purchase, and purchases would be restricted to 2 drinks per person. VIP ticket holders would have access to free beer and wine within the fenced in VIP corral. VIPs will enter via a separate VIP cue (both over and under 21). Those over 21 will be scanned and given a wristband that may be used as an ID for a drink at the bar. The bartender will hole punch the wristband with each drink, and free drinks will be restricted to 2 per person. Introduction The X Games will be holding competition in a variety of action sports at Buttermilk Mtn., January 22a' to 25th' 2015. Twenty hours of competition will be televised on ESPN and ESPN 2. To accommodate the influx of traffic to the Aspen vicinity, X Games Organizers are working with the Aspen Skiing Company, City of Aspen, and the Highway Patrol in determining the impact of spectators to the area. The Traffic Management Plan includes: Educating and Informing the public as to traffic, puking, and shuttle information; and Management and Supervision of traffic on area roads, parking lots, and shuttle procedure. Management and Supervision of the X Games Transportation Management Plan will be conducted by Local Police, Highway Patrol and X Games Puking & Shuttle Staff (see Attachment B). The Plan will utilize one major satellite parking location, as well as a variety of shuttle buses to accommodate the large crowds that visit Aspen for the X Games. Routes to the Aspen area will be identified. A variety of media outlets will be used to publicize traffic, transportation, and parking information. Directional signage will also assist in providing spectators traffic information and advisories. Contingency plans will be developed in the event that the area is overwhelmed by traffic or if poor weather/road conditions develop. 2. Assumptions 1. Spectator capacity for the event is 15,000 at one given time (12,000 spectators and 3000 credential staff, athletes, media, VIP's). 2. The resort will be busier on the weekend than the weekdays, with Saturday being the busiest day of the event. 3. There is no onsite spectator parking at Buttermilk Mtn. base area. 4. All spectators will need to be shuttled to and from the event. 5. We anticipate that 6,000 spectators will take local transit (RFTA). 6. A satellite parking location for 1,200 cars (or 3,600 people) is in the process of being secured (Intercept Lot). 7. 1000 Spectators will be dropped off. S. X Games shuttles will run from the Intercept Lot to the Buttermilk base area during the four days of the event (see Attachment A). 9. At the point that the satellite lot is full, the event will be considered "at capacity". If and when the event is determined to be at "at capacity", spectators traveling to the X Games for the day on Highway 82 will be directed into downtown Aspen. 10. The "out" at the end of the day (approx 9:30 pm) will present be the biggest challenge (see Attachment A). 11. The plan must be heavily publicized (newspapers, websites, radio stations, roadside message boards, etc.). 12. The plan must be well coordinated between local police, highway patrol, parking & shuttle manager, and media outlets, etc. 2. 000027 3. The Plan The Transportation Management Plan will rely on the coordinated effort between the X Games, ASC, Local and State Traffic Control, and respective Marketing & Communications Departments. Each department will take predetermined action when the following traffic scenarios develop: Condition Green (traffic and puking light); Condition Yellow (traffic moderate and satellite lot 80% capacity with 100% capacity eminent). All spectators on Highway 82 traveling to the X Games will be directed into downtown Aspen to park and take RFTA shuttles to Buttermilk. Condition Blue/Black (Buttermilk at capacity). If and when Condition Red develops the X Games will be considered "at capacity". Spectators will be notified that the event is "at capacity" with "limited puking" in Aspen and to tune to 103.1 FM for further details. RFTA shuttles to Buttermilk will be suspended. In the unlikely scenario that the venue does reach capacity further details will be discussed with the Emergency Response Team. Local Transportation: The use of RFTA will be targeted for local transportation (from Aspen to Buttermilk). Weare looking into increasing RFTA service along regularly scheduled mutes (exact routes and schedules TBD). Staff, athletes, and spectators will be able to utilize this service, which in tum will keep additional vehicles off area roads. Spectator Shuttles: The X Games and ASC are in the process of coordinating parking and shuttles (see Attachment A) from the Intercept Lot to Buttermilk base area. Staff & VIP Shuttles: A separate shuttle system is being developed for staff and VIP's to get from Aspen to Buttermilk base area. ASC Shuttles: The existing ASC shuttle system that runs between the different ASC base areas will be enhanced. Six additional shuttle buses will be added to the route on the days of the X Games. 4. Publicity/Communications An integral part of the transportation management plan will be the ability to communicate a number of travel and puking issues to the local community and to the communities from which the X Games spectators are expected to travel. Event and Pre -Event Communications The Marketing and Communications department of the X Games, as part of its ongoing communications plan, will utilize the reach of the media, including radio, television, newspapers, posters, flyers and the intemet. We will target the local area and larger metropolitan locations. Through relationships with the media that we are continually developing and strengthening, the Marketing and Communications arm of the X Games will inform the public about the following: - Recommended routes to and from the X Games. - Public busing, transportation, parking and shuttle information. - Travel tips for visiting the Aspen area in the middle of winter. (e.g., carry chains, blankets, food and water) - Schedule of events. 000028 Emergency situations as they may warrant. 3. - Spectators will be directed to tune into 103.1 FM for event and transportation updates. This information will also be available on www.xgames.com, X Games mobile app and in a Spectator Information Guide distributed regionally throughout the month of January, in the weeks leading up to the X Games. Signage Temporary roadside signage is proposed to direct traffic to event parking lots. Signage will also serve to inform drivers of any traffic advisories in the area. (see Attachment C) Signs and barricades will also be installed to block cars from restricted parking areas. Emergency Communications An X Games Command Post will be established at the Buttermilk base area to monitor all X Games related activities. A Communication Flow Chart (see Attachment B) has been created to assist in the orderly flow of information between all necessary agencies. This information will consist of any incident or changing condition on site or in the regional area. If weather or capacity crowds should warrant, we will initialize the media, internet, and utilize the public address system at X Games venues to inform the public as to the changing conditions and safety precautions to take. This will be done in coordination with local authorities. In all communications our message will be, "Expect Delays, Plan Ahead, Leave Early, and Use Caution". As stated previously, the plan will incorporate communication between all appropriate agencies to indicate specific traffic scenarios that develop: Condition Green, Yellow, and Red. 5. Parkin¢ & Shuttles The one major satellite parking lot is located at the Intercept Lot (capacity 1,200 cars). As mentioned previously, there is no onsite spectator parking at Buttermilk base area. A private bus company will be contracted to run the X Games shuttle from the Intercept Lot to Buttermilk base area along Highway 82. The shuttles will run each day of the event from 7:00 am to 11:00 pm. 6. Contingency Parkin Locations This location will be utilized if needed for truck parking, emergency overflow parking, or an impound lot for vehicles that have been towed. 7. Management & Supervision Local and state police will monitor traffic flow on area roadways. The parking & shuttle manager will supervise the satellite puking lot and spectator shuttle traffic flow. Both groups will be in constant communication and determine each traffic scenario (Green, Yellow, Red). As mentioned previously, each department will take predetermined action when each traffic scenario develops. A Security Command Post will be established at Buttermilk base area. The Command Post staff will monitor all developments and communicate all traffic scenarios. 000029 4. All bartenders will be Tips Trained. ESPN will have security personnel in all areas that are trained in friendly intervention and will prevent alcohol from leaving the specific areas listed above. There will be alternative beverages available at all times when alcohol is being served. The event is nonsmoking. Free public transportation is provided into Aspen, Snowmass and the Intercept Lot. Free public transpiration to the event is heavily advertised as there is no public parking on site. We will be working with the Pitkin County Sheriff to continue with the same plan as in years past to provide a detox holding area for any underage contacts until a designated guardian arrives. All adult detox cases will be transported into Aspen's detox facility.
