CUSTOMER FACILITY CHARGE TO INCLUDE ALL RENTAL CAR OPERATORS
BENIFITING FROM THE USE OF THE ASPEN/PITKIN COUNTY AIRPORT
RESOLUTION NO. 2015
1. Pitkin County, a Colorado home -rule County, is the owner, sponsor and operator of
the Aspen/Pitkin County Airport (Sardy Field), located in the vicinity of Aspen,
Colorado, and has the authority to regulate commercial activities and to lease and
license space at the Airport, pursuant to, inter alia, 1973 C.R.S. 41-4101 et.Sea.. 30-
35-202, Title 10 of the Pitkin County Code, and Section 8.7.2 of the Pitkin County
Home Charter.
2. Pitkin County owns, operates, maintains and develops the Airport, in Part with
Federal grants, state funds, Passenger Facility Charges, Customer Facility Charges
(CFC) and user fees; and
3. Pitkin County adopted a $5.50 CFC to fund certain capital projects; and
4. The Airport intends to continue to collect the $5.50 CFC to accomplish additional
projects designed to facilitate major customer service improvements at the
Aspin/Pitkin County Airport.
NOW THEREFORE BE IT RESOLVED by the Board of County Commissioners of Pitkin
County, Colorado that:
SECTION 1: That the Customer Facility Charge (CFC) currently established at $5.50 be
periodically adjusted, as needed, the daily CFC upon each airport rental car companies'
customer's rental contract,
SECTION 2: The CFC will be collected on a daily basis for all cars rented for twenty-
four or fewer hours for the first transaction day, and every twenty-four hours for each
transaction day thereafter.
SECTION 3: The CFC will be collected by all rental car companies operating at the
Airport either as on -airport tenants or off- airport operators picking up customers at the
Airport.
SECTION 4: The CFC collected by the rental car companies shall be held in trust by the
rental car companies for the benefit of the Airport and shall be remitted monthly to the
County in accordance with procedures established by the County's Director of Finance.
SECTION 5: Rental car companies and their agents hold only a possessory interest in the
CFC, and no legal or equitable interest.
SECTION 6: That this resolution shall take effect on February 1, 2015.
