HomeMy WebLinkAboutbocc.res.030.2015RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO APPROVING AMENDMENTS TO THE MASTER PLAN FOR THE CASTLE CREEK CAMPUS TO ALLOW ADDITIONAL HEIGHT FOR BUILDING NOS. 2 AND 7 Resolution No.030-2015 RECITALS 1. Music Associates of Aspen Inc. ("Applicant") has submitted an application to the Board of County Commissioners of Pitkin County, Colorado ("BOCC") to amend the Master Plan for the Castle Creek Campus, as follows: A. To accommodate mechanical equipment and an accompanying screen on the roof of Building #2 (Addition to the Administration Building). B. To increase the height on the north side of Building #7 from between 4" and I I" above 28'. 2. The property is located at 225 Music School Road, off of Castle Creek Road, and is legally described as Lot I -A, M.A.A. Inc., Filing No. 1. 3. The property is zoned Public -Institutional ("P -I" ), contains 38.48 acres and is within the Urban Growth Boundary. 4. The BOCC rezoned the property to P -I, pursuant to Ordinance No. 014-2008. The BOCC granted approval for a P-1 Master Plan, site plan review and GMQS exemption for civic and institutional uses, pursuant to Resolution No. 050-2008. Other related approvals/amendments have been granted pursuant to BOCC Resolution Nos. 103-2008, 029-2009, 60-2011, 6-2012, 41-2013 and 112-2014; BOCC Ordinance No. 034-2008; and Administrative Decision Nos. 105-2008, 44-2011, 57-2011, 45- 2013 and 006-2015. 5. Condition 2 LC of BOCC Resolution No. 050-2008 establishes a height limit of 28' except as follows: A. Building 41 (Administration Building) has an existing height of 36' to the peak of the roof; this height will not be exceeded with the renovation/remodel of the building. B. Building #2 (Addition to Administration Building) is allowed a height of up to 36' to the peak of the roof as calculated by the Land Use Code, with an additional 8' permitted to the top of the proposed skylight/architectural element; C. Building #s 8, 9 and 1 I (Ensemble Buildings) and Building #15 (Lower School) are allowed a height of up to 40` to the peak of the roof as calculated by the Land Use Code. 6. The BOCC considered the amendments at a regular meeting on April 22, 2015. 7. The BOCC finds that the proposed make-up air unit ("MAU") cannot be accommodated within the basement of Building 42 and none of the commercially available units can comply with the 3' encroachment above the allowable height limit that is provided in Sec. 5-20-60(e) of the Land Use Code ("Code"). The BOCC further finds that the proposed screen on the roof of Building #2 is necessary to decrease potential sound transmission from the mechanical equipment onto the campus. 9. The BOCC further finds that the MAU and screen will be lower in height that the previously approved exception for an architectural projection; the building is approximately 20' below the level of Castle Creek Road and existing mature trees that will remain on-site will help to screen the building from view from Castle Creek Road; and that the Historic Preservation Officer has conceptually approved the equipment and screen on the roof. ' 10. The BOCC further finds that the minor increase (4" to 1 1 ") in the height of Building 97 on the north end is justified in order to tie the building in with the adjacent playing field and walkways and to maintain the 10' height for the brass classrooms in that portion of the building. 11. The BOCC further finds that Building #7 is approximately 19' below the level of Castle Creek Road and existing mature trees that will remain on-site will help to screen the building from view from Castle Creek Road; and the height increase is minimal and will not be discernible from Castle Creek Road. NOW, THEREFORE, BE IT RESOLVED by the BOCC that it hereby approves the proposed amendments to the Master Plan for the Castle Creek Campus, subject to the following conditions, which shall run with the land and be binding on all successors in interest: L The Applicant shall adhere to all material representations made in the application or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. All conditions of prior approvals shall remain in full force and effect, except as amended herein. 3. Condition #2 LC of Resolution No. 050-2008 shall be replaced with the following: A height limit of 28' is established for buildings on the campus, except as follows: I) Building # 1 (Administration Building) has an existing height of 36' to the peak of the roof; this height will not be exceeded with the renovation/remodel of the building. 2) Building #2 (Addition to Administration Building) is allowed a height of up to 36' to the peak of the roof as calculated by the Land Use Code. The following encroachments above the 36' height limit are allowed, as shown on Exhibit A: a) Flues and vents shall not exceed the 36' height limit by more than 10'. b) Mechanical equipment shall not exceed the 36' height limit by more than 5'3". c) A roof screen to decrease sound transmission onto the campus from the equipment on the roof shall not exceed the 36' height limit by more than 4'. 3) Building #s 8, 9 and I I (Ensemble Buildings) and Building #15 (Lower School) are allowed a height of up to 40' to the peak of the roof as calculated by the Land Use Code. 4) Building #7 is allowed to exceed the 28' height limit only as shown on Exhibit B.
