21. Additional Terms and Conditions of Permit (check all that apply).
At the time of issuance of this permit you are required to post $_ as financial security to ensure successful completion of
your revegetabon plan. These monies will be held for two growing seasons from the date of completion of the project and will only be
released at that time if a site visit by Pitkin County Land Management confirms that successful revegetation has been accomplished.
Applicant is obligated to contact Pitkin County Land Management (970-920-5214) to schedule the required two-year site visit. The
monies will be forfeited if successful revegetalion is not confirmed after two growing seasons, or if Applicant fails to timely schedule the
required site visit.
A Fugitive Dust Control Plan approved by the Environmental Health and Natural Resources Department is required
Documentation of decreed water rights is required.
_ Documentation of State Engineer approval of Arjurisdictional sized dam, or documentation of fling of a Notice of Intent to
Construct a Non-Junsdictional Water Impoundment Structure (in the case of non-jurisdictional size dam) is required.

Over view of 10" Receiver Project located at Aspen Valley Ranch, Woody Creek Colorado
SourceGas is now being required by Federal mandate from the DOT (Department of Transportation) and
PHMSA (Pipeline & Hazardous Materials Safety Administration) to periodically inspect pipelines. To that
end SourceGas must build a new receiver facility to allow for the inline inspection tool (smart pig) to be
received and removed from the pipeline on our 10" pipeline which currently ends at Aspen Valley
Ranch.
The project consists of the creation of a site for the receiver assembly, installation of a new receiver
assembly, creation of a berm along the north and west sides of the site to block the visible view from
the properties to the north and west of the site. The south and east sides are already blocked by trees
and hillside which will obscure the assembly from Upper River Road. A road to the site already exists.
This project is entirely on private property of Aspen Valley Ranch and does not intersect Pitkin County
ROW.
The installation of the assembly, the creation of the site, and the berm work is expected to take
approximately three weeks to complete. Work is scheduled to begin in late September or early October
with an expected completion date by the end of October 2009.
Depending on weather conditions following the completion of the project SourceGas will decide
whether to run the inspection tool in late October or early November or to hold off until spring of 2010.
Once the tool has been run all anomalies must be classified and exposed for verification. Each site
where an anomaly is detected by the tool must be dug up and visually inspected to determine whether
the pipeline is damaged by corrosion or other damage and whether or not repairs are required. Those
anomalies classified as critical (immediate repair) must be inspected and corrected within 30 days of the
tool run. All other anomalies are classified as scheduled repairs and must be inspected and corrected
within 1 year of the tool run.

That As en Valley Ranch LLC, a Colorado limited liability company, as ("Grantors'), for themselves, their heirs,
successors and assigns, for and in consideration of the sum of Ten Dollars ($10.00), the receipt and adequacy of which is
hereby acknowledged, does hereby grant, convey and confirm unto, Rocky Mountain Natural Gas LLC, a Colorado
limited liability company whose address is 370 Van Gordon Street, Lakewood, CO 80228, its successors and assigns
("Grantee"), a right-of-way and easement to survey, construct, install, inspect, maintain, renew, repair, remove, replace
and operate pipeline(s) and appurtenances, including all above -ground structures associated therewith, for the
transportation of natural gas or any other substance which can be transported by pipeline, in, on, over, under, upon and
through the following described lands, situated in a portion of Section 5, Township 9 South , Range 85 West of the 6th
Principal Meridian, County of Pitkin, State of Colorado, more particularly described as follows:

(the "Subject Lands")
This Right -of -Way Grant is subject to any and all other easements, fights -of -way, variances, memorandums and/or
agreements of record.
TO HAVE AND TO HOLD said right-of-way and easement unto Grantee so long as such pipelines and appurtenances, or
any part thereof, shall be maintained, together with the right of ingress to and egress from the Subject Lands for the
purposes herein stated, at the will of Grantee. Grantors)retain the,right to use and enjoy the Subject Lands, subject only to
the right of Grantee to use the same for the purposes herein expressed, and subject to the limitations contained herein.
Grantor hereby binds himself, his heirs, executors, administrators, successors, and assigns to warrant and forever
defend all and singular the right-of-way and easement herein conveyed unto Grantee, its successors and assigns, against
every person whomsoever lawfully claims the same or any part thereof (effective term only if initialed).
Grantors hereby acknowledge that the consideration received herewith is full consideration for the right-of-way and
easement granted herein, and also for damages to both the Subject Lands and growing cropsSubject occasioned by the initial
nit y
installation of Grantee's facilities. Grantors reserve the right to cultivate, use and occupy
the purpose consistent with the rights and privileges herein granted, and which will not interfere with or, in the sole judgment of
Grantee, endanger any of the facilities thereon or Grantee's use thereof. Such reservation by Grantors shall in no event
include the right (i) to construct any buildings or structures of any kind; (ii) to impound, retain, collect or store any water; or
(iii) to plant any trees or shrubs upon the right-of-way and easement granted herein without the express written consent of
Grantee.
Grantee agrees to lay all pipelines at a sufficient depth to avoid interfering with cultivation of the soil, and to pay Grantors
for damages to growing crops, fences or other improvements which may arise from the operations of Grantee. Any such
damage, if not mutually agreed upon, shall be ascertained and determined by three disinterested persons, one appointed
by Grantors, one by Grantee, and the third chosen by the two persons so appointed. The written award of a majority of
such three persons shall be final and conclusive upon Grantors and Grantee.
It is agreed by Grantors that any payment of consideration due under the terms hereof may be made jointly to Grantors
and any mortgagees of record at the time such payment becomes due. This Right -of -Way Grant and the duties and
obligations created herein shall run with the land and shall be binding upon Grantor, Grantee and their respective heirs,
devisees, successors and assigns.

Revegetation Plan for 10" Receiver Project located at Aspen Valley Ranch, Woody Creek Colorado
SourceGas will follow the recommendations of the Pitkin County Revegetation Plan for the areas of the
project where the land is to be restored which include the following:
Reseeding areas along the edge of the access road and site
Reseeding the entire new berm that will be built around the north and west sides of the
easement.
SourceGas will have our contractor use the Pitkin County Revegetation Plan for implementation of the
seed. We will use the recommended Pitkin County seed mix for non -irrigated pasture land for the
project.
Reseeding will occur within 30 days of the end of construction and SourceGas will retain a weed control
contractor to maintain the ROW and easement for a period of not less than two years.
