The World Vision Aspen Invitational Bike Ride through Michele Jensen (hereafter, the "Applicant") has applied to the Director for approval of a Special Event Permit to conduct a fund raising bike ride on July 25, 2015. Approximately 60 riders are expected to participate. The ride begins in Paepcke Park in Aspen and travels on 7°i Street to the bike path and continues up Castle Creek Road to Ashcroft. Riders travel back down Castle Creek Road onto the bike path and up Maroon Creek Road to the Forest Service parking lot at the Maroon Bells. Riders travel back down Maroon Creek Road, onto the Hwy 82 bike path to the Owl Creek Trail Bike Path to Snowmass Village. From there they follow Highline Road through the roundabout and merge onto the Brush Creek Trail and travel along the trail to Smith Hill Way to McLain Flats Road. McLain Flats Road will be traveled back to Aspen where the event ends at Paepcke Park with a catered picnic. 4. The Pitkin County Sheriff's Office, the Aspen Fire Department, Aspen Ambulance District, the Communications Department, and the Emergency Manager have all been referred on this event. Pitkin County Open Space and Trails and the United States Forest Service (USFS) have issued permits for use of County owned trails and USFS lands, respectively. The City has issued permits for use of Paepcke Park. The Applicant has provided a Certificate of Insurance covering this event and naming the County as an Additional Insured. 6. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4-30-50(i) of the Land Use Code. THE DIRECTOR HEREBY APPROVES the Special Event Permit for the World Vision Aspen Invitational Bike Ride subject to Applicant's compliance with each of the following conditions: All material representations made by the Applicant in the application (which shall specifically include representations made in all related supporting documents, correspondence subsequently provided by the Applicants, and representations made by phone), shall be adhered to, and considered conditions of approval, unless superseded by specific conditions in this Determination. 2. The Applicants must demonstrate possession of applicable permits at all times during the permitted activity and present such permits upon request. Page I of 2 3. No emergency access shall be blocked. 4. Riders shall be no more than two abreast on roadways and shall ride single file when traffic approaches. 5. Riders shall stay on the right side of the road and not ride against traffic. 6. Riders shall stay in the right lane, except when passing another vehicle, preparing for a left turn or avoiding hazards. 7. On curving canyon roads without bike lanes or shoulders, riders shall ride single tile. 8. Riders shall obey traffic laws, signs, and signals, and use hand signals to indicate left or right turns. 9. Failure to comply with the conditions of approval may result in revocation of this permit. No Parking/Reserved Signs will be needed for the Portable Toilets, for reserved parking spaces, bike corral and Barbeque Trailer. This is a small event and we can manage security. We will contract with Mountain Rolls Offs to provide 2 portable toilets and hand washing station. See Attached. This is not a race, but rather a casual ride to raise funds for a cause. Ride Banners will be posted on the Gazebo in the Park directing riders to the registration check in prior to ride. Additionally there will be 2 small tents for shade and chairs. Start Finish Station at Paepke Park will be staffed throughout the ride and will be equipped with SAT Phone, Water, Gatorade, snacks and first aid kit. Admission is on a first-come first- served basis. 2) All participants in the activity agree to abide by and obey all rules and regulations of Pitkin County Open Space and Trails, and any other regulations that may apply. 3) Approval to hold this activity does not imply that extra services will be provided nor does it place any additional liabilities on Pitkin County Open Space and Trails. 4) The permittee agrees to provide signage regarding the activity one week prior to the activity should OST staff determine it is necessary to minimize use conflicts. 5) The permittee agrees to hold harmless and indemnify Pitkin County Open Space and Trails and its staff from any death, injury or property damage occurring as a result of this activity. 6) The permittee shall supply all necessary manpower and equipment to safely conduct this activity. The permittee shall be responsible for any and all damage to park resources and/or facilities that result from this activity. 7) All Pitkin County ordinances and Colorado statutes apply. 8) The area in which the activity takes place shall be cleaned up and restored to its prior condition. 9) Entry to a property/park may be prohibited when the property/park is at capacity. Exceptions are not made for special activities. 000009 10) Pitkin County Open Space and Trails maintains the right and authority to amend or cancel this permit at any time should the applicant fail to abide by conditions agreed to or if public health, safety and welfare so dictate. 11) The permittee may.be assessed an Impact Fee for extra services provided by Pitkin County Open Space and Trails. Payment, if required, is due upon submittal of this application unless other arrangements have been approved: 12) This permit does not grant exclusive use of the site. Permittee shall ensure that the rights and privileges of other park visitors are recognized. 13) Permittee must demonstrate possession of applicable permits at all times during the permitted activity and present such permits upon request. PITKIN COUNTY OPEN SPACE AND TRAILS . STANDARD CONDITIONS FOR SPECIAL EVENTS 1. The permittee hereby expressly binds himself or itself to indemnify and hold harmless Pitkin County and each of its offers, agents, employees and insures against any and all liability, loss, damage, demands, for any claim, injury, or damage allegedly sustained received, and expresses of whatsoever nature (including court costs and attorney fees) which arise from or are caused by the acts of the premittee, its officers, employee, agents, contractors or subcontractors, in connection with or in any way arising out of the activities of the permittee. (Amount of insurance specified by Pitkin County on Pitkin County Permit.) 2. Snrav naintine or other permanent markine of the trail surface is strictly prohibited. Events requiring measured miles or the provision of other information to event participants must utilize nonpermanent means of conveying the information. Failure to remove mile markers or other participant information from the trail within 24 hours may result in revocation of the permit or action by Pitkin County government to withhold permits for future events. The permittee is responsible for any remedial efforts necessitated by a violation of this condition. 3. The permittee shall maintain the premises to standards of orderliness, neatness:, sanitation, and safety acceptable to Pitkin County Open Space and Trails. 4. The permittee shall pack out or otherwise remove from the area all refuse resulting from operations under this permit. 5. The permittee, in exercising the privileges granted by this permit, shall comply with all Federal, State, and Pitkin County laws and regulations which are applicable to the area or operations covered by this permit. This includes Pitkin County Title XII regulations requiring bicyclists to travel at safe speeds and to yield to equestrians and pedestrians. 6. The permittee shall submit and comply with a safety and operation plan, approved by Pitkin County Open Space and Trails, during the operational period of this permit. The permittee shall contact Pitkin County Community Development and comply with any special use requirements specified by the County. 7. The permittee shall exercise diligence in protecting from damage the land and property of Pitkin County Open Space and Trails used in connection with this permit, and shall pay Pitkin County for any damage resulting from negligence or from the violation of the terms of this permit or of any law or regulation applicable within the area used by the permittee, or by any agents or employees of the holder acting within the scope of their agency or employment. f , 8. The permittee shall notify Pitkin County of any substantial changes in the event type, route, venue or dates. Changes may be subject to approval by Pitkin County, In case of change of address, telephone, and/or contact.person for the event, the permittee shall immediately notify the permit agency agent. 9. Rising waters, high winds, falling limbs or trees, and other hazards are natural phenomena that present risks, which the permitted assumes. The permittee has the responsibility of inspecting the activity area and immediate adjoining area for hazardous conditions and, after securing permission from the Pitkin County, removing such hazards. 10. No signs or advertising devices shall be erected on the area covered by this permit, or highways lending thereto, without prior approval of Pitkin County government as to location, design, size, color and message. Erected signs shall be maintained or renewed as necessary to neat and presentable standards. 11. The event will not cause undue disturbance or inhibit safe travel on Pitkin County owned or managed properties or right-of-ways. 12. Permittee hereby certifies that he/she has acquired valid approvals for conducting the event as proposed hereunder from the owner or manager of each of the properties proposed to be accused, crossed or otherwise directly affected by this event. 13. This permit may be terminated upon breach of any of the conditions herein. The holder shall be liable for any damage suffered by the United States resulting from or related to use of this permit, including damages to National Forest resources and costs of fire suppression. 11. The holder shall hold harmless the United States from any liability from damage to life or property arising from the holder's occupancy or use of National Forest System lands under this permit. 12. The holder agrees to permit the free and unrestricted access to and upon the premises at all times for all lawful and proper purposes not inconsistent with the intent of the authorization or with the; reasonable exercise and enjoyment by the holder of the privileges thereof. 13. This permit is subject to all valid existing rights and claims outstanding in third parties. 14. This permit may be revoked or suspended upon breach of any of the conditions herein or at the discretion of the authorized officer. Upon expiration or revocation of this authorization, the holder shall immediately remove all improvements except those owned by the United States, and shall restore the site within 1 day, unless otherwise agreed upon in writing. If the holder fails to remove the improvements, they shall become property of the United States, but that will not relieve the holder of liability for the cost of their removal and restoration of the site. 15. This permit is a license for the use of federally owned land. It does not grant any interest in real property. This permit is not transferable. Upon approval of the authorized officer, the holder may enter into agreements with third parties to exercise the rights and privileges granted by this authorization. 16. The holder is required to comply with standards for adequacy and type of services set out in the attached operating plan. 17. The holder, in advertisements, signs, brochures, letterheads, and like materials, as well as orally, shall not misrepresent in any way, either the accommodations provided, the status of the authorization, or the area covered by it or the vicinity. Pursuant to 31 U.S.C. 3717, et seq., interest shall be charged on any fee amount not paid within 30 days from the date the fee or fee calculation financial statement specified in this authorization becomes due. The rate of interest assessed shall be the higher of the rate of the current value of funds to the U.S. Treasury (i.e., Treasury tax and loan account rate), as prescribed and published by the Secretary of the Treasury in the Federal Register and the Treasury Fiscal Requirements Manual Bulletins annually or quarterly or at the Prompt Payment Act rate. Interest on the principal shall accrue from the date the fee or fee calculation financial statement is due. In the event the account becomes delinquent, administrative costs to cover processing and handling of the delinquency will be assessed. Delinquencies in excess of 60 days shall be referred to United States Department of Treasury for appropriate collection action as provided by 31 U.S.C. 3711 (g), (1). For the purpose of administering this permit (including ascertaining that fees paid were correct and evaluating the propriety of the fee base), the holder agrees to make all of the accounting books and supporting records to the business activities, as well.as those of subleases operating within the authority of this authorization, available for analysis by qualified representatives of the Forest Service or other Federal agencies authorized to review the Forest Service activities. These signs shall be conspicuously displayed at the public entrance to the premises and at other exterior or interior locations, as directed by the Forest Service. 4. The Forest Service shall have the right to enforce the foregoing nondiscrimination provisions by suit for specific performance or by any other available remedy under the laws of the United States or the State in which the violation occurs. 25. Equal Access to Federal Programs (132). In addition to the above nondiscrimination policy, the holder agrees to insure that its programs and activities are open to the general public on an equal basis and without regard to any non -merit factor. 26. Insurance, Commercial General Liability (B-10). INSURANCE. The holder shall furnish proof of insurance, such as a certificate of insurance, to the authorized officer prior to issuance of this permit and each year thereafter that this permit is in effect. The Forest Service reserves the right to review and approve the insurance policy prior to issuance. The holder shall send an authenticated copy of any insurance policy obtained pursuant to this clause to the authorized officer immediately upon issuance of the policy. Any insurance policies obtained by the holder pursuant to this clause shall name the United States as an additional insured, and the additional insured provision shall provide for insurance coverage for the United States as required under this clause.
