Vos Caudill, Pitkin County, CO ADMINISTRATIVE DECISION OF THE PITIUN COUNTY, COLORADO COMMUNITY DEVELOPMENT DIRECTOR GRANTING APPROVAL FOR THE RUSSELL MINOR AMENDMENT TO A DEVELOPMENT PERMIT Administrative Decision No. &O—Q - 2015 RECITALS Thomas and Pamela Russell (hereafter referred to as "Applicant") has applied to the Pitkin County Community Development Director ("Director") for a Minor Amendment to a Development Permit to amend a previously approved building envelope/site plan for the purpose of constructing a one-time 300 square foot addition (in the form of multiple small additions) to a legal non -conforming residence that resides within the 100' setback from the mean high water mark of the Roaring Fork River and Woody Creek. Outside the 100' setback from the Roaring Fork River and Woody Creek, a detached shed, a walking path, and a sitting bench are proposed. 2. The subject parcel is situated at the confluence of the Roaring Fork River and Woody Creek. The subject parcel is located at 60 Doc Henry Road, Woody Creek. Legal Description, Attachment A. PID#: 264309300019. The lot is within the AR -10 zone district and is currently developed with a single family residence. The Planning and Zoning Commission approved a Building Envelope for the subject parcel pursuant to PZ Resolution No. 88-44 (Book 582 Page 622). The Building Envelope was recorded at Book 23 Page 40. Though a building envelope was approved, the decks on the southeast side of the residence are not within the approved Building Envelope. A foundation plan that was approved by the Building Department in 1989 shows that the footprint of the house is in compliance with the building envelope, however the decks are outside the building envelope. These decks were also permitted. Almost the entirety of the residence resides within the 100' setback from the mean highwater mark of the Roaring Fork River and Woody Creek, making the residence a legal non- conforming structure. 4. The Director finds that the proposal to construct multiple additions in the form of a pergola, bedroom expansion, 2nd floor staircase, and spa/hot tub, that add up to 300 square feet of development to the legal non -conforming residence, all of which is at least 50' from the mean highwater mark of the Roaring Fork River, is permissible pursuant to Code Section 9-50-20(c)(3). Additional square footage may not be added to the residence utilizing this Code section in the future. 5. The Director further finds that the two (2) stairway areas depicted on the Site Plan that lead down to the Roaring Fork River are permissible and will reduce erosion. 6. The Director further finds that the additions are located outside the 100 year floodplain of the Woody Creek and the Roaring Fork River. The Director further finds that the walking path, bench, and detached shed are permissible and can be approved. The Applicants shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Prior to submission of any future permit applications, the Applicants shall be required to submit for approval by the County Attorney and Community Development an amended Site Plan in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation. 3. The bedroom addition, and if the exterior of the existing structure is refinished, shall utilize indigenous earth tone colors. Non -reflective roofing shall also be utilized. 4. The property is within a low wildfire hazard area. All roofing shall utilize a "Class A" rating for materials. 10' of defensible space shall be created around the residence. 5. Any development including landscaping features are prohibited within the 100' setback of Woody Creek and the Roaring Fork River except these items specifically enumerated by this determination. 6. The stairways leading down to the Roaring Fork River shall not be expanded, enlarged, lengthened, or enhanced. 7. At building permit submittal, the Applicant shall: A. Submit a construction management plan for review and approval by Planning/Zoning. B. Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes. C. Submit a landscaping and tree replacement plan for 6" d.b.h trees that are removed that are not part of wildfire mitigation or are dead/dying. D. Submit a lighting plan that is consistent the Land Use Code. 8. Prior to permit issuance, pay the applicable road impact fees. 9. Prior to Certificate of Occupancy for the additions, the thistle that exists on the northern portion of the parcel above the residence shall be treated and/or removed. 10. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. Parcel History: The parcel was created in July 27,1988 as part of a 1041 Hazard Review Plat with a minor amendment for a building envelope (Plat recorded 9/12/89 in Book 23 Page 40 as Reception #315028). Previous Land Use Approvals: Resolution No. Pte, recorded on January 4th, 1989 grants the 1041 Geologic Hazard Review approval. Access: The Property is currently accessed by a gravel driveway directly off of Doc Henry Rd. at the northern edge of the property. OOOOJ5 REVIEW CRITERIA FOR SPECIFIED LAND USE CODE SECTIONS SEC. 2-20-150: AMENDMENTS TO DEVELOPMENT APPLICATIONS AND PERMITS (a) APPiicability This section establishes the procedures for minor and major amendments to development applications. (b) Minor Amendments Defined A minor amendment to any development application or permit is one that meets the following criteria, as determined by the Community Development Director: (j) Is consistent with action(s) taken during previous development approvals for the property; and (2) Does not change the use of the proposed development between residential, commercial and tourist accommodation uses; and (3) Does not change the basic character of the approved use of land on which the activity occurs, including basic visual appearance and method of operation; and (4) Does not constitute anew land development activity; and (5) Does not increase off-site impacts in the surrounding neighborhood; and (6) Does not endanger the public health, safety or welfare, and (7) Does not violate any Land Use Code standard; and (8) Does not substantially increase the need for on-site parking or utilities, or affect affordable housing generation; and (9) Does not increase the floor area of the use by more than five (5) percent or decrease the open space on the site by more than five (5) percent. The Applicant is requesting approval to amend a previously approved Building Envelope/Site Plan and define a new Activity Envelope for the single family home. The additions to the current residence will comply the above criteria. The current placement of the residence meets the above criteria however the existing residence exists within the 100' setback from the mean high water mark thus giving the residence a legal non -conforming status. The amended Building Envelope is in full compliance with the Land Use Code and conforms to Pitkin County's Comprehensive Plan. 7-20-40 FLOODPLAIN HAZARDS (a) Floodplain Maps (f) The standards in this section apply to mopped floodplain hazard areas as depicted in the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map, National Flood Insurance Program (June 4, 1987, and including anysubsequent amendments to that map) and areas determined by the County Floodplain Administrator to be in flood hazard areas. (2) Where a property owner believes that the mapped floodplain hazard areas shown on the FEMA Flood Insurance Rate Mop are inaccurate, the property owner may request that FEMA process an amendment to that map, or may present alternative mopping to the County Floodplain Administrator, who may accept such mapping as an indication of the floodplain area only if the County Flood Plain Administrator believes the alternative mapping to be more accurate than the FEMA Flood Insurance Rate Map. (3) Where the 100 -year or intermediate regional flood has not been established, a property owner may conduct a floodplain study to determine the boundaries of the floodplain. The property owner should consult with the County Flood Plain Administrator to determine the appropriate methodology for the floodplain study. (4) Where the 100 -year or intermediate regional flood has not been established by the FEMA Flood Insurance Rate Mop pursuant to subsection (1) above, or by a property owner study pursuant to subsection (3) above, this regulation shall apply to all lands within an area that is twenty (20) horizontal or five(5)vertical feet (whichever land area is greater) from the existing high waterline on any river, stream or material drainage channel, and any area that the County Floodplain Administrator determines to be a flood hazard area. (S) It shall be the burden of the applicant to demonstrate that the property seeking development approval is not within a floodplain hazard area. (b) General Standards (1) All activity and development is prohibited within the 100 -year floodplain except as specifically permitted in this subsection (b) or by subsections (c), (d), or (e) below. All permitted activity shall be reviewed for compliance by the County Floodplain Administrator through a floodplain development permit. (2) Within the 100 -year floodplain, no use, fill, construction, excavation, embankment or alteration on or over any portion of the floodplain shall be permitted that would result in any of the following: (a) The storage or processing of materials that in times of flooding are buoyant flammable, explosive, or otherwise potentially injurious to human, animal or plant life. (b) The disposal of garbage or other solid waste materials. The human occupation of structures either fixed or mobile, permanent or temporary. (C) Substantial solid debris being carried downstream by floodwaters. (d) Any obstruction that would impair the flow or storage capacity of a floodplain so as to cause foreseeable damage to others either within or outside of floodplain boundaries. (e) A substantial increase in sedimentation or erosion. The infiltration of floodwaters into on-site water supply and wastewater disposal systems that would impair their functioning or pollute the stream. (fi Damage to or destruction of aquatic ecosystems, including but not limited to, wetlands OO O O J 7 and riparian habitat areas (g) The storage or processing of materials that in times of flooding are buoyant flammable, explosive, or otherwise potentially injurious to human, animal or plant life. (ft) The disposal of garbage or other solid waste materials. The human occupation of structures either fixed or mobile, permanent or temporary. (t) substantial solid debris being carried downstream by floodwaters. 6) Any obstruction that would impair the flow or storage capacity of a floodplain so as to cause foreseeable damage to others either within or outside of floodplain boundaries. (k) Asubstantial Increase in sedimentation or erosion. The infiltration of floodwaters Into on-site water supply and wastewater disposal systems that would impair theirfunctioning orpollute the stream. (q Damage to or destruction of aquatic ecosystems, including but not Bmlted to, wetlands and riparian habitat areas. (c) Floodplain Hazards - Uses Permitted The following uses shall be permitted In a floodplain area to the extent that they are not prohibited by any other regulation and they comply with the guidelines set forth in subsection (b) above. (f) Agricultural uses such as general farming, grazing, forestry, sod farming and wild crap harvesting. (1) Identf,ed and approved public and private recreational uses are permitted in the floodplain only if the approved uses do not cause a concentration of people in such areas during high flood hazard probability. Any structures associated with such uses shall be subject to the provisions of subsection (b) above. Terrestrial and aquatic habitat restoration activities shall also bean allowed use in the floodplain, provided that the BOCC makes a finding that the restoration project has been designed for the purpose of restoring, or preventing further degradation of the natural, dynomkc functions of the river, stream, or other body of water, the applicant shall be required to provide sufficient scientific information to establish both the existence of pre -restoration degradation and the scope and desirability of the post - restoration improvements. Acceptable scientific information may include, but is not limited to, information on channel hydrology, site geomorphology, streambed characteristics, mocroinvertebrate populations, and fish populations. Applicant must also demonstrate that the scientific information provided has been generated by an individual(s) or legal entity lies) qualified to render an assessment in all pertinent subject areas. This demonstration maybe provided in the form of a curriculum vitae (CV) for an individual, a company resume of project experience, personnel certifications and licenses, etc., or any other manner reasonable under the circumstances. (3) Bridges or other structures for irrigation, drainage, flood control, hydropower, or water diversion may be allowed upon approval of plans and specifications by the County Floodplain Administrator and Community Development Director, provided they are engineered to prevent blockage of drainage channels during peak water flows and their placement does not result in the loss of wetlands or riparian areas. All structures shall be required to cleorspon the waterway to the maximum extent practicable. (d) Redstone Townsite Floodplain Exemption Area Because of the extensive historical development within the floodplain of the Redstone Townsite, the public interest in providing incentives for the preservation of the historic characterof the Townsite, and the determination that the floodplain will not be unduly impacted, any property within the Redstone Townsite zoned Village Commercial or Village Residential shall be allowed to develop within the floodplain, subject to the following development standards: (f) No Alternative Building Site If there is no alternative building site on the property, development may be approved subject to compliance with the minimum development standards setforth in Sec. 7-20-40(e). (2) Building site with Fewer Impacts If the building site proposed creates fewer Impacts than if the development was limited exclusively to an area outside of the 100 -year floodplain, development may be approved subject to compliance with the minimum development standards set forth in Sec. 7-20-40(e). (e) Standards if No Hazard -Free Area Exists In the event that an application is denied because there is no hazard free area on a site, and an appeal is granted pursuant to Sec. 2-20-180 or relief Is granted pursuant to Sec. 1-40-150, the proposed activity or development shall be reviewed according to subsection (a) above and the following standards: (f) New residential structures, and any additions to existing residential structures, shall have the lowest floor, Including the basement elevated one (1) foot or higher above the base jloodlevel. (2) New commercial, industrial, or other non-residential structures, and any additions to the same shall either have the lowest floor (including the basement) elevated to the level of the base flood elevation; or, together with attendant utility and sanitaryfacilities, shall: (a) Be flood proofed so that below the base flood elevation the structure is watertight with walls substantially Impermeable to the passage of water,* and (v) Have structural components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy. (3) New commercial, industrial, or other non-residential structures, and any additions to the some shall be certified by a registered professional engineer licensed in the State of Colorado or architect that the design and methods of construction are In accordance with accepted standards of practice for meeting the provisions of this section. Such certifications shall be provided to the Pitkin County Floodplain Administrator. See response below section 7-20-80 TI ORM 7-2040 RIVER AND STREAM CORRIDORS AND WETLANDS (a) Riparian and Wetland Areas and Buffers (1) Protected Features Each Site Plan shall identify each of the following features on the property. (a) Blue line" perennial streams shown on U.S. Geological Survey maps of the area; and ((J) Intermittent streams or streambeds known or apparent from field study, with the exception of man-made waterways such as ditches and water features. (d) Isolated, natural wetland and riparian areas. (2) Minimum Setbacks All activity and development shall maintain a minimum setback from the protected features identified in subsection (I) above. (a) All activity and development after the 5th of July; 2006 shall maintain a riparian area/wetland buffer of at least one hundred (100) feet measured horizontally from the identifiable high water line of each feature identified in subsections (a)(1)(0) and (b) above. This one hundred (100) foot setback maybe reduced to between one hundred (100) feet and a minimum of fifty (50) feet upon demonstration by the applicant that such reduction shall not result in water quality degradation, stream bank erosion and/or a reduction In the quality of riparian or wetland habitat pursuant to standards In Section 7-20- 80(4). (b) All activity and development after the 5th of July, 2006 shall maintain a buffer of a minimum of twenty-five (25) feet from isolated wetlands and/or riparian areas identified in (a)(1)(c) above. (3) Additional Setbacks (a) Site specific Factors In addition, some or all activity and/or development maybe required to maintain an additional riparian area/wetland setback of up to fifty (50) feet from each feature indentified in subsection (a)(1)(a) and (b) above — beyond the minimum setback in subsection (2) above. The width of any required additional setback may vary across different portions of the property, and the types of activities or development prohibited within the additional setback may also vary in different portions of the additional setback. Establishment of any additional setback requirement shall be based on an analysis of the following limiting factors during review of the Site Plan or Activity Envelope for the proposed development or activity: 000010 1. Slopes adjacent to the protected feature equal or exceed thirty (30) percent. 2. Highly erodible soils or unstable streombank conditions are present. 3. The proposed use of the property presents a special hazard to water quality or wetlands (e.g., storage or handling of hazardous or toxic materials). 4. The one hundred (100) year or intermediate regional food zone exceeds the minimum fifty (50) foot setback requirement. S. Trees, shrubs, or other natural feotures that provide for streambank stability, habitat enhancement far aquatic environments, and riparian area protection exist or to maintain pre -development riparian plants. 6. Habitat for plant animal, or other wildlife species listed as threatened or endangered by the United States Fish and Wildlife Service exists. 7. Habitat forplant animal, or other wildlife species listed by the State of Colorado as rare, threatened, or endangered, species of special concern, or species of undetermined status exists. 8. The area is needed to prevent or minimize food damage by preserving storm and food water storage capacity. 9. The area is needed to protectfish spawning, breeding, nursery and feeding grounds. 10. The area is needed to preserve areas of special recreational, historical, archeological, scenic, or scientific interest. (b) Public Health and Safety In appropriate cases, a setback of greater than one hundred fifty (150) feet may be required by the Board of County Commissioners in order to protect the public health, safety and welfare. (4) ReducedSetbacks (a) Site Specific Factors —New Development Activity Where an applicant is seeking a reduction in the one hundred (100) foot riparian/wetland setback specified in subsection (a)(1)(a) above, a site specific analysis shall be submitted to prove that there is no area on the property that con be used for development outside of the one hundred (100) foot setback, without encroachment into the following area(s) prohibited from development in Section 7 of the Land Use Code: 1. Slope; 2. Geologic Hazard 3. Severe Wildfire; and 4. Wildlife Habitat 000011 In the event that no developable area exists outside of the 100 foot setback, the applicant shall provide an analysis demonstrating compliance with the following criteria as well as any other criteria specified by Pitkin County, as part of the Site Plan or Activity Envelope application for the proposed development or activity f. Slopes adjacent to the protected feature are less than thirty (30) percent. 2. Highly erodible soils or unstable stream bank conditions are notpresent. 3. The proposed use of the property does not present a special hazard to water quality or wetlands (e.g., storage or handling of hazardous or toxic materials). 4. The one hundred (100) year or intermediate regional food zone does not encroach into the setback reduction requested. 5. Trees, shrubs, or other natural features that provide for stream bank stability, enhance wildlife or aquatic movement within a stream corridor, provide habitat enhancement for acquotic environments and riparian area protection do not exist. Or will be unaffected by the proposed activity or development within the setback reduction being requested. 6. Habitat for plant animal, or other wildlife species listed as threatened or endangered by the United States Fish and Wildlife Service does not exist within the setback reduction being requested. (7) Habitat for plant, animal, or other wildlife species listed by the State of Colorado as rare, threatened, or endangered, species of special concern, or species of undetermined status does not exist within the setback reduction being requested. 8. The area within the setback reduction being requested is not needed to prevent or minimize food damage b preserving storm and food water storage capacity. 9. The area within the setback reduction being requested is not needed to protectfish spawning, breeding, nursery and feeding grounds. 10. The area within the setback reduction being requested is not needed to preserve areas of special recreational, historical, archeological, scenic, or scientific interest. If the riparian/wetland setback is reduced under this provision and the setback area shows signs of riparian/wetland vegetation disturbance or removal, the Applicant may be required of submit a restoration plan for review, approval, and implementation. (b) Site Specific Factors - Reclamation of Previously Developed Areas Where an applicant is seeking a reduction in the one hundred (100) foot riparian/wetland setback specified In subsection (a)(1)(a) above for purposes of reclaiming a previously - developed area (e.g., removal of concrete rubble, or removal of a paved roadway or parking 0000'-2 lot), the application shall include an analysis demonstrating that the proposed reclamation of the site will result in; 1. A return to natural conditions that better preserves and/or enhances the protected feature and other natural attributes of the site. 2. Preservation and/or enhancement of any public viewsheds. 3. Preservation and/or enhancement of any public recreational opportunities associated with the protected feature. The applicant shall also address any other site-specific factors specified by Pitkin County during review of the Site Plan or Activity Envelope for the proposed development or activity. (C) Variations in Encroachment in Prescribed Setback The width of any permitted encroachment into the one hundred (100) foot setback may vary across different portions of a property, and the types of activities or development allowed within the encroachment may also vary on different portions of a property. (b) General Standards 1. All development and activity involving disturbance of the land shall be prohibited within the setbacks established in subsection (a) above, except as permitted by subsection (c) below. 2. In the event that an application is denied because there is no portion of the site where the proposed activity can take place outside of the required buffer areas, and on appeal is later granted pursuant to Sec. 2-20-18O, or relief is granted pursuant to Secs. 2-40-90 or 2-40-15O, the proposed development shall be reviewed according to the mitigation standards in subsection (d) below. (C) River and Stream Corridors and Wetlands Exceptions (1) Bridges, roads, paved and gravel trails, utility crossings, existing overhead utility lines, irrigation devices, water diversion facilities, culverts, and food control structures, maybe permitted in riparian and wetland buffer areas upon a finding that there is no feasible alternative location and that any adverse impacts will be adequately mitigated as required by subsection (d) below. (2) Bank stabilization, riparian restoration work and restoration of natural, dynamic riverine functions (in accordance with the requirements of Section 7- 20-4O(c)(2)) may also be permitted in riparian and wetland buffer areas upon the BOCCfinding that any adverse impacts will be adequately mitigated, as required by subsection (d) below. (3) Development on lots in County approved subdivisions with designated building or development envelopes. (4) Development on lots in the Lazy Glen MHP Subdivision/PUD may develop according to setbacks identified in the PUD approval. (5) Development on lots zoned VC or VR in the Redstone Historic Townsite shall maintain a minimum twenty (20) foot setback, measured horizontally from the identifiable high waterline of each feature identified in subsections (a)(1)(o) and (b) above. 000013 (6) Expansion of legal nonconforming structure(s) in the form of added height and bulk, with no changes to existing structure footprint subject to provisions in Section 9-50-20(c). (7) Placement and maintenance of improvementsfor a micro hydroelectric facility maybe permitted within riparian/wetland area and associated stream and riparian/wetland setbacks, upon Ending that any adverse impacts will be adequately mitigated, as required by subsection (d) below. These facilities include: (a) Intake facilities (catch basins, gate valves, sediment tanks); (b) Transmission pipelines of ll" diameter or less (C) Exposed/anchored or shallow buried; (d) Hydro turbine generator power delivery systems housed in an outbuilding in accordance with Section 4-30-050(k); and (e) Tailraces to return water flow back to a stream. 69 In addition to requirements outlined in subsection (d) below, a site specific analysis shall be submitted for review and approval that identifies riparian, wetland, and in -channel habitat that will be disturbed as a result of construction of the facility and associated Infrastructure. A mitigation plan that employs best management practices for restoring such disturbed habitat shall also be submitted for review and approval. A bond shall be collected to ensure revegetation and mitigation occurs. (8) Development on lots in the Little Elk Creek Village Subdivision shall maintain a one -hundred foot (100 f) setback from the identifiable high water line of Little Elk Creek except in the following circumstances: (a) An owner of a legally created residential structure, or portion thereof, that encroaches partially or completely into the fifty foot (50 f) setback area from Little Elk Creek may redevelop, reconstructor replace that portion of the structure which encroaches into the ffty foot (50 ft) setback area in the same footprint configuration as exists prior to the reconstruction, with no additional encroachment allowed into the fifty foot (50 f) setback. (b) An owner of a legally created residential structure, or portion thereof, that is partially or completely within the area that is at least fifty feet (50 f.) from Little Elk Creek, but lets than one -hundred (100 ft) from Little Elk Creek may redevelop, reconstruct, orreplace the structure within this area, with no additional encroachment allowed into the fifty foot (50 ft) setback, but with expansion permitted in the area that is at least fifty (50 ft) from Little Elk Creek. In either of these cases, enhancement of riparian vegetation will be required through the site plan review process. The riparian vegetation enhancement required will be proportional to the extent of the riparian habitat degradation on the site. A construction management plan and drainage and erosion control plan will be required to insure there will be no deleterious effects on existing riparian vegetation. (d) Mitigation Standards Any disturbance of the buffer area must be reclaimed by regrading and revegetation in accordance with the Pitkin County Revegetation Guide or as directed by the Pitkin County riparian expert the U.S. Army Corps of Engineers, U.S. Environmental Protection Agency, or Colorado Division of Wildlife, and compliance with such standards shall be included as a condition of any approval. In addition, the following standards shall apply: 00001 (1) Utility corridors in buffer areas shall be located at the outside edge of the buffer. (2) Access roads for utility maintenance shall be located outside the buffer area. (3) Access for utility maintenance in buffer areas should beat specific points rather than parallel to the utility corridor. (4) Development shall incorporate specific measures designed to reduce erosion and prohibit sedimentation; no development that will increase stream sedimentation and suspension loads shall be permitted. (S) Development shall comply with sec. 7-20-30 and those stream setbacks contained in Table 5-1. (6) Removal or disturbance of vegetation in riparian and wetland buffer areas shall be avoided to the maximum extent practicable. (7) Areas where vegetation in wetland or riparian buffer areas is disturbed or removed shall be revegetated as quickly as possible, but in no event later than one growing season following conclusion of construction activities in the area. (8) Channelizotion of streams is prohibited; development shall be designed to fit the channel rather than allowing changes in the channel in order to fft the development. (9) Perennial stream channels shall be bridged whenever possible; when this is not practicable, culverts shall be designed to avoid plugging and prevent washouts. (10) Development shall not result in the raising of water temperatures. (11) Alterations to stream channels (including their capacity, filling and dredging) shall be prohibited unless it has been satisfactorily demonstrated, through site-specific scientific study and analysis (including an evaluation of all upstream and downstream impacts), that the proposed channel work will improve the dynamic stream channel function, the habitat for a diversity of species, and that future and historical public uses, such as stream navigation, recreation, and aesthetics are not diminished by the proposed channel improvements. All approved stream work must be permitted. Acceptable scientific information may include, but is not limited to, information on channel hydrology, site geomorphology, streambed characteristics, macroinvertebrate populations, and fish populations. Applicant must also demonstrate that the scientific information provided has been generated by an individual(s) or legal entity (ies) qualified to render an assessment in all pertinent subject areas. This demonstration maybe provided in the farm of a curriculum vitae (CV) for an individual, a company resume of project experience, personnel certifications and licenses, etc, or any other manner reasonable under the circumstance 000015 The following text is addressing both section 7-2040 and 7-20-80: 1) Stream Margin Setback Improvements No unpermitted uses are proposed in the floodplain. The 100 year floodplain is referenced on the attached siteplan. The utilization footprint within the site as a cultural landscape that has been utilized in that regard throughout the history of the property. The current uses of landscape have evolved as an intimate landscape with family friendly systems such as lawn, dwelling space, sitting space, outdoor recreation. The existing uses are easily identifiable on site. The boundaries of the landscape such as irrigation, sod, pathways, connections, are historical and the focus of the current program seek to emulate what has historically occurred. The adjacent property owners (across stream and upstream) have similar configurations of mixtures of native fringe and cultural/traditional landscapes. The tight systems that create this topography also guide the usable (livable) space versus the native fringe zone. The context of the site is really important to the uses. Although some of the landscape and cultural uses are technically within the stream margin set -back, the topography of the site really provides an excellent barrier and "division" of natural habitat that provides definition to the cultural landscape and the natural landscape today. The mission of the applicant is to focus on preserving these boundaries permanently. Utilizing the current configuration, this program will be successful with current topographical and ecological boundaries that exist on site. 2) River Bank Improvements a) The organic pathways that exist on the site that lead to the river provide a framework for the correct type of access. In two locations, a historical trail has accessed that riverbank. These trails are steep and is prone to erosion. In order to maintain the vegetation, it is best to use this existing trail accesses. In order to prevent erosion along this access and keep existing vegetation intact, a few stone stairs (dryset) will be installed in the bank that mimic the character of the bank, but prevent erosion or vegetation degradation. b) The firepit facility that is desired on the top of bank (turf zone) should be addressed with Pitkin County. Without any precedence or existing structures, we need to talk about the cultural nature of the landscape on the top of bank The firepit is a dry stack organic structure that does not require a building permit or structural engineering. 3) Arboricultural There are dead and severely declining trees in the steam margin setback which are a clear and present danger. A report and an application is forthcoming to request and provide documentation of significant tree hazards on the property. As for vegetation, the utilization of native riparian and riverine adapted species within the stream margin setback is an important concept and tenant of the design. 00009.0 9-50-20 RESTORATION WITHOUT SIGNIFICANT CHANGES (c) Restoration, Repair, Reconstruction, Replacement, Remodel, and Additions to Legal Non- conforming Structures A legal non -conforming structure maybe expanded, repaired, restored, reconstructed, replaced, or remodeled as long as the activity does not increase the non -conformity. Prohibited enlargement of the non -conformity shall include, but not be limited to: expansion of the floor area where the floor area for the zone district has been exceeded and expansion of the structure in to the setbacks, including an increase in the mass of the existing structure within the setbacks; expansion of the structure into any other area where the development standards or the building codes prohibit development. Expansion of the structure into the setbacks, including an increase in the mass of the existing structure within the setbacks is prohibited, except in riparian/wetland setbacks, in which height and bulk may be added to an existing residential structure with no change to the existing footprint of the structure, subject to compliance with the following criteria: (3) Notwithstanding paragraphs (1) and (2) above, any residential structure that is legally non -conforming with respect to riparian/wetlond setbacks is permitted a one-time total 300 sq. ft. above grade attached expansion without requirement of o demonstration that no developable area exists outside of the 100 foot setback area. This expansion must maintain at least a 50 foot riparian/wetland setback, and there must be demonstration to the satisfaction of the Environmental Health/Natural Resources Department that the expansion can be sited without detriment to the wetland/riparion habitat. A riparian/wetland mitigation plan that outlines improvement and/or restoration of the subject property maybe required to be submitted to the Community Development Director for review, approval, and implementation as part of this analysis in order to obtain this exemption. The existing residence currently almost entirely sits within the 100' setback from the mean highwater mark. The applicant's proposed above grade additional square footage is under 300 sq. ft. and beyond the 50' setback mark. A majority of the additional square footage is within the existing footprint.
