HomeMy WebLinkAboutbocc.res.122.2002 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO,APPROVING A TEMPORARY USE/SPECIAL EVENT PERMIT TO UTILIZE THE BASE OF BUTTERMILK AREA AND COZY POINT RANCH FOR THE PROPOSED 2002 JAZZ ASPEN/SNOWMASS LABOR DAY FESTIVAL Resolution No.L-2002 RECITALS I. Pursuant to Section 3-200-030 of the Pitkin County Land Use Code, the Board of County Commissioners of Pitkin County, Colorado (`BOCC") may approve a Temporary Use/Special Event Permit for commercial activities or special events that exceed 72 hours in duration. 2. Joe Lang and Jazz Aspen/Snowmass (hereafter "Applicants") have applied to the BOCC for approval of a Temporary Use/Special Event Permit for use of the Buttermilk Base Area to stage the 2002 Jazz Aspen/Snowmass Labor Day Festival, and Cozy Point Ranch for public parking for the proposed event. 3. The events will take place August 30, 2002 through September 2, 2002 between the hours of 10 A.M. and 10 P.M. 4. The BOCC heard this application at a duly noticed public hearing on July 10, 2002, at which time evidence and testimony were presented with respect to this application. NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners that it does hereby grant approval for the Jazz Aspen/Snowmass Labor Day Festival Temporary Use/Special Event Permit to utilize the Buttermilk Base Area and Cozy Point Ranch subject to the following conditions: 1. The Applicants shall obtain the proper Electrical and Building Permits from the Building Department for the temporary staging area at the base of Buttermilk. The Applicants shall also obtain a Temporary Contractors License from the Building Department. 2. Temporary lighting shall be provided during time of egress at Cozy Point and Buttermilk satisfactory to the County. 3. Patrons shall be allowed a maximum of 4 drinks per person per trip to the bar. 4. All bartenders shall be TIPS certified. 5. The Applicants shall cease serving liquor one hour prior to the finish of the music. 6. The Applicants shall provide evidence of General Liability insurance with Pitkin County named as additional insured. Minimum limits of$1,000,000 per r;: laa -zo�z occurrence (and personal & advertising injury) and$2,000,000 for general aggregate, and products-completed operations aggregate are required. This evidence of insurance should be provided to Risk Management staff no later than 30 days prior to the first day of the event. 7. The Applicants shall submit a final Traffic Management Plan for review and approval by the Pitkin County Engineer prior to August 9. The Plan must be signed by a Supervisor of the contracted company that will be handling the traffic management. As part of the Traffic Management Plan, the Applicants will be required to submit a Towing Plan and a Signage Plan suitable to the County Engineer. 8. The Applicants, if necessary, shall be required to revegetate the Cozy Point Ranch to the satisfaction of the Ranch manager. 9. The Applicants shall be required to submit a finalized Security Plan to the Pitkin County Sheriffs Office and the Aspen Police Department for final approval by August 9, 2002. 10. The Applicants shall be required to submit a complete Event Coordinator's Application to Pitkin County Environmental Health no later than 2 weeks prior to the event. In the event that food vending will take place,the Applicants shall be required to submit a complete Special Event Food Service Application to Environmental Health 2 weeks prior to the event. 11. The Applicants shall be required to get approval from the Aspen Fire Protection District prior to the beginning of the event. 12. The Applicants shall be required to submit a Handicap Accessibility Plan to the Building Department for review and approval no later than 2 weeks prior to the event. 13. The Applicants shall not be allowed to utilize the Stapleton Parcel portion of Buttermilk Parking for reserved parking. 14. In the event that any of the above specified deadlines are not satisfactorily met, the BOCC may make a finding that the Applicant is not in compliance with this approval and the approval will be null and void. 16. All material representations made by the applicant in the application shall be adhered to and considered conditions of approval, unless amended by other conditions. � ; �zZ— zcro2 APPROVED AND ADOPTED ON THE 10TH DAY OF JULY 2002.
