Vos Caudill, Pitkin County, CO AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO AUTHORIZING THE CONVEYANCE OF A PORTION OF TRACT C, GOVERNMENT LOT 20 SUBDIVISION EXEMPTION TO 214 WEST COOPER LLC ORDINANCE NO. 'V/ -2015 RECITALS 1. 214 West Cooper LLC is the owner of a parcel of land described as Lots P and Q, Block 54, City and Townsite of Aspen, Pitkin County, Colorado, commonly known as 214 West Cooper Avenue, Aspen, Colorado, which is more specifically described in the records of the City of Aspen. 2. The Board of County Commissioners of Pitkin County ("Pitkin County") is currently the owner of a parcel of land that adjoins Lots P, Q, R and S, Block 54, City and Townsite of Aspen, known as Tract C of Parcel A, Government Lot 20 Subdivision Exemption, recorded in the records of Pitkin County in Book 30 Page 23 ("Remainder of Tract C"). 3. Tract C originally adjoined the length of Lots K -S, Block 54, City and Townsite of Aspen (the "City Lots") and was donated to Pitkin County by Wolftone Corporation in 1993 pursuant to a conditional option on the Government Lot 20 Subdivision Exemption Plat. 4. The County previously conveyed that portion of Tract C adjoining City Lots K -O to CD Holdings LLC through Ordinance Number 27-2014. 5. The County desires to sell the Remainder of Tract C and 214 West Cooper LLC desires to purchase the Remainder of Tract C. 6. 214 West Cooper LLC has offered $85,000 to purchase the Remainder of Tract C; that portion adjoining City Lots P -S. As a consequence of the County receiving Tract C as a donation it is free to transact this property with the proceeds going to the County's General Fund. 7. The BOCC finds that adoption of this ordinance is in the best interest of the public health, safety, and welfare of the citizens of Pitkin County and therefore declares this ordinance and legislation to be effective immediately upon adoption. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Pitkin County, Colorado that the Chair or Chair's designee is hereby authorized to execute a Special Warranty Deed conveying the Remainder of Tract C to 214 West Cooper LLC (that portion of Tract C as described on the Government Lot 20 Subdivision Exemption Plat that adjoins Lots P- S Block 54, City and Townsite of Aspen) and any other documents necessary to complete the transaction subject to the recommendation for approval as to form by the County attorney.
