COLORADO,GRANTING 1041 HAZARD REVIEW AND SITE SELECTION FOR A MAJOR
DOMESTIC WATER SYSTEM APPROVAL TO HOLLAND HILLS METROPOLITAN
DISTRICT

RECITALS
1. The Holland Hills Metropolitan District("Applicant")has applied to the Board of County
Commissioners of Pitkin County,Colorado("BOCC")for a water storage tank and road to the tank. The
new water system will provide consolidated control and treatment systems,a reliable potable water supply,
potable water storage,and fire protection for the Holland Hills Subdivision.
2. The Planning and Zoning Commission("Commission")at a regularly scheduled meetingon July 16,
2002,reviewed the application,and a recommendation of approval was forwarded to the BOCC with
conditions.
3. The BOCC heard this application at a duly noticed public hearingon July 24,2002,at which time
evidence and testimony were presented with respect to this application.
4. The BOCC finds that the Applicant's proposal complies with the Pitkin County Land Use Code,
provided that conditions of this document are adhered to.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County
Commissioners that it does hereby grant approval to the Holland Hills Metropolitan District 1041 Hazard
Review and Site Selection for a Major Domestic Water System, subject to the following conditions,
which shall run with the land and be binding on all successors in interest:
1. The Applicant shall record a 24 x 36 inch mylar 1041 Hazard Review Site Plan in accordance to
Section 5-70-040 of the Land Use Code within 90 days of approval. The site plan shall also be submitted
in a digital format for integration into the County Geographic Information System (GIS). The site plan
shall include the following:
A. The location of the security fence/gate.
B. The location of the bike trail.
2. The Applicant shall comply with the provisions of Resolution No. 187-2000 unless otherwise
replaced or amended by the conditions of this approval.
3. The Applicant shall comply with the recommendations made by Hepworth-Pawlak Geotechnical,
Inc.,report dated April 10,2002(Job No. 102 202),regarding the final grading of the project site.

4. The Applicant shall comply with the requirements outlined by BLM which include but are not
limited to: clean up the existing,unauthorized landfill along the length of the drainage,the disturbed area
shall be reseeded with a native grass/forb seed mixture, the erection of sediment barriers to prevent erosion
and to constrict heavy equipment movement and soil disturbance to the smallest area possible, and paint the
facility with the same reddish color found in the natural rock and soil background in the area(Munsell Color
2.5 YR 4/4).
5. The Applicant shall comply with the following wildlife mitigation:
A. No construction activity shall occur between November 15 and April 15.
B. A Revegetation Plan compliant with Pitkin County Revegetation Guidelines shall be submitted
and approved by the Natural Resources Division prior to the issuance of a building or
earthmoving permit. A$5,000 revegetation bond shall be submitted to the Community
Development Department prior to the issuance of a building or earthmoving permit.
C. A Weed Management Plan shall be submitted to and approved by the Natural Resources
Division prior to the issuance of a building or earthmoving permit.
D. No dogs shall be allowed on site by construction workers.
E. The proposed fence shall be wildlife friendly and comply with County requirements.
6. Use of the access road where it crosses the Basalt/Old Snowmass Trail or any material change in the
trail which may occur to access the waterline or for other reasons at a future date shall be in compliance with
Section 2.06.01 of the Assets Management Plan.
7. Prior to the issuance of a building or earthmoving permit,the Applicant shall provide assurance to
the County Engineer and the Open Space and Trails Land Steward that the required repair to the Basalt/Old
Snowmass Trail is completed.
8. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use
Code, § 4-140 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on July
24, 2005.
