Vos Caudill, Pitkin County, CO ADMINISTRATIVE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF PITKIN COUNTY, COLORADO, APPROVING THE DAVID AND KRISTI LUMPKINS SITE PLAN REVIEW Administrative Decision No.L -2015 RECITALS 1) David and Kristi Lumpkins (hereafter "Applicant") have applied to the Community Development Director of Pitkin County (hereafter "Director") for Site Plan Review approval to develop a single family residence. 2) The property is located at 460 Tejas Trail off of Hoaglund Ranch Road, and is more specifically described as Lot 5, Roaring Fork Meadows Subdivision/PUD. 3) The lot is zoned AR -10 and contains 8.274 acres. 4) The BOCC approved the Morrow/Wmgo Junction Ranch Subdivision/PUD, pursuant to Resolution Nos. 068-2004, 143-2005, 144-2005, and 051-2008. The Final Plat was recorded in Plat Book 78 at Pages 84- 86 and later amended in Plat Book 94 at Pages 3540. The PUD Guide is recorded as Reception No. 523402. The name was subsequently changed to Roaring Fork Meadows Subdivision/PUD. The approval allows up to 8,250 square feet of floor area on Lot 5 with the use of two TDRs or growth management allotments (maximum of 5,750 square feet above grade and 2,500 square feet below grade). 5) The portion of the subdivision/PUD above the Alexis Arbaney Ditch is encumbered by a Conservation Easement recorded as Reception #523401. 6) The BOCC designated four cabins on Common Parcel 1 to the Historic Register, pursuant to Resolution No. 051-2008. As an incentive for the designation, the BOCC granted a growth management exemption for up to 2,500 square feet of subgrade space for each of Lots 2-5. Therefore, a TDR or a growth management allotment is required on Lot 5 for the initial 5,750 square feet of floor area, but the additional 2,500 square feet of below grade space does not require a TDR or a growth management allotment. The Covenant Agreement for the Preservation of Historic Resources is recorded as Reception No. 550630. 7) The BOCC approved the subdivision of the adjacent Barta Parcel into two lots and the inclusion of those lots in the Roaring Fork Meadows Subdivision/PUD, pursuant to Resolution Nos. 016-2012, 017-2012 and 003-2013. The Amended Plat was recorded in Plat Book 105 at Pages 8-11. The Amended PUD Guide was recorded as Reception #605667 and the Amended Vested Property Rights Agreement was recorded as Reception #605668. 8) The First Amended 1041 Hazard Review Site Plan for Lot 5 was recorded in Plat Book 94 at Page 45. Pursuant to Article 11. Le of the Amended and Restated Roaring Fork Meadows Subdivision/PUD Guide (Reception #605667), Site Plan Review is required for development on Lot 5. Administrative Decision No. W-2015 Page 2 9) The Director finds that the request complies with the applicable provisions of the Land Use Code ("Code"), as follows: A) The First Amended 1041 Hazard Review Site Plan designates a building envelope and various other development envelopes — landscaping, utility, access, disturbance and accessory. The Applicant has combined those envelopes into one Activity Envelope, consistent with the current Code. The proposed residence is sited within the previously approved Building Envelope and the Site Plan recorded as a result of this approval will define where all activity within the Activity Envelope will occur. B) The residence will not be visible from Highway 82 in the vicinity of the Wingo pedestrian bridge, due to the existing berm along the highway. The residence may be visible from Highway 82 in the vicinity of Lazy Glen, but the impact is limited due to the distance from the highway (approximately 1/3 mile) and the existing trees along the river corridor. Earth tone materials will be used for the residence. The mass of the residence is broken into smaller forms, roof profiles are varied in orientation and height, and the roof lines are below the height limitations. C) The proposed residence contains approximately 8,138 square feet of floor area, with 5,744 square feet above grade and 2,394 square feet below grade. A maximum of 8,250 square feet of floor area is permitted, with a maximum of 5,750 square feet above grade with the use of one TDR and 2,500 square feet below grade (exempt from growth management as an historic incentive). D) The existing well on the lot is permitted by the State (well permit number 60907-F) for use inside one single family dwelling and an additional dwelling unit, and the irrigation of not more than 5,000 square feet of home gardens and lawns. The well is permitted to be operated only under the conditions outlined in the Basalt Water Conservancy District's contract #435. The well was drilled in 2005. E) The on-site wastewater treatment system ("OWTS") is accommodated within the Activity Envelope. The conceptual design shows a setback of 550' from the well and of 250' from the pond. Compliance with the County's OWTS regulations will be demonstrated at permit. F) Condition #5 of BOCC Resolution No. 051-2008 requires completion of the restoration work on the historic cabins, prior to issuance a development permits for residences on Lots 3-5. This work has been completed to the satisfaction of the Historic Preservation Officer. The condition also requires installation of interpretive signage along the Rio Grande Trail or at the trailhead by the Wingo Bridge, prior to issuance of development permits on Lots 3-5. The Applicant made a payment of $7,793 on April 1, 2015 for the required signage. G) Prior to issuance of a building permit for a residence on any of Lots 3, 4 or 5, BOCC Resolution No. 077-2011 requires employee housing mitigation for 3.465 FTEs. The Applicant has constructed a three-bedroom deed -restricted unit on Common Parcel 1, which mitigates for 3 FTE. The Applicant has paid the required payment -in -lieu for the remaining 0.465 FTE. H) The proposed landscaping is more concentrated adjacent to the residence, with clumps of deciduous trees along the edges of the meadow and below the Alexis Arbaney Ditch to screen the residence from the trail. These plantings are consistent with Sec. 7-20-130 of the Code. I) The PUD Guide specifies that the areas below the Alexis Arbaney Ditch and outside the Building Envelopes are the Agricultural Easement areas, and states, "The uses allowed in the Agricultural Easement areas are the existing or replacement or similar easements as currently exist, utility extensions, driveways, landscaping, and those uses associated with continued agricultural or ranching uses or activities, such as but not necessarily limited to irrigation systems and facilities, grazing cattle or horses, haying operations and similar agricultural and ranching activities. The landscaping outside of the Building Envelope is permitted by the PUD Guide. J) A fire hydrant is located on Lot 4 adjacent to Tejas Trail. The location is acceptable to the Basalt and Rural Fire Protection District (`Basalt Fire") and will supply the necessary water supply for manual fire suppression. K) Basalt Fire has found the access and turnaround acceptable. Administrative Decision No. 01-2015 Page 3 L) The proposed roof -mounted solar energy collectors comply with Sec. 4-30-50(h) of the Code. The panels will be located on the south facing roof of the garage and provide 416 square feet, which complies with the requirement to provide a minimum of 400 square feet of roof space sited for solar gain. The collectors will lay flat on the roof, will not protrude above the ridge of the roof and will maintain the required 3' setback from roof edges. The collectors will be used primarily for on-site purposes. M) Improvements to the pond include relining the pond to repair leaks, the creation of wetland benches to improve aquatic habitat, relocation and improvement of the overflow, and expansion of the pond for aesthetic purposes. The pond is being used to store and maintain use of legal water rights. N) In association with the development of Lot 5, landscaping and pond improvements will also occur on Lot 4. The owner of Lot 4 has authorized these improvements. APPROVED by the Director, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. All prior conditions of approval related to Lot 5 shall remain in full force and effect, unless specifically amended herein. Prior to submission of any building permit applications for the residence, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation of them. The Site Plan shall be amended to include the boundary of the originally approved Building Envelope, since it is referenced in the PUD Plan. 4. The parcel is exempt from Growth Management for up to 8,250 square feet of floor area. At building permit application for the new residence, the Applicant shall surrender one TDR Certificate and a copy of the deed(s) evidencing the Applicant's acquisition of the Certificate (if applicable), in order to develop the initial 5,750 square feet of floor area. The additional 2,500 square feet of below grade space is exempt from growth management without the use of a TDR. 5. With the building permit application for the residence, the Applicant shall: A. Provide proof of an adequate water supply (in terms of quantity and availability) for domestic and fire protection purposes. The well permit limits irrigation for home gardens and lawns to 5,000 square feet; irrigation rights for additional area must be demonstrated. B. Submit a site specific drainage and erosion control plan prepared by a qualified engineer or geologist for review and approval by the Planning Engineer. If the project disturbs more than one acre, a State Stormwater Permit shall be obtained prior to permit issuance. All historic and natural drainage patterns shall be maintained. C. Submit a constriction management plan for review and approval by the Planning Engineer. D. Submit a detailed landscape plan and revegetation plan for disturbed areas with appropriate seed mixes. All plants used for landscaping and revegetation shall be native plant species and no berry - producing species shall be included. The lawn to the west of the residence shall be composed of native grasses. E. Submit an exterior lighting plan. The proposed outdoor lighting shall be reduced by 30% and all fixtures shall comply with the Code requirements. Administrative Decision No.b—L-2015 Page 4 F. Submit a fireplace/woodstove registration form with the Community Development Department, if necessary. 6. Prior to issuance of a building permit for the residence, the Applicant shall: A. Obtain an On -Site Wastewater Treatment System ("OWTS") Construction Permit application from Environmental Health. B. Pay the applicable road and employee housing impact fees. C. Obtain a County access/driveway permit, which shall be approved by the Planning Engineer and Basalt Fire. D. Obtain a fireplace/woodstove permit from the Community Development Department, if necessary. The Applicant shall obtain an Earthmoving, Clearing and Grubbing Permit for any and all hardscape, retaining walls, earthwork, ponds, utilities, revegetation, landscaping and any water course/water feature improvements. Native riparian species shall be installed around the pond. Prior to submission of a permit for landscaping and pond improvements on Lot 4 (in association with the development of Lot 5, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan for Lot 4. 8. Prior to issuance of a Certificate of Occupancy, the Applicant shall: (a) raise the barrel of the dry hydrant on Lot 4 to the satisfaction of Basalt Fire; and (b) Basalt Fire shall test and approve the dry hydrant and associated supply. 9. The Applicant shall comply with all standards for development within Scenic View Protection Areas as represented in the application and approved in this Decision. The exterior of the residence shall utilize indigenous earth tone materials or colors and the roofs shall have a non -reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflectivity, with the exception of materials associated with solar or photovoltaic equipment. Driveway lighting is prohibited and all other lighting shall comply with the lighting code. 10. Landscaping shall be substantially consistent with the landscaping shown on the site plan. Areas disturbed by construction shall be re -vegetated within one growing season of the project's completion. Landscaping shall be completed prior to issuance of the Certificate of Occupancy for the residence. 11. When improved, the pond shall comply with the following standards in order to be wildlife friendly: A. The pond shall have a minimum side slope of 3:1, preferably 5:1 (excludes dam area). B. Any pond lining shall be backfilled and covered with minimum 24" topsoil/backfill material unless a clay lining is installed. C. Provide a littoral shelf on at least two of the sides of the pond. D. If the pond is stocked with fish, they must be certified disease free. 12. No development, including grading, excavation, fill placement, berming, landscaping, vegetation removal or disturbance, well or on-site wastewater disposal system, shall occur outside of the approved activity envelope. 13. No development in excess of 30" above or below natural grade shall occur within the setbacks of the parcel, with the exception of driveways and associated retaining walls of up to 6' above or below Administrative Decision NotOL-2015 Page 5 natural grade and fencing. Landscaping in the form of berms within the setbacks shall not exceed four feet from the most restrictive grade. Any development located within setbacks mandated by County zoning regulations that does not comply with these restrictions shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 14. The Applicant shall provide adequate engineering of any retaining walls over 4' in height. All retaining walls shall be a maximum of 7' in height. 15. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit. Any structures represented in the application may not be permitted under building and zoning regulations. 16. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. 17. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use ode § 2-20-170 and C.R.S. § 24-68-105. We chose not to include pinon or juniper and instead provide groupings of cottonwood and aspen. The view corridors to the meadow from the trail remain in place. In accordance with this change I did also move the OWTS slightly. I believe these plans should settle this topic. While this plan does open up the views from the trail, it still includes a significant number of spruce trees along/below the ditch, which is not consistent with the character of the area. The cottonwoods are consistent with vegetation along the ditch, and the other nearby vegetation above the trail would be pinon/juniper. I would not be as concerned with spruce for screening if they were located in closer proximity to the residence, rather than throughout the upper portion of the meadow. We are willing to consider pinon or juniper in the upper portion of the meadow, since it is at least consistent with the vegetation above the trail. Please discuss and get back to me. I am OK with the other changes. Did you discuss the pond setback issue with Joanna? These have been revised per our last meeting and per our phone call on Tuesday. The changes should address your concerns for opening up the meadow views from the trail. I also changed the species of the tree grouping in the far SE comer so it fits better with the existing vegetation. Our project team has established a new, and all-encompassing, activity envelope to replace the previously established envelopes and which encapsulates all proposed development on the property. The proposed activity envelope avoids constrained areas on the property as defined in section 7-10-50, most notable of those being the steep slopes at the north portion of the property which are a designated conservation easement. The layout of the proposed activity envelope has been carefully crafted to include only those areas on the site that are required for the proposed residence, accessory uses and associated infrastructure and landscaping. In keeping with the spirit and design intent of the 2010 site plan, we have located the proposed residence fully within the boundary of that previously established building envelope. If you, or any other County representatives, plan to visit the site please note that the 2010 building and disturbance & accessory envelopes are still staked on the property and that we have flagged the approximate footprints of the house and pavilion for visual reference. Section 4-30-50(h) Solar Enerey Collectors Response: We anticipate the design and installation of solar hot water system as part of the construction of this residence and to achieve the points necessary to meet the Pitkin County efficient building ordinance. All panels associated with this system will be located on the south facing roof of the garage. The hot water generated from this system will be piped to a heat exchanging system to be located in a lower level mechanical room within the residence and will only be used to supply domestic hot water to this residence. In keeping with section 7-20- 120(d)(4) the rooftop mounted panels associated with this solar hot water system will not protrude above the ridge line of the roof nor will they be silhouetted against the sky if viewed from nearby roads. The rooftop location of these panels means that they will not shade the evapotranspiration leach field for the residential OWTS. The rooftop location of these panels provides 416 square feet of available and accessible area, which includes the assumption of the required 3 foot setback from roof edges. We will ensure that the rooftop mounted panels will be arranged as contiguously as the system design allows and that they will not be separated into distinct groupings unless there is no viable alternative. Section• 7-10-50 & 60: Site Plan Response: The Site Plan for Lot 5 incorporates an Activity Envelope that avoids Constrained Areas as described below and is in keeping with the previously approved Building, Landscape, Disturbance and Accessory, and Utility and Access Envelopes. Steep slopes are limited to the area of the lot within the Conservation Easement. The existing Alexis Arbaney Ditch and the parallel ranch lateral ditch are located outside of the proposed Activity Envelope with the exception of an irrigation water connection to the lateral ditch. The unconstrained portion of the property not including the Conservation Easement area does not contain flood plain, geological hazards, wildfire hazards, wildlife habitat, river or stream corridors, wetlands, irrigated lands for food or crop production, historic preservation areas or archeological resource areas. For the purposes of Chapter 7, "Constrained Areas" include all areas included in each of the following categories... (i) Areas of Statewide Interest listed in C. R. S. 24-65.1-101 et. Seq.), (ii) steep and potentially unstable slopes, (iii) water courses, drainage channels and areas subject to erosion, (iv) flood plain hazard areas, (v) geological hazard areas, (vi) severe or low to moderate wildfire hazard areas, (vii) wildlife habitat areas, (viii) river and stream corridors and wetlands (ix) irrigated lands for food or crop production, (x) historic preservation areas, and (xi) archeological resource areas. The proposed location of the activities and development as shown and the extent of which are represented by the Activity Envelope, and shown on the site plan drawings, are located as to minimize impacts on surrounding properties, comply with the Land Use Code, as well as the PUD Guide for the Roaring Fork Meadows Subdivision. 000002 Page 2of5 Section: 7-20-10; Site Preparation and Grading Response: Grading and fill placement is encompassed within the proposed Activity Envelope as well as clearing, grubbing and vegetation removal. No tree removals over six inches DBH are proposed at this time. The activities and development proposed within the Activity Envelope do not disturb Constrained Areas, natural terrain, or stream vegetation. The portion of the lot within the Activity Envelope is not native untouched terrain as the lot is part of a former ranch. All disturbed areas will be revegetated with topsoil placement as part of the operations. Please refer to the civil engineering report, and associated drawings, included with this site plan review package for additional information related to site preparation and grading. We understand that the scenic view protection corridors have been established by Pitkin County with the intent to minimize visible impacts of new development when viewed from this County road. Pursuant to the recommendations outlined in the Pitkin County Land Use Application Manual we have analyzed and documented the views from Highway 82 toward the site in two locations that we believe to be the worst case scenarios. These locations are noted on sheet A1.1 and the resulting existing and enhanced photographs are shown on sheets A1.3 and A1.4 respectively. Existing photos from the property are included on sheet A1.2 for reference. On sheets A1.3 and A1.4, the location of photo number 1, taken from Highway 82 looking east, is approximately 2,800 feet from the proposed residence. From this location there is a large, existing earth berm on the north side of Highway 82 that runs parallel with the Highway from the Rio Grande trail bridge to Wingo Junction. We have approximated the effect of this berm on visibility of the proposed residence on the first graphic overlay shown on sheet A1.4. We believe that this existing berm willfully obscure any view of the proposed residence from Highway 82. On sheets A1.3 and A1.4, the location of photo number 2, taken from Highway 82 looking north, is approximately 1,600 feet from the proposed residence. From this location there is an existing and continuous tree line comprised of Aspen and Cottonwood trees that occurs on an elevated plateau to the north side of the Roaring Fork river. We have approximated the effect of this tree line on the visibility of the proposed residence on the second graphic overlay shown on sheet A1.4. We believe that this existing tree line is likely to make the proposed 000003 Page 3of5 residence nearly indistinguishable when viewed from Highway 82. As shown on our site plan, additional trees will be planted to the north of the existing tree line to increase screening of the residence from Highway 82. Regarding the design of the proposed residence... As noted in our response to section 2-30-20(g) above, we have set the footprint of the residence fully within the boundary of the building envelope established in 2010. As evidenced by the exterior elevations on sheets A1.5 and A1.6, we have developed the exterior design with a variety of massing and forms that contribute to a more natural, human scaled composition. The exterior materials are in keeping with other mountain style homes in the County, with earth toned natural wood, stone and composite shakes and patina steel comprising the primary palette. Our intent is to create a home with a design aesthetic that is firmly rooted in the history of this area. We have kept the roof lines well below the height limitations for this property. We have also created roof profiles that vary in orientation and height and we have avoided long, continuous roof planes in the design. The profile of these roof lines do not protrude above adjacent ridge lines, which will maintain the existing natural look of the Basalt foothills from Highway 82_ Regarding the design of the landscape... The historic use of the property as an irrigated meadow is an important context to the Owners. We will be retaining, and/or returning to original condition, large areas of existing meadow on the property. An area to the north of the existing pond, and continuing on to the adjoining lot 4, will be maintained undisturbed. An existing area on the high point of the property to the east of the proposed residence will be maintained undisturbed. Existing old-growth tree lines will be maintained. There are some existing trees around the existing pond and in some areas along the edge of the property that are young enough to transplant. Wherever possible we will retain or transplant the existing healthy trees to work with the design of the landscaping. In order to construct the proposed residence on the naturally sloping site we have designed new escarpments into the topography to the east of the footprint. These changes in topography will be less than 4 feet, which will allow us to use natural stone retainage and keep as much of the earthwork as possible within a limited area. The resulting effect will be of a naturally terraced landscape that has eroded to expose stone edges that then fade back into the land. We have routed a softly curving driveway along the south end of the property, following the existing dirt drive as much as practical. There is an extended portion of the driveway court to the south of the garage which has been included solely to accommodate the requirements of fire truck turnaround. Regarding the design of the landscape... The historic use of the property as an irrigated meadow is an important context to the Owners. We will be retaining, and/or returning to original condition, some of the existing irrigated meadow on the property. An area to the north of the existing pond, and continuing on to the adjoining lot 4, will be maintained undisturbed. The proposed development preserves natural vegetation, but does place structures within a portion of the existing irrigated meadow. However we believe this irrigated meadow is not visible from Highway 82. Revegetation of disturbed areas will occur with topsoil placement and seeding and planting of native vegetation, which will then be irrigated. Existing old-growth tree lines will be maintained. There are some existing trees around the existing pond and in some areas along the edge of the property that are young enough to transplant. Wherever possible we will retain or transplant the existing healthy trees to work with the design of the landscaping. New trees are planned surrounding the structures, as defensible space allows, to soften ridge lines and tie the site into the greater surroundings. In order to construct the proposed residence on the naturally sloping site we have designed new escarpments into the topography to the east of the footprint. These changes in topography will be 4 feet or less, allowing us to use natural stone retainage and keep as much of the earthwork as possible within a limited area. The resulting effect will be of a naturally terraced landscape that has eroded to expose stone edges that then fade back into the land. We have routed a softly curving driveway to skirt the edge of the meadow and take advantage of natural vegetation to the south to screen it, while following the existing dirt drive as much as practical. There is an extended portion of the driveway court to the south of the garage which has been included solely to accommodate the requirements of fire truck turnaround. 000004 Page 4 of 5 Section: 7-20-130• Landscaping and Vegetation Protection Response: The proposed development meets the purpose and intent of this section. The activities and development preserve the existing tree and shrub vegetation, screen the improvements from public view from Highway 82 and do not interfere with the rural character of the County. Section: 7-20-140; Lighting The following drawing sheets are included in support of our response for this section: A1.7 Exterior Lighting Plan Response: We have designed the exterior lighting plan to comply with the standards outlined in the Pitkin County Land Use Code, section 7-20-140. We understand that the goal of the County is to ensure residential exterior lighting provides adequate safety and security while avoiding light trespass on to adjacent properties. Included with this site plan submittal package are manufacturer cut sheets for the each of the (3) fixtures that are planned for the exterior lighting package, which complement the exterior lighting plan on sheet A1.7. All fixtures and locations planned avoid conditions of uplighting, highlighting and floodlighting as defined by the Code. Control of these fixtures shall be both manual and tied into a whole -house lighting controls system to maximize access and minimize energy consumption. Light fixture A is a fully recessed, exterior step light that is mounted in the riser of exterior steps. This is a 13 watt, LED fixture whose light source is fully shielded from view. The locations for this fixture have been selected to provide safely illuminates pathways from the visitor parking area to the main entry of the residence, from the residence to the exterior pavilion and from the residence to the exterior spa. Light fixture F2 is a lantern -like, exterior sconce that is wall mounted. This fixture will be supplied with (3) 15 watt incandescent candelabra bulbs, with the light source softened via a translucent, diffusing glass lens. The locations for this fixture have been selected to provide illuminated areas immediately outside of all exterior doors from the residence. Light fixture F3 is a lantern -like, exterior pendant that is ceiling mounted. This fixture will be supplied with (4) 15 watt incandescent candelabra bulbs, with the light source softened via a translucent, diffusing glass lens. Water Supply & Fire Protection Potable water for the site will be provided by a private well located to the south of the proposed • residence near the fire truck turnaround. The well will be utilized for the residential sprinkler system • and general residential use. Fire protection water shall be provided to the Basalt & Rural Fire Protection District through the use the existing lined pond and dry hydrant system. The existing dry • barrel hydrant is located on Lot 4 along Tejas Trail which is fed by gravity flow. As coordinated with • the District, the existing hydrant sits too low and will be raised as a part of the construction for this arinnnl `, site. According to the District, no additional hydrants or pullouts are required to serve this property. D. Wastewater Treatment Wastewater treatment for the new residence will be handled by a new onsite wastewater treatment system (OWTS). Predesign investigations yielded no shallow groundwater and slopes of less than 20%. Treatment is proposed at a wastewater Treatment Level 1 with the use of pressure dosing, sequencing zone distribution and a gravelless chamber absorption field. The septic tanks and pressure dosing pump will be located near the driveway. The absorption field will be located northwest of the residence, with the absorption field being located uphill from the tanks and the existing pond. The system will utilize sequencing zone distribution to pressure feed the individual absorption trenches. The average daily wastewater flow is estimated at approximately 1,200 gpd. Other Utilities Gas, electric, and telephone services and pedestals are all located southeast of the existing pond and will be extended to the proposed residence. Service extensions are shown on the Underground Piping Plan extending under the proposed driveway to a point near the southeast corner of the proposed garage. 000016 F. Drainage 1. Existing Conditions The 8.3 acre site was previously developed with a dirt access drive and a lined pond. In general, the proposed building site slopes from the northeast to southwest with site vegetation consisting of native trees, shrubs and grasses. Tejas Trail is located southwest and downhill of the proposed building site. According to the Natural Resources Conservation Service Web Soil Survey, soils are Hydrologic Group C/D above the building site and A within the building site. Hydrologic Group C/D soils typically have a slow to very slow infiltration rate when thoroughly wet, consists chiefly of soils having a layer that impedes the downward movement of water or soils of moderately fine texture or fine texture with a high shrink/swell potential and have a slow to very slow rate of water transmission. Hydrologic Group a soils typically have a high infiltration rate when thoroughly wet, consist mainly of deep, well drained to excessively drained sands or gravelly sands and have a high rate of water transmission (Web Soil Survey). 3. Proposed Conditions The land use will be large -lot rural residential. to two (2) minor drainage basins. • • • The development will divide the drainage basin in • Figure 4: Developed Drainage Basins i. Basin -A Basin -A consists of the majority of the roofs, patios and landscaping along with areas uphill of the residence (approximately 12.13 acres). Disturbed areas will be revegetated with trees, shrubs, and vegetative ground cover. Impervious areas will include roofs, patios, walks and the lined pond with a net watershed percent effective imperviousness of 5%. In general, runoff will sheet flow in upper reaches of the basin and shallow flow thereafter. The location and configuration of the building, along with a swale above the building, will direct runoff around the building and into the existing pond. The pond contains at least 12 -inches of freeboard which will effectively detain the runoff from the modelled 5 -yr and 100 -yr storm events. The existing discharge point is an existing culvert situated at the west end of the pond. The pond will be used for water quality improvement and to reduce the rate of runoff from the site and protect downstream properties during major storm events. Roofs will be guttered and downspouts will be to vegetated areas and swales leading to the pond. Heat tape must be installed in the roof gutters and downspouts throughout to minimize the potential for freezing. The estimated peak runoff rates from this basin into the pond are: 5 -yr: 2.53 cfs; 100-yr:18.71 cfs The pond freeboard and existing culvert will effectively reduce the discharge rate down to approximately 3.92 cfs which is far less than the historic rate of 19.09 cfs. 000013 Page 4 W. Basin -B Basin -B consists of the driveway/turnaround and areas below the pond (approximately 2.84 acres). Native vegetation will largely remain untouched and disturbed areas will be revegetated with shrubs, and vegetative ground cover. Impervious areas will include the driveway, turnaround and walks with a net watershed percent effective imperviousness of 8%. In general, runoff will sheet flow in upper reaches of the basin and shallow flow thereafter. Roadside ditches and a culvert with riprap outfall will be used to convey runoff and minimize erosion. Low Impact Site Design The landscaping strategy is to terrace the property and restore disturbed area with trees, shrubs, lawn and other vegetative ground cover. The estimated extent of disturbance and vegetative replacement is represented on the Plans. Low Impact Site Design (LID) principals have been considered for implementation as follows: Principle 1: Consider stormwater quality needs early in the design process The need to manage and treat stormwater runoff was discussed early in the design process affording the design team an opportunity to discuss the options and evaluate their feasibility. In respect of the topography and existing pond, plans were made to reduce flow velocities and scour through the use of terracing with boulder landscape walls. Existing vegetation, grassed waterways and lawns were decided as a feasible means to reduce sediment transfer/hydrocarbon pollution and the existing pond was considered a reasonable structure to permit sediment fallout for the larger Basin -A and reduce the outfall rate during a major storm event for the overall site. Principle 2: Use the entire site when planning for stormwater quality treatment The design implements multiple swales, roadside ditches, terracing, lawns and the existing pond to convey and treat runoff at multiple locations. Much of the site was designed to reduce flow velocities and disturbed areas are largely planned to be revegetated with trees, shrubs, lawn and vegetative ground cover. Vegetated and erosion fabric lined swales were also incorporated to pretreat runoff and minimize the potential for soil scour. Principle 3: Avoid unnecessary impervious area The design limits the amount of impervious area required for the driveway and turnaround the minimum amount required and utilizes step -stone walks to promote vegetative growth. Principle 4: Reduce runoff rates and volumes to more closely match natural conditions The existing lined pond provides ample detention for the minor and major storm events in Basin - A within the freeboard. The pond and existing outflow culvert will produce a net effect of reducing the overall peak runoff rate from the site during major storm event to far less than the historic (natural conditions) rate. Principle 5: Integrate stormwater quality management and flood control The vegetated swales will provide some pretreatment of the runoff while the bioretention facility and existing seasonal pond will provide additional quality management through vegetative screening, sediment fallout and a reduced peak flow rate from the site. Principle 6: Develop stormwater quality facilities that enhance the site, the community and the environment The design contains a series of swales and water features which combined with the existing pond will enhance the character of the community and the environment. Principle 7: Use a treatment train approach A train approach has been applied by flowing runoff from the roofs over lawn and landscaped areas to swales leading to the existing pond. This will provide multiple points for sediment and pollutant removal. Principle 8: Design sustainable facilities that can be safely maintained Swales have been kept shallow to enable grass trimming and landscape maintenance. Terraces have been spaced to afford access between the various levels. 0 • • • Principle 9: Design and maintain facilities with public safety in mind • No excessive grade breaks or excessively tall boulder walls are proposed which could cause • maintenance difficulties or dangerous conditions. The existing pond was engineered by another • party and is understood to be in conformance with industry standards. The property is located within mountainous terrain and will require the Homeowner to exercise reasonable precautions • to access the existing pond, swales and terraces as he or she would to access other portions of • the property. • 5. Hydrologic Criteria & Structures • The stormwater management system has been designed detain the 100 -year runoff from Basin - • A in the existing pond and direct excess runoff from Basin -B around the residence and driveway. Rainfall intensities are based on rainfall IDF curve data obtained from the National • Oceanic and Atmospheric Administration (NOAA). Runoff rates and volumes were estimated • using the Modified Rational Method and the Autodesk Storm and Sanitary Analysis 2014 stormwater modeling software. Copies of this information have been included in the Appendix. • As previously discussed the proposed design will reduce the site peak runoff rate during the 100 -year storm event to a rate which is far less than the historic conditions. Therefore, the • proposed improvements should improve the drainage conditions for downstream properties and • conveyance systems. • 6. Operation and Maintenance • Erosion control measures and Best Management Practices (BMPS) should be followed during • construction to insure that the property and the adjacent sites are not impacted from sedimentation. This plan utilizes a combination of erosion control logs, sediment control fencing, • grass lined swales, erosion fabric lined swales, area inlets and pipelines to minimize erosion, • control runoff rates and improve water quality. ♦ During construction activities and until vegetation can be established, sediment control fencing should be installed along the lower limits of all excavations. Certified weed free hay bales, check dams, silt dikes or erosion control logs should be installed across swales/ditches and • around the overflow structure in accordance with Colorado Department of Transportation M- Standards. During construction, the Contractor shall be responsible for removing debris from the • grates, repairing any damaged erosion controls, and removing accumulated sediment from behind hay bales, check dams, silt dikes, erosion control logs and sediment control fences after each storm event. After construction, the Homeowner shall be responsible for removing debris • and sediment after each storm event and dredging sediment on an as -needed basis. • The grass lined swales and area drains must be inspected and maintained routinely to remove • debris and ensure that the systems are operating effectively. The design plans more specifically locate many of the erosion control features. These plans are a good representation of the site requirements, but may not be all inclusive. The Contractor shall be responsible for complying with all local and state guidelines and permitting issues. Sediment and mud should be prevented from leaving the construction site by immediate placement of a stabilized construction entrance at the construction entrance. The Contractor should be responsible for cleaning and general upkeep of the site and adjacent roadways. As an effective dust control measure, water may be utilized to minimize uprising of dust. Good housekeeping BMPs should be followed throughout the entire life of the project. These include but are not limited to: refuse receptacles should be regularly emptied and equipped with lids; • keeping machinery in good operating condition to prevent leakage; • apply appropriate (not excessive) amounts of fertilizer to the landscaping; • scheduled maintenance cleaning of any downstream curb and gutter, culverts and ditches; • general site cleanliness and proper training of employees; and • G lading must be performed (but not in excess) to ensure that drainage is directed avlfay from all structures in all directions. Once construction activities are completed, final stabilization of the disturbed areas should begin. Within one growing season of the project completion, uniform vegetative site coverage should be equal to or greater than 70% of the pre -disturbance levels, or equivalent permanent, physical erosion reduction methods should be employed. When the site is determined to have reached the final stabilization stage, erosion control structures can be removed. G. DEFINITION OF TERMS The following terms when used in this policy mean: (a) "Amount of Insurance": The amount stated in Schedule A, as may be increased or decreased by endorsement to this policy, increased by Section 8(b), or decreased by Sections 10 and 11 of these Conditions. (b) "Date of Policy": The date designated as "Date of Policy" in Schedule A. (c) "Entity": A corporation, partnership, trust, limited liability company, or other similar legal entity. NOTICE OF CLAIM TO BE GIVEN BY INSURED CLAIMANT The Insured shall notify the Company promptly in writing (i) in case of any litigation as set forth in Section 5(a) of these Conditions, (it) in case Knowledge shall come to an Insured hereunder of any claim of title or interest that is adverse to the Title, as insured, and that might cause loss or damage for which the Company may be liable by virtue of this policy, or (iii) if the Title, as insured, is rejected as Unmarketable Title. If the Company is prejudiced by the failure of the Insured Claimant to provide prompt notice, the Company's liability to the Insured Claimant under the policy shall be reduced to the extent of the prejudice. PROOF OF LOSS In the event the Company is unable to determine the amount of loss or damage, the Company may, at its option, require as a condition of payment that the Insured Claimant furnish a signed proof of loss. The proof of loss must describe the defect, lien, encumbrance, or other matter insured against by this policy that constitutes the basis of loss or damage and shall state, to the extent possible, the basis of calculating the amount of the loss or damage. DEFENSE AND PROSECUTION OF ACTIONS (a) Upon written request by the Insured, and subject to the options contained in Section 7 of these Conditions, the Company, at its own cost and without unreasonable delay, shall provide for the defense of an Insured in litigation in which any third party asserts a claim covered by this policy adverse to the Insured. This obligation is limited to only those stated causes of action alleging matters insured against by this policy. The Company shall have the right to select counsel of its choice (subject to the right of the Insured to object for reasonable cause) to represent the Insured as to those stated causes of action. It shall not be liable for and will not pay the fees of any other counsel. The Company will not pay any fees, costs, or expenses incurred by the Insured in the defense of those causes of action that allege matters not insured against by this policy. (b) The Company shall have the right, in addition to the options contained in Section 7 of these Conditions, at its own lost, to institute and prosecute any action or proceeding or to do any other act that in its opinion may be necessary or desirable to establish the Title, as insured, or to prevent or reduce loss or damage to the Insured. The Company may take any appropriate action under the terms of this policy, whether or not it shall be liable to the Insured. The exercise of mese rights shall not be an admission of liability or waiver of any provision of this policy. If the Company exercises its rights under this subsection, it must do so diligently. (c) Whenever the Company brings an action or asserts a defense as required or permitted by this policy, the Company may pursue the litigation to a final determination by a court of competent jurisdiction, and it expressly reserves the right, in its sole discretion, to appeal any adverse judgment or order. 6. DUTY OF INSURED CLAIMANT TO COOPERATE (a) In all cases where this policy permits or requires the Company to prosecute or provide for the defense of any action or proceeding and any appeals, the Insured shall secure to the Company the right to so prosecute or provide defense in the action or proceeding, including the right to use, at its option, the name of the Insured for this purpose. Whenever requested by the Company, the Insured, at the Company's expense, shall give the Company all reasonable aid (i) in securing evidence, obtaining witnesses, prosecufing or defending the action or proceeding, or effecting settlement, and (ii) in any other lawful act that in the opinion of the Company may be necessary or desirable to establish the Title or any other matter as insured. If the Company is prejudiced by the failure of the Insured to furnish the required cooperation, the Company's obligations to the Insured under the policy shall terminate, including any liability or obligation to defend, prosecute, or continue any litigation, with regard to the matter or matters requiring such cooperation. (b) The Company may reasonably require the Insured Claimant to submit to examination under oath by any authorized representative of the Company and to produce for examination, inspection, and copying, at such reasonable times and places as may be designated by the authorized representative of the Company, all records, in whatever medium maintained, including books, ledgers, checks, memoranda, correspondence, reports, e-mails, disks, tapes, and videos whether bearing a date before or after Date of Policy, that reasonably pertain to the loss or damage. Further, if requested by any authorized representative of the Company, the Insured Claimant shall grant its permission, in writing, for any authorized representative of the Company to examine, inspect, and copy all of these records in the custody or control of a third party that reasonably pertain to the loss or damage. All information designated as confidential by the Insured Claimant provided to the Company pursuant to this Section shall not be disclosed to others unless, in the reasonable judgment of the Company, it is necessary in the administration of the claim. Failure of the Insured Claimant to submit for examination under oath, produce any reasonably requested information, or grant permission to secure reasonably necessary information from third parties as required in this subsection, unless prohibited by law or governmental regulation, shall terminate any liability of the Company under this policy as to that claim. 7. OPTIONS TO PAY OR OTHERWISE SETTLE CLAIMS; TERMINATION OF LIABILITY In rase of a claim under this policy, the Company shall have the following additional options: (a) To Pay or Tender Payment of the Amount of Insurance. To pay or tender payment of the Amount of Insurance under this policy together with any costs, attorneys' fees, and expenses incurred by the Insured Claimant that were authorized by the Company up to the time of payment or tender of payment and that the Company is obligated to pay. Upon the exercise by the Company of this option, all liability and obligations of the Company to the Insured under this policy, other than to make the payment required in this subsection, shall terminate, including any liability or obligation to defend, prosecute, or continue any litigation. (b) To Pay or Otherwise Settle With Parties Otter Than the Insured or With the Insured Claimant. (1) to pay or otherwise settle with other parties for or in the name of an Insured Claimant any claim insured against under this policy. In addition, the Company will pay any costs, attorneys' fees, and expenses incurred by the Insured Claimant that were authorized by the Company up to the time of payment and that the Company is obligated to pay; or (ii) to pay or otherwise settle with the Insured Claimant the loss or damage provided for under this policy, together with any costs, attorneys' fees, and expenses incurred by the Insured Claimant that were authorized by the Company up to the time of payment and that the Company is obligated to pay. Upon the exercise by the Company of either of the options provided for in subsections (b)(i) or (it), the Company's obligations to the Insured under this policy for the claimed loss or damage, other than the payments required to be made, shall terminate, including any liability or obligation to defend, prosecute, or continue any litigation. DETERMINATION AND EXTENT OF LIABILITY This policy is a contract of indemnity against actual monetary loss or damage sustained or incurred by the Insured Claimant who has suffered loss or damage by reason of matters insured against by this policy. (a) The extent of liability of the Company for loss or damage under this policy shall not exceed the lesser of (i) the Amount of Insurance; or (ii) the difference between the value of the Title as insured and the value of the Title subject to the risk insured against by this policy. (b) if the Company pursues its rights under Section 5 of these Conditions and is unsuccessful in establishing the Title, as insured, (i) the Amount of Insurance shall be increased by 10%, and (ii) the Insured Claimant shall have the right to have the loss or damage determined either as of the date the claim was made by the Insured Claimant or as of the date it is settled and paid. (c) In addition to the extent of liability under (a) and (b)'the Company will also pay those costs, attorneys' fees, and expenses incurred in accordance with Sections 5 and 7 of these Conditions. 9. LIMITATION OF LIABILITY (a) If the Company establishes the Title, or removes the alleged defect, lien, or encumbrance, or ares the lack of a fight of access to or from the Land, or cures the claim of Unmarketable Title, all as insured, in a reasonably diligent manner by any method, including litigation and the completion of any appeals, it shall have fully performed its obligations with respect to that matter and shall not be liable for any loss or damage caused to the Insured. (b) In the event of any litigation, including litigation by the Company or with the Company's consent, the Company shall have no liability for loss or damage unfit there has been a final determination by a court of competent jurisdiction, and disposition of all appeals, adverse to the Title, as insured. (c) The Company shall not be liable for loss or damage to the Insured for liability voluntarily assumed by the Insured in settling any claim or suit without the prior written consent of the Company. 10. REDUCTION OF INSURANCE; REDUCTION OR TERMINATION OF LIABILITY All payments under this policy, except payments made for costs, attomeys' fees, and expenses, shall reduce the Amount of Insurance by the amount of the payment. 11. LIABILITY NONCUMULATIVE The Amount of Insurance shall be reduced by any amount the Company pays under any policy insuring a Mortgage to which exception is taken in Schedule B or to which the Insured has agreed, assumed, or taken subject, or which is executed by an Insured after Date of Policy and which is a charge or lien on the Title, and the amount so paid shall be deemed a payment to the Insured under this policy. 12. PAYMENT OF LOSS When liability and the extent of loss or damage have been definitely fixed in accordance with these Conditions, the payment shall be made within 30 days. 13. RIGHTS OF RECOVERY UPON PAYMENT OR SETTLEMENT (a) Whenever the Company shall have settled and paid a claim under this policy, it shall be subrogated and entitled to the rights of the Insured Claimant in the Tills and all other rights and remedies in respect to the claim that the Insured Claimant has against any person or property, to the extent of the amount of any loss costs, attorneys' fees, and expenses paid by the Company. If requested by the Company, the Insured Claimant shag execute documents to evidence the transfer to the Company of these rights and remedies. The Insured Claimant shall permit the Company to sue, compromise, or settle in the name of the Insured Claimant and to use the name of the Insured Claimant in any transaction or Irrigation involving these rights and remedies. If a payment on account of a claim does not fully cover the loss of the Insured Claimant, the Company shall defer the exercise of its right to recover until after the Insured Claimant shall have recovered its loss. (b) The Company's right of subrogation includes the rights of the Insured to indemnities, guaranties, other policies of insurance, or bonds, notwithstanding any terms or conditions contained in those instruments that address subrogation rights. 14. ARBITRATION Either the Company or the Insured may demand that the claim or controversy shall be submitted to arbitration pursuant to the Tide Insurance Arbitration Rules of the American Land Title Association ("Rules'). Except as provided in the Rules, there shall be no joinder or consolidation with claims or controversies of other persons. Arbitrable matters may include, but are not limited to, any controversy or claim between the Company and the Insured arising out of or relating to this policy, any service in connection with its issuance or the breach of a policy provision, or to any other controversy or claim arising out of the transaction giving rise to this policy. All arbitrable matters when the Amount of Insurance is $2,000,000 or less shall be arbitrated at the option of either the Company or the Insured. All arbitrable matters when the Amount of Insurance is in excess of $2,000,000 shall be arbitrated only when agreed to by both the Company and the Insured. Arbitration pursuant to this policy and under the Rules shall be binding upon the parties. Judgment upon the award rendered by the Arbitrator(s) may be entered in any court of competent jurisdiction. 15. LIABILITY LIMITED TO THIS POLICY; POLICY ENTIRE CONTRACT (a) This policy together with all endorsements, if any, attached to it by the Company is the entire policy and contract between the Insured and the Company. In interpreting any provision of this policy, this policy shall be construed as a whole. (b) Any claim of loss or damage that arises out of the status of the Title or by any action asserting such claim shall be restricted to this policy. (c) Any amendment of or endorsement to this policy must be in writing and authenticated by an authorized person, or expressly incorporated by Schedule A of this policy. (d) Each endorsement to this policy issued at any time is made a part of this policy and is subject to all of its terms and provisions. Except as the endorsement expressly states, it does not (i) modify any of the terms and provisions of the policy, (ii) modify any prior endorsement, (iii) extend the Date of Policy, or (iv) increase the Amount of Insurance. 18. SEVERABILITY In the event any provision of this policy, in whole or in part, is held invalid or unenforceable under applicable law, the policy shall be deemed not to include that provision or such part held to be invalid, but all other provisions shall remain in full force and effect. 17. CHOICE OF LAW; FORUM (a) Choice of Law: The Insured acknowledges the Company has underwritten the risks covered by this policy and determined the premium charged therefor in reliance upon the law affecting interests in real property and applicable to the interpretation, rights, remedies, or enforcement of policies of title insurance of the jurisdiction where the Land is located. Therefore, the court or an arbitrator shall apply the law of the jurisdiction where the Land is located to determine the validity of claims against the Title that are adverse to the Insured and to interpret and enforce the terms of this policy. In neither case shall the court or arbitrator apply its conflicts of law principles to determine the applicable law. (b) Choice of Forum: Any litigation or other proceeding brought by the Insured against the Company must be filed only in a state or federal court within the United States of America or its territories having appropriate jurisdiction. 18. The plan shall include: • No berry bearing species shall be included in the landscaping plan. • All plants used for landscaping and revegetation must be native plant species. • The applicant shall also commit to a noxious weed management plan. • Water rights should be demonstrated • No tree removal is proposed, however, for any removal of trees which are over 6" Diameter at Breast Height (DBH) shall be mitigated at 1 inch of replacement DBH for each DBH of tree removed.
