Castle Creel: Properties, Inc. ("Applicant") has applied to the Pitkin County Board of County Commissioners ("BOCC") to construct a single family residence and a detached caretaker dwelling unit, which requires the following approvals: • 1041 Hazard Review and Conceptual Submission to establish a building envelope; and Special Review for a Caretaker Dwelling Unit. 2. The property is located in the Castle Creels valley, off of Midnight Mine Road, and is more specifically described in the attached Exhibit A. The property contains approximately 44.225 acres and is zoned AFR-10. 4. The Planning and Zoning Commission ("Commission") reviewed the application at a duly noticed public hearing on November 10, 1998. The Commission gave the project a score of 58 points, which exceeds the threshold score of 43, and, therefore, recommended that the BOCC grant one non - metro residential GMQS allotment for the Castle Creek Properties property. 5. The Commission also recommended that the BOCC approve the 1041 Hazard Review, _Conceptual Submission and detached Caretaker Dwelling Unit, subject to conditions. 6. The BOCC accepted the score and granted one non -metro residential GMQS allotment to the Castle Creek Properties property on April 28, 1999. The Resolution has not yet been recorded. 7. BOCC heard this application at a duly noticed public hearing on November 17, 1999, at which time evidence and testimony were presented with respect to this application. 8. The BOCC finds that this application proposes develooment in the best possible location, given the hazards identified on the property, and that the development meets the requirements of the Land Use Code. NOW, THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners that it does hereby grant approval to the Castle Creek Properties 1041 Hazard Review, Conceptual Submission and Caretaker Dwelling Unit, subject to the following conditions which shall run with the land and be binding on all successors in interest: 1.
