Title 11 of the Pitkin County Code requires every building to be issued a Certificate of
Occupancy or Letter of Completion. Because the referenced permit has not been brought

Administrative Determination NoVQ-2010
RECITALS
Steve and March Henley ("Applicants"), have applied to the Community Development Director of Pitkin County,
("Director"), pursuant to Section 2-20-150(b) of the Pitkin County Land Use Code ("Code"), to amend the Woody
Creek Subdivision (formally the mobile home park) PUD Guidelines for Lot 55 to allow a variance in height as
measured at the mid -point, from eighteen feet (18') to eighteen feet six and three-quarter inches (18' 6 3/4") and for
the overall height of the structure from twenty-three feet (231) to twenty-four feet two and one-third inches (24'
21/3"). The height limits are established on Page 8 of the Guidelines, which are recorded per Reception number
515412.
2. The property is located in the Woody Creek Mobile Home Park and is described as Lot 56, Woody Creek
Subdivision. PID#2643-161-06-056.
3. The property is zoned MHP/P.U.D. and contains 5,285 square feet.
4. The Planning and Zoning Commission granted approval to the Housing Office for a fully developed land
subdivision exemption for the Woody Creek Tavem and Mobile Home Park pursuant to Resolution No. PZ -99-2.
A Fully Developed Land Subdivision Plat was recorded at Book 54, Page 76.
5. Additionally, the BOCC granted approval in 2001 for Conceptual Subdivision, Planned Unit Development,
GMQS Exemption for deed -restricted housing units, Rezoning from SR to MHP/PUD and Special Review for
parking in the PUD pursuant to Resolution No. 085-2001. In April 2005, the property received Detailed and
Final Plat and GMQS Exemption approval pursuant to BOCC Resolution 046-2005.
6. A Minor Amendment was granted in 2006 pursuant to Administrative Decision No. 99-2006 for some lot line
adjustments and a subsequent Amendment was granted by the BOCC to eliminate the fire sprinkler requirement
for each residence pursuant to Resolution No. 020-2007. The BOCC pursuant to Resolution No. 047-2007,
amended Condition No. 5 of Resolution No. 046-2005 to allow the issuance of Building Permits prior to the
infrastructure of the subdivision park being completed. Administrative Decision No. 96-2007 amended the PUD
Guidelines to reduce some of the existing setbacks for Lots 45-58 (the newer portion of the Subdivision).
7. The Director finds that the request is consistent with the requirements of the Land Use Code.

RECITALS
I. Aspen/Pitkin County Housing Authority ("Applicant") has applied to the Board of County
Commissioners of Pitkin County, Colorado ("BOCC") for the following approvals for the Woody Creek
Mobile Home Park ("Park"):
A. Subdivision/PUD Conceptual Submission to accommodate the subdivision of an 8 acre parcel
into 60 lots;
B. Rezoning of the entire park from SR/PUD (Special Residential/Planned Unit Development)
to MHP/PUD (Mobile Home Park/Planned Unit Development);
C. Special Review for Parking in the PUD; and
D. GMQS Exemption for deed -restricted resident occupied ("RO") housing units.
2. The property is located on Upper River Road in the Woody Creek area. The Park is located to the
west of the Woody Creek Tavern and north of the new Woody Creek Post Office and Fire Station across
Upper River Road. The property is more specifically described in Exhibit A.
3. The Planning and Zoning Commission ("Commission") at a regularly scheduled meeting on January
2, 2001, reviewed the application and recommended conditional Conceptual Subdivision approval to the
BOCC.
4. The BOCC heard the first reading of this applicationat a duly noticed public hearing on April 11,
2001, at which time evidence and testimony were presented withrespect to this application.
5. The BOCC heard the second reading of this application on April 25, 2001, at which time additional
evidence and testimony were presented with respect to this application.
6. The BOCC finds that the Applicant has complied with the applicable policies and regulations of the
Pitkin County Land Use Code and respective Master Plans, provided that conditions of this document are
adhered to.
7. The BOCC finds that the zoning of the Park shall be amended to allow for a maximum lot size of
3,000 square feet instead of maximum of 5,000 square feet as required by the Pitkin County Land Use
Code.
8. The Applicant has requested approval to rezone the entire park from SR/PUD (Special
Residential/Planned Unit Development) to MHP/PUD (Mobile Home Park/Planned Unit Development).
The BOCC finds that Rezoning of the property shall occur at Final Plat.

NOW, THEREFORE, BE IT RESOLVED by the Pitkin County Board of County Commissioners
that it does hereby grant Conceptual Subdivision, Planned Unit Development, GMQS Exemption, Rezoning,
and Special Review approval for the Woody Creek Mobile Home Park, subject to the following conditions
which shall run with the land and be binding on all succeszrs in interest:
I. Prior to Detailed Submission, the Applicant shall provide alternative site plans and work with the
Community Development Departmentto look at Planned Unit Development ("PUD") solutions either within
the Land Use Code or through amendments. This shall include the possibility of movingexisting units to the
new lots for safety reasons.
2. Prior to Detailed Submission, the Applicant shall resolvethe lot line discrepancies between
neighboring properties and the subject property.
At Detailed Submission the Applicant shall:
A. Submit a proposed Affordable Housing deed restriction with a final determination as to the type
of restriction to be made by the Board of County Commissioners.
B. Submit the proposed PUD Guide for the Park. The Applicant shall submit proposed standards
which shall, at a minimum, address Floor area restrictions, structure height and setbacks.
Replacement trailers shall comply with section 3270-040 to the maximum extent possible.
C. Submit a PM10 mitigation program to Environmental Health Department, for review and
approval. The plan shall propose specific and enforceable controls to fully mitigate or offset all
PMio increases in the non -attainment area caused by the project.
D. Comply with the codes and requirements of the Aspen Fire Protection District. The Applicant
shall submit details on the proposed 10,000 gallon water storage tank and fire hydrant locations
should be provided. The location of the fire hydrants shall be identified on the utility plan. The
Applicant shall also provide dimensions on the proposed cul-de-sac.
E. Provide to the Environmental Health Department documentation that the well meets setback
requirements from wastewater treatment facilitiesand adjoining wells, and that quantity and
quality and storage capacity of the well water is adequate. This documentation is required prior
to action on any future State of Colorado site application for the wastewater treatment plant
upgrade.
F. Provide detailed design criteria, a funding plan and a time table for replacement for the
replacement of the existing wastewater treatment plant. The design criteria must be in a form
suitable for submission to the State of Colorado for review and comment.
G. The Applicant shall work with the Roaring Fork Trarsit Authority (RFTA) to determine a
suitable location for the bus stop that is currently located in front of the Woody Creek Tavern.
H. Submit drafts of the Protective Covenants and the Subdivision Improvements Agreement,
detailing improvements, their costs, and methods of financing.
1. Submit a Landscaping Plan and a noxious weed management plan, in accordance with the Pitkin
County Noxious Weed Management Plan for the entire Park.

J. Verify compliance of the proposed new 1 I lots with "Solar Access" as outlined in section 3-60-
060 of the Land Use Code.
K. Verify compliance with open space requirements for the entire Park.
L. Address all intended uses on proposed Lot C. This shall include future operation of Woody
Creek Electric. If this use is proposed to continue, documentation stall be submitted to
determine if the use is legally non -conforming.
4. At Final Plat the Applicant shall:
A. Submit a Fugitive Dust Plan to the Environmental Health Department. The plan shall include
measures to ensure that dust does not become a nuisance and travel onto adjacent properties.
B. Submit a Drainage and Erosion Control Plan to the County Engineer for review and approval.
C. Provide documentation acceptable to the County Attorney drat the legal water supply plan is in
order.
D. Obtain a Right -of -Way Encroachment Permit from the County Engineer for the portions of the
Park that are located in the right -of --way of Upper River Road.
E. Submit, for review and approval by the County Engineer, a Construction Management Plan in
accordance to the Asset Management Plan prior to the Board of County Commissioners review
of Final Plat. The Construction Management Plan shall indicate that vehicles associated with
construction (i.e. employee traffic, construction vehicles, staging and deliveries) shall not violate
County Law, such as parking on County rights-of-way.
F. With the Final Plat application, the Applicant shall srbmit will serve letters from utility
companies.
At the time of building permit application submittal for each Idt:
A. All addresses shall be clearly marked and visible with minimum 2" non-combustible letters and
shall be clearly visible at the primary point of access from the public or common access road and
installed on a non-combustible post.
B. A cash -in -lieu payment for school impact mitigation as required by the Land Llse Code for each
new unit shall be paid.
C. A cash -in -lieu payment for parks/recreation/open space mitigation as required by the Land Use
Code for each new unit shall be paid.
D. Pursuant to Ordinance No. 022-2000, the 11 new lots are subject to the Fair Share Requirements
and shall pay a road impact fee as calculated at the time of building permit issuance for each lot.
E. The Applicant shall submit an Access/Driveway Development Permit for review and
approval by the County Engineer for the new access for the new section of the Park. The
access shall comply with County standards outlined in the edition of the Asset Management
Plan in effect in effect at the time of issuance of the permit.

F. The Applicant shall record a Final Plat in accordance with Section 5-40-020 of the Land Use
Code which meets the approval of the Community Development Department and County
Attorney. The plat shall also include:
I ) The location of the 8" outlet line that will service the Park bythe 100,000 gallon water tank
placed on the Elam property.
2) All parking shall be identified.
3) The refuse centers in the new and existing sections of the Park shall be identified
4) An easement for the Dinsmoor driveway along the south end of the subject property
acceptable to the County Attorney.
6. Landscaping and revegetation on the new lots shall utilize low water (xeriscaping) native plant
materials and concepts. The timing of any sprinkler systems shall be decreased for low water plants. All
areas disturbed by construction shall be revegetated within one growing season of project completion.
7. Street signs shall be installed. Street signs shall comply with Section 3110-030 of the Pitkin County
Land Use Code, as well as the standards of the Aspen Fire Protection District.
8. Install and use approved bear proof garbage containers as required by BOCC Ordinance No. 010-
2001.
9. Lighting shall comply with the Pitkin County lighting standards at the time of installation.
10. At the time the water and sewer lines are constructed within the street, utility lines shall also be
buried if cost efficient.
11. Development of 30 inches above or below grade within the approved setbacks as part of the PUD
requires approval of a variance by the Board of Adjustment.
12. A fireplace/woodstove application must be filed and approved by the Community Development
Department prior to submittal of any building permit applications.
13. The Applicant is not required to submit annual reports attesting to conformance with the conditions
of this approval, nor is the proposed use required to commence within 12 months of the date of this approval,
as would otherwise be required under the Special Review provisions in the Land Use Code.
14. The Applicant shall adhere to all material representations made in the application or in public
meetings or hearings and shall consider those representations to be conditions of approval, unless amended
by other conditions.
15. Approval of the conditions is contingent on the Rezoning of the property. If the property is not
rezoned at Final Plat, this approval shall become null and void.

RECITALS

Subdivision shall have the right to voluntarily install rim sprinkler systems.
6. The BOCC further furls that the lack of ready availability of fire sprinkler systems for
manufactured homes, and the fan that the requirement is not a universal requirement
County -wide for other manufactured home communities wartamts the removal of the
requirement that systems be installed in all new and replacement units for the Woody Creek
Subdivision.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissiorsers
that it hereby grants approval for the Woody Creek Subdivision Mirror Amendment to a
Development Permit to eliminate the Condition requiring that all new and replacement units within

RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PIPKIN COUNTY,
COLORADO, APPROVING A MINOR AMENDMENT TO A DEVELOPMENT PERMIT
TO AMEND CONDITION NO.5 OF BOCC RESOLUTION NO. 046-2005 FOR THE
WOODY CREEK SUBDIVISION

RECITALS
Woody Creek Subdivision ("Applicant'), has applied to the Board of County
Commissioners of Pitkin County, Colorado (`BOCC") pursuant to Section 2-20-150(b) of
the Pitkin County Land Use Code ("Code'), to amend Condition No. 5 of BOCC Resolution
No. 046-2005 to allow for the issuance of building permits prior to the infrastructure being
completed. This will constitute the third amendment to the Subdivision approval.
2. The property is located along Upper River Road, across from the Woody Creek Fire Station.
The BOCC granted approval in 2001 for Conceptual Subdivision, Planned Unit
Development, GMQS Exemption for deed -restricted housing units, Rezoning from SR to
MHP/PUD and Special Review for parking in the PUD pursuant to Resolution No. 085-
2001. In April 2005, the property received Detailed and Final Plat and GMQS Exemption
approval pursuant to BOCC Resolution 046-2005. A Minor Amendment was granted in
2006 pursuant to Administrative Decision No. 99-2006 for some lot line adjustments and
a subsequent Amendment was granted by the BOCC to eliminate the fire sprinkler
requirement for each residence in 2007 (020-2007).
4. The BOCC heard this application at a special meeting on June 5, 2007, at which time
evidence and testimony were presented with respect to this application.
5. The BOCC finds that the proposal is consistent with the applicable Criteria in the Land
Use Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
that it hereby grants approval for the Woody Creek Subdivision Minor Amendment to amend
Condition No. 5 of BOCC Resolution No. 046-2005 to allow for the issuance of building permits
prior to the infrastructure being completed subject to the following conditions, which shall run
with the land and be binding on all successors in interest:

RECITALS
1. Woody Creek Homeowners Association ("Applicant'), has applied to the Community Development
Director of Pitkin County, ("Director"), pursuant to Section 2-20-150(6) of the Pitkin County Land
Use Code ("Code"), to amend the Woody Creek Subdivision (formally the mobile home park) PUD
Guidelines to reduce the setbacks for Lots 45-58 (new portion of the Subdivision). The setbacks are
established on Pages 6 and 7 of the Guidelines, which are recorded per reception number 515412.
This will constitute the fourth amendment to the Subdivision approvals.
2. The properties are zoned MHP/PUD.
3. The Planning and Zoning Commission granted approval to the Housing Office for a fully
developed land subdivision exemption for the Woody Creek Tavern and Mobile Home Park
pursuant to Resolution No. PZ -99-2. A Fully Developed Land Subdivision plat was recorded as
Book 54 at Page 76.
Additionally, the BOCC granted approval in 2001 for Conceptual Subdivision, Planned Unit
Development, GMQS Exemption for deed -restricted housing units, Rezoning from SR to

Purpose
On May 11, 2005 the Pitkin County Board of County Commissioners
(hereinafter the "Board") approved the Woody Creek Subdivision
Planned Unit Development (hereinafter "WCSPUD" or "PUD") Detailed
Submission/Final Plat (Site Specific Development Plan) pursuant to
the Pitkin County Land Use Code (hereinafter the "Code"). Section
3-170 of the Code establishes the Planned Unit Development
(hereinafter "PUD") standards which allows variance from the strict
adherence to the area and bulk requirements of underlying zone.

Each provision of this PUD Guide shall be specifically
enforceable by the Declarant, its successors and assigns, and
Pitkin County by a proceeding for any legal or equitable relief,
including prohibitive or mandatory injunction or action to recover
damages. In the event of any litigation between the parties
involving the interpretation and/or enforcement of this PUD Guide,
or any provision hereof, the prevailing party shall be entitled to
an award of its costs incurred therein as a part of the judgement
or stipulated settlement entered in such litigation.
AMENDMENT
The covenants, conditions, and restrictions contained herein
may be amended, modified, or revoked by the agreement of the
Declarant, its successors and assigns, and Pitkin County. No
amendment or revocation shall be effective without the consent of
the Declarant and Pitkin County.
SEVERABILITY
Invalidity or unenforceablility of any provision of this PUD
Guide, in whole, shall not affect the validity or enforceability of
any other provision, or any valid and enforceable part of a
provision of this PUD Guide.
NOTICE
Any notice permitted or required under this PUD Guide shall be
in writing, and delivered either personally or by mail. If
delivery is made by mail, it shall be deemed to have been delivered
forty-eight (48) hours after a copy has been deposited in the
United State mail, postage prepaid, certified mail, and addressed
to the party at their last known address.

WHEREAS, the Declarant is the owner of all the real property

collectively, the "Development Approvals").
NOW, THEREFORE, Declarant hereby submits the Property to this
Woody Creek Subdivision Planned Unit Development Guide ("PUD
Guide") and declares that the Property shall at all times be owned,
used or occupied subject to the provisions of this PUD Guide, which
provisions shall constitute covenants running with the land, and
shall be binding upon and inure to the benefit of Pitkin County,
and the Declarant, and any person or legal entity acquiring any
interest in the Property.
FURTHER DEVELOPMENT
Future development of the Woody Creek Subdivision PUD, except
as permitted herein, or which is otherwise inconsistent with the
Development Approvals is prohibited without approval of Pitkin

III. Land Use Plan

U.L946'A depicts an overall site plan for the WCSPUD. This section
establishes permitted land uses. Land uses not identified are
prohibited.
A. Lots 1-58
Permitted land uses are limited to one single-family dwelling unit
per lot and related accessory outbuildings such as sheds.
B. Open Space Parcels A -C
Open space parcels are to remain undeveloped. The existing
structure located on Open Space Parcel C shall be demolished prior
to ,issuance of a certificate of occupancy for the waste water
treatment facility building.
Landforms in excess of 30 inches in height developed in compliance
with the WCSPUD Landscape Plan (see Figure 2) and landscaping are
permitted on the Open Space Parcels.
C. Common Tracts 1-3
This section establishes permitted land uses on the Common Tracts.
Common Tract 1 - Common Tract 1 may be improved with a
trash structure to enclose a dumpster(s) and a waste
water treatment facility. The dumpster(s) need not be
enclosed within a structure. The waste water treatment
facility building will be developed in general compliance
with Figure 3, WCSPUD Waste Water Treatment Plant
Improvments Plan; Figure 4 and WCSPUD Waste Water
Treatment Plant Outfall Line. The waste water treatment
plant shall be located within the building envelope on
Common Tract 1 as defined on Figure 3 and the WCSPUD
Final Plat recorded at Book *7Y Paged/
Common Tract 2 - Common Tract 2 will be improved with the
common building(s) for the WCSPUD Homeowners. Future
improvements shall �'Lbelocated within the building

include: picnic shelter, storage facility, meeting rooms,

existing buildings until the Tract is redeveloped as
proposed in the Plan.

The existing structures located on Common Tract 2 are
legal non -conforming structures which may continue to
exist. Any replacement structure(s) shall be developed
within the approved building envelope referenced above.
The existing legal non -conforming commercial use of one
of the buildings on Common Tract 2 may continue to exist.
If the non -conforming use is discontinued for more than
one year, the non -conforming use of the structure shall
be permanently discontinued.
3. Common Tract 3 - Common Tract 3 may be improved with a
laundry mat for use of the WCHMP residents and a trash
structure to enclose a dumpster(s). The dumpster need
not be enclosed within a structure. Use of the laundry
mat by non-residents is prohibited.
D. Parking
Parking in the WCSPUD is limited to residents and their guests.
Automotive vehicles and trailers shall be parked in the common
parking areas designated on Figure 1 or on Lots 1-54. Thee three
designated common parking areas are located west of the Woody Creek
Tavern, north of Common Tract 2 , and west Open of Open Space C.
(Wastewater Treatment Facility).
Each individual lot shall include areas to park two vehicles. on -
street parking and parking in Open Space Areas or Common Tracts is
prohibited. Use of the parking areas by non-residents is prohibited
unless they are guests visiting WCSPUD residents.
Vehicles or trailers parked in common parking areas shall be
limited to vehicles and trailers with current, valid, Colorado
license plates.
The existing structure located in the parking lot on the south side
of Lot 15 shall be removed or demolished upon redevelopment of
Common Tract 2. Parking may be permitted on the south side of the
buildings on Common Tract 2 until the Tract is redeveloped.
IV. Area and Bulk Requirements
This section establishes area and bulk requirements for the WCSPUD.
The development of most lots in the Park will benefit from some
form of zero lot line development. The purposes of the zero lot
line development are to maximize solar gain and the size of yards
and to minimize fire danger.

The allowable floor area of improvments on a lot shall be

Floor area is limited to 1,000 square feet on Common

limitation as measured by Pitkin County at time of building

If a lot owner develops a fence, it shall be located on

Fences shall be located at least five feet from dwelling
units if the fence runs parallel to the wall of a unit.
The five foot fence setback provides for fire separation
and maintenance of yards and dwelling units.
Fences may encroach within the five foot setback at the
end of a fence to bring closure to a fenced yard at the
dwelling unit. This encroachment within the fence
setback provides for a dwelling unit to serve as one or
more sides of a fenced yard.
B. Accessory Structures
This section establishes standards for accessory structures.
In most cases accessory structures are storage sheds.
1. Location on Lots
If a lot owners develops an accessory structure, it shall
be located on the lot he/she owns.
Individual lot owners shall not develop or place
structures on Common Tracts or Open Space. The Woody
Creek Subdivision Planned Unit Development Homeowners
Association may develop or place structures on Common
Tracts as permitted in the WCSPUD Plan.

VI. Fire Mitigation
The WCSPUD shall implement the fire mitigation program defined in
this section. All development within the Park shall adhere to the
applicable fire mitigation standards in this section.
A. Tall grass shall be cleared and maintained within ten feet
(10') of residential and accessory structures.
B. Non-combustible roof material, including, but not limited to,
tile, asphalt, or metal roof material is required. Wood shake
shingle roofs are prohibited.

feet away from structures, and to keep fire fuels away from
stacked wood.
H. Lot Owners shall be required to maintain at least one (1) ten -
pound ABC -class fire extinguisher in each dwelling unit.
VII. Lighting
Lighting shall comply with the standards of the Pitkin County Land
Use Code in effect at the time of installation.
VIII. General Restrictions
The following general restrictions shall apply to the WCSPUD.
A. Underground Utility Lines
All new water, electrical, telephone, natural gas, and other
utility pipes or lines within the Subdivision, shall be buried
underground and not be carried on overhead poles or above the
surface of the ground. All utilities shall be buried in or
adjacent to roads or driveways, or within utility easements

While it was our sincere attempt (after submitting 3 completed home proposals before
one met all the PUD criteria) to comply with the PUD requirements of an 18' mid span
and 23' peak heights, the topography of our lot was an issue that required extensive
investigation prior to our permit application in April of 2010. The lot had been altered by
no less than four different gradings to allow for a neighbor's "spoils" to be stored and
then removed twice, two different grading changes to accommodate Mr. 011ie Fields and
storage of equipment and trailers during construction of other neighbors' homes. In
addition, in the building of the Woody Creek Subdivision infrastructure, no permanent
monuments existed to denote property corners and early topography maps also
contradicted one another which precipitated a totally new survey performed by John
Howarth at Aspen Survey Engineers. 1 have enclosed his topography survey.
While a mark on the rise of the pavement somewhere between the mid -point and SE
monument was agreed upon as the "zero" mark from which to measure elevation, this
point was estimated at the time to be 7337' and all correspondence after that point
reflected this specific elevation. Indeed, the actual mid -point between the SE and NE
comers is 7337.22 while the `k" marked on the pavement more closely reflects the
elevation of the actual SE comer at 7338.01. Based on the agreement to use the 7337'
figure, the peak of our home measures at 7361 A I for a figure of 24.19' which exceeds
our PUD guideline by 1.19'. Had this measure been made from the curb near the "x" the
height measures 23.40'. While the manufacturer of the home, after much adjusting and a
5 month wait for state stamped drawings to reflect these height requirements, was exact
in meeting the qualifications with a roof heightapproved by Community Development of
22' 11" and a mid-6Pan of 17' 4'/x", it has been determined that the excavation and
concrete footers for the home were not done to the specifications clearly laid out for
Jewkes Concrete even if we were to use the higher elevation. While complying with our

request to make the lot fairly even after so much grading activity, it is clear that Mr.
Jewkes not only graded the lot too high in the middle, but did not "sink" his footers deep
enough to satisfy the exacting criteria we were bound and eager to follow.
While the house, as you can see in the attached photographs, does not tower above the
only neighboring 2 story home (out of 4 total in the subdivision) it does appear to be
higher from the curb than planned as evidenced by a third step into the home at the front
door. This error was not one that 1, March Henley, with an untrained eye and NOT the
listed contractor on the project could ascertain. Had I been able to rectify the footers and
grading prior to the actual setting of the house on June 29, I would have gladly done so.
Now, 3 months later, we are anxious to occupy our new home and want to do whatever is
necessary to mitigate this unforeseen error in the excavation/concrete phase of building. ]

and allow us to proceed with our final phase of construction in applying for our
Certificate of Occupancy.

Finished floor elevation of house: 7339.95'
Finished garage slab elevation: 7338.27'
While the allowable mid span is 18', to calculate the actual mid span height of the house,
I have added 1.19' to the actual approved house plans measurement of 17' 4 %2"
(17.375'). This comes to 18.565' which makes the mid span exceed requirements by
.565' or approximately 6".

This letter confirms our conversation regarding the elevation to which our house will be tied. The elevation of
7337' as evidenced on our official survey is the number that will be used for the most restrictive elevation
number for measurement to the midpoint of the roof
This letter also confirms that since this lot was originally purchased, there has been significant activity that may
have affected the topography of the lot. Spoils from the Kinney house were "stored" on our lot as a personal
favor and when they were removed, Joe Fredericks had to go back and remove more dirt as there was too much
left behind. In addition, Aspen Earthmoving removed a berm at the rear of the lot at 011ie Fields' request and
the water and sewer lines were "located" by Joe Fredericks (Infinite Alpine Landscapes) which took much
digging as there are still no "As Builts" for our subdivision. The lot will be regraded only to and not exceeding
this elevation number of 7337'.
