SUBMITTING TO THE ELECTORATE AT AN ELECTION TO BE
HELD ON AUGUST 13, 2002, A QUESTION REPEALING ARTICLE IX
OF THE COUNTY'S HOME RULE CHARTER TO MAKE THE
CHARTER CONSISTENT WITH THE STATE CONSTITUTION
Resolution No. -4 r_-2002
RECITALS
1. The County of Pitkin in the State of Colorado (the "County" and the"State,"respectively) is
a duly created political subdivision of the State, organized and operating as a home rule county
pursuant to the general statutes of the State and a county home rule charter (the "Charter") adopted
pursuant to the Colorado County Home Rule Powers Act.
2. The members of the Board of County Commissioners of the County (the `Board") have
been duly elected, chosen and qualified.
3. The Board has found Article DC of the Charter to be in conflict with Section 20 of Article X
of the State Constitution and desires to repeal Article IX to make the Charter consistent with the
State Constitution.
4. The Board desires to submit such proposal to the electorate at the primary election to be
held on August 13, 2002.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF PITKIN COUNTY, COLORADO:
1. The Board has determined, and hereby determines that the interest of the County and the
public interest and necessity require the submittal of this Home Rule Charter matter to the
electorate at the primary election to be held on August 13, 2002.
2. The question to be submitted to the electorate shall be as follows:
Shall Pitkin County Home Rule Charter Article IX, "Limitations on Tax Levy," be
repealed to make the Charter consistent with the State Constitution, Article X,
Section 20, "The Taxpayer's Bill of Rights," which imposes similar limits on tax
levies, such action to be effective as of the effective date of the Taxpayer's Bill of
Rights?
3. The officers of the County are hereby authorized and directed to take all action necessary or
appropriate to effectuate the provisions of this Resolution.

REGULAR MEETING ON THE 12TH DAY OF JUNE, 2002.

JUNE, 2002.
