Vos Caudill, Pitkin County, CO RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO,GRANTING APPROVAL FOR THE ASPEN CONSTRUCTORS/309 SAGEBRUSH LLC SPECIAL REVIEW BOCC Resolution No. NO -2015 RECITALS Aspen Constructors, also known as 309 Sagebrush LLC, ("Applicant") has applied to the BOCC for Special Review approval to reconfigure office space that will exceed 1,500 square feet of floor area for a single business in the B-2 zone district. The Applicant currently owns Sagebrush Condominium Unit G and operates the Aspen Constructors office business from this location. The Applicant recently purchased Sagebrush Condominium Units J and K and is desirous of combining Unit J into one floor plan with Unit G. Unit K is not proposed to be combined and would be reserved to lease to another business. A doorway will connect the Units G and J. Combining Unit G and Unit J will create an office space that exceeds 1,500 square feet of floor area for a total 2,175 square feet of floor area. No footprint or floor area expansions are part of this request and reconfiguration of the interior space of the units would only occur. 1. Land Use Code Section 4-30-40(p) requires that when proposed office space exceeds 1,500 square feet of floor area per business in the B-2 Zone District, Special Review approval from the BOCC is required. 2. The properties are located at 309 AABC Ave and are within the B-2 Zone District(Legal Description, Attachment A). • 3. The BOCC heard this application at a duly noticed public hearing on October 14th, 2015 at which time evidence and testimony were presented with respect to this application. 4. The BOCC finds that the proposed reconfiguring of the Sagebrush units to create a single office space that is greater than 1,500 square feet of floor area up to 2,175 square feet of floor area is appropriate and compatible with the surrounding neighborhood. The BOCC also finds that the increase in size of the unit will not create any additional adverse impacts or burden on public services as outlined in the Special Review criteria in Code Section 2-30-30(h). NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners that it hereby grants approval to the Aspen Constructors/309 Sage Brush LLC Special Review subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application and public meetings. 2. Prior to reconfiguration of the subject spaces, the Applicant shall apply for and attain appropriate building permits. 3. The office space for the Aspen Constructors business is limited to 2,175 square feet of floor area. Aspen Constructors office floor area shall not expand without further County review and approval. If the subject properties change ownership or change use, the Applicant shall notify the Community Development Director within 30 days of the transaction of the properties or use change to understand if further County review is required.
