The properties within your Association are served by onsite wastewater treatment
systems (OWTSs), commonly referred to as "septic systems". Recently, there have
been several inspections of systems within your association due to the requirement to
obtain an OWTS Use Permit (a permit that approves continued use of an OWTS) prior to
sale of a property served by an OWTS. One of these systems necessitated repairs prior
to issuance of a permit, while others received a permit without making any changes to
the system. It has become clear that some of these system components encroach on
setbacks, designed to be protective of public health and the environment, to the
domestic drinking water well on the property and to Sopris Creek.
Unfortunately, the infrastructure serving the cabins is aging. As the cabins were
developed, OWTSs were installed and repaired in a manner that accommodated each
unit, depending on the development timeline. Today, the Colorado Department of Public
Health and Environment requires a more holistic approach to design and citing of
OWTSs on properties with high density.
With some forethought and planning, the infrastructure on the property can be
addressed in a way that improves system functioning while providing better protection of
public health and the environment. A "master plan", if implemented over time can be
cost effective and reasonable for the long term sustainability of this development. If
nothing proactive is done to address the issue of aging and non-compliant systems,
when repairs are necessary or a catastrophic failure occurs, it will be costly to the
homeowners.
The first step should be to institute a maintenance plan for the existing systems, as
described in my memo to the Sopris Creek Cabins Homeowners' Association dated
11/3/10. A maintenance plan should be documented and submitted to this department
for review to assure the protocol being implemented is likely to be cost effective and
provide the best chances for these aging systems to function properly. The second step
will be to create a "master plan" to address the replacement and proper citing of OWTSs
in a manner that is consistent with current state and local regulations, also mentioned in
my memo of 11/3/10. A fund should also be created to allocate money specifically for
the purpose of creating a plan and system replacement.
Please let me know if you have any questions. I would be happy to meet with you to
discuss this letter and begin working toward a maintenance and replacement plan for the
OWTSs on the property.

This memo is intended to give some background information on existing infrastructure and buildings on
the property and what limitations may exist, as well as to provide thoughts about future planning.
Septic
Permits and documentation:
Permit 80009 was repaired in 1980 consists of a 1000 gallon tank that serves units 7&8 and another
1000 gallon tank that serves Lot 11 and runs into a 25' x 60' absorption area located about 300' from the
residences. The permit indicates approval for 3+1+1 bedrooms (although we know unit 8 added a
bedroom in 1987 and this department signed off at that time).
Permit 79081 was repaired in 1979 and serves units 9 & 10. The existing 1000 gallon tank and drywell
remained in service and an additional 540 square feet of absorption area was added (10'x54') adjacent
to the residence on lot 11. This permit indicates approval for the system to serve 3 bedrooms.
Permit 76048 was an original permit for systems that serve the new residential duplexes. Units 1&2 are
served by one 1250 gallon tank and a 10'x80' absorption area. Units 3&4 and units 5&6 have the exact
same size system components serving each. All tanks are adjacent to the units and all absorption areas
are located near units 1&2. The permit indicates approval for 12 total bedrooms, so one could assume 2
bedrooms in each unit, since each duplex is served by separate systems.
There is another old document, presumably from the early 1970s, from K R Whittlesey that indicates the
position of the exiting septic in front of what we could assume are units 7&8 and 9&10. It appears that
some of that system remains in use while other components of that system were removed.
In 1980 when Resolution 80-37 was approved, this department wrote a memo citing a letter from the
Sopris Creek Cabins Homeowners Association showing intent of the HOA to maintain all of the systems
every two years. It also states that the declarations and covenants of the subdivision include any
common area to be available for individual sewage disposal systems (ISDSs).
Maintenance:
It is recommended that the tanks not only be pumped, but checked for integrity all system compontens
be evaluated through an inspection process similar to that required when obtaining a "OWTS Use
Permit" to assure all tees are on the tanks properly and it is recommended that effluent filters be
installed on the outlet tees to assure no solids are traveling to the fields.
The areas above the absorption fields should be protected. There should be no additional irrigation, no
heavy equipment, and no large animals grazing over the area. Ideally, the areas should be fenced to
assure there is no additional compaction. Native grasses and vegetation is preferred for effective
evapotranspiration in the field areas.
Looking ahead:
Many of these systems are aging and it is important to look forward so as systems fail or additional
development is requested, any system addition or repairs can be efficient and compliant with current
regulation. Many of the system components on the property are not clustered in a method that is
consistent with current regulation. In addition, many of the system components may not meet current
setback standards to the well on your property or water courses (Sopris Creek). A "master plan" should
be developed so as system repair and replacement is necessary, this plan can be implemented. A septic
system designer should be consulted so a design can be developed that is in compliance with Pitkin
County's Onsite Wastewater Treatment System Regulation (6.28) and the Colorado Department of
Public Health and Environment's WQSA-6.
Water:
Well permit 43200 was issued in 1970. This permit was recently clarified by the Colorado Division of
Water Resources. "Central System serving Sopris Creek Cabins (1 units), see SEO SB -35 comment.
Location clarification & ownership verification needed. Limit historic use prior May 8, 1972."
These comments indicate that more work should be done with the Division of Water Resources to
assure all legal issues with this well are resolved. The comments also indicate that the structures
"legally" served by this well were in existence prior to 1972. Duplexes 1&2, 3&4, and 5&6 were all
constructed after 1972 and presumably are not legally served by this well.
Building/Planning/Zoning:
There can be no increase of bedrooms until the septic systems are appropriately sized and located.
The pre -1972 units could expand number of bedrooms or other areas requiring increased water usage if
the septic systems were appropriately sized and located.
The post- 1972 units will not be able to do any expansions of areas requiring increased water usage until
appropriate legal water system is established and approved by the Colorado Division of Water
Resources and septic systems are appropriately sized and located.
All the duplexes are "existing nonconforming uses" and any expansions /additions would require
approval by the BOCC through a public hearing process per Land Use Code Section 9-50-30. Given the
lot sizes, presumably setback variances would also be required.

Attached for your records, please find a copy of the Well Permit for the Sopris Creek Cabins Subdivision for
use of the Mussell Well. As you can see by Conditions of Approval #6, this permit is sufficient to serve the 11
Units considered single family homes within the subdivision. Unit 11, currently owned by Mr. Ernemann, upon
whose property the well resides, filed an Application for Change in Use (Water Court Case No. 09CW 161) to
be allowed to dig a second well on his property for his own exclusive use. This application is what led to the
discovery by the State Water Engineer that the Mussell Well, while having been historically used by the 11
homes in the Sopris Creek Subdivision, had never been permitted. The State Water Engineer was satisfied with
the HOA's application for a permit and permitted the well for use by the subdivision in October of 2011.

1) This well shall be used in such a way as to cause no material Injury to existing water rights. The issuance of this permit
does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from
seeking relief in a civil court action.
2) The, construction of this well shall be In compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
8) Approved pursuant to CRS 37-90-137(2) and the decree granted for the Mussell Well In case no. W-607, Division 5 Wamr
Court. The operation of this well Is subject to the terms and conditions of said decree. -
4) The pumping rate of this well shall not exceed 45 GPM.
6) The average annual amount of ground water to be appropriated shall not exceed 7.13 acre-feet.
6) The use of ground water from this well is limited to its historical domestic uses as described in Division 5 Water Court
case no. 09CW161-(pending), Including ordinary household uses and Irrigation. These uses are not to exceed normal _
household uses inside 12 single family units and 3,506 square feet of lawn and garden irrigation per unit.
7) This well shall be to not more than 200 feet from the location specified on this permit and not more than 200 feet
from the location decreed for the Mussell Well in case no. W-607 (decreed locaflon is Tract 67, Section 13, Township 8
South, Range 87 West, 6th PM at a point whence A.P. No. 8 of Tract 67 bears South 16 degrees 42 minutes 37 seconds
East, 456.28 feet).
8) The approval of this permit does not grant a water right. This well is subject to administration by the Division Engineer In
accordance with applicable decrees, statutes, rules, and regulations.
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case
number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings.
10) For the future administration of this well, the Division Engineer of Water Division 5 may require the well owner to Install
and maintain a totalizing flow meter on this well.
NOTICE: This permit has been approved for 7.13 acre feet of withdrawls per year. You are hereby notified that you have
the right to appeal the issuance of this permit, by filing a written request with this office within sixty (60) days of the date of

Operational Status: At the time of the inspection the tank was overfilled and water was not reaching the absorption
field due to a collapsed outlet pipe. The tank was pumped as part of the inspection and the inlet tee was found broken
off. Repairs to the outlet line and inlet tee were completed during the inspection. After repairs, the 1000 gallon tank
that serves both units #7 and #8 appeared to be in good working condition. The absorption field appeared to be
working properly, there was no evidence of failure or surfacing effluent.
Inspector Recommendations: Determine the exact location of the absorption area and cease practices of irrigation and
grazing large animals over the absorption area. Tank lids were found to be worn and replacement of the lids was
recommended. The system serving units 9 & 10 was not inspected, but further investigation of the condition of this
system is recommended.
Department Recommendations: The department recommended adding an effluent filter to the outlet tee in the tank to
prevent solids from entering the field.
Issuance of this OWTS Use Permit is based solely on the conditions observed and reported by the inspector to the Department on the dote of the inspection(s) and
on Department records at the time of permitting. The issuance of this permit does not constitute o guarantee, warranty, or representation by the Department
that the system will operate properly or will not foil or that the system will not be subject to future enforcement action to correct non-compliant conditions.
Estimated capacity of the system has been listed on the permit and we recommend that you monitor and/or meter water use to prevent overuse and possible
