Schwester, (hereafter "Applicant"), has applied to the Community Development Director of Pitkin County, ("Director"), for a Minor Amendment to a Development Permit to amend Administrative Decision No. 77-2014, specifically condition 43 that limits the height of the previously approved garage/CDU, to 20' as measured to the ridge of the roof. The Applicant further requests to shift the approved location of this proposed structure to an alternative location. 2. The property is zoned RS -30 PUD and contains approximately 35.4 acres according to the Pitkin County Assessor. 3. The property is located at 1800 Stone Road, Basalt; commonly described as Lot 14, West Sopris Ranch, Parcel Identification #: 246515300006 (Legal Description, Attachment A). 4. The Lot established a building envelope through a 1041 Hazard Review recorded at Book 38 Page 94 (Rec. No. 388235). This 1041 was granted approval through a regulatory takings pursuant to BOCC Resolution 95-179 which rescinded previous BOCC Resolution 95-168 denying 1041 approval. The parcel received a Reinstatement of Vested Rights pursuant to BOCC Resolution No. 100-2000. An amended 1041 Hazard Review site plan that shifted the building envelope westward was approved pursuant to Administrative Determination No. 25-2003 and recorded at Book 65, Page 77. In 2006, the property received approval to enlarge the previously approved building envelope in effort to construct an addition to the main house. Most recently the parcel received approval for an Activity Envelope, Site Plan, and Special Review for a Caretaker Dwelling Unit (CDU) pursuant to Administrative Decision No. 77-2014 (Reception No. 614769). An Activity Envelope/Site Plan was not recorded in association with this approval. 5. The application was referred to the Emma Caucus. Comments were received and are included in the file. 6. The Director finds that the property is located within a mapped Scenic View Protection Area as viewed from Hwy 82, West Sopris Creek Road, and East Sopris Creek Road and that the Applicant has erected story poles to replicate the amended location and height of the future structure, and that the future structure will not project above a ridgeline as viewed from West Sopris Creek Road, East Sopris Creek Road, or Hwy 82, within Pitkin County jurisdiction. The proposed garage/CDU will, however, be visible and obstruct a ridgeline from Highway 82 within Eagle County jurisdiction, specifically at Crown Mountain Park. The Director further finds that the mitigation such as color schemes, roof materials, and landscaping will aid in lessening the visual impact from this location. Page 1 of3 The Director further finds that the request to amend condition #3 in Administrative Decision No. 77-2014 to eliminate the language "as measured to the ridge" is consistent with BOCC Resolution No. 95-179 and other previous land use actions regulating the subject property. 8. The Director finds that the request is consistent with the requirements of the Pitkin County Land Use Code. APPROVED by the Director, subject to the following conditions: 1. The Applicant shall adhere to all material representations made during the application process. 2. Condition #3 of Administrative Decision No. 77-2014 shall be rescinded and replaced with the following language: "Pursuant to BOCC Resolution No. 95-179, the approved accessory barn/CDU structure shall be limited to a maximum height of 20', measured as defined per the Land Use Code (Section 5-20-60). " 3. The exterior of the garage/CDU shall utilize indigenous earth tone materials or colors and all roofs shall have a non -reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflection, with the exception of materials associated with solar or photovoltaic equipment. Material samples shall be submitted at building permit submittal for review and approval by the Community Development Director. 4. There shall be no exterior lighting on the northeast or northwest sides of the garage/CDU structure. All glazing on the northeast and northwest elevations of the garage/CDU shall have shades installed and drawn in the evening hours to lessen the light visible during the night time. 5. Prior to submission of any future building permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.1 and 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation of them. 6. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. Galena Street Aspen, CO. 81611 Location: 1800 Stone Road, West Sopris Ranch Lot 14 PID#: 246515300006 Zoning: RS -30 Owner: Aspen View Mountain LLC Representative: Ramsey Fulton MINOR AMENDMENT TO A DEVELOPMENT PERMIT Dear Mr. Michael Kraemer, This letter is the first item in a nine -item application for a Minor Amendment to a Development Permit, proposing to amend Administrative Decision No. 77-2014. We propose; (1) an update to the site plan, slightly shifting the location of the proposed CDU/Garage structure on the site, and (2) a revision to the administrative decision language addressing the maximum building height from ridge of roof designation to the more accommodating definition of Maximum permitted building height as defined per current Land Use Code (Section 5-20-60). Response to Land Use Section 2-20-150(b): Minor Amendment Before we describe in detail why we have proposed this addendum, and how the updates are in-line with the current Land Use Code, we want to express that per Land Use Code Section 2-20-150, this addendum meets the criteria of subsection (b) Minor Amendments Defined. Described below are the two amendments we wish to address, the supporting the supporting Land Use Code Sections, reasons for request, and supporting documents. Site Plan Update The draft site plan that was submitted as part of the previous Development Application included a building footprint and activity envelope that has since been further developed and refined to allow for adequate vehicular access to the garage given the maximum building heights described herein, while moving the proposed building farther from the ridgeline of the property. Keeping with the intent of the general proximity of the previous site plan drawing, a new proposed site plan is included in this packet. The story poles previously erected on the site were relocated and surveyed to match the proposed building footprint, and roof ridgeline. Further, as discussed, an improvement survey is included with this submittal that illustrates the existing grading of the development area, along with the updated story pole locations. These updated story pole locations are also noted and illustrated on the proposed site plan, as is proposed grading. It should be noted that while the previous proposed site plan indicated a conceptual Activity Envelope, our proposed site plan illustrates the proposed siting of the structure and the constrained area of the activity envelope requested for site design, grading and re -vegetation of disturbed areas. Maximum Building Height Condition #3 of the Administrative Decision No. 77-2014 states: "Pursuant to BOCC Resolution No. 95-179, the approved accessory barn/CDU structure shall be limited to a maximum height of 20' as measured to the ridge of the roof." Upon review of BOCC Resolution No. 95-179, specifically #14, we did not find that they maximum building height is defined as a measurement to the ridge. This subsection states: OC"All structures shall be limited to a maximum building height of 20 feet." In which case, the currently adopted Land Use Code: Section 5-20-60: MEASUREMENT OF BUILDING HEIGHTS, subsection (a) On Pitched and Gambrel Roofs - allows for the mid -point of the roof (as defined) be used as the maximum permitted building height, with expressed limitation and allowances. Such a definition will allow the proposed design, as expressed in the Administrative Decision No. 77-2014 to be feasible at this site location. Furthermore, as it is our understanding that the primary concern of the Community Development Department is that we remain compliant with the Scenic View Protection criteria and intent (as described below), we do not see reason for this request to be in conflict with the previously adopted Administrative Decision. Response to Land Use Section 7-20-120: Scenic View Protection As part of our minor Amendment to the previous resolution, and as discussed in our pre -application meeting, we felt it necessary to both move the story poles to the newly proposed building site and document that their heights are equal to or greater than the proposed building's primary ridgeline. Thus, we have included an improvement survey that illustrates the current location and USGS height of each story pole. This same information is used as an overlay to our proposed site plan, illustrating that the story poles are in-line with the proposed primary ridge of our structure and at a greater elevation than our proposed roofs ridgeline. These story poles, as documented, were examined at various locations along Highway 82 and along West Sopris Creek. The story poles were found to not be visible at any point along the Scenic Protection Right -of -Ways within Pitkin County, per Section 7-20-120(b). A graphic map of our findings is included as part of this packet, and we hope you find this evidence sufficient to satisfy any requirements. In summary, the proposed CDU/Garage primary ridgeline is not visible from Highway 82 anywhere east of Original Road in Eagle County, and is not visible anywhere along Emma Road, Sopris Creek Road or West Sopris Creek Road. It is also not visible from the bottom of Stone Road. In conclusion, we appreciate your understanding and thank you for working with us on this. I am hopeful that you will be able to see our rational for making this minor amendment, and grant us a resolution that will allow this project to work on the property. Once again, if you can adjust the maximum building height to not include the word 'ridge' and accept our updated site plan, this is all we are in need of to carry forward. The Applicant shall comply with the following standards for Development in a Severe Wildfire Hazard Area. A. Defensible Space: The area around all buildings/st metures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): i. Brush, and non -ornamental vegetation shall be removed and not replaced wit ' a 10' jeninwter of the residence. Grasses, forbs and irrigated ornamentals are all long as a not brushy or coniferous. ii. Installed or native landscaping within 20' of the residence shall not contain any brushy species -- only grasses or forbs are allowed. Aspen trees are allowed near the house, as long as they are not within 10' of the structure, and are kept limbed to 10' (unless the trees are less than 10' tall). No trees of any species may be within 15' of any window on the south, east and west sides of the home. On the north side of the house, aspen trees may be within 10' of a window. vii. The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Roofing Materials: Class A coveting or Class A assembly as defined by the currently adopted Building Code. No wood shakes or shingles. All other adopted Building Code compliant methods and materials permitted. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following. i. All roof coverings shall be constructed of non-combustible materials and installed on a Class .A roof assembly. ii.. The application notes the story poles for the new location are not visible from West Sopris Creek Road or Highway 82. However, there is no mention of visibility from East Sopris Creek Road. Also, we understand the poles may be seen from Highway 82 in Eagle County and/or Willits Lane near Willits PUD. Meanwhile, the well permit indicates a well depth of over 900' and a quantity of 3GPM as tested by the driller. The Caucus is concerned about the adequacy of this supply and what it means for the neighborhood. Consensus: The proposed improvements should meet all zoning requirements, including setback, height, ridgeline (scenic), water available to the home, etc. We assume the barn has been reviewed by the bam/ag committee.
