Galena St. Aspen, Colcrado~ 81611 Attn: Pitkin County Baord of Adjustment Ref: Section 7-]0-0]0-C-2 We request a vairiance of 400 square feet for a loft to the home located at 2495~ Fryingpan River Road,. Meredith Colorado. The loft will be used as a workspace for sewing, and quilting f which supplements our income. Also a spare bedroom and bath for children and grandchildren when they visit. The loft will have absolutely no effect on the original outside structure of the home or lot. There will be an outside stairway in the back, which is not visible from the front. The stairway is for easy access to the upstairs as well as a fire escape. ~he heat ma!~er must go on the seco~td level to meet manufacturers specifications and also meet code requirements. There is no other place in the design of the home to install the heat ma~er. We have owned this property since 1966 and originally had a home on this property before the ordinance now in effect was implemented. The original home was destroyed in a propane explosion in 1973. Than~f you. ~ MEMORANDUM TO: TO Ail Board of Adjustment Members FROM: Joanna S. Schaffner, Zoning Officer DAT~: February 24, 1997 Pdt: March 4, 1997 Meeting Just three items for your information: 1. The Board of County Commissioners (BOCC) have not yet completed their interviews for the appointment of new Board of Adjustment members and have extended the terms of all present board members (except Mr. Cooper's) until April 1, 1997, at which time new members will presumable have been appointed. Therefore, you are all welcome back for one more meeting!! 2. As we are attempting to stagger the terms of members, (see previous memo), staff expects the Board to appoint two regular members and one alternate member to three year terms. If you have strong feelings either way about being appointed for a three year term, please call me at 920-5105. We do not know at this time who might be considered for a three year appointment, and staff will not be making any recommendations. Stay tuned... 3. Last month, we had only one application before the Board, (a request for additional FAR). YOU may recall that the applicants, Mr. and Mrs. Neal, were not in attendance. The Neals were given the wrong meeting date (my fault! and apologies!), but will be present for the March 4, date. Further discussion with the applicant and a recalculation of the existing residence, reduces the variance request from 500 square feet to 340.5 square feet. The loft plan itself has not changed. This reduction occurs for two reasons: A. The stairs are already in place to access mechanical equipment in the loft area, and so are deducted from the amount of request and are added to the amount existing, and B. Deck areas which were formerly included in floor area are now exempt. This area has been deducted from the existing amount and increases the amount of available floor area. Given these two changes, the following floor area calculations apply: Allowed pursuant to AFR-2 zoning 1,416. Existing: Lower Level (30 x 40) + Upper Stair 28.5 1.228.5 Remaining floor area 1,416 - 1,228.5 187.5 Proposed loft >5'6" in hgt (16 x 26.5) + (13 x 8) 528. Please change the dats on your sign to March 4, 1997 and re-post it from February. 24 to March.4, 1997. The Board heard your request as presented by me at their February 4, !997 meeting. Basically, i explained that a house previously existed on the lot, but that this house exploded in the early 70's. A f~w years ago, you applied for a new house, and because the zoning !imised your floor area, it was ne6essary fcr you to delete a loft area from your building plans. At this time, you wish to add the 564.5 square foot loft back into the house. I also explained to the Board the calculations for your request. They are as follows: Pursuant to the AFR-2 zone district, the floor area ratio is 13% of the lot area for lots up to 25,000 square feet in size. 1. ~ ~ Allowed Floor Area 10,890 sq ft x .13 = 1,415.7 sq ft 2. -Allowed Existing Remaining 1,415.7 sq ft ~,352 sq ft = ' 64 sq f~ 3. Some Board members seemed inclined to approve the request because they felt that there was no increase in building footprint and that the request had negligible impacts. OCher members felt philosophically opposed to the request, stating thaE the 1,416 square feet allowed by the AFR-2 zone was sufficient for a single family residence on a 1/4 acre, lot, and that i=wasmo=~ floor area than the original survey seemed to indicate was'containe~ i~ previous structures on the site. Historically the Board has had difficulty in finding a hardship to approve requests for increases in floor area. A hardship finding is required for the Board to approve a variance request. A list of type of hardships they can consider can be found in your application packet. I have enclosed this section in case you no longer have the original packet. The Board tabled your application because of a lack of demonstrated hardship and because they did not want to take action without the applicant being present. Their request is that you strengthen your argument for hardship, and appear at the March 4, 1997 meeting at 5:15 pm in the Sisser Cities meeting room located in the basement of City Hall in Aspen. I have also enclosed for you another copy of the Affidavi~ of Posting, since we do not want this next meeting date queered by a noticing deficiency. Please attach a new picture of the sign with the corrected date. You may wish to have it certified here at City Hall on the day of the meeting. Again, i am sorry for the confusion on the dates and hope this didn't cause you too much of an inconvenience. It was not my inten~ uo mislead you or have you miss your hearing.
